Schiff: House Select Committee Has Evidence That Trump “Engaged in Likely Multiple Criminal Acts”

Representative Adam Schiff (D-CA) went on CNN’s “Don Lemon Tonight” to tout the work of the House Select Committee investigating the Jan. 6th riot. In that interview, Schiff declared that the Committee has enough evidence showing former President Donald Trump “engaged in likely multiple criminal acts.” While vague on the specific crimes, Schiff emphasized that the Justice Department did not have to wait any further to launch a criminal investigation based on what has already been disclosed. While the Committee has disclosed new evidence in the form of videotapes and testimony, it has not presented new material evidence of criminal acts in my view. That could still come but the first two hearings largely focused on a “conspiracy” to challenge the election certification and allegations that Trump knew that there was no compelling evidence of widespread election fraud.

If there is evidence of criminal conduct by former president Trump or others, most of us would support the calls for prosecution. It is also possible that the Justice Department is investigating such crimes or has undisclosed evidence. The hearings, however, have not established such a foundation. That can still come but these crimes have elements that have not been addressed in hearings that have lacked any opposing views or adversarial elements.

The decision of Speaker Nancy Pelosi to abandon the long tradition of bipartisan members on such selection committee has robbed the investigation of credibility and legitimacy for many Americans.

Indeed, Schiff’s reference to evidence held by the Committee is likely to bring up memories of his highly controversial public statements that the House Intelligence Committee, which he chairs, had direct evidence of Russian collusion despite the countervailing findings of Special Counsel Robert Mueller. He never produced the evidence and later it was revealed that Justice officials and FBI agents had told his Committee that they did not find such evidence.

Now, Schiff is maintaining that:

“I certainly believe there’s enough evidence for them to open an investigation of several people, and so did Judge David Carter of California believes the former president and others were engaged in likely multiple criminal acts. So if the Justice Department concurs with Judge Carter, let alone my own view or others, they should be pursuing that. So, yes, I think there is sufficient evidence to open an investigation. It would be of you up to the Justice Department ultimately to decide does that evidence rise to proof beyond a reasonable doubt such that they’re comfortable indicting someone. But there’s certainly, in my view, enough evidence to open up investigations.”

The reference to the Carter opinion has become a mainstay on cable news. I was critical of Judge Carter’s opinion when it was released. Much of the Jan. 6th hearings seem to be structured along the same lines as the Carter decision which was, in my view, strikingly conclusory and unsupported in critical parts of the analysis.

Judge Carter simply declares that Trump knew that the election was not stolen and thus “the illegality of the plan was obvious.” Putting aside the court’s assumption of what Trump secretly concluded on the election, a sizable number of Americans still do not view Biden as legitimately elected. The court is not simply saying that they are wrong in that view but, because they are wrong, legislative challenges amounted to criminal obstruction of Congress.

In 2005, it was Democrats who alleged that a presidential election was stolen and challenged the certification in Congress of the votes in Ohio. The claim was equally frivolous but Democratic leadership praised the effort, including Speaker Nancy Pelosi who praised Sen. Barbara Boxer’s challenge and insisted that “this debate is fundamental to our democracy.”

The Democrats did not, however, demand that Vice President Dick Cheney refuse to certify, an important distinction to be sure. Jan. 6th was a desecration of our constitutional process and one of the most disgraceful days in our history.

However, the lack of factual foundation for the challenge (cited repeatedly by Judge Carter in the Trump challenge) did not make this a criminal or fraudulent effort.

Some attorneys believed (and still believe) that it was possible for Pence to refuse to certify. Holding such a legal view is not a crime and sharing that view with the White House is not a conspiracy. Indeed, Eastman and others were publicly stating essentially the same thing. That is what triggered the debate with many of us challenging their interpretation.

Yet, Carter is conclusory and dismissive on this critical point in declaring “President Trump and Dr. Eastman justified the plan with allegations of election fraud — but President Trump likely knew the justification was baseless, and therefore that the entire plan was unlawful.” Trump is still insisting that he believes the opposite. The question is why arguing that point with Pence and others amounted to a criminal act. In the end, wiser minds prevailed and the theory was not used by Pence.

