Are Rep. Tlaib, the New York Times, and Other Media Guilty of Disinformation on the Hospital “Strike”?

The NY Times Should Answer for Some of These Photo Choices
The New York Times and Rep. Rashida Tlaib (D., Mich.) have long denounced disinformation on social media and called for censorship of those spreading false information. They and various other media outlets now find themselves accused of immediately spreading false images and accounts of the recent explosion at the hospital in Gaza. The NYT picture above is not even the hospital and the Biden Administration has concluded it was not only a Palestinian missile in the incident but it struck the parking lot rather than the hospital itself. While there is still debate over the origin of the missile that struck the hospital, United States intelligence and the Biden Administration have concluded that it was not an Israeli missile but a Palestinian missile. I am open to evidence on either side and investigations continue., However, it was not (and has not been) established that this was an Israeli missile.

Moreover, the missile did not destroy the hospital but appears to have landed in the parking lot. Finally, the actual death toll remains in dispute.

While the caption on the photo above acknowledged that it is not the picture of the hospital, it created a powerful image with the headline. The more important question is why the New York Times would simply repeat the accusation from Hamas on the origin of the missile when there are thousands of missiles going back and forth between Israel and Gaza.

The New York Times not only immediately declared Israel as the source but said that hundreds were killed. The BBC completed an investigation with the assistance of experts, who said that the evidence was not consistent with an Israeli missile strike and further suggested that the death toll was lower than widely reported.

Likewise, Foreign Policy magazine is still showing a misleading picture of a huge crater that turns out to be from an entirely different location. Actual drone footage does not show the type of large crater that would have been left by an Israeli missile in the parking lot.  The Wall Street Journal showed this crater in the parking lot:While the New York Times can claim that it later covered the countervailing findings of Israeli and American intelligence, that is not the case with Rep. Rashida Tlaib (D., Mich.). Last night, after the Biden Administration released its own findings that the missile came from Palestine, Tlaib led a mass protest while denouncing Israel for the strike:
“People think it’s okay to bomb a hospital where children, you know, what’s so hard sometimes is watching those videos and and the people telling the kids, ‘Don’t cry.’ And like, let them cry!”And they’re shaking [INAUDIBLE] they keep telling them not to cry in Arabic. And they can cry, I can cry, we all can cry. If we’re not crying, something is wrong! And so I’m telling you right now, President Biden, not all of America’s with you on this one. And you need to wake up and understand that! We are literally watching people commit your genocide and killing a vast majority just like this. And we still stand by and say nothing. We will remember this. But all of you, you need to know, I swear to God [INAUDIBLE] You are on the right side of history! You are! You’re doing everything possible to save lives! What is wrong with that? Stop it!”

Tlaib wrote on social media that “Israel just bombed the Baptist Hospital killing 500 Palestinians (doctors, children, patients) just like that” on X.

She later refused to apologize for repeating the claim viewed as false by the Biden Administration and others. What is striking about Tlaib’s protest speech is that she is denouncing the loss of First Amendment rights in this controversy in making these claims.I have repeatedly said that I oppose censorship of those who are making these claims. That will come as no surprise to regulars on this blog. However, Tlaib has not been a voice for free speech. While objecting to the censorship of Palestinians, Tlaib has supported the push of Democrats to get greater levels of “content moderation” on social media. Tlaib cut off Facebook CEO Mark Zuckerberg when he tried to defend policies to minimize censorship as protecting “hate speech.”Likewise, the New York Times has been unrelenting in attacks on Elon Musk and Twitter for restoring free speech protections on X and supporting broader censorship of disinformation, misinformation, and malinformation.

Of course, NY Times, Tlaib, and others can count on the free speech community will continue to support their own ability to speak even when they are accused of spreading disinformation.

This controversy shows, again, how selective the media has been in its calls for bans and censorship. That includes various journalistic and scientific figures banned for expressing skepticism over pandemic claims from the origins of the virus to the efficacy of certain treatments. For example, when many people raised the possibility that the virus may have been released from the nearby Chinese virology lab (rather than the “wet market” theory), they were denounced as virtually a lunatic fringe. Even objections to the bias of authors of a report dismissing the lab theory were ridiculed. The New York Times reporter covering the area called it “racist” and implausible.  Now, even W.H.O. admits that the lab theory is possible and Biden officials are admitting that it is indeed plausible.

Fortunately for the reporters of the New York Times and Democratic members like Tlaib, free speech values should protect their right to continue to post these views despite their truth or veracity. One can only hope that they might want to consider showing others the same consideration.

  1. Alexandria Ocasio-Cortez, Ilhan Omar, Ayanna Pressley, and Rashida Tlaib are direct and mortal enemies of the American thesis of freedom and self-reliance, the Constitution, the Bill of Rights, actual Americans, and America.

