Below is my column in Fox.com on the recent suggestion that Justice Sonia Sotomayor should step aside for a younger justice in the interest of extending a liberal voting block on the Supreme Court. It is part of a growing number of calls for changing the Court that range from buying out justices to sweating them out.
Here is the column:
“I live in frustration ... To be almost 70 years old, this isn’t what I expected.” Those words from Justice Sonia Sotomayor appear to resonate with some liberals, but not in the way intended by the jurist. Some activists and journalists are beginning to nudge Sotomayor to leave the Court in order to be replaced by a younger jurist, much as was done to Justice Stephen Breyer in 2021 and 2022.
On CNN, journalist Josh Barro bluntly wondered why Sotomayor remains on the bench when younger jurists could be brought on to guarantee a liberal vote for years to come. He indicated that many liberals are frustrated with her for not stepping down: “I find it a little bit surprising, given what Justice Sotomayor describes there about the stakes of what is happening before the Supreme Court, that she’s not retired. She’s 69 years old, she’s been on the court for 15 years.”
Sotomayor gave her frank assessment of being “tired” and “frustrated” during an appearance at University of California’s, Berkeley. She suggested that the Supreme Court’s conservative majority contributes to her daily burden. It was a notable interview not only for its content but for its moderator, UC Berkeley Law Dean Erwin Chemerinsky.
Chemerinsky previously shocked many in the legal community by denouncing Sotomayor’s six conservative colleagues as “partisan hacks.” In response to Chemerinsky’s probing, Sotomayor took an implied swipe at her colleagues and declared: “I live in frustration. Every loss truly traumatizes me in my stomach and in my heart. But I have to get up the next morning and keep on fighting.”
She added that the workload is overwhelming: “There used to be a time when we had a good chunk of the summer break. Not anymore. The emergency calendar is busy almost on a weekly basis.”
Many clearly would like to see her lessen that load by following the pattern of former liberal colleague, Justice Breyer, who retired in 2022. Demand Justice, a liberal group that has pushed court–packing as a solution to the Court’s conservative majority, drove a billboard truck through the streets of Washington with slogans like “Breyer, retire. Don’t risk your legacy.”
At 69, Sotomayor shows no signs of mental decline. She has been a highly effective justice, stepping into the vacuum created by the death in 2020 of Justice Ruth Bader Ginsburg. Of course, few ever questioned the “Notorious RBG” in her decision to stay on the Court, despite her much older age and longer tenure. While some of us noted that Ginsburg was taking a huge risk in not allowing then-President Barack Obama to pick a successor, she remained on the Court in spite of medical problems and ultimately was replaced by Justice Amy Coney Barrett.
Ginsburg, however, was almost 20 years older than Sotomayor. There is no concern for deterioration or death on the bench in Sotomayor’s case. It is simply a matter of swapping out justices like light bulbs before they burn out.
The grumbling from the left reflects the raw political calculations that are now commonly applied to the Supreme Court. Justices are treated as cutouts for partisan outcomes; the worth of a justice is now largely seen as her potential longevity rather than her jurisprudence. Sotomayor‘s seat is viewed as a lock for liberals, who want to trade for a new model before the new year (and a possible Republican president)
None of this is surprising in a time when law school deans have called
Seton Hall Law Assistant Dean Brian Sheppard treated such turnovers on the Court in strictly transactional terms, calling for Congress to “buy out” justices by offering them “large sums of money.”
Georgetown Law Professor Josh Chafetz and others are interested in taking a more active approach to making continuation on the Court as unpleasant as possible — at least for conservatives. Chafetz previously declared that the “mob is right” in targeting and harassing justices, and he told a law school panel in 2022 that “I want to suggest that courts are the enemy, and always have been.” He suggested that Congress should retaliate against conservative justices by considering the withdrawal of funding for law clerks or even “cutting off the Supreme Court’s air conditioning budget.”

Apparently, it is better to do that than wait for some biological clock to toll. By cutting off the air conditioning daily and harassing justices at home nightly, activists may finally induce some jurists to flee the Court.
These are the voices that dominate at some of our leading law schools, teaching students that opposing views should not be tolerated on our highest court. Doerfler is correct about one thing: There is nothing laughable about what they are suggesting. We must decide as a people if we will protect our courts or will reduce their makeup to a simple matter of turning up a thermostat.