There were crimes that day, of course. Some of those at the rally rioted and were charged largely with trespass and unlawful entry. A handful have been charged with seditious conspiracy. The court does not cite any evidence that Trump directly advocated violence while noting that Trump told the crowd to peacefully go to the Hill.

Consider the implications of Carter’s opinion. There was rioting when President Trump was elected while various Democratic leaders continued to claim that he was not the legitimately elected president, a view echoed by Hillary Clinton. While they did not riot in Congress, they committed other crimes.

Under Carter’s theory, the baseless claims that Trump was not legitimately elected could have been used by the Trump Administration to seize confidential legal material given to the 2005 leaders. After all, there was not a solid factual basis for these claims and they knew it. They further fueled the mob by making these claims in public.

The January 6th Committee spent much of the first two days hammering away at how many people, including Attorney General Bill Barr, told Trump that the fraud allegations were unfounded. That is important evidence to made part of the public record. However, we knew that such statements were made to President Trump, who continues to refuse to accept the overwhelming judgment of lawyers inside and outside of the White House.

That evidence amplifies the view that there was not a basis for these allegations. However, most of us reached that conclusion two years ago. The question is whether there is new evidence of criminal acts.  After the riot, District of Columbia Attorney General Karl Racine announced that he was considering arresting Trump, Donald Trump Jr., Rudy Giuliani and U.S. Rep. Mo Brooks and charging them with incitement. So what happened to that prosecution?

The failure of Racine to charge Trump was not due to any affection or loyalty to the former president. It was due to the paucity of direct evidence of a crime that would hold up in court.

The reason is that the speech itself was not a crime. Indeed, it was protected free speech. They knew that a court would throw out such an indictment and, even if they could find a willing judge, any conviction would be thrown out on appeal.

In Brandenburg v. Ohio, the Supreme Court ruled in 1969 that even calling for violence is protected under the First Amendment unless there is a threat of “imminent lawless action and is likely to incite or produce such action.”

Schiff is suggesting that, if the Committee can prove that Trump really, really, really knew the election was lost, his reckless push against election certification would somehow become a crime. That is not, in my view, correct. We need to see direct evidence that Trump coordinated, facilitated, or materially supported the violence of Jan. 6th. Yet, on the opening day, the Democrats were again playing the same clip of Trump telling the Proud Boys to stand down in the presidential debate. That type of implied encouragement would fail as evidence in a criminal case.

Schiff also told Lemon:

“Our mission is to expose the facts to the public light about a plot to overturn a presidential election, the first non-peaceful transfer of power we’ve had in our history, and prescribe remedies, legislative remedies to protect our country going forward. The principal mission of the Justice Department is to bring people to justice who break the law. We can make a referral, but of course, the Justice Department doesn’t sit around waiting for referrals from us, at least, they haven’t in the past. I hope they’re not simply waiting for us now. It’s their duty to follow the evidence and, if there are credible allegations of crime, to pursue them against anyone, including former presidents.”

The question (not asked) is what new material evidence has been raised. Much of the new evidence reinforced the same (and widely accepted) claim that Trump was ignoring the advice of his own counsel and refusing to accept the weight of the evidence on the election fraud claims.

The Democrats have also suggested that there may have been fraud in collecting millions in contributions to challenge the election. Yet, in making the fraud allegation, the Democrats did not quote the specific language used by various groups in raising money. These pitches often come with reservations or conditional language from legal counsel that allow a broad use of such funds. Indeed, Democratic members have been accused of using such funds for personal benefits. This is a common issue with members of both parties, but their counsel often cited the general language used with donors in seeking contributions. None of those provisions were quoted by the House Committee despite the fact that the Democrats were aggregating multiple charities with different pitches to donors.

