Republicans Join Democrats in Defeating Censure of Rep. Tlaib

Like many, I have been highly critical of the statements made by Rep. Rashida Tlaib (D-Mich.) accusing Israel of bombing the hospital in Gaza and other inflammatory comments. However, I also opposed the effort to censure Tlaib on free speech grounds. I was impressed by the comments of Speaker Mike Johnson on the measure and the 23 GOP members who took the unpopular step of voting against the measure even though they disagreed with her viewpoints.

The 23 Republicans joined all House Democrats in a 222-186 vote to block the disciplinary measure pushed by Rep. Marjorie Taylor Greene (R-Ga.) for her criticism of Israel after Hamas launched a deadly attack against the country last month.

The resolution adopted the same type of ambiguous and overly broad definition of insurrection used by Democrats against Republicans. Green’s resolution accused Tlaib “antisemitic activity, sympathizing with terrorist organizations and leading an insurrection” at a House office building.

Tlaib has spread what many would declare “disinformation.” However, that rationale has been used extensively by many to censor and ban opposing views on social media and in academia. It should not be used to censor elected representatives in Congress. Clearly, this carries no real penalties and the House has every right to speak as an institution. However, as Speaker Johnson noted, it leads to endless measures. It also creates a growing expectation that every position deemed offensive or false should be subject to institutional action.

In an appearance with Fox Host Sean Hannity last night with other GOP members, Johnson explained that he opposed such measures in the interests of free speech. He noted that members say controversial things “all the time” and that it is a slippery slope to use such disciplinary measures in a tit-for-tat pattern.

I have previously raised concerns over the threats to free speech in this period of great tension in Congress and on our campuses.  I have denounced Hamas as a terrorist organization, but the solution is not to curtail free speech rights on our campuses.

That is not true about conduct like tearing down posters and threatening others. Recently, Harvard students (including Ibrahim Bharmal who is an editor of the Harvard Law Review) was implicated in a disturbing incident involving Jewish protesters who were shoved and pursued on campus. At Cornell, a student, Patrick Dai, was arrested after threatening Jewish students.

Our campuses and our Congress have a shared value as forums for the expression of political viewpoints. They serve as important spaces for the exchange of opposing views, including some views that may enrage or insult many of us. Yet, if we are to find any resolution of these issues, it will be through the use of free speech, not through its denial.

Loudon County is also where a male “trans” high school student sexually assaulted different girls, different schools. The Superintendent of Loudon County Public Schools was fired (with pay, ~$300K) after a grand injury blamed the school district for the handling of the Trans/sexual assault incidents and subsequent covering it up. Why Loudon County, VA (the most affluent county in the nation) and not BFE America?

  3. The problem isn’t Rashida Tlaib. The problem is that her antisemitism appealed to a majority of voters who elected her. Tlaib is the face of her district, Detroit and Dearborn.

    No Jews live in Saudi Arabia, Syria, Lebanon, or Jordan. At this point, do any Jews dare to live in Dearborn, MI, the home of so many antisemitic rallies? How are the Jewish enclaves in Detroit faring, surrounded with enough people to have voted in a blatant antisemite to Congress?

    You can show her video of Hamas’ rockets falling on the hospital parking lot, and show her current photos of the hospital, still standing. She will insist that IDF fired. missiles deliberately, directly, at the hospital and killed hundreds of people.

    You can show her evidence that IDF warns Palestinians to evacuate military strike zones ahead of time, while Hamas has orders to rape, torture, kill, castrate, and hack off other body parts of every civilian man, woman, and child they could catch. She will insist that Israel deliberately targets civilians.

    You can show her Hamas’ own body cam of the shooting of a father, gang rape of the mother, while they put her screaming baby into an oven to burn to death, as Nazis do. She will insist that Israel had it coming, and is worse. Any limitations at all, on abortion is a war on women, but Jewish women and little girls must have had it coming to be gang raped until their pelvises broke.

    You can prove that Jews are the indigenous people of Judea, where Judaism evolved, tracing its roots both archeologically and genetically to this area back to the Bronze Age. She will still call them colonizers.