Why stay or return home to be with your family and countrymen where you can be happy, never complain, and build and establish your own fundamental law and your own country when you can come to America and have this entire country and everything you dream of and desire confiscated from Americans and handed to you on a silver platter?

Then they are dead. How do we know how the economy is doing? We are both heavily involved in the economy. We can see the present and recognize those things that are dangerous to the future. Anyone interested can do that, but only a few of our corporations think long-term, caring only about what they get. To them, tomorrow is someone else’s problem.

She’s on a court that has thrown stare decisis in the garbage can, she’s on a court that does nothing when her fellow jurists take and receive money and vacations from close personal friends. She’s going to watch the conservatives flip 180 on constitutional “originalism” and “textualism” when it serves their purpose to protect Trump. And she watching fundamentalists’ so-called Christians flood the court with wish lists tearing apart the separation of church and state. And that’s just a couple of reasons, no wonder it’s not what she expected.

We went from gay marriage, a change I supported before Biden, Obama or the Clintons, to demanding that men compete against women in sports, men be allowed to parade around with an erection in a spa in CA because they say they are a woman. to felonious men claiming to be a woman and being sent to women’s prison where they rape women, real women. I recall hearing a NPR article about how terrible it was for trans convicts, who could not get into women’s prisons.
They did mention a women’s rights group fighting against trans men in women’s prisons in the failed state of CA.
What the left OUT was the fact several women were raped by those men pretending to be women and that is why the women’s rights group was doing the fighting.

How ignorant are we? There is a very good reason that the Supreme Court can never be assembled as a partisan divided institution! The reason is actually very simple, the Constitution of the United States, like the Articles of Confederation before it, is a participation versus compliance agreement between the States to form the Union, and it must establish the benefits, privileges, rights of participation in decision making, and cost of membership in the Union. And because the States have agreed to comply with all the decisions they make together as a Union, there must be a conflict and dispute resolution agreement when decisions are made by a properly assembled and properly operated legislature disenfranchise or otherwise affect one or more States disproportionately. The process for resolving these conflicts and disputes must be agreed to by all the States because they also agree to abide by the decision to resolve their differences. This is where the Supreme Court comes into play.
Since all the States are agreeing to abide by the decisions of the Supreme Court, they must also participate in assembling a court by consensus agreement, and the only way to do that is by the process established by Article 9 Clause 2 of the Articles of Confederation:

The united states, in congress assembled, shall also be the last resort on appeal, in all disputes and differences now subsisting, or that hereafter may arise between two or more states concerning boundary, jurisdiction, or any other cause whatever; which authority shall always be exercised in the manner following. Notice it’s impossible to assemble a partisan or biased court, and all petitions for redress must be made to Congress, all decisions are final and cannot be overturned, because it is the last resort on appeal, and all the States must participate in assembling the court. Also notice that there must be a pool of no less than 7 and no more than 9 judges and only 5 judges are chosen by lot starting with the partitioner to hear and decide the dispute, and that does not include the Chief Justice who presides over the proceedings, they do not participate in the proceedings.
The only things that changed with the adoption of the Constitution of the United States was that the pool of judges was continually seated with the “Good Behavior Clause”, the addition of the Chief Justice to preside, and the President to make nominations for replacements when vacancies occur, a number and required qualifications each nominee must possess determined by the States as they are assembled in the Senate through their rules for their proceedings, if you are wondering that falls under the advice part of the appointment process, then the States deliberate those candidates qualifications and suitability and determine a choice by vote, 1 vote per State, and a majority of all the States is necessary to the choice, that is a consensus choice, legislative process, the consent part of the appointment process, then the President is empowered to appoint that choice.
I understand that we are a naive and basically ignorant society, but we all should be able to understand that partisan is not collective, and in the United States we have a collective governing system based upon distributed power, not a consolidated system based upon individual power determined by competitive partisan elections to establish the composition and control of our governing institutions.