If there was fraud, it should be prosecuted. However, again, the Committee needs to do more than throw out the allegation of fraud without addressing the specific elements needed for the crime, including what language was specifically used by these different groups in collecting funds.

Schiff’s pitch on CNN for prosecution is reminiscent of the nightly claims made by legal experts of clear evidence of criminal collusion or other crimes that would soon be used to frog march Trump and his family to prison. There were breathless accounts of crimes ranging from treason to bribery to obstruction to espionage. It is easy to make such claims on a cable show. However, if Schiff believes that the Committee has evidence of “likely multiple” federal crimes, he should be able to lay out the evidence in these hearings. The hearings will resume on Thursday and that case is still be made.

    In the Preferred Practice Pattern of evidence based medicine, the lowest scores of reliability go to studies that show “high risk of confounding or bias.”

    In other words, if the reader sees a low score and bias they must read the study with caution. That does not mean they will not learn something. Nor should they always believe a high score. Caveat Emptor!”

    The same holds true in many aspects of business or government functions. The slightest appearance of conflict of interest must be disclosed, especially during an investigation.

          More significantly, the House passed legislation to create an independent National Commission (analogous to the 9/11 Commission), but the Senate Republicans filibustered it. That Commission would have had 5 members chosen by the Democrats in both chambers and 5 members chosen by the Republicans in both chambers, with neither party having any veto at all over the members chosen by the other party. The Republicans could have chosen Jordan and Banks for that Commission if they’d wanted. The only reason the House Select Committee exists is because the Senate Republicans filibustered the National Commission to Investigate the January 6 Attack on the United States Capitol Complex Act. The membership of House Select Committees is always totally up to the Speaker, since the nation was founded.

          Now ask yourself why the Republican leadership wouldn’t endorse Cheney and Kinzinger, even though they’re both clear conservatives — just look at their voting history — and Cheney had even been part of the Republican leadership. It’s solely because they’re not Trumpists. Ask yourself why the Sentate Republicans filibustered the creation of the National Commission. Most Republicans have been trying to undermine this investigation all along.

    A man who toured the Capitol complex with a Republican lawmaker the day before the Jan. 6, 2021, attack later marched on the building while making threats against Speaker Nancy Pelosi and other prominent Democrats, the House committee investigating the attack said on Wednesday.

    The panel released surveillance video of a tour of parts of the Capitol complex conducted by Representative Barry Loudermilk, Republican of Georgia, a day before the violence. During the tour — which lasted several hours, despite the complex being closed to the public at the time — he is seen with the group entering three different office buildings and approaching the entrances to tunnels leading to the Capitol.

    The video that the committee released also featured footage apparently taken by a person who is marching toward the Capitol on Jan. 6, and can be heard saying, “There’s no escape, Pelosi, Schumer, Nadler. We’re coming for you.”

    A committee aide said investigators had learned that the voice was that of the man seen in the surveillance footage of Mr. Loudermilk’s tour taking a photograph of a staircase in the Capitol complex.

    Commenter Alan and The Blog Stooge furiously noted that Representative Loudermilk’s tour was investigated and cleared by Capitol Police.

    However The Select Committee’s new interest in this matter concerns one particular man identified on Loudermilk’s tour. That same man was a participant in the January 6th demonstrations.       All the videos were reviewed and the police that are around the visitors are highly attuned to suspicious activities. How many people on this blog haven’t visited at least on sensitive site? I doubt that many. Most people take a lot of pictures. These people were probably no different.

The Capital Builder was closed on Jan 5 but the House Office Buildings that were toured were open to the public on that day. Also, to the best of my knowledge the House Office Buildings were not breached on Jan 6.

        You should know better by now than to believe the NYT but you just can’t help yourself, every time they place the football out there you take your best running start at it just like Charlie Brown and just like poor old Charlie, you are always left flailing at the end.