    She can listen to an intercepted phone call in which Hamas demanded a Gaza hospital hand over its fuel, to add to its sizable stockpile of fuel, food, and all the other aid that has poured into Gaza, and she will still blame the Jews for the hospital running out of fuel. Hamas received enough money and aid to build a state of the art water and power system, but it’s the Jew’s fault they don’t have water and power. The Jews are commanded to pour treasure into Gaza “for aid” that will just be seized by Hamas to kill more Jews. Meanwhile, not a single Arab nation has agreed to receive Palestinian refugees. The Jews have to pay for terrorist activity against Jews, apparently.

    I don’t know if she hears static when presented with contradicting evidence. Brainwashed people can get hostile and agitated when presented with proof that contravenes their ideation.

    I’ve got nothing. These people cannot be reasoned with.

    Imagine, for a moment, what life would be like for American Jews if someone like Rashida Tlaib ever became President, or if a majority in Congress reflected her views. In London, over 100,000 pro-Hamas demonstrators packed the Bridge, chanting slogans like, “Oh Muslim, there is a Jew behind me. K!ll him.”

    I’ve said for years that there are people in every single country who would fit in wonderfully if they immigrated to the US, assimilating to Western culture. You can find people like this all over the world. I also said that if you import a random cross section of regions where terrorism, antisemitism, total intolerance of LGTBQ, and no respect for women, they would not abandon those beliefs just because they set foot on Western soil. Well, here we are today, when American Jews in Jewish-majority neighborhoods are warned not to walk outside, and many London Jews fear to tread almost anywhere.

    Tell me again how Islam is the religion of peace, but a little old baker who didn’t want to bake a custom Satanic cake, Halloween cake, or a transgender cake, is the real threat to America. Christians are always targeted as being a threat, such as the attacks on Speaker Mike Johnson, but apparently it’s perfectly acceptable to call for the ethnic cleansing of Jews “from the river to the sea”, from their own religious homeland.

    When faced with a massive increase in antisemitic threats, harassment, and assaults, what did President Joe Biden do? He appointed VP Kamala Harris to combat Islamophobia.

  7. Jonathan: Shortly after taking office in 2017 DJT executed a Revocable Trust making his kids trustees over the operation of the Trump organization and all the properties in NY while DJT was “playing” at being President.

    So yesterday Don Jr. was called to testify before Judge Engoron in AG Letitia James civil fraud case. And what did Don Jr. have to say about his role as one of the trustees–a position with fiduciary responsibilities? He was shown a number of documents he did not recognize. One was a 2017 statement of financial conditions. Another doc he didn’t recognize was a power of attorney executed in March 2017. That power of attorney designated Don Jr. as his dad’s agent without limits as to compliance certificates concerning real estate and banking transactions.

    Other aspects of Don Jr.’s testimony did not go well for him. He tried to blame others. He said he relied on Mazars USA to prepare the company’s financial statements. He admitted “I know nothing about GAAP–I leave it to my accountants”. Sounds like Alan Weisselberg, the former convicted CFO for the DJT organization.

    As a trustee Don Jr. had a responsibility to know something about basic rules of accounting. He had a fiduciary duty to assure the company’s financial statements were accurate and true. And they weren’t! When he testified Don Jr. didn’t even bother to try to argue the inflated value of the company’s properties were actually accurate.

    Poor Don Jr. He is incompetent to act as a trustee and fiduciary of a NY company. That’s why I think in his final decision Judge Engoron will order that neither Don, Jr. nor his father, nor Eric, nor Ivanka can never serve as an officer or board member of any NY company. If this was “The Apprentice” show the verdict would be “You’re fired!”.

