A Response to Lawrence O’Donnell on the Weaponization Hearing

After my testimony before the Select Subcommittee on Weaponization of the Federal Government yesterday, I found myself the subject of a segment on MSNBC’s Lawrence O’Donnell where criticized me for a bizarre exchange with freshman Democrat Dan Goldman. O’Donnell did not actually show the full exchange, but the claim is patently false and I wanted to briefly respond.

I appeared before the Committee to discuss the constitutional limits on the government supporting or directing censorship. I have written about the concerns over “censorship by surrogate.”

Rather than address that testimony, Rep. Goldman asked the following question: “have you ever worked for the federal government?” 

I answered “yes.”

Goldman then proceeded to ask me to explain how I worked for the federal government. I have actually worked in all three branches in various capacities through the years and started by noting that I started with internships. Goldman then interrupted and pressed me on the internships. Obviously, despite O’Donnell’s claim, I was not claiming a single internship as a credential to discuss the Twitter Files.

O’Donnell scoffed at the fact that I mentioned that I worked for Congress as counsel and said that this is not working in Congress. However, the question was whether and then how I worked for the federal government. When I then tried to discuss other work for the government, Goldman cut me off.

The tactic of reclaiming time to prevent such explanations is common in such attacks. I have previously objected to the tactic used against other witnesses, but it remains a favorite of members.

(Rep. Goldman also cut off my fellow witness when he asked the former FBI agent if he had ever investigated extremist groups. When he also answered “yes” and tried to explain, Goldman also cut him off).

This is much like complaining about the weather in Washington. I understood that I would be attacked for raising these questions. (On MSNBC, member of Congress who also testified yesterday were denounced as “Putin apologists” and Putin lovers.). However, I felt that some brief response was warranted.

I note that JT shared his credentials/resume on pages1 and 2 (including 5 footnotes) of his written testimony (link in yesterday’s post), He briefly mentions this blog at the beginning of footnote 2. Not sure I would have mentioned the blog and would have at least made clear that the comments on the blog do not represent or speak for me (like he clarified in footnote 1 for GW and media).

  5. You can bet your bottom dollar that as I write this post the Democrats are plotting how they can discredit the FBI whistleblowers. They lady who is an FBI whistleblower was in tears because of her loss in faith in a law enforcement agency that she had worked at for years. She praised the rank and file of the FBI but she broke down when she testified about the corruption of the leadership at the FBI. There will be no compassion for this women who has come forward because she loves her country by the Democrats on the commission. Even though she has given up a career that she loved the Svelaz and Anonymous attack dogs on this blog will show no mercy. They will only damn her because she cares and refuses to be a political tool of the left. The Senate is in play in 2024.

  9. Melvin Belli, the “King of Torts” once said that being kicked out of the American Bar Association was the equivalent of being kicked out of the Book of the Month Club. I think an analogous statement could be made about being “questioned” by Goldman, attacked by Schulz or criticized by Lawrence O’Donnell. They have proven time and again that they are silly, nasty children in grown up bodies with limited mental capacities and no integrity.

    1. I stopped being a due paying member of the American Medical Association years ago, as did two-thirds of America’s licensed physicians (due to Obamacare being supported by the AMA). Most physicians I know have contempt for them. So the religious devotion and apparent obsequiousness to the ABA is baffling to me.

      1. As a first year lawyer in 1987 I had my membership in the ABA paid for by my new law firm. Nearly every missive I received from the ABA made it clear–even in 1987–that it was a political organization, not a legal organization. I never renewed my membership, and I think overall membership has dropped every year since. Moreover, the only time I ever heard of the ABA while practicing law was in connection with law school accreditation or vetting Supreme Ct justices. I don’t consider the ABA qualified to do either job.

        1. I have a similar view of the ABA. I will probably cancel my membership this year.

      2. You need to go back further when the AMA made a deal with the government and Medicare to create the code numbers. As compensation they were provided with the rights for such information and have since sold it to the publishers of the books you use as a reference. AMA members knew nothing about this agreement for a long time.

        My understanding is that such information is supposed to have been published for free so that no royalties had to be paid, but the AMA got the royalty.

                1. George, I won’t argue with your interpretation. I think you might have much agreement with some of what you say.

                  What perplexes me is why you presented that errant Lincoln entry.

                  I’ll make one comment. There is no right to secession, but according to Jefferson, there are times when Revolution is necessary. You can call it secession, but others might call it a power grab or something else. In any event, Lincoln kept the union whole, whether you appreciate that or not.

                  1. Secession is not prohibited by the Constitution. Please cite for that. Omission does not preclude. The Founders availed themselves of it as did West Virginia; secession is globally ubiquitous. You’re making pseudo-law up of your opinion. Slavery must have been ended legally. It’s the law.

                    1. George, there is no right of secession. Logically secession means no successful federal government can exist. The Articles of Confederation proved that, so James Madison changed his views. He desired to offer such legislation to add force to the federal government’s needs.

