Two years ago, I wrote a column denouncing Canadian Prime Minister Justin Trudeau’s use of a counter-terrorism law to shut down the Freedom Convoy trucker protests as an authoritarian attack on free speech. Now, a Canadian court has agreed and ruled that the use of the Emergencies Act was unlawful and “unreasonable.” Despite Trudeau’s attacks on civil liberties, he remains a favorite of the media as an iconic figure on the left.
Various civil liberties groups have opposed the iron-handed measures of Trudeau, including The Canadian Civil Liberties Association and the Canadian Constitution Foundation. The characterization of political critics as terrorists has long been a signature of authoritarian governments. The Canadian Parliament actually extended those powers, dismissing civil liberties concerns. Fortunately, despite the actions of Trudeau and the Parliament, there is an independent court system in Canada.
The use of the Emergencies Act allowed the government to arrest the leaders of the Freedom Convoy, freeze bank accounts of protesters, and seize donations of other citizens. Trudeau simply declared that the protesters were “threats to the security of Canada that are so serious as to be a national emergency.”
In his ruling, Justice Richard Mosley wrote:
I have concluded that the decision to issue the Proclamation does not bear the hallmarks of reasonableness – justification, transparency and intelligibility – and was not justified in relation to the relevant factual and legal constraints that were required to be taken into consideration.
Trudeau merely cited the potential for violence without any compelling support for an imminent risk of violence. The court declared:
The potential for serious violence, or being unable to say that there was no potential for serious violence was, of course, a valid reason for concern. But in my view, it did not satisfy the test required to invoke the Act particularly as there was no evidence of a similar “hardened cell” elsewhere in the country, only speculation.
In many ways, the court stated the obvious, but this was an obvious point that other courts and a majority in Parliament ignored:
I agree with the Applicants that the scope of the Regulations was overbroad in so far as it captured people who simply wanted to join in the protest by standing on Parliament Hill carrying a placard. It is not suggested that they would have been the focus of enforcement efforts by the police. However, under the terms of the Regulations, they could have been subject to enforcement actions as much as someone who had parked their truck on Wellington Street and otherwise behaved in a manner that could reasonably be expected to lead to a breach of the peace. [309] One aspect of free expression is the right to express oneself in certain public spaces. By tradition, such places become places of protected expression…To the extent that peaceful protestors did not participate in the actions of those disrupting the peace, their freedom of expression was infringed.

It would be a mistake for Trump to select another Trump-like figure as VP. He needs someone who reassures people who don’t like or trust Trump. Mike Pence filled that role well.
I tend to agree. While I strongly suspect that Lake greatly appeals to Trump, she is not going to be a strong positive factor helping him to win the election.
While the lawfare against Trump is garbage – there is a small possibility it lands him in jail anyway – If he does not win the election.
The odds of wining are good, but adding a few points to the odds would be very well worth it.
Trump has a reputation of being able to bury the hatchet with those who are prepared to do so.
While Haley is NOT my prefered VP, she ticks all the boxes to improves his odds of getting re-elected.
Trump does NOT need to appeal to evangelicals and the groups Pence brought to the table in 2016.

Many people will be angry at that choice, but none will choose not to vote for Trump if he picks Haley.
While there are many people who would sit the election out or vote for Biden who might vote for Trump if he picks Haley.
My money is on Haley, because she is the best improvement to his odds of winning.
The problem here is that Trump’s VP will probably become President, maybe for more than 8 years. Haley as President means unending war in the Mid-East for that entire time.

I don’t know that I am correctly seeing through the fog. Who and what is Nikki Haley? I am MAGA. Trump is MAGA, as is DeSantis and a number of other prospective candidates. That is a scary invasion of personal freedoms where vaccination is dubious or perhaps contraindicated for many. Nikki appears to support too much censorship and surveillance, which is popular with the WEF group. Is she the Democrat answer for 2028? Should Trump be elected in 2024? 43% of her vote came from people who said they would vote for Biden over Trump.

That could not be allowed. The last time people like that protested publicly led to the american revolution.

The entire left wing nut regime was in serious danger if non left wing nuts peacefully protested.
That could expose the fact that the left had lost touch with people.
The successful efforts to thwart protests like the truckers protest in the US as well as Canada.
The successful efforts to turn the J6 protests violent are all efforts to protect the lefts exclusive right to protest.
If protests counter to left wing nut goals were allowed, those could be compared and contrasted with the violent protests of the left – such as the BLM riots.