If there are errors or misrepresentations, responsibility and liability for that falls on the representative of the company. No “licensed professional” would make up numbers for tax or other purposes, including valuations of real property or other assets used for securing loans. No “licensed professional” is going to ignore obviously false appraisals of property or valuation of other assets knowing that a lender or tax authority relies on the information provided. I once was employed as counsel for my state’s Department of Insurance, which requires insurance companies, third-party administrators and other fiduciaries to report financial information verified by CPAs and actuaries. These professionals have standards they must follow, which doesn’t include making up numbers. That’s just Trump’s story. You might want to visit the website of the AICPA for information about CPA professional standards. My knowledge comes from personal experience, not “leftist propaganda”. Records of sales and appraisals of comparable properties from 10 years prior exist–and, on that basis a fair market value from 10 years ago can be obtained. There ARE properties comparable to MAL, and this is what appraisers use all of the time. Trump’s numbers were greatedly exaggerated. And, contrary to the arguments on alt-right, pro-Trump media, it doesn’t matter that he paid back loans, or that the lenders made a profit–he LIED on loan applications to borrow money on more-favorable terms than if he had told the truth. When the appraiser appraises a property, he calls that appraisal an opinion since that is all it is. When he appraises it for taxes, it is still his opinion which can be challenged.

              Rush Limbaugh’s home sold for $155 Million and it is tiny compared to Mar a Lago. Whose figure is closer, the judges, at $18 to $27 million or Trump’s. Real estate prices bounce all over the place but in the Palm Beaches on the water they are exceptionally high and command a price based not just on what the seller wants but on the purchaser to whom an extra $100 million is near meaningless.

      I don’t know my own tax returns. I have no idea if they are prepared correctly, because I am not a CPA. I leave it to our accountant. How in the world would an executive be able to tell if CPAs and a team of tax attorneys properly prepared the taxes of the 500 business entities under the Trump Corporation, bringing in revenue of over $650 million?

      You go to law school for a reason. Donald Trump, Jr has a degree in economics. The state and federal tax codes are so complex that even when a tax attorney is absolutely sure the taxes are prepared correctly, the IRS might disagree.

      I knew someone who was audited once, many years ago, over a disagreement about deductions. A second IRS agent came in, and he disagreed with the first one. He said, if two IRS agents cannot agree whether these deductions were correct, then how could an average American without a degree in accounting possibly get it right? That ended the audit.

        Then you and Iowan2 completely misstate the role of outside tax preparers. Let’s make a simple analogy. It’s tax season and you submit all your tax information (1040s, tax statements from earnings on your savings account, etc.) to your accountant. Based on what you submit your accountant prepares your return and sends it to you. Right so far? You are then responsible for reviewing and verifying the accuracy of everything in the return. Still with me? The final step is you sign the return and send it on the IRS (or it is done electronically). What happens if you intentionally fail to report some outside income or try to take deductions to which you are not entitled? You may be audited. You may even be asked to appear at your local IRS office. Iowan2 seems to think you can blame these omissions on your tax preparer. Nope. You are solely responsible for the tax return you signed.

        And this is Don Jr’s predicament when he testified before Judge Engoron. Don Jr. and his siblings were trustees of their dad’s revocable trust. As such they had a fiduciary duty to verify the accuracy of all statements of financial conditions of the Trump Organization. If Don Jr. has a degree in economics why is it that he testified that “I know nothing about GAAP–I leave it to my accountants”? With his degree how is it he doesn’t know anything about generally accepted accounting principles? Unless he was willfully ignorant of his dad’s years of overvaluing his properties so he could get loans and other favorable treatment. Don Jr. simply signed off on all the statements knowing they were fraudulent. He was part of the scheme to defraud the people of NY.

        None of this has been lost on Judge Engoron. We can probably expect a decision by the judge by early December. How do you think he will rule? I expect Judge Engoron to require that DJT and his kids to disgorge all their ill gotten gains. That means DJT will be out of business in NY. And if Engoron agrees with AG James neither DJT nor any of his kids will be able to serve as an officer or board member of any NY company ever again. That’s what happens when you breach your fiduciary responsibilities and take New Yorkers for suckers!

