Beholding the Beholders: Hunter Biden’s Art Dealer Defies the House Over Business Records

It appears that Hunter Biden’s art dealer believes that his art should be left entirely to the eye of the beholder — and not Congress. Georges Bergès reportedly refused last week to provide the House Oversight Committee with the identities of the buyers of Biden’s high-priced art work. While counsel William Pittard insists that the list of purchasers must remain secret, it is hard to see the viable legal basis to refuse the demand of the House Oversight Committee, if made subject to a congressional subpoena.

The Biden sales have long been a subject of intense debate over whether it is another form of influence peddling or money laundering. Even President Barack Obama’s ethics head has raised objections.

Former Obama-era ethics official Walter Shaub called the art sale a “terrible idea” and noted that “it just is implausible that this art from an unknown artist would be selling at this price if it didn’t have the Biden name attached to it.”

As a new artist, Biden is fetching prices that exceed the prices of some Picassos. The quality of the work will be left to others to debate, but the Oversight Committee has a legitimate interest in looking into whether the art is being used to funnel money to the family of President Joe Biden.

In January, House Oversight Committee chair James Comer (R-KY) requested that Bergès testify before Congress. Comer has long alleged that Chinese buyers are behind the sales, though there is no public proof to support that allegation. He has stated that “arrangement with Hunter Biden raises serious ethical concerns and calls into question whether the Biden family is again selling access and influence.”

Pittard wrote that “[i]n light of these considerations, providing the documents and information requested in your letter seemingly would defeat the efforts of Mr. Biden and the White House to avoid the ‘serious ethical concerns’ that you raise.” He added that “Mr. Berges hopes that you and Mr. Biden can resolve that tension.”

The question is what happens if they cannot “resolve that tension.” The Oversight Committee is investigating a host of avenues through which foreign interests were allegedly able to funnel millions into the Biden family coffers. It is hard to see how a court would find that these business records could not be subpoenaed by a congressional committee if they decide to move forward.

Berges could refuse to testify without a subpoena, but he must appear if so served. He could then invoke his Fifth Amendment privilege against self-incrimination to refuse to testify.

What is interesting is that this is only the latest lawyer to defy Congress on a Hunter Biden inquiry. We previously discussed how Hunter Biden’s personal counsel Abbe Lowell refused a demand for evidence sought by the House.

These moves appear to be channeling the same strategy of Steve Bannon who was ultimately charged with contempt and convicted. At the time, I said that Bannon was asking for a contempt charge and Biden appears to be replicating this same ill-considered strategy.

These may be just the opening salvos to seek to negotiate with Congress, but they can backfire as they did with Bannon. The categorical refusals could expedite matters in pushing these conflicts before a court where Congress would have the advantage.

    It’s pretty clear even Fox News engaged in the type of censorship Turley is always squawking about. Fox News executives prevented trump to be interviewed. That seems awfully familiar.

  3. Jonathan: Art is truly in the eye of the beholder. You seem to thing the Oversight Committee led by GOP Chair Comer has a legitimate interest in private art sales. Why? So maybe we should step back and analyze your claims that animated Comer’s investigation.

    First, in the art world galleries typically keep the names of byers confidential–even from the artist. Why? Because other wise an artist could bypass the gallery and deal directly with the client. It’s in the interest of the gallery. Second, Georges Berges, who represents Hunter, is relatively new in the competitive art community of Manhattan. What better way for Berges to gain more recognition by representing Hunter–even though he is definitely no Picasso. Name recognition is important in the art world.

    Third, when Berges took on Hunter, and with all the controversy surrounding the Biden name, the Biden WH insisted on a confidentiality agreement so the names of the buyers would remain confidential to avoid even the appearance of a conflict of interest. Berges even agreed to reject any offer he deemed suspicious or that came in over the asking price. Since these involved private art sales counsel for Berges and Hunter have told the Oversight Committee to basically pound sand–arguing the Committee had no legitimate interest in who buys Hunter’s art.

    So where do we stand? Naturally, Comer can issue subpoenas and force Berges and Hunter to testify. If they both take the 5th where does that leave the Committee investigation? At a dead end. The Committee can refer the two to the DOJ for possible prosecution–like the Jan.6 Committee did with several reluctant witnesses where the evidence showed they had committed crimes. Does the Oversight have similar evidence, as you claim, that Berges and Hunter are funneling “millions into the Biden coffers”? So far, I have seen nada, zip evidence that would support criminal charges.