When governments use blacklisting in an overly manner (ie: McCarthyism, Alien & Sedition Acts, etc) it usually results in huge embarrassments to the governing authorities.
Governments never learn, they simply transition from somewhat “overt” blacklisting to “covert” blacklisting (ie: Cointelpro, etc).

With regard to foreign relations – what is it you want ? Our “aliies to like us ” or Our “Allies to persue policies that are in their and our interests” ?
I WANT Europe to be fearful that the US will not have their back against Russia – beyond countering the nuclear threat.
It is self evident at this time that Europe is more than capable of dealing with Russia without the US leading the way.
Biden continuing the Status quo of allegedly friendly relations where Europes policies are neither in our interest or in Europes interest is NOT a good thing. We are seeing more and more european governments shift right. Why ? Because they are witnessing the incongruity between the consequences of leftist policies and their promise.
Europe has its own immigration problem – far worse than ours. That may be beyond europes ability to resolve.
But the defense of Europe against Russia is entirely within the ability of Europe – without US assistance beyond providing deternence against Russia use of Nukes.
Ukraine is an important issue – and the US should give moral and even some actual assistance.
But resolving the issue is a european problem – not a US problem. Further as the War in UKraine should make self evident to all but the moron in this video as well as democrats and the left – Russia is a paper tiger.
If Russia tried to attack a united europe – even a weakly united europe, it would be defeated.
Right now Ukraine does NOT need more US weapons to defeat Russia – they are doing as much as they can and more will not tip the balance.
What Ukraine needs is Soldiers. If One large European country – Poland, Germany, France was willing to provide Troops to Ukraine to assist in its conflict against Europe – Russia will lose badly. If not, Russia will ultimately prevail, but will be so weakened as to be unable to attack a significant neighbor for more than a generation.
With respect to China – we once again have this nonsense that words will somehow bring about WWIII.
Japan has publicly committed to treating an attack on Taiwan as an attack on the Japanese homeland.
Biden has publicly committed to the US responding to a Chinese attack on Taiwan with US forces.
What exactly is it that Trump can say that would “provoke” china further ? Nothing.
Though Biden’s rhetoric has been more confused, Biden has maintained Trump’s containment policy.
Despite this video’s claim otherwise, there will be no difference beyond rhetoric between Trump and Biden on China.
The key question regarding china is as its internal problems worsen – Will Xi do something stupid ?
It does not matter whether Biden or Trump is president.
What does matter is building a Coalition – involving the US with the nations negatively impacted by China to contain china and respond to chinese agression. Trump built that coalition. Biden has quietly stuck with it – because it is the right policy.
With respect to Iran – FIRST, no one has successfully negotiated with Iran since the Ayatolahs took over PERIOD.
Pretending that the Iran deal was to anyone’s benefit besides Iran is lunacy. While Iran is far weaker that China, Iran is the most dangerous foreign power in the globe. They have repeatedly show the willingness to directly and indirectly risk large scale war.
They beleive that the west and their enemies are weak and will not act. The only measures that have worked regarding Iran have been blocking them. Contra this reports claims there is no beneficial relationship between Iran and Russia, and to the extent Iran and China have any positive relationship built on oil – that depends on the US, Europe, India, Philipines, and Japan not blocking Iranian oil to China.
China has NO ability to protect its foreign trade, nor does Iran. Both economies are completely vulnerable to economic and/or military blockade.
It is likely that Iran will get nukes eventually. We have slowed that down for a very long time. But it can not be stopped and it could occur soon.
When that occurs SOMEONE will sell the Saudi’s nukes. Could be India, or Israel, or NK, but most likely is Pakistan. Regardless, they have the money and they will buy them. And we will have nuclear detente in the mideast.
Further Getting Nukes will not change Iran into a good guy. Nor will getting nukes actually change the balance of power in the mideast.
As noted the Saudi’s will just buy nukes. The US will turn a blind eye or wag our fingers, but it will happen and we will secretly encourage it as the best response to a nuclear Iran.

