MSNBC Commentator Calls For Trump’s Removal Under The 25th Amendment Over The Disinfectant Controversy

MSNBC commentator Mike Barnicle this week called for the removal of President Donald Trump under the 25th Amendment for his bizarre suggestion that disinfectants might be injected into patients to clean their blood in minutes.  Many of us criticized the President for the comments and found his later claim to have been speaking “sarcastically” to a reporter as clearly untrue. Trump later suspended further briefings, which have served as a critical avenue for information from task force members like Dr. Fauci and Dr. Birx. Yet, despite my respect for Barnicle, it is important to be clear about what is a constitutional versus a political matter.  As I have previously written (here and here) and publicly discussed, the 25th Amendment was not designed and will not address this type of controversy.

Barnicle stated the view of many over the comments on the use of disinfectant, but suddenly took a constitutional turn:

“In a rational, political world, of which we are not part, we’re no longer a part of that, there is no longer a rational political world around us, I’ll tell you what might be on their minds: the 25th Amendment. Because yesterday, the president of the United States actually posed a threat to public safety, to the public safety of the citizens of this country … Those are the musings of a man who has spent a whole lot of his lifetime in a tanning bed. So, he’s been exposed to ultraviolet rays in order to look like he has a tan all the time. Those were the irrational rants of a man who, somewhere out there in this country, God forbid, some inherent of his, someone who follows him closely and adores him, and there are many people like that … will take a little sip of Clorox bleach today to ward off the potential of the virus, and they will die.”

There have been similar calls for over three years to use the 25th Amendment to address controversial statements and policies by the President.  Ironically, this type the amendment like a type of constitutional lysol that can be used wipe away a unduly elected but controversial president. That is not its function.

As I have previously written,Section 4 has, essentially, two avenues for dragging a president from the Oval Office. First, there is the mutiny option. A vice president and a majority of the Cabinet can agree that the president is “unable to discharge the powers and duties of his office” and notify Congress that the vice president intends to take over. If Vice President Pence could get eight Cabinet officers to sign a letter to that effect, he would immediately become the “Acting President.”  But if the president then declares to Congress that “no inability exists,” Trump could resume his powers. Pence and the rebellious Cabinet would then have to send another declaration within four days to the President pro tempore of the Senate and the Speaker of the House that says, more or less, don’t believe a word, he’s unfit. Once Congress had the second declaration, if not already in session, it would have 48 hours to assemble to debate the issue. It would then have 21 days to vote on the president’s fitness. To remove the president, two-thirds of both houses would have to agree. If Congress did not vote within 21 days, the president would get his power back.

In other words, the use of the 25th Amendment over this latest controversy would be unwarranted as it is unlikely.  The likelihood of removing Donald Trump under the 25th Amendment for this controversy is about as likely as his receiving an honorary medical degree.

    Claiming he was being sarcastic after the fact allows Trump to turn the question back on his critics — “What, can’t you take a joke?” Trump did the same thing in August 2019 when he claimed that he was just being sarcastic when he called himself “the chosen one.” He was “kidding, being sarcastic, and just having fun,” Trump tweeted: “no more trust!”

    That plays into the whole worldview of Trump and his supporters, which relies on distrust, polarization and outrage to make sense of political information. Trump doesn’t make mistakes, actually, but the lying mainstream media says that he does (a frame of distrust). The lying mainstream media hate Republicans, which is why they never tell the truth about them (a frame of polarization). And the lying mainstream media are just trying to distort Trump’s words and turn them into something else to “get” Trump (a frame of outrage).

    And sure enough, Rush Limbaugh invoked all these frames to explain away Trump’s comments Friday.

The Drive-By Media is attempting to persuade and convince people that Donald Trump told people to drink Drano at the White House press briefing yesterday,” Limbaugh informed radio listeners. “That Donald Trump told people to go out and get a syringe and inject Clorox in their arms, and that this could be dangerous, that Donald Trump is killing people now in the White House press briefing. … Now you can’t watch mainstream media for 10 minutes without hearing about how some conservative or some network had somebody on it that said something that a bunch of doofus, dunce Americans listened to and now they’re dying.”

