MSNBC Commentator Calls For Trump’s Removal Under The 25th Amendment Over The Disinfectant Controversy

MSNBC commentator Mike Barnicle this week called for the removal of President Donald Trump under the 25th Amendment for his bizarre suggestion that disinfectants might be injected into patients to clean their blood in minutes.  Many of us criticized the President for the comments and found his later claim to have been speaking “sarcastically” to a reporter as clearly untrue. Trump later suspended further briefings, which have served as a critical avenue for information from task force members like Dr. Fauci and Dr. Birx. Yet, despite my respect for Barnicle, it is important to be clear about what is a constitutional versus a political matter.  As I have previously written (here and here) and publicly discussed, the 25th Amendment was not designed and will not address this type of controversy.

Barnicle stated the view of many over the comments on the use of disinfectant, but suddenly took a constitutional turn:

“In a rational, political world, of which we are not part, we’re no longer a part of that, there is no longer a rational political world around us, I’ll tell you what might be on their minds: the 25th Amendment. Because yesterday, the president of the United States actually posed a threat to public safety, to the public safety of the citizens of this country … Those are the musings of a man who has spent a whole lot of his lifetime in a tanning bed. So, he’s been exposed to ultraviolet rays in order to look like he has a tan all the time. Those were the irrational rants of a man who, somewhere out there in this country, God forbid, some inherent of his, someone who follows him closely and adores him, and there are many people like that … will take a little sip of Clorox bleach today to ward off the potential of the virus, and they will die.”

There have been similar calls for over three years to use the 25th Amendment to address controversial statements and policies by the President.  Ironically, this type the amendment like a type of constitutional lysol that can be used wipe away a unduly elected but controversial president. That is not its function.

As I have previously written,Section 4 has, essentially, two avenues for dragging a president from the Oval Office. First, there is the mutiny option. A vice president and a majority of the Cabinet can agree that the president is “unable to discharge the powers and duties of his office” and notify Congress that the vice president intends to take over. If Vice President Pence could get eight Cabinet officers to sign a letter to that effect, he would immediately become the “Acting President.”  But if the president then declares to Congress that “no inability exists,” Trump could resume his powers. Pence and the rebellious Cabinet would then have to send another declaration within four days to the President pro tempore of the Senate and the Speaker of the House that says, more or less, don’t believe a word, he’s unfit. Once Congress had the second declaration, if not already in session, it would have 48 hours to assemble to debate the issue. It would then have 21 days to vote on the president’s fitness. To remove the president, two-thirds of both houses would have to agree. If Congress did not vote within 21 days, the president would get his power back.

In other words, the use of the 25th Amendment over this latest controversy would be unwarranted as it is unlikely.  The likelihood of removing Donald Trump under the 25th Amendment for this controversy is about as likely as his receiving an honorary medical degree.

Sure, the 25th won’t work, but there’s a good chance the GOP will lose TOTAL in November, including the senate, and kiss liberty goodbye. Pence has acquitted himself well, in a difficult spot, and he may at least prevent a Dem landslide if he topped the ticket. The ONLY chance is to get Trump to step down immediately! Buy him off, whatever.

I have a couple that I bought when I was painting something, and they are somewhere in all the hardware and tool stuff. And yes, I have plenty of paper goods. And a freezer full of meat. And other stuff. I am just chilling at home, Plenty of coffee and plenty of tea and tobacco. I sleep with a gun beside me in case Antifa or other Democrats decide to raid my fortress. I also need more liquor, so I may have to do a drive-thru liquor purchase to restock a few things. St. Brendans and Malibu Rum.

    Republicans were taken aback this past week by the results of a 17-state survey commissioned by the Republican National Committee. It found the president struggling in the Electoral College battlegrounds and likely to lose without signs of an economic rebound this fall, according to a party strategist outside the R.N.C. who is familiar with the poll’s results.

    The Trump campaign’s own surveys have also shown an erosion of support, according to four people familiar with the data, as the coronavirus remains the No. 1 issue worrying voters.