    In my humble opinion and free speech, Rashida Tlaib must have been censured by Congress and exiled. Rashida Tlaib enjoyed American freedom of speech. Rashida Tlaib simultaneously committed felonious perjury, incitement, international defamation, and false condemnation. If the Senate maintains a dress code, Congress must maintain a truth code. Rashida Tlaib willfully subscribed to and perpetuated the “Big Lie” that the Israelis deliberately and savagely bombed the al-Ahli Arab Hospital, in fact adhering to the enemies of Israel and the U.S., giving them aid and comfort. Barbarian Hamas, the enemy, killed and kidnapped Israelis and Americans and, in fact, inadvertently bombed the al-Ahli Arab Hospital with errant rockets launched from a proximate Hamas site.   10. Jonathan: Your right again. 23 GOP House members correctly joined the Dems in rejecting Marjorie Taylor Greene’s attempt to censure Rep. Rashida Tlaib for her “free speech” right to criticize Israel for its air bombardment of Gaza. Although you used the opportunity to accuse Tlaib of spreading “disinformation” about what Israel is doing to Gaza. Israel is trying to bomb Gaza into oblivion. The photos of Gaza show widespread devastation–more like photos of Dresden, Germany during WW11. Over 8,000 civilians have been killed–many of whom are women and children. It now borders on genocide. Palestinian civilians are paying the price for the actions of a few. That is a violation of the laws of war. And that is what Tlaib is complaining about. That’s not “disinformation”.

    MTG was quick to denounce the House rejection of her resolution. She went on “X” to declare: “Our country is in the worst crisis in it’s [sic] history in every category and the Democrats are full blown communists and the Republicans can’t even censure Rashida Tlaib”. Republican Rep. Chip Roy (TX) called MTG’s resolution “feckless” with “factually unverified claims” including that Tlaib led an “insurrection”. MTG then ranted about Roy: “Oh shut up colonel Sanders, you’re not even from Texas, more like the DMV”…etc., etc. It seems MTG is now the unhinged voice of the House MAGA Republicans.

    The MAGA Republicans in the House have formed a circular firing squad. They fight among themselves while Rome burns. They can’t agree on anything. They spend the people’s time fighting over petty issues. No doubt the voters next year will have something to say about who governs the House.

  16. I totally oppose expulsion but a censure has nothing to do with censorship. It is an expression by the House of its repudiation of the conduct or speech being targeted.
    If a Representative had made a speech promoting white supremacy and calling black people by racially repugnant names, the House would rightly censure that Representative and rightly so.
    As long as censure carries no physical or financial penalty, it is an appropriate way to express disgust.

  17. I have difficulty understanding Professor Turley’s position here. This was a censure motion. As I understand it, it consists of a formal disapproval of Tlaib’s comments. Thus, it is a rebuke of, and not interference with, Tlaib’s speech. Given Tlaib’s pro-terrorist propaganda, I see nothing inappropriate with censure. Criticism of speech is not equivalent to precluding it. And if the point is that criticism of off-the-wall comments might have a “chilling effect” on speech (i.e., encouraging a bit of caution and reflection before blurting), I’d suggest that would be a good thing.

  18. Today the Congress is just a little less horrible. Just maybe, the adults in the room decided to say enough. By defeating a censure, the House is just a tad better today.

    In this case, the adults are the 23 Republicans. Not the rest of the Republicans nor the entire Democrats. They voted for the politics. Enough already, time to protect the institution. I just hope this is the start. Enough of the tit for tat.

    I am no fan of Tlaib. As fas as I am personally concerned, she is anti-Semitic running around saying she is pro-Palestinian. That is her right; she may not be someone I hold up as a leader, but it is up to her constituents to remove her, not me or Congress. As long as any members break no laws, they are duly elected and should serve regardless of who they upset.

    Defeating this censure in the name of free speech is the right course. Nobody has to like what she says, but she does have the right. I hope Tlaib understands that her bill may come due when she cannot get legislation through or find common cause due to her rhetoric.

    This goes for Marjorie Taylor Greene too.

    Regardless of who does or does not like whatever member, they were voted in and their constituents ultimately decide. If the voters want to represented by a fool, that is their right. We certainly have had plenty serve on both sides of the aisle.

      No sane person would posit that one man, one vote democracy is rational, logical, or otherwise good and beneficial, as it takes society down to the lowest common denominator rather than its highest and best use.