  6. Adam Schiff said that he had proof in writing that Trump colluded with the Russians. He never produced what he said he had. Now he says there is proof that Trump committed a crime. He didn’t have any evidence then and he doesn’t have any evidence now. Once again we will find that Mr. Schiff will fail the put up or shut up test. I wonder if slimeballness is inherited.   7. There comes a time when irresponsible declarative statements by members of Congress such as one Adam Schiff need to be revealed as truthful or untruthful. In Schiff’s case, he’s made many unsupported statements he claims are truthful and supported by ‘evidence’ but has yet to provide ANY evidence at all. It would be interesting to see how Schiff would fare under enhanced interrogation techniques.

This was apparently money that came from Trump’s “Official Election Defense Fund” that was supposed to be used for legal challenges to the 2020 election. I have seen some tweets by those who donated hard earned dollars to the fund. They are not happy that their money was used for such a purpose. But, hey, they should have expected this from the No 1 grifter in the country.

    The attacks follow a leaked Supreme Court decision that revealed Roe v. Wade may be overturned this month. If overturned, abortion would no longer be protected by the federal government but would still be legal in many states.

On Fox two days ago you got another 15″ of fame by claiming Trump may be a “terrible person” but so far there is no evidence he committed any crimes. This post echoes your comments on Fox. I have a different take.

    The first two hearings have clearly shown Trump knew he had lost the 2020 election. Yet Trump persisted in the “Big Lie”. Why? Because it presented an opportunity to raise a lot of money from his gullible supporters. In the weeks after the election he sent out millions of solicitation emails to his supporters to donate to the “Official Election Defense Fund” that took in $250 million. The “Fund” does not exist. It was fake! Instead of using the money to pursue claims of “election fraud” a lot of the money was diverted to Trump’s political cronies. Almost $500 thousand went to something called the “Trump Hotel Collection”. If Trump really believed in his “election fraud” claims he could have requested state-wide recounts in the key states of Pennsylvania, Michigan and Wisconsin. But that would have required “Fund” money–up to $20 million for the recounts. Trump took a pass. He wanted the money for other purposes unrelated to fighting the election results. He wanted to line his pockets. A number of former federal prosecutors have said Trump could be prosecuted for wire and mail fraud.

    You may recall evangelical leader Jim Bakker was convicted in 1998 on 24 criminal counts–8 counts of mail fraud, 15 counts of wire fraud and 1 count of conspiracy. Bakker sold $1,000 “lifetime memberships” that entitled his followers to an annual 3-day night stay at a luxury hotel. Tens of thousands of memberships were sold but only one 500 room hotel was ever built. If Bakker why not Trump?

    Trump is continuing his fundraising schemes. He turned 76 yesterday. In emails to supporters Don Jr. asked his father’s supporters to sign Trump’s “official” B-day card–but only if well-wishers donated at least $1. Don Jr. told donors: “”HURRY–there is not much time left. I can only save your spot for 20 MINUTES”. If every loyal Trump supporter sends in just $1 that’s a sizable haul! Back in February Trump told his supporters that for a donation he would bestow the title of “Great MAGA King Status”. Who wouldn’t want to be “King” for a day? Ruth Ben-Ghiat, a historian at NY University and expert on authoritarian leaders, said that Trump has been “extremely disciplined in grifting and in trying to use the presidency to make money”. And, I might add, a lot of money!

    In your analysis you forget one important thing. The Jan. 6 Committee has no prosecutorial powers. It does not have to lay out all the “specific elements” (your words) of each crime Trump has committed. That’s the job of the DOJ if they decide to prosecute Trump. But your job on Fox is to obfuscate and you are doing it quite well!

McCarthy withdrew all 5 nominees when Jim Banks and Jim Jordan were refused as choices due to their blind loyalty to Trump and manifest unreasonableness.             I can honestly say I have never watched Hannity, Ingrahman, or Levin.