    This is why this I think this is just a fishing expedition. It’s interesting that the Republican have shown no interest in either Jared Kushner or Ivanka who both held official position in the Trump administration. Their conflicts of interest are legion. The day after the end of the Trump administration Kushner parlayed his government position to set up an investment firm with $2 billion from Saudi Arabia. That’s the kind of corruption neither you nor the Republicans in the House show any interest. That’s why I don’t treat your allegations against Hunter Biden seriously.

If you would have told me that such a thing was happening twenty years ago I would have thought you were unhinged. There was no hiding this arrangement. However, in the case of Hunter Biden the donors don’t want to be identified. Please notice that I used the word donors rather than purchasers of fine art. Yet you come to Biden’s defense with a what about this argument that doesn’t withstand scrutiny when the details are revealed. The term “work of art” connotes something that art critics, or museums, or people in the art business, believe to have intrinsic value and usually market value. Indeed, the opinion of instrinsic value by the professionals can often create a market value. Can you identify any critics who praised HB’s works? Any museums that exhibited his masterpieces? Even great artists have had trouble to establish a market for their works. Van Gogh only sold one painting in his llifetime. Yet HB is able to command high prices from the beginning of his entry into the art market. A miracle or a con?       1. edwardmahl: I know the phrase. I phrase it the way I do because “beauty” is not always the criteria for judging art. I don’t know what the critics are saying about Hunter’s work. I have seen pics of some of his work and I am not impressed. The Q is what Georges Berges thinks. As I said in my earlier comment I think Berges took on Hunter, not so much because of the quality of the art, but because of the “Biden” name. So far Berges made the right bet. He has expanded he presence in Soho and if he is forced to testify before the House Oversight Committee his face will be on the cover of every newspaper and art magazine in the country. It’s really not a “con” but it’s every fledging art gallery’s wet dream.

        As to conflicts of interest Turley wants us to believe that the Biden family is the most corrupt in American history. His premise is that “foreign interests” are funneling money through the art gallery and Hunter’s art to put money into Pres. Biden’s pocket. Do you really believe that? The kind of corruption Turley is talking about we saw during the Trump years when the Saudi’s invested in heavily in Trump’s real estate empire and Jared Kushner’s new investment business. The Saudis are continuing this by paying Trump to use his golf courses as venues for their new golf tournaments. That’s corruption with a capitol “C”. That’s something Turley doesn’t want to discuss. Biden is not a real estate billionaire so the opportunity for that kind of corruption doesn’t exist. If Biden were really corrupt there would be other ways to funnel money and gain influence with the Biden administration–like using “shadow” orgs to donate to Biden’s 2024 campaign. But the optics of the Hunter situation are such that if I were Joe Biden I would tell my son: “Sonny, paint all you want but don’t sell anything until your daddy leaves office”.

        I think Van Gogh is overrated. He has been over-commercialized. But Van Gogh appeals to the masses–perhaps because he lived in poverty, had mental health issues and cut off his ear. Two of Van Gogh’s contemporaries, Gauguin Talouse Lautrec, were better painters in my humble opinion. Jackson Pollack was also overrated. But someone paid $140 million for Pollack’s Painting No. 5–a large “drip” painting using commercial paints. Go figure.

        Which brings us back to Hunter’s paintings and what might motivate someone to buy his work. Besides the name recognition Hunter has a story. He recovered from alcohol and drug abuse. And he has mounting legal bills–the tax investigation and now having to hire expensive counsel to represent him in the dispute with the Oversight Committee. Maybe some are sympathetic to his situation and want to support him. Who knows. But I doubt it’s “foreign interests” who want influence with the Biden administration. Believe what you want. I think Turley’s is motivated by a desire to echo the GOP plan to make it difficult for Biden to run in 2024 because they think that he will be dogged by claims of “corruption”. So far that is not a top priority for voters.

      Like the Fox personalities – I wanted hard evidence of the claim that DVS rigged the election.

      Powel never provided that evidence.
      At the same time – those 60 court decisions YOU Rant about – precluded any serious election fraud investigation most anywhere.

      What we do know is that many many things happened that violated the law. That the law and the election rules were not followed,
      That there was massive ballot harvesting which was illegal in every state except California.
      That every major democratic city is missing chain of custody records for hundreds of thousands of ballots.