It is probable that absent a resolution of Paelstine the relations between Israel and the Saudis will remain secretive. But those relations exist nonetheless. Israel and SA both benefit. Israel need SA to thwart Iran as an Arab state, and SA needs israeli technical and military assistance to do so.

End to Russian sanctions.
US aid to repair the failing Russian energy infrustructure.
US aide to repairing NordeStream Pipelines.
Agreement that Ukraine will NOT join NATO.
A russian land bridge to Crimea.
Return of all other occupied teritory to Ukraine.
Some kind of security guarantee to Ukraine.
With minor adjustments that is almost certainly doable.
For those who are clueless Without US assistance Russia can not bring its energy exports back to prewar levels PERIOD.
It does not have the skills necescary to do so, and can not do so in less than a decade.
Any peace deal or even just an armistace that does not end the blockade of technical assistance to Russia assures long term russian poverty.

They were there with troops on the ground outside the wire before many of our NATO allies ever got around to showing up. When we went into Iraq, again, Ukraine was one of the very first countries to have troops on the ground beside us. In both countries, Ukraine was there from the very beginning to the very end.
Despite the fact “it wasn’t their war”. And I don’t remember hearing anyone saying to them, not even once, during the years they were in the sandbox beside us “Pack up and go home; this is not your war”. Every deployment I did over there, at some point or other I saw Ukrainians. Some of those tours many of our NATO allies were there: either never did send troops, or soon packed up and left.
And so why isn’t this America’s problem? Because, sucks to be them that Obama and his foreign policy expert Biden, refused to provide that protection we promised them because of our fear of them having nuclear weapons?
Putin would have invaded anyways, even if he was invading a country whose citizens had nuclear weapons and memories of the Holdimor?
No he wouldn’t have – if you think the opposite, go ahead and change my mind.
Regardless of Biden corruption in Ukraine, and corruption in Ukraine just like we have here in the USA, there would never have been a Putin invasion of Ukraine if Ukraine had not trusted us and refused to surrender their nukes because they did not trust us. Every dime we have sent there and every person who has been killed in that war lies squarely at the feet of the nation that was so terrified of Ukraine having nukes as a defense against Russia, that we told them they didn’t need the nukes because big, powerful America, their friends, would protect them.
Yes, it was the feckless, terrorist loving Team Obama/Biden that violated that trust and that promise – but it is America’s name on that action, not theirs.
Even if you reject the idea that what happens to Ukraine because of the cowardice and political agendas of Team Obama is now America’s problem, the rest of the world doesn’t see it that way.
We can talk “not our war” all we want, pretending we aren’t aware of the deal we made with Ukraine to surrender those nukes, pretending we aren’t aware they were beside us in Afghanistan and Iraq pretty much every single day we were there from beginning to end. World leaders remember both of those sets of facts, and they see what we’ve done and haven’t done. Both our allies and adversarial nations see us doing that – just as Biden is now doing the same to Israel because of the neo-Nazi wing of his party. The reason friendly nations are cutting side deals with adversarial nations like Russia and the ChiComs is that everything they see us doing and not doing tells them that American promises and assurances aren’t worth the paper they’re written on. Meanwhile, the Chicoms are looking at two unanswered invasions of Ukraine, the Afghanistan abandonment, pressuring Israel to not fight their terrorists as we fought ours… and it isn’t a deterrent.
There are second and third order affects that will come from this. I’m retired now, but America’s foreign battlefields are not over. We are not omnipotent; in fact, each day we become less powerful as the Soviet Democrats rot our military from inside – further emboldening adversarial nations.
At some point, we are going to need to ask for the help of nations that watched how we abandoned Ukraine after our promises, and what we ask will entail them taking their own risks to provide that assistance. Nations are going to remember how Ukraine got screwed by our promises and some of them are going to decide that American promises are too risky and the promises aren’t worth the paper they’re written on. The troops in uniform when those days come around may come up short because the foreign support that was needed won’t be there.
The results of that are going to be pretty expensive as well. Most of all for those still in uniform.