    Polling this early is, of course, not determinative: In 2016 Hillary Clinton also enjoyed a wide advantage in many states well before November.

    Yet Mr. Trump’s best hope to win a state he lost in 2016, Minnesota, also seems increasingly challenging. A Democratic survey taken by Senator Tina Smith showed the president trailing by 10 percentage points there, according to a Democratic strategist who viewed the poll.

    The private data of the two parties is largely mirrored by public surveys. Just last week, three Pennsylvania polls and two Michigan surveys were released showing Mr. Trump losing outside the margin of error. And a pair of Florida polls were released that showed Mr. Biden enjoying a slim advantage in a state that is all but essential for Republicans to retain the presidency.

    To some in the party, this feels all too similar to the last time they held the White House.

    1. The accuser is particularly flakie and erratic in her statements. She may be telling the truth or not but given that it is also not in character with any other accusations against Biden, serious judges of the situation would have to discount it.

      Ford’s accusation against Kavanaugh were totally in character with his other behavior at that time. Was he a serious rapist? No, he was a drunk a..hole who was also a bully. His erratic behavior at the hearings, including his obvious lies about his loutish youth, was more disqualifying than anything he tried to do to Ford.

    Trump Was Out Of His Mind

    Trump’s first days in office became a frightening preview of the insanity to come.  The new president kept insisting crowds at his inauguration were much greater than reported.  This led to a days-long national argument in which Trump supporters tenaciously defended their new leader.

    That first Monday in office Trump hosted a dinner for the Majority and Minority leaders of Congress: McConnell, Ryan, Schumer and Pelosi.  The purpose of said dinner was to discuss Congressional priorities.  Russian interference was already a front page story and there was speculation it would be a topic at the dinner.

    Instead of addressing Russian interference, Trump claimed, without a shred of evidence, that Hillary Clinton’s Popular Vote victory was the result of ballot stuffing by ‘illegal aliens’.  Trump therefore demanded a bipartisan commission be formed to investigate illegal voting.

    In a normal America Trump’s assertion of illegal voting should have ended his presidency right then and there.  No proof existed that Clinton’s Popular Vote victory represented ‘illegal votes’.  It was a false assertion out of the blue.  Schumer and Pelosi should have promptly walked out.  But they were too polite.

    So instead Schumer and Pelosi allowed a sham commission to be formed.  The investigation went nowhere fast; lacking any hard evidence.  The real story was Russian interference which Trump kept dismissing as ‘fake news’.  Yet Trump’s entire cabinet acknowledged that Russian interference was based on real Intelligence.

    So America had this bizarre situation, in the earliest days of Trump’s presidency, where he kept claiming vote fraud by illegals while denying Russian interference.  Any objective observer could have seen, at that early stage, Trump was irrational and unfit for office.  Yet no one in power had the honesty to say out loud what everyone was thinking: “The new president was nuts!”

    Historians will look back on this presidency with total confoundment. “How is it”, they will ask, “that a lunatic was able to continue in office while behaving irrationally every single day?”  Historians will chart timelines noting the hundreds of warning signs.  Yet somehow a maniac maintained a lock on power; enabled by Republicans and rightwing media.

    The Covid-19 pandemic would have been a disaster under ‘any’ president.  Even with national unity and the most capable of leaders, this crisis would have been a huge challenge.  But to enter a crisis like this with an irrational buffoon as president is possibly the gravest situation America has ever faced.

    Trump appeared at a campaign rally on March 2, 2020 in North Carolina. He played golf on March 8th. It hasn’t even been two months that he’s been holed up at the WH (with the exception of the events listed above in his tweet). But according to him, he hasn’t “left the White House in many months.”

    “Many months.”

    Poor Donald. What a self-absorbed baby. Can’t take the heat? Then he should get out of the White House and let an adult run the country.

    There are many people who wouldn’t mind being “holed up” in a place like the White House — even for a couple of months.

    People are dying and Trump’s whining.

      Or when the ingrate Michelle O. commented during an interview that there are places she would like to travel to “again” now that she is out of the White House, but, as she put it, she would like to go back and be able to “walk in the front door this time.”