      That every time it has been possible to check signatures – that more than 6% fail to meet even the most minimal standards.

      What we do know is that The DNC, the Biden Campaign, the MSM and the alphabet government agencies colluded with Social Media to Censor negative stories about the Biden’s and to silence critics.

      What we do know is that There was massive collusion to rig the election.

      What we do know is that those involved in the conspiracy had no problems acting immorally, unconstitutionally and even illegally to rig the election.

      Did they also rig voting machines – Probably not – but if so only because the odds of getting caught are too high.

      Trump did significantly better than expected and predicted pretty much everywhere in the US EXCEPT for 6 large cities in critical Swing states.
      These are places that Biden did not visit ONCE during the campaign. In Every one of these Biden did better than he did elsewhere in the country – most of the country he UNDER Performed Hillary in 2016 and most of the country Trump over performed 2016.
      Except these 6 key cities in 6 swing states everyone of which Biden did much better than Clinton, and much better than he did nationwide.
      These are also the places were 95% of the ZuckerBucks went.
      These are the places where Democratic NGO’s essentialy took over the local elections.

      None of the above is PROOF of Fraud. But almost any element above is a valid reason for further inquiry – which except in AZ Did not happen.

      In Newark the courts looked thoroughly at and find massive fraud in the 2020 Democratic Primary.
      More recently A democrats is under investigation for significant fraud in 2021.
      There are myriads of examples of Courts conducted REAL Inquiries into elections in the US and elsewhere with Far weaker claims than in the 2020 Presidential Election.

      Yet those 60 Courts that you claim all sided against Trump – not a signle one allowed actual inquiry into a highly unusual and definitely suspicious election.

      Ultimatelyit is Government that must prove to Voters that elections are trustworthy. Not Candidates, Not courts.

      Neither Trump nor Biden have a RIGHT to be president. But Voters have the RIGHT to an election that was conducted according to the law, and that THEY based on THEIR criteria TRUST.

      2020 was not a trustworthy election.

      Trust is incredibly important – it is the foundation for the social contract, the legitamacy of government.

      Distrust Fox if you want – that does not lead to anarchy.

The season finale is a massive shootout with a bone circling overhead.

  12. Well, sometimes, States Attorney Generals can act where congress and the DOJ fail to tread. The Bidens may slip up and do something seemingly outrageous in a Red State and then a state Attorney General can take action. The actions of the AG in New York against Trump and the local prosecutor in Fulton County, Ga also against Trump rate prime examples.

  14. Why are the Republicans helping the Bidens and Democrats run out the clock? Every witness should receive a document subpoena before the hearing. Why waste a month or more unless you have no real intention of doing what you said you would do.

        Democrats chose their own committee members, they are given equal time.
        Normal rules are being followed.

        As to Subpeona’s – there is no subpeona the Republicans in the house have issued that is nto far more justifiable than those of the prior democratic congress.

        Personally,. I see the constitutional power of Congress to “investigate” – outside of its legitimate role of govenrment oversight as severly limited.
        I would not support Congressional subpeona’s of private parties for private actions AT ALL.
        I would not support prosecution for defying any subpeona that did not have an actual final order of a court requiring compliance.
        Nor would I support Law Enforement prosecuting failure to comply with a subpeona until the Subpeona’s party got a court order requiring compliance.

        But that is NOT the current state of the law.

        The only thing that does not favor house republicans regarding the subpeona’s they have issued is that the same partisan DOJ that prosecuted Congressional subpeona’s issued by democrats will not prosecute those issues by republicans.

        Otherwise the only differences favor republicans who have been far more reasonable than democrats.

        Wow, “secretly” Fox hosts and management did NOT buy Sidney Powells claim that DVS had altered the ballot counts to favor Trump, at the same time as Fox hosts like Carlson were critical of Powell Publicly on their shows and demanding evidence.

        Or that one Allegation such as the claim that DVS equipment altered ballot counts is a strae man for ALL claims of election fraud.

        By just after midnight election day in 2020 there was ample reason for people to be very suspicious of the election.

        The ONLY acceptable, appropriate and trustworthy response by those running the election would have been to let the sunlight in.

        That did not occur, and still does not, and that has caused a reasonable lack of public trust in elections.

        If you want elections to be trusted you need to grasp that ease of voting MUST ALWAYS take a back seat to conducting trustworthy elections.
