Oregon Case Renews Debate Over Sanctuary Laws

Sergio_Jose_Martinez_31_1501021110440_10127549_ver1.0The case of Sergio Jose Martinez, 31, in Portland, Oregon is likely to magnify the current debate over sanctuary cities.  Martinez broke into the home of a 65-year-old woman and sexual assaulted her. He then stole her car and proceeded to assault another woman.  He was finally arrested after a chase by police. It was discovered that Martinez was previously arrested and, despite a long criminal history and an immigration detainer, was released by authorities.  He has been deported 20 previous times and has at least five probation violations.

The Immigration and Customs Enforcement (ICE) lodged an immigration detainer against Martinez and asked for authorities to notify them before releasing Martinez.  The notice would have allowed ICE to take custody, but in December 2016 he was released without notifying ICE.  Multnomah County leaders and Sheriff Mike Reese wrote a letter to assure the public that “The Sheriff’s Office does not hold people in county jails on ICE detainers or conduct any immigration enforcement actions.”

Martinez has a felony conviction for burglary and three misdemeanor convictions for battery, theft, and obstructing a public officer.   I have previously discussed how sanctuary laws are too restrictive on the underlying crimes that are exempted from the protections.

Martinez is now facing include first-degree kidnapping, first-degree robbery (two counts), second-degree assault, first-degree sex abuse, first-degree sodomy and first-degree burglary.

  2. I don’t understand the pro-sanctuary city argument. Is this a power move? Are these progressive left cities okay with centralized government except for law enforcement?

    The US government just imposed new sanctions on Russia for their interference in our 2016 elections. Why bother? What would it look like if a foreign government undermined our election process? Would we have to fear a federal government that would create laws detrimental to our life, liberty and property? Are sanctuary cities part of a plan to undermine federalism and the 10th amendment? What is the logical argument in favor of allowing someone that is in our country illegally, that has committed additional crimes up to and including rape and murder, to be released into our communities?

    Why isn’t our federal government imposing sanctions on these threats to our national security?

  5. Mr. Martinez should be jailed for a very long time. Deportations doesn’t seem to work in his case and the failure of the sheriff to notify ICE was wrong. There are cases in which illegal immigrants may warrant protection of some sort but that was clearly not the case here. Sanctuary or any similar policy must be afforded, if at all, with some judgment applied otherwise the illegal status of a perpetrator seems to become a defense to appropriate federal law.

We also need to set them up with some free public housing, free food, free education (so they can major in social justice and transfeminist economics), free automobiles, and a miscellaneous stipend.

      Take it from somebody who works in criminal law on occasion, a good number of those on parole and probation are still committing crimes. Let’s estimate that at 4,751,400 x the recidivism rate of 77% and we get about 5,312,000 more who should be locked up.

      That brings us to 7,532,000 (2,220,300 + 5,312,200) people who should be in jail, or more than three times the current number.

      To make it even worse, there are about 70 million people in America with criminal records. Take away the 7 million or so “in the system” above (6,899,000) and that leaves 63 million people with criminal records who are now outside the system.

      If only 1 in 10 of those people are still doing evil bad things, that is another 6,300,000 people who should be in jail. Add that to the 7,532,000 above and you get 13,832,000 folks who should probably be in jail. Or, about 6.2 times more people should be in jail, than actually are in jail (13,832,000/2,220,300). Or, a net increase of 11,612,200 more people in the hoosegow.

      Sooo, that back of the envelope calculation is why a lot of people who should be in jail are not in jail. There’s just too darn many of them.Which, is why we need a vibrant and healthy and quick system of capital punishment!

At one point, it may have been kind, decent, or even smart to not arrest an illegal alien who simply reported a crime. But as time passed, and there was a veritable flood of illegals, the whole thing changed to where now, not even the criminal illegal aliens are being reported. Because the Liberals couldn’t keep up with what is really happening.

        I guess the Democrats need every vote they can get. Plus, it helps with fundraising when you can whine over the fate of the poor illegals, who for the most part are just trying to better their lives. But a country has to do what is best for it, not what is best for the poor and unfortunate all over the world. And frankly, taking in millions of under-skilled workers hurts the country. We can’t afford them, and it causes problems for our own poor and under-skilled workers. Not to mention, the bad ecological effects of adding millions of high baby outputting illegals.

