
As someone who has called for the disbarment of Michael Cohen for well over a year, the belated decision by the New York bar this week to disbar the disgraced lawyer is welcomed news. There are few ex-lawyers that you can say this about, but the removal of Cohen from the bar has materially improved the value of everyone’s license across the country.
The panel of Justices Dianne Renwick, Sallie Manzanet-Daniels, Angela Mazzarelli, Jeffery Oing, and Peter Moulton found that disbarment was warranted by Cohen’s guilty pleas to tax evasion, campaign finance law violations, and lying to Congress.
Notably, the Attorney Grievance Committee filed for disbarment back on October 3, 2018.
As I have said before, repeatedly, Cohen has spent his career as a legal thug whose only appeal was his willingness to do things that most lawyers would not do.
As a longtime critic of Cohen, I argued for Trump to sever ties with Cohen at the start of the Administration. Trump instead pushed Cohen into greater prominence and publicly embraced him as his lawyer. In the end, the only concern of Cohen is Cohen himself. When Trump promised access to wealth and power, he was his loyal hatchet man, promising to take a bullet for him. When the special counsel discovered his myriad criminal acts, Cohen became a Mueller man.
Cohen distinguished himself as a thug who threatened journalists, university students, and anyone else deemed a threat to Trump. In 2015, when Harvard Lampoon staffers played a prank on Trump by having him sit in the stolen “president’s chair” from the Harvard Crimson for a photo and an endorsement, Cohen threatened the students with ruin. He is quoted as saying: “I’m gonna come up to Harvard. You’re all gonna get expelled. If this photo gets out, you’ll be outta that school faster than you know it. I can be up there tomorrow.”
Then there was his threat against former Daily Beast reporter Tim Mak, who simply wrote about a biography by former Newsweek reporter Harry Hurt. The biography, titled “Lost Tycoon,” includes allegations in a sworn deposition from Trump’s first wife, Ivana, that Trump raped her. In a phone call recorded by Mak, Cohen told the reporter: “You’re talking about Donald Trump, you’re talking about the frontrunner for the GOP, a presidential candidate, as well as private individual, who never raped anybody and, of course, understand that by the very definition you can’t rape your spouse,” the latter, of course, being legally incorrect. Cohen declared: “Mark my words for it, I will make sure that you and I meet one day over in the courthouse and I will take you for every penny you still don’t have, and I will come after your Daily Beast and everybody else.”
None of these acts seemed to prompt bar action in New York though the action in October was not widely known. It was only after his criminal plea that he was finally and thankfully disbarred.
I will listen to the testimony of Cohen today, though with a considerable level of skepticism. It is not a matter of credibility. Cohen has none. The issue is whether Cohen can support allegations with hard documents and evidence. Otherwise, the testimony will be a useless as Cohen’s word. The one improvement however is that Cohen will not continue to disgrace and degrade the legal profession. He has that distinction with Trump’s other lawyer, Roy Cohn who was also disbarred.
In the end, the White House attacks on Cohen come at a cost. As bad as Cohen was, he was the President’s choice as counsel both before and after the election. Moreover, even a serial liar and crook can do damage in a hearing when he was once your serial liar and crook.
It’s tiresome listening to the mixed up logic of Natacha, Peter Shill and all the goofy others that can’t seem to understand what evidence and proof are so I am going to copy two of the most important questions of the day.

TRUMP COMMITTED AT LEAST 5 FELONIES
Cohen’s testimony includes accusations — relating to Trump’s racism, his lack of concern for the public weal and his attempts to conceal his academic record — that, if true, are simply embarrassing. But, as noted by Max Bergmann of the Moscow Project at the Center for American Progress, the president’s former lawyer also implicated him in at least four felonies:
1. Conspiracy to defraud the United States. Cohen testified that he was present in July 2016 when Trump took a call on the speakerphone from Roger Stone, who said “that he had just gotten off the phone with Julian Assange and that Mr. Assange told Stone that, within a couple of days, there would be a massive dump of emails that would damage Hillary Clinton’s campaign.” According to Cohen, Trump replied, “Wouldn’t that be great.” (Stone has denied that account, in possible violation of a judge’s gag order.) Trump cannot claim that he did not know where the leaked emails ultimately came from: It had been public knowledge since mid-June 2016 that Russian hackers had penetrated the Democratic National Committee.
2. Lying to the FBI and the Justice Department. According to CNN, Trump, in his written testimony to special counsel Robert S. Mueller III, claimed “that Roger Stone did not tell him about WikiLeaks, nor was he told about the 2016 Trump Tower meeting between his son, campaign officials and a Russian lawyer promising dirt on Hillary Clinton.” Cohen contradicted those assertions.
3. Suborning perjury. Cohen testified that Trump encouraged him to lie to Congress about his attempts in 2016 to build a Trump Tower in Moscow and that his personal lawyers reviewed the mendacious testimony.
4. Violating campaign finance laws. Cohen testified that Trump told him to pay off a porn star and reimbursed him for doing so. Cohen even produced a check Trump signed while he was president and another one that was signed by Donald Trump Jr., implicating the president’s son in this felony, as well.
To these four offenses, one may add: 5. Bank, wire and tax fraud. Cohen testified that Trump inflated his assets to win bank loans and deflated them to reduce his taxes — precisely the kind of scheme for which Trump’s former campaign manager, Paul Manafort, is now facing lengthy prison time. And Cohen added that he knew of other offenses that federal prosecutors are still investigating.