It is “not our war” because US national interests are not at stake.
Russia is a failing state. This war will bring about that failure more quickly. But the failure is inevitable.
We do not need to do anything to bring about that failure.
It is within Russias power at significant cost in blood and treasure to defeat Ukraine,
That is likely the last act of significant aggression they will ever be capable of militarily.
They have a declining population a serious imbalance between men and women and
This is making it substantially worse.
Russia is not coming back from this.
Absent a peace deal they will be a pariah in the western world.
Only a few nations in the world have the ability to repaid NordeStream, or bring back online the pipelines and oil wells that have been shutdown do to this war, and if the war does not end soon, even more wells and pipelines will have to shutdown slowly and will not return for a decade. Russia’s black sea fleet has been severely damaged and Russia probably can not afford to repair and replace losses.
While they have vast “dumb” conventional reserves and have managed to produce/maintain sufficient of those to maintain the war,
Replacing the higher tech losses will be far harder and take longer.
While Russia has global support that is more significant that the West has counted on – only India and China are significant contributors to Russian exports.
My point is this war has substantially weakened Russia already and that while some recovery will occur if the war ends,
Russia is nto getting back to where it was at the start of the war ever.
Ukraine is NOT a consequential US interest.
It IS a consequential European interest.
While this war has proven to Europe that Europeans need to look to their own defense – more so that Trump demanding they spend 2% of GDP on the military, it has also established that there is no threat to Europe that the Europeans can not deal with with little more than material and energey support from the US.
Europe has lots of its own problems – SOME of the same ones Russia has – though not nearly as severe.
Regardless, from the US perspective our most important global relationships have less and less to do with Europe, Russia or the mideast with advancing Time. As I have outlined before – It is increasingly evident that Europe, Russia and the Middle east are a European national security interest, and will be more so in the future.
The US military no longer has the capacity to secure global freedom of the seas. That ability and role is NOT coming back.
Frankly the US should sell or give away a substantial portion of its mothballed destroyers and frigates to nations like Israel, Europe, India, Taiwan, Philipines, The UK, Canada, NZ, and AU.
The US military is also no longer capable of fighting two significant wars on two theaters concurrently.
That is the bad news. The good news is that our military can go pretty much anywhere int he world it wants to and no force in the world can stop up. Outside the coast of China where we can not survive once ammunition runs out, and we do not yet have the resupply and/or energy weapons to overcome that, there is no force in the world that can challenge the US.
China is the worlds next greatest military power, but it takes a century to build and learn to fight a navy and despite its size the Chinese navy would not last days against the US. More importantly The chinese navy does not have the ability to protect its own global trade even during peacetime.
At this time and projecting into the lifetimes of my children US national interests lie in
North America – Canada and Mexico – our relationship to mexico is a complex mess. We are dependant on Mexico for low-medium skill manufacturing, and if Mexico continues its slide towards being a Narco state the US is going to have to act.
Mexico either gets its act together, or we are Going to invade Mexico. Not tomorow, but soon enough.
Canada is barely a country anymore. Increasingly it is Just a US vassal, it is dependent on the US and we are dependant on it.
And that relationship will likely continue for decades.
The US national interest lies heavily in the Pacific Rim – Taiwan, Japan, South Korea, and increasingly Malaysia, Philipines, Vietnam,
and even China. China has worse future problems than Russia. China is past the point of no return for demographic collapse.
That is going to make China dangerous and volatile for decades to come. Right now China is probably at the pinnacle of its power.
Japan has similar demographic problems. Japan is growing to be a formidable military power and is likely the second most powerful navy in the world – and unlike China – they have a century of naval tradition and they can fight a navy.
Regardless the US is in a similar position regarding the Pacific Rim as it was with Europe during the cold war.
The next major sphere for the US is the anglo sphere – this overlaps north american and the pacific rim – Adding only the UK.
Regardless, the UK will likely be an increasingly significant global partner for the US. And Brexit was a far more rational move than it is credited with. UK has always been a global trading nation – and UK trade with the rest of the world was being constrained by the EU.
Despite the 20m wide English Channel, The UK has always been separate from Europe and is growning more so.
I expected Trump to strike a free trade deal with the UK during his first time. That should be trivial.
It near certain will happen if he is re-elected. That is possibly one of the simplest Trade Deals the US could ever make.
The UK agrees that anything made in the US meets UK standards, The US agrees anything from the UK meets US standards
No tarrifs on anything. The same deal could be easily expanded to the Anglosphere – the former common market, or the UK could be added to NAFTA or whatever it is now called.
And the Final area of consequential US interest is south america. South America is a mess. But it does NOT have the extremely serious demographic problems of Europe and Asia. South America is going to be a very messy continent with rapidly rising standards of living
presuming it can shed its F$#kd up socialist tendencies, and resolve some important problems like property rights
Anyway, that is my view of the directions of the world and the US into the future.
And that is a significant driver of all kinds of aspects of US politics.
The US is at the start of reindustrializing. We will not do so completely. But we are going to see significant returns of manufacturing into the US. We have just brought in 8M semi skilled immigrants. We are going to have to put them to work doing something.
Though there are more drivers than that.