  7. Perhaps the sheriff should take a stroll down to his jail and thank Mr. Martinez for a job well done: that is, proving the sheriff is more of a politician than an honorable law enforcement officer.

    Multnomah County should celebrate. They accomplished a great deal in ruining the life of an ordinary citizen so that they could foist their liberal laurels. One of these days, it might just be one of these political elites that suffers as a result when their mother gets raped by one of these magnificent criminal aliens. Statistically the chances of that are low, but the odds of someone within the community doing so is 100%. But as long as it is not the politicians, why would they care.

    1. I would suggest that the Sheriff needs to decide whether he wants to be a social worker or a cop. Right now, he is definately more politician / social worker than LEO. I think Trump should cut-off federal funds to any cities that refuse to cooperate with federal immigration officers. If they want to thumb their noses at federal laws, let them pay more taxes and lose any support from federal LEO, including the FBI.

      1. A true sheriff cares more about his community than criminals. If ICE provides a way to remove problem children from the county why would this not be utilized? From a cost/benefit perspective it is much more efficient than having to wait until they victimize someone and are actually caught in the act, then money is paid for jailing and trial.

        If the FBI called up the MCSO and said a suspect in a federal racketeering crime is in their custody, I’m sure the jail would work out the details to keep him in jail. So I don’t see how ICE should be treated any different.

  8. That isn’t what sactuary cities were set up for. They were set up to protect innocent people who had no other strike against them but that they were undocumented from being deported. The police and/or jail officials dropped the ball. They are blaming the fact that Portland is a sanctuary city for their incompetence. They should have known better. They’re idiots.

    1. Louise represents one of the basic liberal species. She is really not intellectually able to understand what sanctuary cities means. My wife and I explain it to liberal friends, like Louise, who are misinformed. You see Louise, there was a time when Federal detainers were ROUTINE and ALWAYS HONORED. But liberal cities and states[CA] began doing EXACTLY what occurred here under the Obama Administration, w/ the tacit approval of the Obama Administration. If Louise were to read the link provided by Darren, she would see this is EXACTLY the intent. Now, there is another species of liberals who understand this is what sanctuary cities do DAILY and consider the victims, like these women, Kate Steinle, etc., just collateral damage for the greater good. My wife retired in 2006 as a Federal Probation Officer. ALL her detainers were ALWAYS honored. This has happened in the last decade and must CEASE. The vast majority of Americans agree.

      A lot of things that Liberals are all for, start out as maybe marginally good and smart, and then go to sh*t as time passes on. Because Liberals do not live in the here and now. They tend to live in some stereotypical-ized fantasy past time period. They have a hard time keeping up with current events, and when they do, they still tend to see things thru the prism of the past.

      For example, The Great Society Programs of the mid-60’s. OK, sooo maybe it was reasonably arguable that giving money to poor blacks would help them over come the un-nice aspects of Jim Crow, and segregation thru the AFDC programs.

      OK, sooo looking at the chart below, which information was readily available at the time — at what point in time should an Intelligent Liberal have said, “Holy Crap! I think we screwed up! We are making the problems worse!”

      Another example is Trayvon Martin. The little thug was banging poor George Zimmerman’s head against the concrete, and when he got shot, the Liberal Democrat intellectual giants thought Trayvon was the victim. How frigging crazy is that??? You know why they reacted that way? Because they were NOT really living in the 21st century, in 2012. They were living maybe in the 1920s when Negroes were lynched for looking sideways at a white woman. Or maybe in the 1950s-1960s when there were segregated drinking fountains. Who knows? But they sure weren’t living in 2012 when the country was chugging full of savage criminal black thugs.

    If they want to keep scum like Martinez in their communities, fine – they can enjoy their grandmothers being sodomized.

    But people like Martinez cross state lines. Somehow their egos take priority over the decisions of our president (and yes, Trump is their president too).

  11. Oregon has top to bottom recall. What they need is a sufficient amount of voters to make a change in their government and electred Judges. Assuming they can get it together lon enoujgh make a stab at showing up and voting. Registration is unelievabley loose there so I left it out of the mix.

    1. He WAS deported – 20 times, according to the article. Which shows that deportation is merely a free trip home, courtesy of the U.S. taxpayer, and that the illegal can easily sneak back in whenever he feels like it.
