Squatter Nation: How Cities Are Allowing an Epidemic of Home Invasion to Rage Across the Country

Below is my column in USA Today on the growing “squatting” trend across the country. The crime has been raging in Europe for many years and it is now becoming something of an epidemic in the United States. It is not legally difficult to combat, but it has proven politically challenging in many cities. The result for homeowners has been a nightmare with little deterrence or assistance from government officials.

Here is the column:

In Texas, a homeowner says she was locked out of her house by a squatter who claimed to have a lease after moving to the state with her family (the woman previously had been evicted from three other homes).

In Maryland, a woman returned from vacation to find two squatters in her bed. They were not only living in her house but also had sold about $50,000 of her furniture.

It is a pattern being played out in many cities in the United States. It also is common in Europe, where squatting has become a political movement with support from the left.

Some squatters enter legally and then just stay. In Long Island, New York, Guramrit Hanspal, 52, has not paid his mortgage for 25 years. The mortgage was foreclosed, but the company that now owns the home has struggled for decades to evict Hanspal, who continues to change lawyers and file lawsuits to delay proceedings.

“I think (squatting is) a fairly big problem, and I think it’s pretty hard to avoid,” Jim Burling, vice president of legal affairs for the Pacific Legal Foundation, told Fox News.

In the case of Rabbi Meyer Leifer, 90, he simply gave Roselee Moskowitz, 67, a place to live when she found herself temporarily homeless during the pandemic. She then just stayed and refused to leave. Mosokowitz reportedly occupies the rabbi’s living room and sits on his couch watching his television.

Prosecutors and politicians play a critical role in these scams. Local authorities have done little to assist homeowners for a variety of reasons – from political calculations to negligence. Instead, they force landowners to go into overtaxed housing courts with notoriously slow dockets. It often takes months or years to get an eviction order.

The resulting lack of deterrence is evident in the brazen attitude of these criminals. A retiree friend of mine was away from her home in Sarasota, Florida, when a squatter moved in and refused to leave. The woman falsely claimed that she had a lease and trashed the home. Eventually, she was arrested but promptly released. She then returned and stole my friend’s car. The police said there was likely little that would happen to the squatter.

The people involved are committing crimes, from breaking and entering to fraud to forgery. Yet, they are rarely prosecuted.

Squatting is not a particularly difficult problem to solve. It simply requires police and prosecutors to enforce existing laws.

In a recent case in Houston, a teacher, Amberlyn Prather, reportedly squatted in a luxury home for months with her family. The property owner said she repeatedly changed the locks only to have the squatters gain entry by climbing on the roof and entering through upper windows. In this case, authorities have a person accused of forging a lease. That should not be difficult to prosecute.

Cities can speed process of reviewing property owners’ rights

Cities can create new legal avenues to address this crime. The key is to force action at the outset. Cities can set up rapid response teams with prosecutors making immediate judgments on lawful possession. They also can fast-track the cases to bring parties into court rapidly.

If a car owner called police to report that someone was sitting in their vehicle without permission, police would make a decision on the spot about ownership based on the registration and other documents. They would not allow the person to drive off and tell the owner to work it out in court.

And it is far less important to return the possession of a car than a home.

Yet, authorities in New York did little to help Marjorie Martin as she sought for three years to evict squatters. It didn’t matter that Christine Rock allegedly filed fraudulent paperwork with the forged signatures of Martin’s mom, father and sister – all of whom had been dead for more than a decade. Rock was accused of putting the utilities in her name and then ignoring the bills.

When Rock was finally arrested, the city hit Martin with a more than $25,000 water bill that was left unpaid by the squatter.

She is not alone. Owners are told that they must continue to pay taxes and other costs for their property, and squatters delay any final orders through failures to appear, changes of counsel and other practices. In the case of Lia Hatzakis, 29, a squatter offered to make up for not paying for the utilities he used by dating her while he lived in her home. She declined.

There is little evidence of legislative action in many cities. However, Democrats in Congress have moved to pass a federal housing law − to bar landlords from learning whether potential tenants have criminal records, which would include past squatter offenses.

The common nuisance of squatting reflects a breakdown in basic deterrence of our laws. Property offenses have been steadily downgraded as priorities in many cities, while prosecutions are viewed as politically risky for officials who do not want to be viewed as targeting people who are homeless.

Before these cases become a movement like the one in Europe, local and state authorities will have to act.  Squatters defend their actions as proper when done according to their own standards. When a woman in England called her squatter to object to his conduct, “Michael” was insulted and left her a message stating, “Just so you know, I’m not doing anything wrong. I’ve done it the right way.”

    Trump averaged 2% growth over 4 years – which is pathetic, and Still the best growth of any president in the 21st century.
    Biden is averaging 1.4% – that is lower than Obama’s pathetic 1.68%, and Biden is heading into a recession so it will get worse.
    In Jan 2021, When Biden took office Growth was 6%. He could have done nothing and been viewed as a superstar.

    The average american gained 3500/year in spendable income under Trump.
    They have lost 4500/year under 2 years of Biden.

    Inflation is Dropping – Because the Fed is doing what it must to purge inflation – and that is causing a recession.
    That is how this works.

    When government spends too much, borrow too much prints too much money triggering significant inflation.
    The only way out is to put the screws to money supply – which will cause a recession.

    The FED can lower interest rates any time they want – and Inflation will explode.

    Follow the actual law and constitution, 38 States constitutionally bar mailin voting – requiring secret ballots. If you do not like that – change the constitution.

    US energy production has risen from its collapse in 2020 under Biden – but far more slowly than under Trump.
    Further there is absolutley no reason the US could not have reached 2019 production in 2021 – Except the politics of the Biden administration.

