Raskin and the Agents of Chaos: Democrats Prepare to Resume Disqualification Efforts in Congress

Calling it “one on a huge list of priorities,” Rep. Jamie Raskin (D., Md.) announced that he will be reintroducing a prior bill with Reps. Debbie Wasserman Schultz and Eric Swalwell to disqualify not just Trump but a large number of Republicans from taking office.

The alternative, it appears, is unthinkable: allowing the public to choose their next president and representatives in Congress. It appears that the last thing Democrats want is for the unanimous decision to actually lead to an outbreak of democracy. Where the Court expressly warned of “chaos” in elections, Raskin and others appear eager to be agents of chaos in Congress.

Soon after the decision, Raskin went on the air at CNN to assure people that he and his colleagues would not stand by and allow the right to vote be restored to citizens in the upcoming election. He pledged to offer a prior bill that would declare Jan. 6 an “insurrection” and that those involved “engaged in insurrection.”

I previously wrote about these “ballot cleansing” efforts because it would not just disqualify Trump but potentially dozens of sitting Republican members of Congress. Rep. Bill Pascrell (D-NJ) sought to bar 126 members of Congress under the same theory. Similar legislation offered by Rep. Cori Bush (D-Mo.) to disqualify members got 63 co-sponsors, all Democrats.

Raskin’s participation in this effort is crushingly ironic. In 2016, he sought to block certification of the 2016 election under the very same law as violent protests were occurring before the inauguration.

The prior bills were sweeping and included members who did not engage in any violent acts (no member has been charged with such violence or even incitement) but merely opposed certification.

Raskin recently offered a particularly Orwellian argument for the disqualification of Trump and his colleagues in Congress: “If you think about it, of all of the forms of disqualification that we have, the one that disqualifies people for engaging in insurrection is the most democratic because it’s the one where people choose themselves to be disqualified.”

In other words, preventing voters from voting is “the most democratic” because these people choose to oppose certification . . . as he did in 2016.

After the ruling, Raskin added the curious claim that the justices “didn’t exactly disagree with [the disqualification theory]. They just said that they’re not the ones to figure it out. It’s not going to be a matter for judicial resolution under Section 3 of the 14th Amendment, but it’s up to Congress to enforce it.”

That was sharply different from the pre-decision Raskin who insisted that there was no real question legally and that the case before the justices was “their opportunity to behave like real Supreme Court justices.”

Well, they did act as “real Supreme Court justices” by unanimously opposing what the Court described as the “chaos” that would unfold with such state disqualification efforts.  Raskin, however, is seeking a new avenue for chaos through Congress.

Raskin’s statement is also bizarre in claiming that somehow the justices agreed with him and the others pushing disqualification. No one, not even the Trump team, questioned that Congress could act to bar people from office. It is expressly stated in the Constitution. It is not an “argument” but a fact.

Of course, the Democrats would need to craft the legislation correctly to satisfy the standard and secure the support of both houses. Neither appears likely at this point.

However, Raskin is succeeding in one respect. He and his colleagues have bulldozed any moral high ground after January 6th. Most of us condemned the riot on that day as a desecration of our constitutional process. Yet, the Democrats have responded with the most anti-democratic efforts to prevent voters from exercising their rights in the upcoming election.

For these members, citizens cannot be trusted with this power as Trump tops national polls as the leading choice for the presidency.  It is the political version of the Big Gulp law, voters like consumers have to be protected against their own unhealthy choices.

Raskin has continued to accuse the nine justices of being cowards in not supporting ballot cleansing. He told CNN that the court “doesn’t like the ultimate and inescapable implications of just enforcing the Constitution, as written.” In other words, all nine justices, including the three liberals justices, are disregarding clear constitutional mandates to protect Trump.

It is the same delusional view echoed by other liberals who were enraged by the decision. Former MSNBC host Keith Olbermann declared that “the Supreme Court has betrayed democracy. Its members including Jackson, Kagan and Sotomayor have proved themselves inept at reading comprehension. And collectively the ‘court’ has shown itself to be corrupt and illegitimate. It must be dissolved.”