                      You act as if you love this country, and I believe you, but this country would not exist if secession were to exist. The nation would have continued to fractionate. Many in the south were expansionistic, so aside from the ability to further fractionate, a war would have broken out between the north and the south as both entities continued to expand.

                      Though not everything Lincoln did was Kosher, he managed to save the union. We can all thank him for that.

                    1. George, it is not the outcome that determines legality. Intentions and the meaning of the law are the determining factors.

                      I admit that there are other arguments, but if one calls for secession and there is no agreement, the law stands with the united nation.

      3. Estovir– In my years practicing law in Texas, the ABA has never, to my knowledge, been a factor. I do not even know anyone who is a member. I think most of us were like Murphy300 and saw it as nothing more than a political organization. As to the AMA, I read JAMA occasionally (just specific articles). As I understand it, the medical articles are peer-reviewed. Is the content reliable? I did not observe how the AMA dealt with Covid and whether JAMA allowed dissenters to publish.

I am confused apparently about the ABA versus when an attorney is “disbarred”, when an attorney is recommended by the ABA for Federal Judicial nominations, law schools being accredited by the ABA, continuing education by the ABA for licensing standards, etc. The AMA has nothing on physicians.           You do well to read JAMA. Consider accessing others like “Cell”, “Nature”, “Immunology”, etc. Most medical journals require a subscription unless if you access them remotely via a university server r on campus. If you live near one, it would be time well spent to access multiple medical journals and read.

          Get alternate views. The more scientific perspectives one gets on a medical topic, the better. The truth will be found somewhere in the middle. A reliable manuscript has at a minimum 100 references, better is 150, 300 is bulletproof. Below I have copied the first few references from a manuscript I am writing on the molecular mechanisms of atherosclerosis. I have over 600 which is overkill but I like swimming in data. I’ll whittle it down to 300 eventually

  10. Let’s see. I worked for the car wash and I was the guy who washed the tires. I guess I must not have worked for the car wash because I had the lowest job on the totem pole. Goldberg accused a man who served in the FBI for many years of testifying because he wanted to plug a book he had written. Sleeze ball would be a compliment for this guy. The ooze was dripping off these two guys. On the one hand Goldberg praises the FBI and on the other he accuses a man who spent his career working at the FBI of having a profit motive for giving his testimony. Stay tuned there are going to be more FBI whistle blowers who will receive the same treatment. Thank you Mr. Goldman for explaining to us what Democrats really are.

Either he has some personal animus, or he is paid, or he hopes to be rewarded by a Democratic adminstration or Democratic media outlet.   14. Goldman was not the only Democrat on the Committee who exhibited reprehensible behaviour. The other two were Rep. Wasserman-Schultz and Alred. The latter was an embarrassment to the state of Texas

    1. Peter K: “Above the Law”s” Joe Patrice’s excellent analysis of Turley is spot-on. Svelaz has posted a link above. You should read it. Bottom line is, as I said yesterday, Turley has NO first-hand knowledge of any facts, and is relying on information from non-lawyers that is incomplete and probably misleading. Yet, he testifies as if it is established fact that somehow Twitter was serving as governmental surrogate and that this constitutes some violation of the Constitution by circumventing the usual First Amendment protections. Where are the facts that this is happening or has happened? Turley said it was from the “Twitter files”–are they complete and/or authentic? Most importantly, what do they actually prove? Nothing has been established, but that wasn’t the point of Turley testifying, which was red meat for the disciples who lack the skill of critical thinking and who believe whatever slop alt right media serves up Expressing opinions premised on unproven facts is speculating, which is exactly the point Rep. Wasserman-Schultz so expertly established. Turley has made a fool of himself regularly since going on the Fox payroll. Being a teacher of law is not a license to make up facts or render opinions based on unproven facts, something Turley knows, and he also knows that no court would allow such speculation under the guise of expert testimony. Turley had nothing of subtance to offer. And, Laurence O’Donnell is right–being employed as an attorney for Congress or otherwise “working for the government” when you are not an actual employee is NOT working for the federal government–it is serving as a contractor.

      1. Gigi – obviously the Twitter files are “incomplete”. There must be billions of preserved comments on Twitter. But exactly how are the tweets unearthed by Taibbi, et al, “misleading”? You next suggest that the tweets are “not authentic”. In what way? Taibbi says that he went to Twitter HQ in San Francisco and directly accessed Twitter equipment to review recorded tweets. Are you suggesting that he is lying? Are you suggesting that the tweets were forged? This is ridiculous, and Turley was fully justified in relying on Taibbi’s reporting, which has proved reliable in the past. We must rely on data from other people to form opiniions about the world.

  15. O’Donnell has a “storied” and controversial history right? Wasn’t it he that stated Deutsche Bank had documents which showed Russian oligarchs had cosigned loans for Trump? Unsourced, completely bogus, he was forced to walk it back. And yet we still hear this lie repeated in media.

    What Turley does here is, once again, expose the inanity.