  3. Interesting

Son of Hamas leader, Mosab Hassan Yousef converts to Christianity.

    1. His comments have more sense and intelligence than anything else I’ve heard yet on this situation, including from Israel or the US. He actually proposes specific solutions to the problem that make a lot of sense. Israel should study what he says carefully.

  4. Israel views any ending to itself as a modern Jewish state to be the equivalent of Armageddon, an unacceptable end-state. Consequently, Jerusalem is now existentially regarding Hamas’s multi-domain sea, land and air assault on Israel and its civilians as a march to Armageddon that must be stopped at all costs.

    1. Wouldn’t all nations consider their own national destruction to be an “unacceptable end-state”?

      1. No, those israel have robbed from are not allowed to, you idiot. The evidence is everywhere. Get a clue dummy.

        1. Imagine if Italy or Ireland were going to be wiped off the map. Jew Haters are feeling pretty bold these days.

  5. Dear Prof Turley,

If you want peace, as the saying goes, pray for justice. Unfortunately, I don’t think those prayers will be answered by Joe Biden, U.S. intelligence services or on the pages of the New York Times.

The conflict in the Holy Lands is not between nation-states on a battlefield. It’s an internal security problem within the state of Israel, for the most part. .. at least for the time being.

‘Terrorism’ – the use of force/violence to achieve political aims – I believe should be restricted to nation-states. Otherwise, acts of violence would best be deemed ‘criminal acts’ and adjudicated in courts of law (see the Mafia and various ‘criminal’ organizations’.).. . as opposed to declarations of ‘war’.

‘Hamas’, I suspect, does not speak for the vast majority of Palestinians.

[the U.S./NATO ‘coalition of the willing’ invasion and occupation of the whole of Afghanistan to capture/kill Osama bin Laden and 15 other Saudi nationals for the ‘alleged criminal acts’ on 9/11 is a clear and enduring case of ‘terrorism’ against the sovereign nation of Afghanistan. The people of Afghanistan had nothing to do with 9/11, notwithstanding I’ve long considered the ‘Taliban’s’ rule there a revolting interpretation of Islamic principles and law. Nor did Iraq .. . or any other nation-state left decimated by the ‘global war on terror’.]

“The vast majority (94%) of Israelis say the current government bears some responsibility for allowing the Hamas attack to occur, and more than three-quarters believe the government bears most of the responsibility, according to a Dialog Center poll reported on by the Jerusalem Post on Thursday.

I’ve come to the conclusion Israel should endeavor, in all ways, to establish itself as the center-international state for religious unity, brotherly love and the application of the ‘Golden rule’ espoused by all the world’s great mono-theistic evolutionary faiths, especially the Jews, Christians and Muslims. .. they all look the same to me.

*O Jerusalem, Jerusalem, killing the prophets and stoning those who are sent to you! How often would I have gathered your children together as a hen gathers her brood under her wings, and you would not! ~ Matt 23:37

    1. ‘Hamas’, I suspect, does not speak for the vast majority of Palestinians.

On what basis do you reach that conclusion? The evidence suggests otherwise. There were pretty huge crowds of Gazans celebrating the terrorist attacks and continuing the atrocities once the hostages or dead bodies of the victims were brought back to Gaza. So is that your private speculation, or do you have any evidence to back it up?

      1. Who the hell is ‘Hamas’, how many of them are there and where are their leaders?

*afaict, 1. only about 200 Hamas ‘militant/terrorist’ did all the despicable acts of violence against civilians, 2. their leaders are living high on the hog in Qatar and 3. Hamas is supported and funded as a Biden/Bibi foil/’cats paw’ in the conflict.

        1. Qatar is the diplomatic space for the world powers to meet those and make their demand orders.
They have to be there the cowardly leaders aren’t going to gaza and meting in israel is a joke.

Watch what propaganda you suck down like a chimp.

No other leaders have been on the front lines since napoleon – quit being so stupid the play you like fiddler on the roof.

          1. We must be talking cross-purposes.

*“The vast majority (94%) of Israelis say the current government bears some responsibility for allowing the Hamas attack to occur, and more than three-quarters believe the government bears most of the responsibility”, according to a Dialog Center poll reported on by the Jerusalem Post on Thursday.

      2. So genocide them as you have said is just. Do it coward.

Many of you cannot get along with your residential home neighbors.

If one invaded and took over your land and the world cops showed up and said it’s all good, you’d of course love life and realize they want death.

        Spook month is real.

  6. Can we maybe talk about how Sidney Powell was forced to plead guilty for DOING HER JOB??? Or is this blog just going to be unrelenting post after post about people ripping down posters for the foreseeable future?

    1. We don’t see a profile name nor Gold Star attached to your comment which means your input remains mysteriously anonymous just like you.

