Contested Election: The 2020 Election Has Proven A Target Rich Environment For Challenges

Below is my earlier column in the Hill on the issues that we are following in the various states.  Many of these issues are now being litigated on the deadlines and conditions for voting. We are still seeing challenges over the voting and now over the counting.  We will be moving to the next phase from counting to keeping votes. Even if a state is declared for a candidate, there will be recount and challenges.  Recounts historically have no resulted in substantial changes with the exception of the Florida recount in 2000 where there were serious problems in the design of ballots and intent of voters.  There remain however categorical challenges like the one kicked back by the Supreme Court in Pennsylvania.

The election is here and the record level of early voting is matched only by the record level of conspiracy theories. Many harbor doubts over whether their votes will count, but such doubts have lingered in history. Like Mark Twain said, “If voting made a difference, they would not let us do it.”

Both sides are fueling such insecurities. President Trump has condemned mail voting as an effort to steal the election, so Democrats accuse him of sparking a coup attempt if he loses. Democrats like House Majority Whip James Clyburn have said that the only way Joe Biden can lose the election is “for voter suppression to be successful.” Republicans accuse Clyburn of fueling riots if Trump is not declared the loser on election night.

It is not surprising that both sides have raised tens of millions of dollars and enlisted hundreds of lawyers for the election challenges based on a “saturation bombing” legal strategy. The litigation started weeks before the election, and thousands of ballots are being set aside in anticipation for court reviews. Every election for president I have covered as a legal analyst has raised challenges, including the ultimate contested 2000 election that ended with the ruling in George Bush versus Al Gore.

It is inevitable with tens of millions of voters across thousands of polls that isolated or systemic problems arise. But this election is different by a high order of magnitude. Mail voting is always a magnet for challenges. In past elections, some mail ballots were not even counted since they would not affect the outcome. Now officials have to process tens of millions of mail ballots in areas that have not dealt with such numbers before. Watch the developments in three basic categories as the election unfolds.

Voting Deadlines

The first category of challenges is deadlines. This will constitute the most extensive form of challenges. The “clocking” of ballots is an effective basis for challenges as the deadlines are set by state law. The results have been mixed thus far. One federal court agreed with the challenge by Minnesota Republicans in rejecting an extended deadline to receive absentee ballots after today. A split panel of the Eighth Circuit ordered that any mail ballots received at a set time tonight must be set aside for potential nullification. There is now litigation on the state and federal level on the issue.

The Supreme Court has issued its own orders. It ended the Wisconsin plan to count mail ballots received up to six days after the election. The bench broke along ideological lines as Chief Justice John Roberts held that such orders constitute “federal intrusion” on state law. However, the bench split evenly on the Pennsylvania extension of the deadline for absentee voting, which left the court orders standing. Roberts voted for that extension as part of such “authority of state courts to apply their own constitutions to election regulations.” Conversely, the Supreme Court voted to support an extension for the deadline of absentee ballots in North Carolina.

Justice Samuel Alito, Justice Clarence Thomas, and Justice Neil Gorsuch have indicated that the Pennsylvania challenges raise not just state but federal issues. It is not clear how Justice Amy Coney Barrett, who sat on the Supreme Court for the first time this week, will decide on the issues. Even if she votes with her colleagues, Roberts is the swing vote.

Voting Conditions

Another category of challenges is conditions. This rises significantly in the election and includes allegations of voter suppression due to long lines or malfunctioned equipment. This year has seen novel challenges and mixed results in this category. Given such high turnout, the time it takes to vote could be an issue. It was the case in the 2012 election, when some voters complained of standing in line for hours. Such delays will likely result in filings for courts to monitor and solve them with extended hours.

The Texas high court denied the Republican petition to invalidate almost 127,000 drive through votes in Harris County. A unanimous Pennsylvania high court ruled that mail ballots must not be rejected due to perceived mismatches between signatures. The Supreme Court upheld an Alabama challenge to curbside voting, supporting the view that it is not permitted under state law. The Supreme Court has also ruled to enforce the South Carolina mandate that absentee ballots be signed by a witness.

There have not been great challenges over the conditions at polling places. Instead, the litigation has focused on the conditions for the counting of balloting, including the denial or separation of monitors from counting and processing areas.

Voting Certification

The most worrisome category of challenges is certification. This comes when the votes must be certified by the states for eventual submission to Congress. Many states do not start counting votes until after polls close. That could leave the outcome hanging by both tabulation and litigation, which could be serious in Pennsylvania. Michigan is also of concern due to its 1,600 districts with different systems. Wisconsin and Nevada will process record numbers of mail ballots with untested systems. Nevada has rejected demands for added standards to count ballots that could spark challenges over potential voter fraud. Such challenges can force recounts, the process that slowed states like Florida in 2000.

The problem is that the states must send certified results to Congress in five weeks. There is a chance that challenges could delay submissions, or that states could send two sets of electors as a result of disputed results. Congress would have to select between those conflicting sets or perhaps disregard submissions. There is also a chance that neither candidate will secure 270 electoral votes, which leads to a dangerous battle.