  7. It’s not just cities that are a problem: here’s something that happened to a family member who lives in a very red state. He inherited a house from his 94-year-old mother who had died. Out of the blue one day, a large business sized enveloped arrived, and he opened it, not realizing that it was addressed to someone else–the address was correct. The envelope contained a loan application for a mortgage on his mother’s home in the name of someone he didn’t know or had ever heard of. His parents had lived there since 1957, and the property had never been rented. The application, which had been filled out over the phone, said that the man owned the house outright, that this had been his residence for the past 2 years, and he was trying to get a mortgage against the equity in the amount of $93,000.00. There were tabs pointing to where the “applicant” was supposed to sign. My friend called the loan company and asked for the name of the loan officer who signed the cover letter. This guy couldn’t care less–his comment was: “well, the house would never have passed inspection if the applicant wasn’t living there, so no harm, no foul.” But, what if he had broken into the house somehow and gotten it inspected? He checked and found out that the applicant had a criminal history for fraud. So, he contacted the Attorney General’s Office in this ruby-red state, and they didn’t even understand the problem–they said “well, it’s not identity theft, so what can we do, plus the guy hadn’t signed the paper yet, so there’s no fraud.” But, he WOULD HAVE signed the application but for my friend mistakenly opening the envelope. I would think that this loan company, which advertises nationally, might have, at minimum, checked with the local assessor’s office to determine who the property belonged to before preparing a loan appliation.

      That’s title fraud. Not squatters. Most of the nation transfers real property using quit claim deeds. and getting a “title” to the property. As far as know, only Oklahoma and Iowa are the only two states that use the process of abstracting and deeds. to transfer ownership. No one can scam the titles to my properties because I have the only original in my lock box.

      The issue is how does each state deal with squatters, the homeless, and theft of the use of property, and how can property owners’ rights be improved at both the federal and state level in all 50 states.

      In general, in blue states, the have nots are treated as morally superior to the haves. As an example, homeless camps are encouraged, and business owners and property owners who complain about homeless camps and human feces at their doorstep are ignored. There are homeless rights, such as right to camp, right to urinate in public, etc. In red states, the homeless are typically required to go to a shelter, and are not allowed to illegally camp on public or private property.

      There is a lot of room to improve the law regarding squatters in all 50 states. In FL, for example, there is no specific law directed at squatters. Homeowners have to file an unlawful detainer and serve the squatter with an eviction notice. However, in FL, squatters are not considered tenants, and they are not protected by landlord-tenant laws in that state. In California, there are squatters rights. A squatter can make legal claim to the property through adverse possession claims, if they occupy for 5 years. If a landowner has a homeless person camping on his property, DA Gascon will not enforce trespassing laws, the police are barred from removing the camper, and that camper stays there for 5 years, he can then file claim to that land through adverse possession. Squatters rights in CA are considered somewhat notorious.

      1. Also, in FL, you can kick someone out of your house, through Ejectment. If, for example, you date someone, break up, and that person refuses to leave, you can have that person removed through Ejectment. In CA, to my understanding, you have to go through an eviction process, even if they are not on the lease, and not paying rent.

        It is my opinion that law makers should look at the pros and cons of how each state handles squatters, glean what works, get rid of what doesn’t, and improve the entire process. For that to happen, however, property owner’s rights have to be respected. There cannot be the underlying paradigm that the wishes and needs of someone who does not own property should be weighed more than that of the property owner.

I know of a guy who applied to become an English language teacher at a Japanese university, claiming to have a degree in foreign language education from Cambridge University. He was quickly hired, but his fellow English teachers quickly discovered that he had no such degree, let alone from the esteemed UK institution. They reported this to the Japanese University authorities, who turned a blind eye to the fraud so as not to lose face….

              The theory – as sold to Republicans was that mailin voting would get more senior voters who find getting out harder.
              In practice this gain has been dwarfed by the young couch potato vote.

              Historically Younger voters have been more willing to work for campaigns, knock on doors run rallies, in modern times post on social media.
              But they have NOT been willing to come to the polls and actually vote.

              In 2020 Mailin voting got a massive number of younger voters to actually vote.
              In 2022 This number – though still very high dropped significantly.
              Voter enthusiasm in the young demographic is even lower today.

              Generally people are more inclined to vote as they get older – until they are less able to.
              And they are more likely to vote conservative as they grow older.

Me and my wife pulled over $30,000.00 out of our retirement savings to do some work on our house. 2 months later we checked our retirement accounts, there was more money in it then than before we took it out.       In May 2023, the inactive labor force amounted to about 99.92 million people in the United States. Labor force measures are based on the civilian non-institutional population 16 years old and over. Excluded are persons under 16 years of age, all persons confined to institutions such as nursing homes and prisons, and persons on active duty in the Armed Forces. The labor force is made up of the employed and the unemployed. The remainder — those who have no job and are not looking for one — are counted as “not in the labor force.” Many who are not in the labor force are going to school or are retired. Family responsibilities keep others out of the labor force.

    The Secret Service is now saying that the cocaine found in the WH was discovered in an area that is used by high level staff and is in the west wing. This being the case it means that someone in a high security position is out there purchasing an illegal drug from some dealer with who knows what connections. Of course this high level staffer of Joe Biden is then ripe for blackmail by whoever has knowledge of the illegal use of drugs.

    Just another day at the Biden WH and with our totally incurious press. If a high level Republican staffer was found with cocaine this would now be an episode of the most intense reportorial digging since Watergate.

      I think cocaine is common in the upper reaches, it gives the needed energy boost and is said to give confidence and EGO since the days of Freud, who prescribed it for that effect.

    When the government fails to fo its job, you have to. We all have a Second Amendment, and most of us have a firearm and a spare knife laying around that doesn’t match our kitchen set. The operative and only words to be spoken are “I was in fear for my and my family’s safety.”