After all, nothing says democracy like ballot cleansing and dissolving courts before a national election.

With the resumption of efforts to disqualify Republicans from running on ballots, Raskin and his colleagues seem to be channeling the spirit of former Mayor Dick Daley in the 1968 Democratic convention in Chicago.

With allegations of abuse by the police in cracking down on protests, Daley declared “the policeman isn’t there to create disorder; the policeman is there to preserve disorder.” With Democrats preparing to return to Chicago for their convention this year, Raskin and others appear to be responding to the Court that “the party isn’t there to create chaos, the party is there to preserve chaos.”

  1. ‘I’m not gonna lie, I want to watch the State of the Union simply because I think this is when the drug cocktail team is gonna really go overboard with the mix.’ @Oilfield_Rando

Ha! Plan to watch Biden’s ‘State of Hate Address’ just out of morbid curiosity
to see how OPEN WIDE Biden’s drug-induced, normally squinty, plastic surgery’d eyes will be
as he speed mumbles and slurs his words
in between his angry old man demented yelling of lies upon lies…
    and bizarro world lean-in-whispers….
    it’s gonna be a hoot..
to watch another lie-filled Biden Hate of the Union speech…..
maybe Speaker Johnson will do something disruptive….
like tear up Biden’s speech in a dramatic fashion….a al Pelosi style disrespect

    1. A SOTU question all Americans want answered…

What’s in the shot they are fixing to jab Biden with before the speech tomorrow?

What is in Biden’s pre-speech drug cocktail?

  2. Democrats are for free and fair elections, as long as you vote Democrat.

They oppose all efforts at securing elections.

  3. Again, Democrats abuse positions of authority to meddle in elections and strike out at their political opponents.

Someone explain to me how Trump could be an insurrectionist for telling people at his rally to “peacefully make their voices heard”, but Democrats are not insurrectionists for urging on the BLM and Antifa rioters who looted, burned, assaulted police officers, bombed federal buildings, burned a police precinct to the ground, seized entire city blocks and kept out police, fire, and EMT in the CHOP/CHAZ zone?

Why was storming the Wisconsin Capitol praised by Nancy Pelosi, who condemned Jan 6?

The Trump rally was peaceful, and occurred blocks away from the Capitol building. A group left the rally before it ended, and proceeded to the Capitol. Capitol police let many of them in, telling them not to break anything. Most of those there thought they then had permission to be there, which was why they were smiling and taking selfies. A group broke away from them, and broke the law, by breaking into offices, and damaging property. A subset of that group tried to force their way to the Senate Floor to protest, and one of them was shot and killed.

I guess they should have been wearing red Handmaid cloaks, and it would have been okay?

The US is already a de facto Single Party, Democrat-Controlled State, because Democrats control all of the three letter agencies. It barely matters who sits in the White House. Trump was persecuted by Democrats in power for his entire presidency, and afterward. It’s what grew his support, in spite of his personal flaws.

  4. “. . .’ballot cleansing’ efforts . . .”

Here’s one way to know that you’re dealing with those possessed by tyrannical urges:

Disqualification from the ballot does *not* require due process of the law.

Pray tell, then: Exactly *how* is such disqualification to be decided? What is that process? Seance? Group feelings? MSM decree?

    1. All acts of government require due process.
All acts of govenrment are acts of FORCE.
All acts of government either infringe on the rights of an individual, or they infringe on the rights of all of us.

Due process is required to assure that those acts are justified, and constitutional.

      1. America was “fundamentally transformed” into communism by “Crazy Abe” Lincoln, who took the law into his own hands and denied not-prohibited and fully constitutional secession. All subsequent acts of Lincoln and his successors remain invalid, illegitimate, illicit, and unconstitutional, from the Civil War to the suspension of habeas corpus, through the confiscation of private property to the failure to enforce borders and extant immigration law, ultimately installing an unassimilable, inimical, foreign, four-million-man, standing army on U.S. soil, and the “Reconstruction Amendments.”