But despite reindustrialization – the US is NOT going to become fully self sufficient. But the significance of Russia, Europe, and the mideast will significantly decline. Africa has enormous resources and potential but there is no idication it will get its act together in my kids lifetime. South America is significantly ahead and will.
All of this effects and is effected by things such as the GOP neo-con split. The war between Trump and the deep state.
The global shifts in US relationships is mirrored in internal deep state politics. Vast amounts of our government aparatus are relics of the cold war. They are Russia focused, Mid East focuses, Europe focused. The people occupying those seats are powerful dinosaurs that see the way the wind is blowing and are fighting to stop it. Trump did not create the shifts I am describing but he has recognized them, identified himself with them and taken the lead in moving towards the inevitable. And that has made him a huge target for the dinosaurs.
Would russia have invaded Ukraine had Ukraine been allowed to keep nukes ?
No! But that is long past. Further it was not happening any other way. This was durring the collapse of the USSR – and Russia would not have allowed the departure from the Warsaw pact of countries still possessing Nukes.
Was Ukraine betrayed by the West – Absolutely.
Is there a massive moral case to aide Ukraine – completely.
The US and the West have been relatively Unique in the world in that our moral commitments have more significance than those of other powers. But it is false pretence to beleive that the US will in all cases uphold its moral commitments – absent compelling national interests. There are no compelling national interest in Ukraine.
I desparately want to be wrong. but the evidence suggests that barring a miracle – Russia can force a war of attrition, and that will slowly
destroy Ukraine.
It is near certain there will be a peace deal in Ukraine – and soon. It is unlikely that Biden will do much prior to the election because any deal is going to be a large loss of face on his part. Biden promised a Russian defeat. We could have abandoned Ukraine early on
at little cost and an enormous savings in lives. Instead we persuaded Ukraine to fight on – that we would help them Win.
Biden owns that. He can not get a peace deal with will not look bad.
Further one of the things Trump proved in his first term is that he is the penultimate deal maker.
His ego is not tied to crushing Putin and he is a far better deal maker than Biden. Possibly than anyone arround.
Regardless, Ukraine is not going to be able to defeat Russia without some other major country putting boots on the ground.
The US is not doing that. If you actually want to see Russia defeated on the Battle field, Europe is going to have to do it.
Europe is going to have to pay for it in blood – the US will supply much of the Treasure.
I do not think that is happening.
Every single moral argument you make regarding the US applies to Europe also.
But Ukraine IS in Europes interest. Though even that is complicated. A bloody war of attrition that destroys Ukraines and weakens Russia is as much in Europe’s interest as A Ukrainian defeat of Russia.
What likely tips the balance is fossil Fuels. Europe needs energy supply stability in Russia and the mideast. Without that Europe is a US Vasal. Dependent on US provided energy imports. One of the reasons it is likely the US blew up Norde Stream is because them cemented European dependence on US energy.
Regardless, at this point any likely outcome in Ukraine is in US interests.
The defeat of Putin with European Troops works for the US.
A deal works for the US – though it does NOT work for Biden.
A war of attrition in which Ukraine is destroyed and Russia is dramatically weakened works for the US.
OAD – as I noted we are int he midst of massive political shifts – in the US, as well as globally.
The US is NOT going to need the help of Europeans in the future. US concerns about Europe and Russia and the Mideast in the future of my children are going to be greatly diminished. For the most part we hope for relative peace, little US involvement and managing the collapse of Russia without releasing Nukes tot he world. That is it. Otherwise we have little reason to care about Europe, Russia, and the Mideast anymore.
While I am not talking the US total abandonment of those regions – they are no longer in our national interests.
That means we will increasingly NOT take the lead in anything. We will maintain cordial relations with Europe. We will trade with Europe.
We will provide Europe with material to allow them to maintain peace in Europe, Russia, and the mideast.
But we are NOT going to continue the role we played from the 70s through today.
As to Trust in the US – the nations in the pacific – the area with the greatest danger of a meaningful conflict – already do not trust us.
While Trump brought them together – something that was only a matter of time anyway. And they are all greatful for the US participation and lead, Taiwan, Japan, Vietnam, Philipines, Malasyia, India, Australia, and New Zealand have the united ability to containe China WITHOUT the US – it will just be far less bloody with us. Japan has already made it clear an attack on Taiwan will be treated as an attack on the Japanese home islands. That is a big deal and a huge threat.
Despite labels China is not communist today – not even close.
The best model of the Chinese political/economic system since Xi took power is Fascism – not communism.
If we want to make global hitler references – the best fit is China under Xi.
Europe and the mideast are NOT the great geopolitical danger spot today – Asia is.
While I beleive the danger of China invading Taiwan is “low”, it is concurrently the highest it has ever been.
And should China even attempt that, it will disrupt the entire world in ways that Russia/Ukraine does not come close to.
China is concurrently by far the most powerful nations in the world after the US, and at the same time the most vulnerable nation in the world.
30% of China’s economy is global trade. A war would tank that instantly.
China already has massive economic and demographic problems.
That is a significant factor making them dangerous right now – powerful nations with internal problems are tempted to solve them by starting external conflicts.
Regardless, if you are worried about where american blood might be shed in the future – look to Asia.
The ODDS favor a peaceful decline of China – but the consequences of being wrong make the conflict in Ukraine look like nothing.
Regardless we are not going to need Europe to deal with China. We are going to need the rest of Asia.
Those nations do not need to Trust the US. It is in their interests to contain China. It is also in ours.