  7. Jonathan: Breaking news! The dam has burst. Sidney Powell, one of the central figures in DJT’s plot to overturn the 2020 election, has accepted a plea deal with Fani Willis. In exchange for 6 years of probation and fines, she has agreed to cooperate with Fani Willis’s prosecution of her former co-defendant Ken Chesebro. That trial is scheduled to start on Monday.

The big Q is whether Chesebro will want to go to trial with Powell as a witness against him? If I were Chesebro’s attorney I would tell him: ” Let’s go over to Fani Willis’s office and see if we can get the same deal. Six years of probation is better than a prison sentence”.

Powell is a huge figure in DJT’s plot. She knows where all the bodies are buried. Will Jack Smith try to get Powell to flip in his Jan. 6 case against DJT. You betcha!

    1. “The dam has burst.” “Where the bodies are buried.” Are you talking about the bodies of the American servicemen wantonly sacrificed by the “Biden” administration’s shameful bugout from Afghanistan? Because the whole point of the Trump years was that there were no bodies. Moderate your transports, Dennis. The fact that a lawyer has been forced to plead guilty for doing her job is hardly a victory for truth, justice and the American way.

    2. More news: Michigan fraudulent elector James Renner has pleaded guilty and is cooperating with the Michigan Attorney General. His 8 felony charges will be dropped in exchange for his cooperation.

“Trump campaign cuts Sidney Powell from president’s legal team”

The abrupt shake-up comes as Sidney Powell makes far-fetched and unsupported claims of voter fraud in the 2020 elections.

      Updated: 11/22/2020 08:50 PM EST

President Donald Trump appears to have cut ties with Sidney Powell, a key member of his legal team who also represents former national security adviser Michael Flynn in his long-running attempt to unravel a guilty plea for lying about his 2016 contacts with Russia.

The abrupt shake-up came in a terse Sunday evening statement from the Trump campaign that offered no explanation for Powell’s removal.

“Sidney Powell is practicing law on her own,” Trump’s personal lawyer Rudy Giuliani and campaign lawyer Jenna Ellis said in the statement. “She is not a member of the Trump Legal Team. She is also not a lawyer for the President in his personal capacity.”

Powell had made headlines in recent weeks for her increasingly outrageous and unsupported claims of voter fraud in the 2020 election, repeatedly vowing to “release the kraken” of evidence, only to refuse to produce it when asked by reporters.
Key lessons from the 2020 exit polls

Powell, in a statement, indicated she intends to keep litigating despite her separation from the Trump team.

  8. One can only hope that they might want to consider showing others the same consideration.

JT, there are many things one can reasonably hope for and that is not one of them. As a constitutional scholar, you more than anyone should know that the American people should never hope those given power with the potential to destroy our lives, our liberty and our property will not do just that. One of the biggest hope failures I’ve seen in my lifetime was the election of Barack Obama. We are where we are today because people bought into the hope message without questioning the fundamental transformation vision. Those abusing power rely on the people only hoping. If we can’t do more than that, then we are finished.

    1. Olly,

Hope is an awful message. It is a submissive word. “I hope the Vikings win on Sunday” because I have no direct influence on the outcome. Obama wanted us to submit to him by hoping.

  9. Jonathan: In the “fog of war” it is almost impossible to distinguish fact from fiction. The facts about the bombing of Al-Ahli Baptist Hospital in Gaza illustrate the problem. The Palestinians say it was an Israeli air strike. That’s the view of the NY Times. Israel and the Biden administration claim it was a errant rocket fired by Islamic Jihad. CNN has adopted that position. It has posted a video it claims shows a rocket it says was fired by IJ and then shows an explosion at the hospital. How does CNN know the rocket was fired by IJ? It doesn’t. It can’t even establish that the explosion in the video came from the rocket. This is what what I mean by the “fog of war” that results in disinformation.

To compound the problem internet service in Gaza has been virtually destroyed by continued Israeli air strikes. So getting accurate information and images of the Gaza hospital destruction is almost impossible. On top of this images of the carnage at the hospital have been censored on social media. The Intercept is reporting (10/18) that Facebook and Instagram users inside and outside of Gaza “have complained of deleted posts, locked accounts, blocked searches, and other impediments to sharing timely information about the Israeli bombardment and general conditions on the ground”. But it’s strange neither Facebook nor Instagram have censored images of the gruesome carnage after Russian airstrikes in Ukraine. Why? Because the Biden administration supports the Ukrainian cause.

So what are we left with? The Biden administration supports anything the Israeli’s do to the people of Gaza and depends on censorship by social media to block out the truth. Seems that should be something you would want to address. I guess not.

    1. Dennis – my compliments. You wrote a comment (quite sensible) without mentioning Donald Trump.

      1. Edwardmahl: Thx for the compliment. But you missed one thing. All my comments are “sensible”.

    2. Why did the Times use an image of a building that wasn’t even the hospital? Is that their view?

    3. As someone with an extensive career in military intelligence analysis and operational assessment, I can say with certainty that this comment is one of, if not the, dumbest thing I’ve ever read. We are all more stupid for having wasted our time on Dennis’s wishful thinking once again.