  5. Ahh yes. The old redefine/rebrand trick. The tried and true cultural revolution style coup standard.
Criminalize The First Amendment by defining the exercise of The Right to Redress and The Right of Assembly as insurrection.
The rebrand trick worked so well on lesser players like parents objecting to their children being raped in school and old ladies praying the rosary that merit terrorist designations guess Jamie and his comrades in communism decided to go for the whole enchilada in one fell swoop by seizing absolute power via legislature fiat with a handy dandy weaponized act to take out The Peoples elected representatives that threaten Jamies vision of absolute power he feels government is entitled to and begin the arrests and removals on the floor of The Capitol.
Just one little problem. When Jamie and his comrades alter The Constitution by reinterpretation of It’s meaning and validity, doesn’t that also alter the source of his authority to govern? If that’s the case then that leaves him only with the authority that comes from the barrel of a gun to defend and hold the newly acquired position of his newly in place governments authority to rule.
And he and his comrades must either use it or lose it….And that probably won’t go over well with the hundreds of millions of armed Americans who are also onto that power from the barrel of a gun thing.

  6. I wonder if Raskin has chosen to ‘accelerate’ his effort to deny Trump the presidency in 2024 because Raskin had a serious brush with the Big “C” – cancer.
Raskin now certain of his mortality in ways only a 1st-time cancer survivor can understand.

  7. Professor Turley Writes:

Most of us condemned the riot on that day as a desecration of our constitutional process.
    …………………………….

One presumes there is a clip of Turley warning that Trump risked legal jeopardy. That’s something Turley might feel secure to say, as a law professor, to preserve his integrity.

But I don’t remember a single column where Johnathan Turley described the ‘Real Donald Trump’.

Instead Turley writes about the theoretic Donald Trump. A billionaire celebrity hugely successful in politics.

But in this ‘age of rage’, crybaby liberals are hurt by Donald Trump. So he’s been the target of serious hatred and nuisance prosecutions.

Turley never phrases it quite in these terms. But the subtext goes pretty much like that. As though Donald Trump is really not that onerous.

In Johnathan Turley’s America no reasonable adult would hate Donald Trump. Not like Hunter Biden! Now there’s someone to watch!!

    1. Do you have something rational to say ?

None of us are obligated to warn others ahead of time with respect to things third parties think they MIGHT do.

As to measuring Trumps success – can you name a US politician who won the presidency of the united states the first time they ran for office ?
That is pretty much the definition of “hugely successful in politics.”

Avoiding accusations of weaponizing politics is easy – do not weaponize politics.
Trump is not 8m votes ahead of Biden right now – because of his MAGA Base,
He is not leading because of the 10’s of millions who love him.
He is leading because millions of people beleive he is less bad than democrats.
That is a problem of the lefts own making

I do not think anyone here agrees 100% with Turley.

But most of us listen respectfully – because Prof. Turley has earned that respect.
Sometimes we disagree passionately. But that does not alter our respect for Turley.

Those here – left and right – but almost exclusively left, who insist on lobbing ad hominem grenades at Turely discredit themselves.

Few here will fault you for disagreeing with Turley or anyone else.

But if your posts are juvenile insults rather than arguments. Please go away.
“no reasonable adult would hate Donald Trump.”
According to the left it is conservatives who are the hateful, hating haters. Yet here you are arguing that people should hate other people.
      Your drowning in hypocracy.

I though the left posts sings that say “Hate has no home here”
Clearly you do not mean anything you say.

“Not like Hunter Biden! Now there’s someone to watch!!”

Almost no one cares about Hunter Biden. But for his powerful father he would be another of the myriads of hedonitic failures who ruined their own lives that no one notices, likely languishing in Jail.

What matters about Hunter is that he is the lead agent selling out the public power of Joe Biden to the highest bidder.