I have participated in lots of debate and discussion on voting since 2000. Long before the 2020 predictable debacle.
While I agree with you that we need to vote
at the polls on election day
only in the precinct where we live.
with paper ballots counted by hand
in small precincts not collesuems,
with the press and observers for both parties
on ballots preprinted by the state prior to the election and handled like currency
With filled out ballots staying in the precinct where they were cast.
With all results being released almost concurrently within the state – or the nation for national elections.
The reasons for doing so is that is the simplest and easiest system that can be trusted by ordinary people.
If you have precincts with about 15,000 voters that you close at 8pm on election day – nothing precludes those ballots being counted by hand by midnight on election day.
It is more important that super majorities of people trust the election than that it is actually conducted well or without fraud.
That said – There is no way to use voting terminals that can be trusted.
But it is possible to use tabulators in a fashion that we can trust.
That is actually quite easy.
Provide in near real time (you can not do real time without violating secret ballot requirements), the totals from each machine – PUBLICLY.
This allows machines that behave anomolously to be identified.
I would also catch people running the same ballot or batches of ballots repeatedly.
It also allows exit polls to be compared to precint results.
When there is a significant discrepancy – that should trigger an investigation.
Randomly audit tabulators. This is relatively easy. If you have 10,000 tabulators in a state, randomly select 500 and by hand count the ballots from those machines – if there is a significant discrepancy – conduct a full audit of all machines anywhere there is a discrepancy.
I would note GA was supposed to do that in 2020 – But Raffensberger killed it. This was not some after the election proposal. It was part of the pre-2020 election plan.
But No one wants evidence of problems with voting machines to come to light.
As I noted above – you can secure tabulators and they are convenient.
But they are NOT necescary.
As I understand this is actually a Democratic lawsuit brought regarding problems in the 2018 Election.
Democrats are for election integrity – except when they are against it.
But Raffensberger is not the least hypocritical. He wants garbage elections ALWAYS.
Raffensberger tanked a GA provision for Random audits of elections – because it would cost $12M/election.
Random audits are one of the most powerful tools against most election problems.
It does not matter how bad the equipment is. or how vulnerable.
If you increase the likelyhood of catching fraud, you radically diminish its likelyhood – even where it is easy.
Finally I would note that from 2000-2019 Democrats have near universally opposed the use of computers and tabulators in elections.

I can explain to you why every claim you make is a stupid lie. But it actually would not matter if they were true – you have lost credibility and whether you are lying again or telling the truth – no one beleives you any more.