Much of the litigation will not be to ensure a clear majority but to reduce the margin for either party. If a party can toss out enough ballots or force enough of its own votes to be counted, it is possible to cut challenges in arguing that, even if successful, they will not alter the outcome. Trump declared that “as soon as that election is over, we are going in with our lawyers.” But that is not necessary since they are already there.

  1. Just a thought. Assume Biden’s in Jan 20th and Pelosi is still splitting her fingernails trying to keep from getting thrown out of the House of Reps. they can do that didn’t you know. Not an impeachment but a rejection. So she’s on a time limit and thinking money money money.

    The new House of Reps is very close about fifteen or less Dems over Repubs. BUT 20 of the Demos are anti Pelosi and that’s enough to tip the scales on the vote for Lame Duck Speaker.

    One of Trumps crew proposes the following to break the blockage of the stimulus second checks.

    Offer to support one half the money needed to bailout the rubber bouncnig check bunch of States and Cities that Pelosi wants to save. Why? She lives in San Francisco a dead beat city and of course that is in California a dead beat state. No Capitol letters they don’t deserve it since their bankrupt. The offer is half the funds now and that frees up the stimulus money AND a third check in January before the twentieth for the same amount leaving Biden to pick up half after Jan 20th. Addition. Both are not subject to taxes sno matter when received.

    Pelosi knowing she hasn’t the votes to remain as speaker nor to stop an ejection vote goes for it. We get our checks a week later. in time for Christmas maybe. and a few weeks later the third check . So Merry Christmas to all. Pelosi and her crowd are gone and we have a new Speaker of the House.

    How was this done. The number of Repubs and the number of Independent Democrats are now the majority. The socialists are the minority. So is it permanent or is it a coalition or? Does it matter? Hmmmmmmm

    At that point the independents say hey! We don’t need the DNC. Dump those debt ridden no goods. Call up Tulsi Gabbard to be the Director or whatever of the IDC the Independent Democrats and the CR Constitutional Republi Party and whoosh go to work on repairing the in debt budget.

    One suggests why not repeal all of the Pelosi scam measures who cares she is gone and her former cartel is powerless. Call up the same situation in the Senate and by the end of the day the Pelosi personal budget is reversed and Biden says. HEY we could use that to cut the debt and pay for the third check. Let the rubber check cities and states be responsible for their funny money situation. I can then inherit the Trump Economy and the Independent Solution!

    Did Biden figure that out? No. Somebody Huntered up a solution and in return got a Federal Pardon. So the dead beat states got their black hole of Cal-gut-ah sentence cut in half the Citizens got their checks and the Socialists? Their is an ongoing investigation on violation of Oath of Office. and a bill in Congress to ban Socialism.

    Six months later none of that group survived the States Evidence Fly on the Wall testimonyof Huma Gotcha Huma Huma Abeendown and I been up and up is much better than a cell full of diesels and as for Comey? Sing Sing Sing! the Pardon request is still in Biden’s waste basket.

If we could all take about a million steps back and view this situation from the perspective of aliens and/or history, this election pandemonium is a necessary process and a culmination to the revelations of the past four years but also to the past 200 plus years of our nation’s life. Every institution has been challenged and has been found wanting. The CIA, the FBI, the federal judiciary – none has stood up to the test. We spent 30 million dollars, which now seems like pocket change, investigating Russian collusion, egged on by the people guilty of collusion with Russia. We impeached a president in the absence of any impeachable offenses and only Professor Turley stood up, not for Trump, but for the rule of law and sanity. We have endured an all out attack on the First Amendment which has been supplanted with mob rule, online and off. We endured a plague which was unleashed for the sole purpose of bringing down Trump, with human life of no account, because he’s the only real threat to the globalist agenda. And if the virus itself weren’t enough to bring him down, as it would have any other president, the left had their “insurance policy” of mail in ballots. When I told my ex-laws in Italy about it, they laughed. “Elections Italian style!” they said. But the difference between the Old Country and the New, as no one who hasn’t lived elsewhere can understand, is that in America, we have recourse. There is compelling evidence of voter fraud on a colossal scale in multiple states and I have no doubt that it will be proven. Whether Trump will be able to overturn the results is another story. But this is where we get to see the grand Rube Goldberg’s machine of democracy at work and this is where we get to see the problems in the system and no matter what happens in this election, those problems must be rectified.

      2. Election Day is over. Polls have closed. Go to bed at 4am and Trump has overwhelming lead in key swing states. Then they keep pumping ballots out of nowhere that still need to be counted for days and days AFTER the election and these ballots always swing the vote tally from red to overwhelmingly blue? It will be hard to prove fraud, but it stinks and destroys the integrity of our elections. You don’t keep pulling ballots out of nowhere AFTER polls close and keep counting votes for days AFTER election day until the results swing dramatically and ovewhelmingly to Democrats. This is what Dems call robust ‘democracy.’ Enough is enough with this stuff the Democrats have been doing for years now and they keep getting away with it.