Drug addicts – even ones with million dollar a year habits – do not come to the attention of congress and are quickly dispatched by the DEA.
Tax Cheats face jail of draconian penalities – in short order, not after years and years.

All this happened – and no one notices. Unless they are brokering the public power of an elected official to the highest bidder.

  8. We should pay attention to proff pape of Chicago – who tracks j sixers and only 10% of defendants have ever oatthed before -0. Oh so jermus bill would throw under the bus the veterans who at 18 took an oath and a contract to die for USA just to get trump=
Sick sick man. Moreover the supremes had non the peons in front of it to decide their fate – but I’m sure they’d say leave it to congresscongress. Who writes the soldiers and sailors act who doesn’t throw vets under the bus just to get rid of donald.better despite the court saying maybe states can decide about state offices -which lawyers are states can’t even get at lawyers since the supreme court is place of review-0so indeed raskins only oath is to through vets under the bus-0 does he have support for that-whowhowho

  9. I have been doing some thinking about how one would go about proving massive voting fraud. Here is one way votes are stolen, in Pennsylvania:

PHILADELPHIA – United States Attorney Jennifer Arbittier Williams announced today that former U.S. Congressman Michael “Ozzie” Myers, 79, of Philadelphia, PA, pleaded guilty today to conspiracy to deprive voters of civil rights, bribery, obstruction of justice, falsification of voting records, and conspiring to illegally vote in a federal election for orchestrating schemes to fraudulently stuff the ballot boxes for specific Democratic candidates in the 2014, 2015, 2016, 2017, and 2018 Pennsylvania elections.

    39th Ward, 36th Division

Specifically, Myers admitted in court to bribing the Judge of Elections for the 39th Ward, 36th Division in South Philadelphia, Domenick J. Demuro, in a fraudulent scheme over several years. Demuro, who was charged separately and pleaded guilty in May 2020, was responsible for overseeing the entire election process and all voter activities of his Division in accord with federal and state election laws.

The voting machines at each polling station, including in the 39th Ward, 36th Division, generate records in the form of a printed receipt documenting the use of each voting machine. This printed receipt, also known as the “results receipt,” shows the vote totals, and the Judge of Elections and other Election Board Officials at each polling place attest to the accuracy of machine results.

Myers admitted to bribing Demuro to illegally add votes for certain candidates of their mutual political party in primary elections. Some of these candidates were individuals running for judicial office whose campaigns had hired Myers, and others were candidates for various federal, state, and local elective offices that Myers favored for a variety of reasons. Myers would solicit payments from his clients in the form of cash or checks as “consulting fees,” and then use portions of these funds to pay Demuro and others to tamper with election results.

After receiving payments ranging from between $300 to $5,000 per election from Myers, Demuro would add fraudulent votes on the voting machine – also known as “ringing up” votes – for Myers’ clients and preferred candidates, thereby diluting the value of ballots cast by actual voters. At Myers’ direction, Demuro would add these fraudulent votes to the totals during Election Day, and then would later falsely certify that the voting machine results were accurate. Myers is also accused of directing Demuro to lie to investigators about the circumstances of the bribes and the ballot-stuffing scheme.

    39th Ward, 2nd Division

Myers also admitted to conspiring to commit election fraud with a former Judge of Elections for the 39th Ward, 2nd Division in South Philadelphia, Marie Beren. Beren, who was charged separately and pleaded guilty in October 2021, was the de facto Judge of Elections and effectively ran the polling places in her division by installing close associates to serve as members of the Board of Elections. Myers admitted that he gave Beren directions to add votes to candidates supported by him, including candidates for judicial office whose campaigns actually hired Myers, and other candidates for various federal, state, and local elective offices preferred by Myers for a variety of reasons.

