In a surprising filing, Fulton County’s district attorney Fani Willis has accused the estranged wife of her alleged lover of conspiring to undermine the Trump prosecution by seeking her deposition in the messy divorce case of Nathan Wade. Willis, again, does not deny having an affair with Wade, who she appointed lead prosecutor in the case. Instead, she accuses Joycelyn Wade of an affair that broke up the marriage and suggests that she is coordinating with Trump forces to interfere with the prosecution.
Willis is accused of major ethical violations in appointing her alleged lover to the position as she went on lavish vacations with him. She previously denounced those raising obvious ethical concerns as being racist due to the fact that both Willis and Wade are black. She did not, however, deny the intimate relationship or the allegation that Wade paid for her vacation expenses.
At issue in the filing is the demand for a pretrial deposition in the divorce case of Nathan and Joycelyn Wade on January 23. Willis’ counsel leveled a full attack on the motivations and associations of Joycelyn Wade. She accused Joycelyn Wade of having an adulterous relationship with a longtime friend of Nathan Wade’s.
Willis’ counsel Cinque Axam then added that Joycelyn Wade “has conspired with interested parties in the criminal election interference case to use the civil discovery process to annoy, embarrass and oppress District Attorney Willis.”
The filing noted that the allegations against Willis were used by Trump codefendant Mike Roman to seek judicial review and remedy for the alleged conflict of interest. A hearing has now been set by the court for Feb. 28th.
Willis bases her conspiracy theory on the fact that, on January 8, Roman’s filing was made public and on the same day, she was served a subpoena and there was a move to unseal the Wades’ divorce case.
That certainly makes this all a bit different from the usual “other woman” element in the divorce case. However, it is not a smart move. The level of animus and vexatious language in the filing only magnifies the concern over the Willis-Wade relationship. By attacking the estranged wife of her alleged lover, Willis only increases concerns over the professional separation between Willis and Wade in making decisions in the case.
Accusing the estranged wife of your alleged lover of being a political conspirator is about as compelling as accusing people raising ethical concerns of being virulent racists.
For example, if Wade were to exceed his authority or act unprofessionally in the case, Willis would be forced to take action against not only an alleged lover but someone she has had to defend as the ideal choice for the position. Their personal relationship would presumably weigh in the balance in any supervisory review or decision.
Likewise, if Willis was taken on vacations by Wade and their relationship is continuing, the termination of his contract could have an economic impact on Willis.
In the end, the accusatory motion was a mistake in my view. Willis could have objected to the necessity of the deposition on factual and legal grounds (as she does) without escalating the rhetoric and recriminations.

Jonathan: Why does it take 2 columns for you to try to make a case against Fani Willis? There is no evidence either Nathan Wade or Fani Willis have exceeded their authority or acted “unprofessionally”. Nor have you offered any evidence that terminating Wade’s contract would have an “economic impact on Willis” or that she “has benefitted financially from the relationship” with Wade.
In your Messenger article you cite Whitworth v. State, a GA Appellate Court decision (2005) for the proposition that “a district attorney should be disqualified when there is a personal interest in the defendant’s conviction”. Aside from the fact there is no evidence Wade has a “personal interest” in the conviction of the RICO defendants, the Court in Whitworth also pointed out another test for conflict of interest. In denying Whitworth’s claim, the Court said: “[For example a] conflict of interest has been held to arise where the prosecutor previously has represented the defendant with respect to the offense charged, or has consulted with the defendant in a professional capacity with regard thereto”. That test applied to Nathan Wade doesn’t apply either because there is no evidence he has ever represented any of the RICO defendants in any capacity. (See also my previous comment 1/19@11:17am)

Is it proven ? No, but it is the type of allegation that has an extremely high probability of being proven with absolute certainty.
Wade is getting removed pretty much no matter what. He is over paid, unqualified and has a contempt in the divorce that he has not cleared.
He will be removed.
For willis to survive:
There must be no romantic relationship.
She and Wade must not have vacationed together and/or Willis must have paid her own way.
She must have some explanation for overpaying Wade.
She must have some explaination for paying wade for 24hrs in one day.
She must have some explanation for paying Wade to confer with the WH.
Pretty much all of those must prove true for Wade to survive.
Next, while neither Wade nore Willis have confirmed a romantic relationship.
No one is denying it – despite Wade’s ex raising it front and center.

