MSNBC Commentator Calls For Trump’s Removal Under The 25th Amendment Over The Disinfectant Controversy

MSNBC commentator Mike Barnicle this week called for the removal of President Donald Trump under the 25th Amendment for his bizarre suggestion that disinfectants might be injected into patients to clean their blood in minutes.  Many of us criticized the President for the comments and found his later claim to have been speaking “sarcastically” to a reporter as clearly untrue. Trump later suspended further briefings, which have served as a critical avenue for information from task force members like Dr. Fauci and Dr. Birx. Yet, despite my respect for Barnicle, it is important to be clear about what is a constitutional versus a political matter.  As I have previously written (here and here) and publicly discussed, the 25th Amendment was not designed and will not address this type of controversy.

Barnicle stated the view of many over the comments on the use of disinfectant, but suddenly took a constitutional turn:

“In a rational, political world, of which we are not part, we’re no longer a part of that, there is no longer a rational political world around us, I’ll tell you what might be on their minds: the 25th Amendment. Because yesterday, the president of the United States actually posed a threat to public safety, to the public safety of the citizens of this country … Those are the musings of a man who has spent a whole lot of his lifetime in a tanning bed. So, he’s been exposed to ultraviolet rays in order to look like he has a tan all the time. Those were the irrational rants of a man who, somewhere out there in this country, God forbid, some inherent of his, someone who follows him closely and adores him, and there are many people like that … will take a little sip of Clorox bleach today to ward off the potential of the virus, and they will die.”

There have been similar calls for over three years to use the 25th Amendment to address controversial statements and policies by the President.  Ironically, this type the amendment like a type of constitutional lysol that can be used wipe away a unduly elected but controversial president. That is not its function.

As I have previously written,Section 4 has, essentially, two avenues for dragging a president from the Oval Office. First, there is the mutiny option. A vice president and a majority of the Cabinet can agree that the president is “unable to discharge the powers and duties of his office” and notify Congress that the vice president intends to take over. If Vice President Pence could get eight Cabinet officers to sign a letter to that effect, he would immediately become the “Acting President.”  But if the president then declares to Congress that “no inability exists,” Trump could resume his powers. Pence and the rebellious Cabinet would then have to send another declaration within four days to the President pro tempore of the Senate and the Speaker of the House that says, more or less, don’t believe a word, he’s unfit. Once Congress had the second declaration, if not already in session, it would have 48 hours to assemble to debate the issue. It would then have 21 days to vote on the president’s fitness. To remove the president, two-thirds of both houses would have to agree. If Congress did not vote within 21 days, the president would get his power back.

In other words, the use of the 25th Amendment over this latest controversy would be unwarranted as it is unlikely.  The likelihood of removing Donald Trump under the 25th Amendment for this controversy is about as likely as his receiving an honorary medical degree.

Instead of the author saying what he/she wants to say, i.e. “I hate Trump and suffer from DTS, but recognize that the 25th Amendment doesn’t apply to Trump’s comment,” the author so deeply suffers from DTS that he/she cannot write a comprehensible sentence. So, the authors ends up with gibberish like this:

    “[T]his type the amendment lie a type of constitutional lysol”? Totally meaningless. And then the author, desperately trying to be clever, but utterly failing, argues that such a “wipe” cannot be used to “wipe away a unduly elected” president. What is an “unduly elected” president? The author, apparently, erroneously believes that the opposite of a “duly elected” president is an “unduly elected” president. But “unduly” is not an antonym of “duly,” except among those who have a poor grasp of the English language. “Unduly” means excessively, exorbitantly, or inordinately.

    And, in any case, the author is wrong. Donald Trump was, indeed, “duly elected.” That is, he was “properly” elected in accordance with the law. The author simply cannot get over the fact that Hillary Clinton was rejected by Americans under the law, and he/she continues to be upset that the Deep State did not succeed in subverting the will of the American people, despite the Deep State’s best efforts to violate laws to achieve that end.

    The author needs to get over it, and to grow up. And should another paroxysm of TDS overwhelm the author, I suggest that he/she seek psychiatric or psychoanalytic treatment, rather than the nearest computer.

  5. I’m sensing desperation from the Dems and their media surrogates. At a time of national emergency, their top priority is the election, yet they are not offering anything better than we have now. To the extent Joe Biden’s family has already been gamed by the Chinese, and his Party remains gullible about what the Chinese Communists’ real intentions are, I’m not going to be sold by mere words coming from Biden. Also, how dangerous would it be to elect a President whom the media decide to go soft on, as the Tara Teade revelations are showing? Where’s all the passion about “accountability” when it’s a Democrat?

The government’s medical experts should have been giving appropriate factual briefings without the President all along but he couldn’t stand the thought of not being on TV.

    The Implementation of the 25th Amendment would need a group of concerned Republicans who are committed to the AMERICAN People. There aren’t any In a position to take that step.

    That was Trump’s statement. It was simple musing that he would have been best advised to acknowledge as such rather than try to pawn off as sarcasm. As for Barnicle’s inane comment, let’s be forgiving and say he was musing as well.

  8. Forget the 25th amendment. This is about the idea that Covid-19 is the latest state budget balancing act scam is just so fitting of the dumocrats. They want your money to fix their problems only they won’t fix their problems. They will continue to spend money they don’t have. They will wait until there is another ‘golden opportunity’ to once again hit up the American Tax Payer to bail them out of a MESS of their creation.

  12. I was watching when President Trump made the comments, which were merely a case of thinking out loud. Granted, he should have made the suggestion out of the public eye. However, those who are piling it on fall under the category of being unable to think outside the box. The briefing and discussion was specifically about how bleach and alcohol killed the virus. President Trump used the word ‘disinfectant” in a general term – it wasn’t used in the briefing by DHS science director Bryan. For that matter, who knows what kind of injection might turn out to be effective? Humans tend to think solely in terms of what we (think) we know. It’s those who have the ability to think outside the box that make important medical discoveries, get man off the ground or into space. Radiation, yellow fever transmission, polio vaccine, penicillin, blood transfusion, etc. were all discovered by men and women who thought outside the box and, in many cases, put their own lives at risk. NONE were discovered by academia. President Trump has something no one else has, the power of the United States, behind him. The US Army lab at Fort Detrick has been working with viruses for decades, both to prevent and weaponize them. Sure, Trump’s comments often need to be taken with a grain of salt but don’t slam him for being able to think outside the box. He may have poor grammar but he’s not afraid to experiment.
