DOJ to Devon Archer: Go Ahead and Testify . . . and Then We Can Jail You

The Department of Justice caused a outcry this weekend when it filed a notice to a federal court on a Saturday that it should move ahead and order the jailing of Hunter Biden’s former business associate and friend, Devon Archer. That came less than 48 hours before Archer was scheduled to give potentially explosive testimony on the Biden corruption scandal. The Justice Department decided that the matter was so urgent that it required a weekend filing before Archer testifies. The optics could not be worse and many took the letter as an effort to intimidate Archer. Then the next day the Justice Department sent a second letter to the court saying it can wait to arrest him after he testifies. After the debacle in Delaware where the Justice Department seemed entirely confused on its own filings, the letters only reaffirmed the image of a department adrift in this expanding scandal.

On Saturday, the Justice Department told Judge Ronnie Abrams of the Southern District of New York that the court should move toward ordering the incarceration of Archer. The timing was viewed by many as intimidating and was reminiscent of the IRS visiting the home of journalist Matt Taibbi on the day that he was testifying to disclose the government’s massive censorship program. (Later, the ranking Democratic member Rep. Stacey Plaskett (D-VI) suggested that Taibbi could be arrested for perjury).

The Justice Department then sent a second letter to the court saying that it can wait: ‘To be clear, the Government does not request (and has never requested) that the defendant [Archer] surrender before his Congressional testimony.” Archer can testify . . . and then we can incarcerate him.

The letters seem to be speaking to Congress, the public, and, of course, Archer rather than the court itself. The Justice Department continues to stumble through this scandal. While it allowed major felonies to expire in the Hunter Biden investigation, it seems on a hair trigger for those who may accuse him or the Department of wrongdoing.

It often seems like the Justice Department under Merrick Garland is a series of step-on-the-rake moments.

  1. If evidence of VP Biden breaking laws is discovered, are there statutes of limitation that would kick in and make it too late to indict or use it in an impeachment trial?

      Good question…

      Impeachment? As we have seen for Trump, its a political process so there’s no statute of limitations. Considering that there’s no period of mention on high crimes and misdemeanors which include bribery.

      Then there’s the issue of the coverup. An ongoing conspiracy to hide this… which includes slow walking the investigation into Hunter’s laptop. There’s more to it but the point is that the clock stops when you have a conspiracy. Which we’re now seeing in the DoJ and FBI actions against Trump and other things.

      So yes he can be impeached. He could also face criminal charges if the stories on the off-shore accounts turn out to be true.

        The cases against Trump will blow up in their faces.
        That’s not to say Trump is completely innocent and as pure as the driven snow… but that Trump is Trump and the charges against him will fall apart under scrutiny.
        Those charges exist to get him to drop out of the 2024 race.

        If the off-shore account story is real… The whole clan of Bidens can go to jail.
        And Joe could be impeached. Of course he could pardon the lot of them to avoid jail time if he does it before he’s impeached. (If they go that route.) They may decide to get the news out and let him still run on the Dem ticket. He could still be charged when out of office.

        So lets see what happens.

And while in office, his kids used their position in government to garner $2B from the studies, and who knows how much more is unreported sitting in offshore banks? Trump encouraged over a thousand people to storm the capitol in an attempt to keep him in power.

        Just stop for a moment and look at the 60+ court cases trump lost. Look at the number of people that worked closely with trump and now say he should be no where near the White House. Those very close to him got a first hand look at how he works and said never again. Look how many of his lawyers are in trouble or paying huge fines for their legal shenanigans.

    If you study American history, when a “subversive” movement emerges, the U.S. Department of Justice has secretly blacklisted the citizen-supporters of subversive groups – citizens supporting the American system through a January 6 coup attempt.

    These are usually lifetime blacklists. After 9/11 about 1 million persons were blacklisted and most weren’t constitutionally-subversive like January 6 supporters.

      2. There is evidence that Trump himself started planning the coup attempt in November of 2020 and Trump himself incited the coup attempt. In meetings, Trump even considered using the military to seize voting machines.

        Trump was then overruled by more than 60 judges, including Trump friendly judges, that he lost the election.

        A jury will probably conclude that if Trump himself hadn’t laid the groundwork for the coup attempt (months before), January 6 likely would have been legal and peaceful.

        As for legal constitutional protest, the First Amendment actually includes the word “peaceably” in the actual text, describing legal protected activity.

  7. Many today have written that Archer is not intimidated by the latest stunt by the Federal Prosecutor. Sure, he isn’t, why tell would he be? One is where could he be incarcerated, Florence Max in Colorado, or Yazoo City in Mississippi both Penitentiaries with high security classifications, or would he be sent to a Correctional Institution like Lompoc in California, or Yankton a Prison Camp in South Dakota? Or while being transferred, to an administrative facility like the Federal Detention Center in Philadelphia, they can’t send him to the Metropolitan Corrections Facility in New York as its temporarily closed (Epstein’s final destination). Secondly, he could have been promised a pardon by President Biden if he zip’s his mouth or wishing for one if he doesn’t divulge damning information, but none the less he’s been made aware that his actions may have consequences’. The way I see it, they’ve placed the carrot on the stick for Archer.
    As for pardon’s he has risks and so does President Biden, the president would most likely not risk giving a pardon prior to the election so at a minimum 15 +/- months in prison which goes back to the first statement where is he to be incarcerated.

    The swords edges are sharp, Archers damned which ever course he takes.

    1. The testimony is evidence and is backed up by contermporanious communications and documents. You are attempting the same smear used against IRS whistleblowers. It is not ‘just; one persons memories. It is narrative supporting corroborating evidence.
      DoJ uses sworn testimony from paid informants that have criminal records, and charges pending.

If there were ever events to cause a Senate inquiry into special interests at DOJ, this weekends attempt to put Devon Archer under wraps for his willingness to cooperate in the Biden corruption investigation is it. Time to root out the co-conspirators that would continue to cover for the perpetrators. No doubt, this is coming from the top, or any decent manager or supervisor would have come down on the parties involved. Does Special Council ring any bells.