Recent comments by the eminent biologist James Watson concerning intelligence test data from sub-Saharan Africa resulted in professional sanctions as well as numerous public condemnations from the media and the scientific community. They justified these sanctions to the public through an abuse of trust, by suggesting that intelligence testing is a meaningless and discredited science, that there is no data to support Dr. Watson’s comments, that genetic causes of group differences in intelligence are falsified logically and empirically, and that such differences are already accounted for by known environment factors. None of these arguments are correct, much less beyond legitimate scientific debate. Dr. Watson was correct on all accounts: (1) Intelligence tests do reveal large differences between European and sub-Saharan African nations, (2) the evidence does link these differences to universally valued outcomes, both within and between nations, and (3) there is data to suggest these differences are influenced by genetic factors. The media and the larger scientific community punished Dr. Watson for violating a social and political taboo, but fashioned their case to the public in terms of scientific ethics. Jonathan: Horror of horrors! Fani Willis is having an affair with her lead prosecutor, Nathan Wade. Every which way but Sunday, DJT, his co-conspirators, the GOP in Georgia and Comer and Jim Jordan in the House have tried to get Willis removed from the RICO case in Fulton County. All those efforts have failed. So what is this latest gambit about?
For 2 years Nathan Wade and his wife Joselyn have been in divorce proceedings. Until now both agreed to keep the divorce sealed to protect their privacy. Fani Willis was no part of the divorce proceedings because the cause of the Wade marriage breakup was due to the fact that Joselyn was having an extra marital affair with Nathan’s best friend. Since then Willis and Wade started their own relationship and went on lavish vacations together.
Fast forward to 1/8/23 when suddenly Joselyn sought to depose Willis. Within hours Mike Roman filed a motion to unseal the divorce proceedings and have Willis disqualified claiming a “conflict of interest”. Who is Mike Roman? He is a principal co-conspirator in Willis’s RICO indictment. He was the “mule” who went around the country putting together the fake electors. Ken Chesebro will be testifying against Roman in the RICO case. So Roman has ample reason to want Willis removed.
Smell something fishy here? In her response Willis lays out what Roman and Joselyn are up to. Willis says: “Defendant Joselyn Wade has conspired with interested parties [i.e., Mike Roman] in the criminal Election Interference case to use the civil discovery process to annoy, embarrass, and oppress District Attorney Willis” [page 8]. In other words, Roman is using the divorce proceedings to try to obstruct Willis’s criminal investigation. That attempt will also ultimately fail.
As to Roman’s claim Willis has a “conflict of interest”, he cites no case authority or court rules to support his claim. If Willis was romantically involved with a defense attorney that would be a “conflict of interest”. But the fact that Willis and Wade go on lavish vacation trips together raises no “conflict of interest” issues. They are on the same team. There is no evidence their relationship has jeopardized the criminal investigation. Further, Nathan Wade is a well recognized and respected litigator in Georgia. Willis hired Wade because of his credentials before they started their apparent romantic relationship. Besides Wade is being paid only about $250 an hour for his services. Chump change for what he could make in private practice.
So what is your cheap shot about? Once again to find some reason to get Willis off the case. That’s because Willis is a strong Black prosecutor with lots of experience in prosecuting RICO cases. DJT fears Willis and this is his latest behind the scenes attempt to remove her. It’s sad you would join in this futile exercise!

Re the notion that Fani Willis could be disbarred: Never happen. Republicans are the only ones who would consider it, since Democrats have already circled the wagons to defend her (see Dennis McIntyre above, twice). And Repubs won’t even *consider* trying to get her disbarred because that will call mob violence down on the head of anyone who tried.
Our host notes that “the judge” called a hearing on “this” for Feb 28th. Thing is, the issue Willis is complaining about–and seeking relief from–is being subpoenaed to testify in the divorce trial of Nathan Wade and wife. But it’s my understanding that Willis has submitted her motion to quash to the judge in the “election interference” case. (That’s from civilian reporting which may have misunderstood.)
If that’s true, Willis’s motion to quash is in the wrong court, and should be heard by the judge in the divorce case. Two different courts. The court Willis submitted her motion to has no jurisdiction over the subpoena.

The Fulton County GA prosecutor has secured SEVERAL plea deals with promises to testify against the other co-defendants . . . there was over THREE years of time and money invested at this late date. These allegations are scandalous yet unverified. There will be an evidentiary hearing next month to get to the truth of this matter and I expect that Fani Willis will swat away these allegations like GA love bugs hovering over Shoo Fly pie 🥧 at the hearing in February.
I believe the plea deals were all misdemeanors without jail time and without pledges to testify in any particular way. Kevin McCarty has written that the plea deals were signs of weakness.

I do believe that The Fulton County GA prosecutor has done due diligence in coordinator with the Jan 6 committee and the sworn testimony of prominent GOP state officials that answered Congressional subpoenaes there. What was discussed with the White House we will never specifically know but we can speculate that it has to do with the Georgia RICO case which has nationwide range. Every illegal action of Rudy Giuliani will be legally attributed to the Donald Trump 2020 reelection campaign via the Georgia RICO statute and that includes AZ, PA, MI and WI too . . . the Jan 6 committee has all their sworn testimony and depositions.

Wade had to pad those billable hours to afford the vacays with Willis and a sharp lawyer caught on that he is raking in the dough from his sugar momma.