        1. The ballots aren’t “out of nowhere”.

          Trump discouraged his supporters from voting by mail, so it’s no surprise that most mail-in votes are from Democrats. If these states had allowed the absentee ballot count to start before Election Day, as occurs in most states, you wouldn’t be seeing this shift now.

Dude, the GOP legislatures in the 3 rust belt states where this is primarily happening all voted down attempts to allow mail-ins to be processed as they came in, instead of on and after election day. These ballots did not come from nowhere and almost all of the mail ins were there before election day. They were early!

          1. How did big states like Texas and Florida get it done? Their election laws do not allow for the shenanigans like we are seeing in PA, for example.

            By ‘this stuff’ I’m referring to examples like PA getting election day extended for three days AFTER to continue accepting ballots, and accepting ballots with no clear postmark, etc. and then counting for days on end with dramatic swings in results we saw on election day, and always in the Dem’s favor. Also other states like Cali that allow for ballot harvesting and vote canvassing, shady practices like these that always swing results to Dems in the days following the election. Maybe they can’t ‘technically’ prove fraud, but Dem practices like these sure stink like it and it should be stopped.

            1. Anonymous, those votes are not part of the tally and are kept separately at present. It looks like they will be superfluous to the outcome. Other than that, the states run the elections and have leeway on these kinds of issues. I don;t know that I’d be holding Florida up as an example however, though they have improved on the system in place in 2000.

            2. Florida allowed the opening and recording of absentee/mail ballots as they arrived. Early voting ended a few days prior to election day. They have been doing extensive voting by mail for years with reforms beginning as far back as Jeb Bush. Florida has its problems with the Republican legislature overturning a constitutional amendment to allow those who have returned to society to have their voting rights restored but since the debacle in 2000, they did figure out how to count votes they allowed to come in.

    So the larger question remains: does President Trump have a Constitutional duty to defend the country against the counting of illegitimate ballots in Nevada? Greater than his Constitutional duty to concede the election if Nevada, at first pass, turns for Biden?

    Al Gore did not concede to President-Elect Bush until 13 December 2000.

    Perhaps Biden, if he declares victory after a win in Nevada, will give President Trump at least this long to concede in his victory speech.

        As they note, “Only votes cast by Nov. 3 are legal according to Pennsylvania and federal election laws. Trump himself has described any effort to vote after Tuesday as clear election fraud.”

        Shouldn’t Trump condemn this email coming from some of his supporters and make it clear to his PA supporters that if they still have their absentee ballots, they should NOT return them now?

Jonathan, all legal challenges of substance should be heard, but that is different than trying to undermine the entire process as Trump has been doing for the last several months and with very little to no evidence.. Turley highlighting these challenges as significant – so far they are not – is just more of his water carrying for the Trump campaign which risks a very dangerous response and result. Joe Biden is up nationally by 4 million votes. 3,000 votes does not dent that expression of the will f the people.

      PS 500 votes separated Al Gore (who won the national vote by 1/2 million) and George Bush in one state where the GOP fought successfully to curb a challenge to Florida’s count. The situations are in no way comparable.

  15. Reuters says that the U.S. Office of Special Counsel has opened an investigation into the Trump campaign’s use of the White House for campaign-related activities to see if federal law has been violated.

    They need to start prosecuting Hatch Act violations. Some people say that the Hatch Act is unconstitutional. Let the defendants argue that in court and see what the judge says.

  16. Voting is a process. And in the real world where process management is done to achieve a consistent output of recognized quality, the undeniable standard of process improvement requires the elimination of Common Cause Variation first and then Special Cause Variation. No organization or business that produces one product, like voting results, would design it with 50 different business units coming up with their own processes. More importantly, they certainly wouldn’t allow any individual business units (states) that fail to continue operating. The idea of federalism is that individual states act like incubators of democracy. We should be overdone on the incubation of the voting process by now. Which of these incubators do it the best? Make that the standard for crying out loud. If that’s not acceptable to the political establishment, then the only conclusion to draw from that is they are using the voting process for an undeclared output.

      1. I suspect it didn’t happen because political power is not to be trusted in the hands of voters. There can be only one reason this process remains a clusterfawk; a bi-partisan, standardized process cannot be leveraged outside the process. No isms, nothing.

    I have personally spoken with people who work at funeral homes in Pennsylvania because they reached out to me. A quick search revealed that 13 individuals they’ve buried in last few months…7 were sent mail in ballots on 9/28.

    Also an 87 year old man applied online for absentee ballot 5 days AFTER his death. “Adam if we were able to find this many so quickly, it gives me great concern.” All info is verified by using obituary data on funeral home websites for DOB and the PA Voter Services website.’

    1. EVIDENCE of fraud. On what scale is this happening? Count enough to tilt it to Biden? Who doubts this vote result maneuvering is going on?

    2. If he thinks he has evidence of fraudulent votes, he should contact the PA Secretary of State’s office and provide that evidence.
