Rep. Ilhan Omar, D-Minn., has long been a leading voice among Democrats calling for censorship and speech controls in the name of combatting disinformation. She is now accused of precisely the same conduct after posting a picture purportedly showing children killed by Israeli forces. In reality, it was a picture of victims of a 2013 sarin gas attack in Ghouta, Syria. The incident should, but is unlikely to, prompt Omar and fellow Democrats to reconsider their push for censorship and other anti-free speech measures. Such false imagery was quickly and effectively addressed in this incident without the need for bans and speech regulation.
Omar has denounced social media companies for their failure to take “information down and discontinuing the accounts of people who practice disinformation.”
The “Squad” member retweeted a photo of dead children with the caption “CHILD GENOCIDE IN PALESTINE.” The photo showed seven dead children wrapping in white clothes with the caption “614 Palestinian children murdered by the Israeli [IDF] forces.”
The false image was quickly identified and challenged, including in a community note from X, formerly known as Twitter. There are obviously children who have been and will be killed in Gaza. However, many will knowingly spread false images or claims as part of that debate. Whoever posted this picture had to have known that it was not showing children from Gaza.
Omar herself has been the victim of false photos, including photos widely reposted by political opponents like former president Donald Trump.
Conversely, she has had to apologize for “anti-Semitic” tweets.
The incident shows that free speech allows for its own disinfectant. Bad speech is countered by better speech as the public judges what is true and what is false.
Ironically, fellow ‘Squad’ member Alexandria Ocasio-Cortez, D-N.Y., triggered her own controversy after warning others about the “incredibly high” amount of misinformation on social media about the war and urged her followers not to be chumps in accepting manufactured or false images:
“If you see a claim, photo, or video that triggers a strong emotional reaction, take a moment to pause and check for veracity/confirmation from multiple sources.”
Meghan McCain then delivered a haymaker by posting AOC’s own picture of herself crying outside a chain fence during a protest over “kids in cages” during the Trump Administration. It was later denounced as a staged photo outside of a parking lot.
Such controversies will continue. The point is only that those advocates of censorship today could well be the targets tomorrow. Rather than silence those who are accused of such false images or claims, the solution is to protect the right of everyone to speak for themselves and to challenge others in these important national debates.
We also recently discussed how figures like Leon Panetta and even the Washington Post continue to voice or embrace debunked claims.
I would oppose efforts to censor Reps. Omar and Ocasio-Cortez despite my disagreement with their views. It is possible that we can, as Americans, unite behind our common article of faith in free speech and oppose the calls for censorship that have been mindlessly echoed by many, including Rep. Omar.

Respectfully, Professor, I disagree that free speech should protect the pictures posted by AOC. Given the level of antisemitism, especially (ironically) in New York, the fact that thousands of people took to the streets to condemn Israel and support terrorism (whether intentionally or through sheer ignorance), and the fact that any reasonable person knows that the pictures would cause an emotional and possibly extreme reaction in those who saw them, there seems no difference between this and yelling “fire” in a crowded theater. If anything, AOC’s despicable act probably is even more dangerous. For far too long we have stood back while progressives support those who pillage and burn our cities; for far too long we have allowed Soros and his minions to determine who becomes our district attorneys and judges; and, for far too long we have tolerated liberal politicians who can do whatever they wish without fear of reprisal either from Republicans or their own voters. Estovir– I do not consider myself a Constitutional scholar but as I understand things, the First Amendment is not revoked, it simply does not come into play, i.e. there is no First Amendment right to falsely yell fire in a crowded theater because it creates an imminent threat of physical harm to the patrons. The First Amendment also does not come into play with defamatory statements if they are made negligently or for public figures, with malice. You are correct, however, that certain Constitutional rights can be “revoked” in the sense that convicted felons can lose their right to vote or own guns. Focusing on the Second Amendment as an example, as you know it is composed of two parts: the “prefatory” “well regulated militia” language and the “operative” clause “shall not be infringed” by Congress. For years the prefatory clause was used to interpret the operative clause meaning that unless the restriction limited the ability to maintain a militia, it was allowed. Then in District of Columbia v. Heller, the Supreme Court reversed the emphasis and held that the operative clause controlled so that a blanket restriction on the right to own weapons was prohibited. Even so, the Court recognized that limitations on certain people owning weapons was allowed, such as felons, mentally ill, etc. I suspect all of this is as clear as mud.

SCOTUS showed in Heller that rights can not be selectively edited, nuanced or interpreted “in context”. The 2A either holds true in its entirety or it does not. SCOTUS saw it as an all or nothing principle.
Real life application:
You have the right to vote unless if you are a felon, you have the right to possess a gun unless if you are mentally ill or a felon, or on the property of a state university, airport, Federal bldg, etc. So real life applications provide an asterisk to these constitutional rights. Moreover, we all agree food, water, clothing and shelter are “rights”. Yet, these are at times deprived as punishment say in prison or in tools for negotiations when terrorist groups hold hostages. When homeowners or residents fail to pay their mortgage or rent, they are evicted. There is ample precedent that shows behaviors can result in people being deprived of their rights, and we enforce these conditions

Well, this is probably unacceptable to all who aren’t brainwashed. On the one hand we demand tears and moral support and denouncements, but on the other hand we say yeah obviously they were killed and more are coming.
So there isn’t a chance I can call that acceptable. I suspect it infuriates those in opposition.
I noticed the same thing in the war in Ukraine – a lot of opposition is decrying the slaughter to the last Ukranian used and bragged about by Biden administration and foreign leaders in NATO, but even those in opposition never mention the dead russians. Yeah I ripped on em hard about – with their little virtue signaling I agree with, but at some point, the point of humanity and modern information at everyone’s fingertips, someone should agree the deaths and the murders on both sides are wrong.