Myers acknowledged in court that on almost every Election Day, Myers transported Beren to the polling station to open the polls. During the drive to the polling station, Myers would advise Beren which candidates he was supporting so that Beren knew which candidates should be receiving fraudulent votes. Inside the polling place and while the polls were open, Beren would advise actual in-person voters to support Myers’ candidates and also cast fraudulent votes in support of Myers’ preferred candidates on behalf of voters she knew would not or did not physically appear at the polls.

During Election Day itself, Myers conferred with Beren via cell phone while she was at the polling station about the number of votes cast for his preferred candidates. Beren would report to Myers how many “legit votes,” meaning actual voters, had appeared at the polls and cast ballots. If actual voter turnout was high, Beren would add fewer fraudulent votes in support of Myers’ preferred candidates. From time to time, Myers would instruct Beren to shift her efforts from one of his preferred candidates to another. Specifically, Myers would instruct Beren “to throw support” behind another candidate during Election Day if he concluded that his first choice was comfortably ahead.

Beren and her accomplices from the Board of Elections would then falsify the polling books and the List of Voters and Party Enrollment for the 39th Ward, 2nd Division, by recording the names, party affiliation, and order of appearances for voters who had not physically appeared at the polling station to cast his or her ballot in the election. Beren took pains to ensure that the number of ballots cast on the machines was a reflection of the number of voters signed into the polling books and the List of Voters. After the polls closed on Election Day, Beren and her associates would falsely certify the results.

    1. And, about 20 years before that:

Saying Philadelphia’s election system had collapsed under “a massive scheme” by Democrats to steal a State Senate election in November, a Federal judge today took the rare step of invalidating the vote and ordered the seat filled by the Republican candidate.

In making such a sweeping move, the judge, Clarence C. Newcomer of Federal District Court here, did for the Republicans what the election had not: enable them to regain control of the State Senate, which they lost two years ago.

Judge Newcomer ruled that the Democratic campaign of William G. Stinson had stolen the election from Bruce S. Marks in North Philadelphia’s Second Senatorial District through an elaborate fraud in which hundreds of residents were encouraged to vote by absentee ballot even though they had no legal reason — like a physical disability or a scheduled trip outside the city — to do so.

In many instances, according to Republicans who testified during a four-day civil trial last week, Democratic campaign workers forged absentee ballots. On many of the ballots, they used the names of people who were living in Puerto Rico or serving time in prison, and in one case, the voter had been dead for some time.

“Substantial evidence was presented establishing massive absentee ballot fraud, deception, intimidation, harassment and forgery,” Judge Newcomer wrote in a decision made public today.

The district, which includes white, black and Hispanic neighborhoods, is overwhelmingly Democratic by registration. Nonetheless, campaign workers testified that widespread voter apathy had prompted them to promote a “new way to vote” to insure a victory. Door to Door for Votes

In addition to specific instances of wrongdoing, the state Republican Party, which filed the suit, contended that the door-to-door solicitation of votes by the Democrats was not permissible under the state election code, which says the Philadelphia County Board of Elections “shall deliver or mail” the ballots to a voter.

The city, whose lawyers represented the board of elections, contended that the statute was open to broad interpretation, but throughout the hearing Judge Newcomer made it clear that he did not agree.

Indeed, the two Democrats on the three-member board of elections, an elected body, testified that they were aware of the voter fraud, had intentionally failed to enforce the election law and had later tried to conceal their activities by hurriedly certifying the Democratic candidate as the winner.

Judge Newcomer ordered that Mr. Stinson, a 49-year-old former assistant deputy mayor of Philadelphia, be removed from his State Senate office and that Mr. Marks, a 36-year-old lawyer and former aide to United States Senator Arlen Specter, be certified the winner within 72 hours.

    2. Meanwhile the president takes an oath to preserve and defend the constitution but someone else boils that down to not enough fraud to overturn.

  10. When I was in El Salvador in the late 70’s early 80’s, there were Right wing death squads. At the time I thought, Oh how horrible. Now after watching these Commies destroy America I have a better understanding of their efforts.

    1. As a young man I was affected by the documentary Roses in December. However later in life I realized it included a dose of leftist propaganda. Regardless I think the current very smart president of that country is on the right track.

