We have previously discussed rising cases of politically motivated violence, including attacks on people wearing MAGA hats. In Delaware, two women reached a particular low point by stealing the hat of a 7-year-old and then screaming profanities, ripping up signs, and one assaulting an individual in a parking lot near the Democratic National Convention on Thursday. The Delaware police hit Olivia Winslow, 21, and Camryn Amy, 21, with an array of well-earned charges, though one charge remains unclear in terms of the relevant conduct. What is remarkable about the videotape is the sense of utter entitlement to attack those with opposing views.
I have been critical of professors who have declared any MAGA displays as proof of white supremacism or fascism. Such views have fueled a type of license to assault and abuse people for their political views. MAGA hats have been banned from some college coffee shops or stolen by fellow students on campuses. Even journalists have declared anyone wearing a MAGA hat to be a per se racist.
Such voices of intolerance reinforce those who claim the right to take violent action as shown in the video taken near the Democratic National Convention. The video is available here.
Winslow and Amy were charged with robbery, conspiracy and endangering the welfare of a child. Amy was also charged with offensive touching.
The endangering charge is the interesting one from a criminal defense perspective. It is true that the women take the hat into the parking lot and the boy follows. However, the mother is bizarrely telling her son to get his hat back from two clearly violent women and to follow them into the parking lot. One of the women eventually throws the hat over the fence. The question is whether the endangerment charge is due to the boy following them, the later violence of the women, or the original attack. If they plead down to misdemeanors, the endangerment charge could fall out.
The law itself includes a child witnessing certain felonies:

(4) The person commits any violent felony, or reckless endangering second degree, assault third degree, terroristic threatening, unlawful imprisonment second degree, or child abuse third degree against a victim, knowing that such felony or misdemeanor was witnessed, either by sight or sound, by a child less than 18 years of age who is a member of the person’s family or the victim’s family…
In any case, the videotape leaves no obvious defense and no course other than a plea. A defense attorney might seek a plea to a single count each. The priority would be to drop the endangering of a child count, which could have the longest lasting impacts on the women in terms of future employment.

The age of the girls is 21 which to me is intetesting. I am a retired who in the last years of teaching had to take and implement two years of Restorative Justice training. This morning maybe 15 minutes ago a parent of a slain daughter at Parkland was on tv talking about how Restorative Justice was used in his daughters school and how Obama Biden put it in schools and how it was a failure and how Trump ended. These kids would have gone through it too. It s one big pillar is empathy. Children do no wrong and there is no punishment until you have completed a healing circle and after that healing circle you repeat the offense at least 3 times. Healing circles were at recess for those who did something wrong and daily in classrooms for 40 minutes. I never put the two the kids thinking there is no wrong with Restorative Justice and the over two years it was taught in public schools. This parent is talking tomorrow at Republican Convention. I will be watching. .By the way at my school, there was no suspensions or expulsions during that time even though there was violence.
It should be obvious by now that an awful lot of these young people are severely emotionally stunted if not simply not well. A 21 year-old that thinks it’s not a big deal to harass a 7 year-old, for any reason is clearly damaged goods. It’s time to start bringing the hammer down and administering the consequences their parents felt were unnecessary.
We might think these young people are emotionally stunted, or that there is something else wrong with them, but I have witnessed children raised in what I consider normal homes acting out like this. We don’t know these two women, and we can consider it possible that they suffer from some malady, but we should also consider that there’s absolutely nothing wrong with them. Perhaps these women just got caught up in the mob mentality, and they think they’re justified, because the “other guys” are “bad guys”. James Fields lost control. In a charged situation with people bashing his car with baseball bats, he quit thinking rationally and plowed his car into a crowd. That is an actual loss of control.

Which came first, the “Charlottesville” comment that came from a president in politics a few months or “Poor kids are just as smart as white kids”, by a man who has been in politics 47yrs?
Craig Nichols, the so called “Charlottesville” comment, was never made by Trump. His comments have been taken out of context since the day he made them, and the lie has been repeated so many times in the past three years, that many actually believe the lie. Goebbles was right when he said, if you repeat a lie long enough, it will become the truth.
I watched the Charlottesville statue matter and listened to what Trump said, but he never once gave any credibility to the small group of ‘Nazis.” As a matter of fact, he “condemned” that group, which is something we never hear about.
If people take the time to research “exactly” what he said, they would learn just how fake the biased media really is.
There is clear cut evidence of a crime, committed by these two, and you want to blame someone else for their actions.
Lay the blame on the individuals without a qualifier that they were somehow driven to it by Trump.
There was a man murdered by a BLM/Antifa person the other night in Portland. Kicked in the head brutally. Is that Biden’s fault?

The counter protestors in Charlotte were anything but peaceful, and I beleive that James field is serving Multiple life sentences for being mentally disturbed and losing control.
I would note that PRIOR to running into the crowd these “peaceful protestors” were bashing his car with baseball bats.
Whatever his flaws Trump did not create this. The left did.
Fields was a clearly disturbed young man – and should be treated as such. Absolutely he was dangerous. But he was also out of control.
These 21year olds actually believe what they are doing is not merely acceptable, but that it is morally right. They are not “out of control”. They are doing what they have been taught and what they beleive to be right.
Trump did not teach them that it is OK to steal from 7Yr olds. Trump did not teach them that your beleifs supercede criminal law, and that you may advance your beleifs by any means necescary.
They learned this nonsense years before Trump.

I saw the video these two woman are NUTS they have severe Trump hatred/syndrome. They deserve to be punished to the max. there was no call for them to do what they did. But, this is what the radical left that the DEM’s support do. throw them in Jail and throw the key where they threw the boys hat.