He was not the valedictorian, salutatorian, nor even on the Dean’s List, and he didn’t receive any academic honors, according to the program from his graduation ceremony. Trump always claimed that Obama was a poor student, and that he is a “very stable genius”. Just more proof of his chronic, habitual lying and narcissism, seasoned with a taste of racism. 2. copies of checks to reimburse him for hush-money payments to adult film actress Stormy Daniels. Trump lied about this when questioned by a reporter. This payment constitutes a campaign contribution, since the purpose was to assist him in getting elected. Failure to report this is a campaign finance violation. The reason was to reel in gullible Evangelicals, which is the same reason for adding hypocrite Mikey Pence to the ticket. Trump isn’t loyal to anyone, including his third trophy wife.
You can dismiss these matters all you want, and as Trump has said that for you believers he could murder someone in cold blood in broad daylight, but you’d still support him. Nevertheless, they paint a picture of someone not fit to occupy the Oval Office, and they help establish Cohen’s credibility.

I’m not talking about the tweets and other white noise going back and forth, but something more in line with an official/ legal response to the allegations.
Trump was relying on the legal advice of Cohen when he handled the Stormy Daniels and the other woman’s payments.
This “my lawyer was advising me” defense can be used in other areas as well, anywhere where there is Trump-Cohen activity alleged to be criminal.
I’ve heard a couple of very brief “hints” of this…..one from Trump, and I think they other from Guiliani.
I think they’ll try to turn this around on Cohen; so we have Cohen’s version, that he was (mis)-guided by Trump, the evil master.
And one response will be “I relied on Michael Cohen and I trusted him” in these dealings.
If it comes down to “he said/he said, it’s a wash.
I don’t view any of the actors in this farce as being very credible, and if it plays out where it’s one guy”s word against another, I don’t think it’s “actionable” as far as impeachment or indictments.
The major question is what Cohen may have captured on tape as he secretly recorded his client(s).
One part of the testimony I did hear was Cohen’s description of how Trump gave orders; Cohen said “he speaks in code”, that knowing Trump, he knew what Trump meant for him to do without Trump specifying it.
If that’s what Cohen has on tape, it won’t have the impact the House and/ or prosecutors need to move forward.

Then, there was video of Trump putting down a NYC council member who opposed his demand for a tax abatement. The woman quoted to him the requirement that a property be either vacant or under-utilized to qualify. He wanted to raze the Bonwit Teller store, which was still open for business, so he claimed that he could put the land to better use by building a taller structure. He was openly insulting and condescending to her when she pointed out that this is not what “under-utilized” means. When he got his way, just out of pure spite and over the objections of the MMOA, he destroyed art deco façade pieces that the museum wanted and had agreed to remove so they could preserve and display them. A representative of the MMOA spoke about this. When she heard he had a wrecking ball there threatening to smash the pieces, she got into a cab and tried to get there to stop him. She was 8 months pregnant, and when her cab got stuck in traffic, she got out and ran on foot, but was too late. Trump is an arrogant, racist, misogynist turd, pure and simple. Watch the series.

I noticed some bias in the way things are presented in a few cases, but overall the ones I’ve seen have been pretty good.

I didn’t see that one in your list, Estovir, so I thought I’d throw it in.
And as I mentioned once before, I’ve actually had good luck with the lawyers that I’ve known, worked with, or hired.
There were 2 or 3 exceptions to that, but in those cases it was their competence more than ethical shortcomings that made me decide to “look elsewhere” for a lawyer.
Cohen lied before Congress as part of his job working for Trump. Republicans calling him a liar only further indicts their leader, who is unfortunately our President and who has publicly denounced “rats” in Tony Soprano style. His “Christopher” Gaetz delivered the most recent message yesterday – “don’t stop lying for Trump or clam-up. It’d be a shame if something happened to that pretty wife of yours.”.
Also, in contrast to our President’s daily lie, Cohen cannot lower his sentence based on his testimony today. He can however face new charges if he lies again before Congress.
I’m not sure of the details of Cohen’s plea deal and sentencing memos…..but my understanding is that Cohen’s cooperation with the U.S. Attorney SDNY was limited, and that Cohen was not forthcoming on matters outside of those charges he already pled guilty to.
In other words, it sounds like the SDNY could choose to bring additional charges against Cohen on additional offenses outside the scope of the offenses that he’s already been sentenced for.
Those are unspecified areas mentioned by SDNY prosecutors during the sentencing process, and because of their belief that Cohen had not entirely “come clean” in all areas, they were the ones pressing for a harsher sentence.
Mueller appeared to be satisfied with the cooperation that he got from Cohen in the areas he was concerned with, and in contrast to the SDNY prosecutors he would have been satified with a lighter sentence.
Even if the New York prosecutors “can make” a case/ additional cases against Cohen, that does not necessarily mean that they will
bring additional charges.
While Cohen may not serve the entire three years, it’s also possible that he could be looking at more time on other offenses if the SDNY prosecutors had a case and went forward with it.
If anyway has a different or clearer picture of where Cohen stands, I’d be interested in hearing it.
I don’t have a comprehensive knowledge of the details of his plea deal and sentencing conditions, so what I presented was just based on my understanding of where Cohen is at, legally.