    Limbaugh’s version of the story was outrageous and absurd; it was tailor-made to reinforce distrust and polarization. Of course Trump didn’t tell people to go out and get a syringe, and reporters didn’t say he did, but that doesn’t matter: Limbaugh’s story was outrage bait. It was designed to reinforce the “us vs. them” frame — they make up stories and say that we are “doofus, dunce Americans,” when we’re just the victims. Limbaugh said that this kind of ginned-up, slanderous controversy happens at least once a week.

    Soros-Funded David Brock Group Accused of Violating Tax Laws

    The David Brock-founded far-left group ‘American Bridge 21st Century probably violated its tax-exempt status by engaging in political activities while illegally posing as a nonprofit, according to a complaint filed Thursday with the Internal Revenue Service.

    The Patriots Foundation filed a complaint with the IRS claiming that the Soros-funded group is largely a political organization and therefore has violated U.S. tax laws.

    “American Bridge has a super-PAC arm that can spend unlimited sums to influence elections. But the primary purpose of nonprofits organized under section 501(c)4 of the tax code like American Bridge cannot be politics. The complaint quotes material given to potential donors to the nonprofit arm in 2017 saying the organization’s mission is ‘to take on Donald Trump,’” Bloomberg reports.

    David Brock is a notorious Clinton operative who runs Media Matters for America – another Soros-funded group tasked with censoring social media of conservative and independent voices.

    Brock once boasted about lying in a book in order to ruin Anita Hill’s credibility on behalf of the Clintons.

    “Groups like American Bridge do not have to disclose their donors, which is why they are sometimes called ‘dark money,’” Bloomberg wrote in their report.

    Foxnews.com reports: Liberal billionaire George Soros has been a prominent donor to American Bridge 21st Century and the group spends millions on ads attacking President Trump.

    The complaint accused American Bridge 21st Century Foundation of engaging in “serious and deliberate violations of the Internal Revenue Code of 1986, as amended (“IRC”) and abused its tax-exempt status” and outlined specific examples, referring to the far-left group as “AB21CF” throughout.

    “Specifically, as detailed below, AB21CF is not operated exclusively for an exempt- purpose; is operated primarily for political purposes; has participated in an impermissible excess benefit transaction with its founder David Brock and True Blue Media LLC; has provided an improper private benefit to Brock and True Blue; has used its income and assets for the personal gain of Brock; and has engaged in commercial, for-profit business activity through its investment in True Blue Media,” the complaint said.

    The complaint said “AB21CF appears to have abandoned any attempts at credibly describing itself as a social welfare organization under section 501(c)(4). Instead, it has become singularly focused on one mission, ‘to take on Donald Trump.’”

    The lengthy document claimed the group planned to create “a 47-person war room to take on Donald Trump with a staff of 23 researchers, a communications team of 16” who feed work to the press for the purposes of rapid-response.

    “This is not a proper nonprofit purpose,” the complaint said. “The IRS should undertake an examination of AB21CF to determine the extent to which it has misused its tax-exempt status.”

    The complaint concluded: “Further, the IRS should determine that AB21CF has engaged in egregious and systemic violations of its tax-exempt status, and take appropriate action as warranted including, but not limited to: revoking its tax- exempt status… imposing any appropriate penalties and additions to tax; and referring violations to the Department of Justice for possible criminal prosecution.

    The Patriots Foundation also filed similar complaints against Media Matters For America and The Franklin Education Forum.

    American Bridge president Bradley Beychok dismissed any wrongdoing by the far-left group.

    “The Patriots Foundation has chosen to purposely mislead the public in order to further its right wing agenda,” Beychok told Bloomberg.

    “He added that Brock resigned from the organization in 2016, before the transfers to True Blue Media were made, and that the group’s board of directors determined the investment would further the mission of American Bridge,” Allison added.

Sure, the 25th won’t work, but there’s a good chance the GOP will lose TOTAL in November, including the senate, and kiss liberty goodbye. Pence has acquitted himself well, in a difficult spot, and he may at least prevent a Dem landslide if he topped the ticket. The ONLY chance is to get Trump to step down immediately! Buy him off, whatever.