      1. Actually the dumbest thing I’ve read on this blog in awhile (and remember Oky commented here and cut and pasted Alex Jones quite regularly) is someone boasting of their intelligence career!! Lol. It let’s us know you actually worked in the mail room.

    4. So getting accurate information and images of the Gaza hospital destruction is almost impossible.</i

500 dead people would be priceless PR for hamas. I'm waiting for evidence the hospital was damaged, before assessing blame or believing hamas.
I understand wanting facts. I refuse to respect anyone that give hamas the benefit of the doubt.

  10. The legacy media, the mainstream media, whatever you want to call it, are narrative factories, propaganda outfits. It has not been about journalism for a very long time. Like any other cartel, it abhors competition. The First Amendment, the principles of free speech and freedom of the press mean absolutely nothing to them now that they control the institutions. Those principles are just tools to be employed selectively, hypocritically to further the interests of the cartel.

The First Amendment, the principles of free speech and freedom of the press used to be hollowed values of liberalism — back when conservatives mostly controlled the institutions, back when the Democrats were the racists. The controlling conservatives mostly shared those principles and shared them genuinely. They allowed the liberals to have their say, though they disagreed. Thus, step by step the Fabians marched through the institutions, gaining control and conveniently having a change of heart on those not so sacred principles.

I am afraid these people will not appreciate the First Amendment, the principles of free speech and freedom of the press unless and until they are out of power and faced with censorship. I say we should do whatever is necessary, and I mean anything, to get them to return to first principles.

  11. Of course you hey are. Talib is furthering the cause and following the dictates of her religion. What is the Times’ excuse.

  12. In this article Mr. Turley wrote it appears it landed in a parking lot. That you rarely hear

  13. Professor Turley, you are too kind. The antisemitic LIE that made its way around the world while the truth was still putting on its pants? Evil. Outright evil.

  14. OT

Sidney Powell just pleaded guilty to six counts of conspiracy to interfere with the 2020 election in the GA case. She has agreed to testify in future proceedings.

    1. I am curious to see whether the good professor changes his tune now.

He stated: “…On the Coffee County allegation, the key details will be whether the access to the machine was viewed as “voluntary” or whether Willis can show a criminal intent.”

      https://twitter.com/JonathanTurley/status/1691261238263595008

If there was solid evidence that it was voluntary, she would not have pleaded guilty to intentional interference with the performance of election duties. This was an intent-based allegation.

      1. Anonymous: Thx for the link to one of JT’s previous posts. But JT has always defended the conspirators in the fake elector scheme in Fulton County. Sidney Powell’s plea deal puts a big hole in JT’s attempted defense of her break-in at the Coffee County elections office.

  15. A professional colleague of mine, who is Syrian, is in a frantic uproar on Facebook. He is fervently passionate to see only one side of these events. It is apparent to me that that he despises Israel and Jews. In time, these things will be sorted out with hard facts. What is not equivocal is the combatants are not two armies of nations facing off on a battlefield. This was an act of terrorism.

He has the attitude of “I’ve made up my mind, don’t confuse me with the facts.” Many have been taught from a young age to have this attitude.

War always has collateral damage and that means people will die and property will be destroyed. It is never good but sometimes, unfortunately, necessary. In this case, however, this was an act of terrorism.

Isn’t it interesting that the cancel culture seems to be working in reverse? Those who were proponents a few years ago are suddenly in the crosshairs?

  16. Think about the determination of leftists to control everyone and everything.
    Now add in the sura.

  17. Typical leftist tactic. Run an uncorroborated headline, post a tweet without waiting for the facts to come to light, use images that are not factual or misleading. Then when called out on it, either double down or pretend it never happened.
    It truly shows their character.

  18. “Iran is Responsible For The Attacks on Israel”

“There can be no doubt about who instigated the attack.

“Hamas and Hezbollah are wholly owned subsidiaries of the Iranian mullahs, who call the shots.”

“The only way to stop Hamas’ and Hezbollah’s recurring attacks against Israel is to treat Iran as the attacker and punish it more than its puppet organizations.” (Alan Dershowitz) (https://www.capitalismmagazine.com/2023/10/iran-is-responsible-for-the-attacks-on-israel/)

    1. Sorry Sam, that is wrong.
Hamas and Hezbollah are separate from Iran.
      That is a fact.

What you are seeing is the proxy war where Iran has aligned and owned these groups due to a shared hatred for Israel (Hamas) and a common religious ideology w Hezbollah.

The Iranians are taking advantage of their hate.

The groups will sometimes act independently from Iran and without consent from Iran.
      (Rare but it happens)
