This week, President-elect Joe Biden made a highly commendable decision to nominate Judge Merrick Garland as the next United States Attorney General. Like many, I praised Garland as an outstanding choice and a move that advanced Biden’s earlier pledge to seek unity. That is why I was so disappointed in Biden refusing to take a position on the effort to impeach Donald Trump next week. As with his equally inexplicable refusal to take a stand on court packing, Biden’s silence on this clearly unsupportable “snap impeachment” was a missed opportunity to show real leadership when it matters most. It is not popular to oppose this impeachment, but leadership often demands that presidents take unpopular but correct positions.
Biden stated on Friday that President Trump “isn’t fit to hold the job” and said that he did not want Trump to attend the inauguration. I have no problem with that statement. Indeed, Trump himself has said far worse about Biden and he has also stated that he does not want to attend the inauguration. I also have no problem with calls for Trump’s resignation or a bipartisan statement of condemnation from Congress. However, critics want to push through an impeachment will little discussion or deliberation on highly dubious constitutional grounds.
When asked, Biden stated;
“I’m focused on the virus, the vaccine, and economic growth. What the Congress decides to do is for them to decide,” Biden answered when asked if he supported such moves. … We’re going to do our job and the Congress can decide how to proceed with theirs. That’s a decision for the Congress to make. I’m focused on my job.”
The defense of the Constitution is “his job” and this would gut both the process and the standard for impeachments. This was an opportunity to take a principled stand to unify the country by asking his party to stand down and not pursue a “snap impeachment.” As I discuss in my column today, this impeachment not only threatens principles underlying impeachment but also free speech in our Constitution.
As with court packing, this is not the time for good people to stand silent even in the face of such unhinged anger. Indeed, Democrats may loathe the day that they embraced the concept of a “snap impeachment” — a contradiction in constitutional terms. Impeachments are designed for deliberative, not impulsive, acts.
Indeed, Biden’s reference to more pressing matters is preciously the point. He should have asked Congress to focus on those issues and not an impeachment that will not succeed in removal but will succeed in undermining our constitutional system.
There could be evidence to support impeachment but it has to be found outside of this speech. That requires an inquiry. Biden should oppose any “snap impeachment” to allow for hearings at a minimum.
This was the type of “Say It Ain’t So, Joe” moment that I was hoping for after the election. Biden could have refused to go along with this plan or to remain silent in the face of a clearly improper use of the impeachment power. He could still have condemned the speech and the President, as many have done. He could then have asked for his party not to do greater damage by rampaging through the Constitution to try to remove Trump in his final days. That was a presidential moment missed by the President-elect.
It’s Biden’s role to protect the constitution but he should reject impeachment as a response to Trump’s failure to do so? Logical thinking too difficult?

Trump incited his private militia to march on the Capitol. He has continued to make incendiary statements implying they can attack the inauguration without fear of harming him or his loved ones. The same ones he told to stand back and stand by, with elements that planned to kidnap a governor, were out there with a noose saying they would hang the second in command of this country.
In the middle of a peaceful transition they violently stormed the place where the chain of command behinds Trump was attempting to ensure that transition. They had weapons, zip ties for hostages, chanted they would kill heads of govt and did kill a capitol officer trying to protect US leadership.
This was an act of terror, directed by Trump who said he would march with them and watched in joy from afar as they violently stormed the buildings where any possibility of checks and balances lay. He didn’t order the national guard, the army, the navy seals or anyone to save our country. When Governor Hogan attempted too he was pushed back time and again for 2 hours until army secretary McCarthy broke the chain of command and allowed a neighboring governor to help save the future of the US.
This was 100 times worse than what the right alleged took place in Benghazi. These elements are still planning attacks on government before and during the inauguration, with more weapons than before, and we can’t count on the current commander in chief to take the necessary actions to stop it. If the violence happens, when it happens, we will be unable to protect the future of this country if we have to rely on Trump to do the right thing for once. He’s become increasingly unhinged. If he’s not impeached he’ll be unstoppable, particularly if Pence has to flee again.
If he is impeached, and McConnell refuses to hold a vote on removal, any act of terror on govt that occurs in the meantime is on him and the GOP. If it happens when it happens at least we can count on them to finally step up and do what must be done to ensure the US doesn’t go down in flames thanks to a megalomaniac with a massive private army who thinks he’s king, and will continue to incite these folks long after he’s gone from office unless he’s checked now and put in a position when he can no longer do so.
He’s shown his character time and making speeches not protected by the 1st amendment by inspiring imminent threats of violence clearly isn’t beyond him. These far right militias are the biggest current threat to democracy and Trump is unpredictable and in support of them and he thinks he can pardon himself for anything he says or does while in office and plans to. Doing nothing is not an option for our leaders if they care about the future of this country.

Gone are the days of Statesmen where honor, integrity, and love of country trumped partisan interests.
I accept that it has been anything but a bed of Roses akin to an afternoon Flower Club Tea….but when it came to genuinely serious and important issues…..our Statesmen rose to the occasion and set partisan differences aside and did what was right for the Nation as a whole.
Did not JFK write a book one time…..that displayed accounts of that back through our history and was applauded for his thoughts in that book?
Where are the Statesmen today….does either Party have any….as there are none showing their presence now.
Biden should have done as Ford did….take an unpopular stand and do what was in the best long term interests of the Nation.

It has not been established that the lawsuits were frivolous. It has been difficult to follow all of them, but I do not believe that these lawsuits were dismissed on the merits.
Being dismissed quickly and before any trial is a major trait of frivolous suits. But some judges did comment extensively on the merits, and then dismissed them.