            I have watched Tucker twice.
            Once on a bit on NPR (YT vid) which was accurate, as I used (past tense) listen to NPR everyday. Then 2016 happened and they went all CNN panel-O-pundits activism. Journalist Matt Taibbi wrote an article that was similar in Tuckers observation of rampant wokeism in NPR reporting. I still will tune into NPR occasionally, but do take my anti nausea pills prior too.
            The other time, a friend forward the YT vid, I think I watched it, but as I cannot recall what it was about, must not of been that important. or made that much of an impression on me.
            So, no, I have no idea what Fox news is reporting. Or any other of the MSM news outlets.
            I make a point of not watching MSM, to include Fox, but read. And I read from alt-media like Matt Taibbi, Bari Weiss, Glenn Greenwald, Charles H. Smith, Sharyl Attkisson and others on SubStack. And of course, Professor Turley.
            I find their comments and reporting to be much more accurate and objective than anything produced on MSM. Or ‘produced’ by the Jan 6th committee. Really, I have been to more than a few 3rd world countries to recognize a stacked deck when I see one. By this one example, America looks more like a banana republic every day they continue their so-called investigation.

            Finally, as I noted elsewhere, Americans are concerned about real problems that impact them daily. Rising food prices (I am concerned), rising fuel prices (I am concerned), purchasing power eroding (I am concerned), crime (okay, not me but people in major cities, not lost on me minorities and women have been a 40% up of sale of firearms, mostly handguns).

            Those are real issues Americans are facing today.
            And it is likely to get worse, as more than a few indicators of a Recession is upon us or already here. The Atlanta Fed cut the second QT GDP to 0. That is right, ZERO. That, technically, puts us into a Recession. Thing is, this go around, it is possible that we will have both a Recession and Inflation (even Hyper-inflation?) at the same time. Who gives a crap what happened on Jan6th when the price of a gallon of gas is $10 or more. Cost of a loaf of bread, $20. Read an article the other day of the possibility of $1 an egg. That same day, I gave away 3 dozen eggs to neighbors who are on fixed incomes.
            That is real issues Americans are having.
            Not what happened on Jan6.

I notice that whever someone like Dennis or myself provides FACTUAL information, we get accused of being mentally ill because the FACTS make clear what a crook Trump has always been and always will be. According to Professor Laurence Tribe of Harvard Law School, soliciting money for a fake organization on the grounds that it would be used for litigation expenses and then applying the proceeds to other uses is wire and/or mail fraud, which are federal crimes. Trump sent out not less than 25 solicitations for money on Jan. 6th alone.

What is worrisome is the gullibility of his disciples who continue to believe his lies even when his own daughter and all the members of his inner circle, except one drunk who has since had his law license suspended, testify under oath that he KNEW he lost, but due to his massive ego, decided to lie about it and try to bully Congress and Secretaries of State to reject valid votes in a free and fair election. You have to have to be suffering from a serious level of delusion to continue believing the Big Lie in the face of the massive amount of evidence proving not only that it is false but that he KNOWS it’s false. More importantly, it is seriously concerning that so many people continue to support someone who is the antithesis of democracy. Trump could not care less about what the American people want, what is best for American, he literally has no leadership abilities, and his entire life revolves around feeding that massive ego. Also worrisome is the fact that he was an atrocious president: he allowed the pandemic to rage out of control because it made him look bad, so he chose to lie about it and down play the seriousness. causing it to be muich worse than it had to be. He started a trade war with China, resulting a shortage of computer chips. Businesses and schools had to close down for about 2 years, and kids are behind in their school work. Some businesses never reopened. He trashed the successful economy inherited from Obama and turned it into a recesstion with unemployment above 10%. His incomptence led to a record defict because he pushed tax cuts that mostly benefitted the very wealthy. Interest payments on the national debt and the shortage of consumer goods due to the shortage of computer chips, which drives up prices due to the law of supply and demand, are the main drivers of inflation, and these are directly the result of Trump’s incomptence. Then, there’s the insurrection he called for when he couldn’t litigate or bully his way past the fact that he lost the election. He still won’t shut up or go away. His ego won’t let h im.

      It is truly amazing that any substantial number of people could support this fat, lying loser.