Jordan also shamed Chairman Elijah Cummings for allowing Cohen to present himself before the committee.
“This might be the first time someone convicted of lying to Congress has appeared again to quickly in front of Congress,” Jordan said.
Townhall reported yesterday that Cohen was disbarred in New York by the Attorney Grievance Committee for the First Appellate Division. Last year, Cohen pleaded guilty for lying before Congress for “making false statements, tax evasion of and campaign finance violation.” He testified falsely about the Trump Organization’s real estate project in Moscow, Russia.
“And there’s a reason this is a first,” Jordan continued. “Because no other committee would do it.”
Jordan later questioned Cohen’s intentions behind his illegal activity and whether or not they were done out of loyalty to Trump. This includes filing false tax returns from 2012 and 2016 and failing to pay $1.4 million in taxes at the time.
He also questioned his involvement in the creation of a fake twitter account called “Women for Cohen.”

Take note todays hearings were supposed to start no less than 24 hours after Cohen released his evidence. in advance to the committee for their review. It was released late in the evening or at night but it appears CNN had all that information much earlier. Lanny Davis knows all the tricks on how to manage lies and protect the Clinton interests.
Also take note that the hearings were limited in scope so the Republicans weren’t permitted to answer damaging questions. What is funny is how many answers to show himself in good light Cohen answered, but stalled with questions he didn’t want to answer until the questioning period was over.

There are a lot of lawyers that act in that fashion. Some of them even end up in Congress. However, with his testimony, the testimony of a proven liar, many Democrats will lionize him and declare him a hero who is trying to save the nation. Those Congressmen are as bad or worse than Cohen.
Actually, I think lawyers in Congress tend to be people who had fairly brief and unremarkable careers in law ‘ere taking f/t public office. Walter Mondale, John Kerry, Handsy Joe Biden, and BO fit that description. A few are like upChuck Schumer and (reaching back) Tip O’Neill, who got the degree but never practiced. Joseph Lieberman gave up a mid-Law partnership for f/t public office, but (unless I’m mistaken) that’s atypical.
A couple of well established, prominent lawyers with decades working outside of DC made their way to ( or near) the top of the DOJ.
I don’t think that John Mitchell really coveted the Attorney General job, but took it anyone because of his close relationship with Nixon.
Webb Hubbell was closely intertwined with both Clintons in Arkansas, but I don’t know how politically active he was before going to D.C.

The one’s I can think of did not put too many years into it. IIRC, Ted Kennedy practiced law for < 1 year, Christopher Dodd and Tom Harkin for < 2 years, Obama for 3, Biden and Mondale for about 4, Jerry Brown for about 5, John Kerry for 6 and change, AM McConnell four about 6, Harry Reid for about 9, Richard Gephardt and Gary Hart for about 10, and Richard Durbin for about 13. Hellary had a lucrative career in law, but there's reason to believe she was hired for her connections as she had a spotty employment history (and bad references) prior to her husband taking office as state attorney-general. John Edwards had a lucrative career; the rap on him is that he got rich as a plaitiff's personal injury lawyer making ample use of Erin-Brockovich-style junk science.
Joe Lieberman shouldn’t be placed with most of those guys. I might differ with some of his ideology but he was mostly a stand up guy.

Trump wasn’t “tight enough” with Cohen to give him a job in the Trump Administration.
Cohen was still able to cash in on his connection with Trump, with big payoffs from at least a couple of major companies.
Selling them “access” to Trump. To really keep that cash machine going, Cohen wanted an actual official role in the Trump Administration.
That factor was brought out in yesterday’s committee hearing.
There’s no way of knowing if being rebuffed for a White House job factored into Cohen’s decision to “flip”…..he had plenty of other incentives to do so.
But it’d be interesting to compare the pre-election Trump-Cohen relationship with the post-election Trump-Cohen relationship.
If Cohen felt spurned, unrewarded for his loyalty, and he anticipate a set of legal problems that would be coming down the road, he may have leaned toward flipping against Trump long before the Cohen indictments were handed down.