I don’t believe the Republicans played this very well. Objections to state election laws being changed with no appropriate legislation should have been done before the election in states such as Pennsylvania, Georgia and Wisconsin. That might have gone a long way in eliminating or mitigating any lawsuits based on mail-in ballots and drop boxes. After the election it was simply too late to do any proper forensics on voting machines, software, and the like. I am assuming there are several states that do not have any paper trails to audit votes tabulated in machines. That all by itself will make any audit a waste of time and should be fixed. Transparency is vitally important regardless of who’s in charge.
This Trump matter is always a bit like the game telephone. No one heard the speech but they keep building on each story someone tells. Trump’s speech is the same speech he has been making ever since this battle over the election results began. In fact three people told a Fox Reporter that they were disappointed because they thought they were going to hear something exciting and new. As I read through it yesterday, I hunted for the things he said to get the crowd to head to the Capitol and tear the place up. He said several times. “when this is over we will all walk to the Capitol”. The Secret Service said he could not take the walk because they couldn’t protect him.
The Press keeps saying his charge to the crowd to go to the Capitol invited the rioting. Here were the comments.
“So we’re going to, we’re going to walk down Pennsylvania Avenue, I love Pennsylvania Avenue, and we’re going to the Capitol and we’re going to try and give… The Democrats are hopeless. Trump does not deserve to be feted and adulation maintained, by NOT somehow showing justice to be done. This surely needs to show that PRESIDENTS are not above the law. Not having the 25th Amendment used or impeachment, how else do we punish a President. When out of office I only hope he is ‘crucified’ for any illegal activities as a private citizen/businessman.
BUT he would seem to have got away scot free from all wrongdoings as President. Very unfair, very UNJUST. The office has been tarnished and brought into disrepute, possibly, irrevocably.

JT and others take the position that unless the President commits serious crime relating to their official duties, and this crime is easily provable only from publicly available evidence (before any other evidence can be introduced), and all the right wing pundits agree, then the President is above the law. And in that case, they can only be impeached. Anything else then then it is the responsibility for the voters on election day.

That an attempted coup fails doesn’t change that it was an attempted coup. Take the attempt seriously. Some of the rioters were looking for Pence to assassinate him. Some had dozens of flex-cuffs to take members of Congress hostage. One had Molotov cocktails with a napalm-like substance. Ashli Babbitt was shot while she was trying to climb into the Speaker’s Lobby, which enters onto the House floor, while some members of Congress were still on the floor.
He tried to get state officials to overturn the results of voting in their states, and he tried to get Pence and Congress to overturn the results of the EC vote. He and Giuliani called Sen. Tuberville to try to convince him to further contest the Congressional vote WHILE the Capitol was on lockdown and members were hiding from a mob that was trying to coerce Congress to overturn the election. Pence was vilified by Trump for doing his job, and some of the rioters wanted to assassinate Pence in response. Trump refused to allow the DC National Guard to assist the Capitol Police, and that assistance had to wait until Pence approved it.

If there’s no likelihood of a 2/3 majority vote in the Senate then there is really no point. I can’t see many Republicans with that sort of “death wish” if they want to remain in the Senate.

Pelosi is not considering whether the Senate will convict – this is now just spiteful politics. Just like Trump and many in the political/pundit class, she doesn’t care enough to back off. It is certainly not in the best interest of the country.

Every time I reach my level of satiation with President Trump, his opponents make him look almost reasonable by their actions. To be clear, I am against “taking to the streets” as long as there remains legal means to address your grievances. In the this case, the legal means played out, it is time to unite as a country and move forward.
I have tuned out of broadcast news and I did not hear Trump’s speech to his followers to get them to the Capitol. I did not hear his address in which he committed to a peaceful transition either. What seems apparent is that this impeachment is an attempt to destroy the Republican Party and incite more violence. Violence that can and should be crushed but that will further and maybe irreparably damage our republic.
If Joe Biden can’t lead on this, when, and on what can he lead?

Do no forget, there are Many of us that see Trump differently than you. I am a Black Trump supporter who disagrees with his choice of words. He is blunt, sometimes crude, and could Evan be discribed as “a bulll in a china shop”. His complaining about the election process in several States was seen as valid by many. Texas put it simply. State Elected officials have No authority or right to unilaterally change voting procedure established by LAW. The supreme court did not disagree, but said Texas did not have standing to bring the action before the court.
I separate what he Did as president, from his behavior. He kept about 80% of his promises and represented OUR national interest more than Carter, Bush, Clinton, and Obama before him.
Those people seem hell bent on making Mr. Trump a political martyr, but are so consumed by their hatred that they fail to see the consequences of their actions. The Democrats hate free speech. Michele Obama just called for mass censorship. You cannot claim to love America while silencing opposing voices and criminalizing dissenting speech. That is fundamentally anti-American.

Trump tweeted he would not attend the inauguration. Twitter overlords determined that should be censored because it might “fuel violence” or “insurrection” or some kind of uprising. Or something. Really?
You are reading it too narrowly. What Michelle O called for was giving MORE power to tech overlords to use their subjective judgment to censor and silence political speech.
Also, it can be argued that what happened was not “insurrection” but rather a “mostly peaceful protest” that was hijacked by extremists and interrupted Congress for a couple of hours.
People argue all sorts of things. There was clearly a group of people there for insurrection. They had maps of the building, they were dressed in tactical gear and had large numbers of flex-cuffs, some were calling for Pence to be assassinated and looking for him.

Private companies can enforce their Terms of Service if those Terms aren’t honored. It’s easy to engage in political speech that doesn’t abridge Twitter’s TOS.
