The office of New York Attorney General Letitia James has publicly released a statement that it is now pursuing a criminal rather than a purely civil investigation against the Trump Organization. The investigation is being handled in conjunction with the Manhattan district attorney’s office. The investigations appear to focus on tax and business dealings. While I have challenged claims of a long litany “slam dunk” crimes related to Russia or Ukraine (or even tweets) that legal experts declared regularly on outlets like CNN and MSNBC, I have long opposed Trump’s effort to withhold his tax records and viewed these tax and transactional crimes as the greatest threat for actual prosecution. Tax and fraud cases are easier to prosecute and more difficult to defend in court.
James’ office has been investigating the Trump Organization since 2019 and announced this week that the civil investigation now has a criminal component:
“We have informed the Trump Organization that our investigation into the organization is no longer purely civil in nature. We are now actively investigating the Trump Organization in a criminal capacity, along with the Manhattan DA.”
Investigating a large organization on tax and fraud issues tends to be a target-rich environment. Real estate is an area notorious for the manipulation of assets and their stated worth. Assets are often undervalued to reduce tax exposure or overvalued to secure bank loans. The greatest danger is when the same assets are involved in such reporting controversies.
Investigators have deposed a slew of Trump Organization officials including Eric Trump, the former President’s son, and Chief Financial Officer Allen Weisselberg.
There could also be upcoming privilege fights over demands for information from tax attorney Sheri Dillon.
One objection is that this is selective prosecution. We previously discussed that issue in the context of James’ investigation of the National Rifle Association. James also ran on the pledge to relentlessly pursue Trump and his aides. In this controversy, the Trump counsel is likely to argue that such reporting tactics are common to the real estate field. However, selective prosecution claims are notoriously difficult to argue. Selective prosecution is a sometimes a viable defense when it is used against a group with discriminatory purpose. See United States v. Armstrong, 517 U.S. 456, 116 S. Ct. 1480 (1996), Yick Wo v. Hopkins, 118 U.S. 356 (1886). The key is that the proof of a prosecution “directed so exclusively against a particular class of persons … with a mind so unequal and oppressive” that it violates the guarantee of equal prosecution under the law.
Likewise, malicious prosecution claims are overwhelmingly rejected. This is usually the basis for a civil lawsuit after prevailing in the criminal system. However, it requires an extremely high showing of abuse. In the criminal system, courts tend to disregard arguments based on the motivations of prosecutors. State prosecutors like James are elected and are often motivated by politics. However, courts are focused on whether the underlying allegations would constitute a crime if proven.
As a defense attorney, I would be more focused on cooperative agreements at this stage, particularly with Weisselberg. Tax and fraud cases are comparatively easier to prove than crimes like obstruction but his cooperation could make this a slam dunk. Moreover, he could convert an investigation into the Trump Organization and make it an investigation into Trump himself. The question is whether Trump was or should have been aware of illegality in the reporting of assets.

When reading such commentary, one cannot tell whether Turley is giving sustenance to the Trumpists’ hope in their ultimate vindication or, rather, is lamenting the ironic prospect of allowing Trump to leverage an acquittal to elevate him to a second term.
Typically, Turley analyzes Trump’s criminal culpability as a defense lawyer should, that is, in cold blood without any consideration of the moral implications. He does not often reveal his moral judgment of Trump’s conduct to the dismay of many of us. His chief complaint against Trump’s detractors has been- what he perceives to be- their rush to judgment in convicting him in the court of public opinion and their discounting Trump’s legal defenses in their exuberance to see him held accountable.
But as this article makes clear, Turley is warning his readers that the threat to Trump’s prosecution for tax crimes is not to be dismissed out-of-hand. It is also clear that Turley is trying to disabuse the Trumpists of any notion that he will prevail on claims of selective prosecution. As he rightly notes, the motivation of the New York prosecutors is irrelevant as long as they do not violate the Constitutional rights of a defendant, break the law, violate court rules or transgress their oaths of office.
Reading the comments posted here, the vast majority will not accept a Trump conviction, smoking gun evidence be damned. While Turley’s employment at Fox serves to blunt Leftist accusations that it does not have any liberals in its bullpen, Turley also provides a necessary reality check for its viewers. Turley is often called upon by Fox hosts to tamp down their viewers’ wild conspiracy theories. In this way, the hosts need not do so themselves thereby preserving their street cred. Turley functions to keep the Fox narrative from getting too far over its skis in defending Trump though he did not do enough to belie the Big Lie in order to avoid Fox being sued for defamation.
In the event there is a prosecution of Trump, Giuliani or Gaetz, it will be very interesting to watch how much Turley will try to bend over backwards to mollify the Trumpists notwithstanding their vehement disgust with him for his not sharing their “Deep State” conspiracy and not validating their utter contempt for the prosecutors, judges, and jurors, indeed, the criminal justice system at large.

Trump has not been deemed guilty. He hasn’t been charged. Heck there’s not even a trial yet.
Nobody is saying he’s guilty. But certainly according to all publicly available evidence his presumption of innocence is sketchy at best.
Right now they are in the process of gathering evidence so that when the time comes the government’s burden of proof will be ready to be demonstrated in court. This is why it takes so long. The have have to make sure they have the necessary evidence to prove whether the charges they plan to levy against Trump are supported.
What evidence? WHAT EVIDENCE? They’ve attempted to impeach him THREE times and come up empty. 20 Democrat FBI Agents went after him for month after month. They used illegally obtained FISA warrants. Trump was impeached and not removed from office because the charges were bogus political grandstanding. His own lawyer also was an admitted perjurer and no charges were ever brought likely due to that credibility gap. “Exoneration” is never found in a court of law. Did you forget that Michael Cohen testified that Trump exaggerated the value of properties when trying to borrow money and when submitting information to Forbes, but undervalued the same properties for tax purposes? Did you forget that he testified that Trump kept 2 sets of books–one for loan and Forbes rating purposes and a second for tax purposes? Pointing out that if these facts are proven to be true, this constitutes a crime is not claiming a “slam dunk”. Media reporting Cohen’s testimony are not speculating about the facts. Trump has been known for years to be a chronic, habitual liar, a cheater in business and in his personal life, and, with 6 business bankruptcies, a generally unsuccessful businessman. Is this piece part of the Fox News/Republican strategy to portray poor widdle Trumpy Bear as a victim of the “deep state” and “mainstream media” , to mitigate the damage of this announcement?
Trump has dealt with thousands of people, and some of them were pissed off when it was over. Of course he has enemies. Michael Cohen is one. He has never ONCE filed for bankruptcy (the four bankruptcies of the casinos were not “his” bankruptcies, although he paid every single penny he owned to creditors of those casinos and as a result those casinos came away with 85% of what he owed, an excellent outcome in Chapter 11 — look at Obama’s GM bankruptcy if you don’t believe that).
Cohen is in jail because of his crimes. Aveniatti is also in jail. Stormy lost the defamation case with Trump and owes Trump over $400,000 because it was all globalist lies. The left is freaking out because they rigged the election and they haven’t fully gotten away with it since the audits continue despite their protests.