      1. I was there when that happened living in a LaLibertad barrio casa Morales. Americans have never seen anything like what was happening there, poverty, Cuban Communists and Napoleon Duarte.

  11. Democrats: (1) people shouldn’t be able to vote for the candidate of their choice, (2) the razor wire securing our border should be taken away, (3) the police should be defunded and violent criminals should be set free to victimize others, (4) affordable energy shouldn’t be available to the poor because climate change, (5) we should bankrupt America and secure a border half way around the world that has no relevance to our vital national interests and which belongs to a nation with which we have no security treaty, (6) our president should be a geriatric patient with advanced dementia.

  12. Professor Turney, Well Articulated and Spot On….!! It seems that the anti-American ‘Manchurian Candidate’ programming that started out in Joe’s Basement in 2020 has now spread to a lot of the Lieutenants.. like Jamie… ludicrous.. yet dangerous.. and totally pathetic…

    1. Jamie has been Manchurian since at least his college days (I was in the same dorm as him for two years).

  13. Some explain to me how Trump telling protestors to make their voices heard peacefully is insurrection, but Joe Biden and Kamala Harris actively encouraging riots, arson, and looting, even going so far as to bail rioters out of jail, was not.

How is it treason for Republicans to complain about stolen elections and election interference, but not when Democrats do the same for every election they lost?

How were Jan 6 rioters supposed to take over the entire US? With blue face paint and selfies? We’re actually to believe that protesting election interference is tantamount to trying to overthrow the government, but burning major cities is not.

Democrats are already positioning themselves to try to overthrow Trump if he wins in 2024, so I suppose “election denying” will no longer be treason if Trump wins?

    This is irrational politicking.

    1. 1.”fight like hell or you’re not going to have a country anymore.” 2. Planning meetings at the Willard Hotel. 3. Reconnaissance trips by the Proud Boys, witnessed by an embedded reporter. 4. Stash of weapons in a Virginia hotel room across the Potomac, waiting for the call from Trump. 5. “Frankly. We did win by a lot “—a proven big fat lie. 6. “Stop the Steal” tours, lying to fans and telling them to come to Washington on Jan 6, promising “it will be wild”. 7. Neither Joe nor Kamala encouraged anyone to riot.

Democrats do NOT steal elections. The insurrection was about stealing power from the rightfully elected President, based on a big fat lie, wrongfully trying to seize power against the will of the American people. “Protesting election interference“? WTF are you talking about? Trump isn’t going to “win “ in 2024, just like he didn’t win in 2020, and lost the popular vote in 2016.

          1. Essentially, all of the arguments that Trump incited tHe Insurrection®™ boil down to this.

Trump promoted Badthink®™, and because some people rioted on the basis of Badthink®™, that was an insurrection and Trump incited it.

Some may argue this applies to Patrice Cullors, Nikole Hannah-Jones, Charles M. Blow, and many others. After all, they chanted, “Hands Up, Don’t Shoot”. They claimed that the police habitually hunt down and gun down unarmed Black men. They claimed the criminal justice system is systemically racist. And some people rioted on this basis.

It would apply if this principle was enforced in an even-handed manner. But the same side that says that Trump was promoting Badthink®™ also believe that Cullors, Jones, and Blow were promoting Goodthink®™, and those who rioted based on this Goodthink®™ were not engaging in Insurrection®™, but fighting White Supremacy®™

      1. ”fight like hell or you’re not going to have a country anymore.”
So ? Have you listened to the comments of democrats ?
Regardless, There is plenty of SCOTUS 1Q decisions to tell us what speech is not protected –
Fight like hell is protected – most every football cause says it about 20 times ever fall.

“Planning meetings at the Willard Hotel.”
First no one trust you – please pprovide sources.

Regardless – meeting with people and planning is not illegal.

“Reconnaissance trips by the Proud Boys”
Again irrelevant and further debunked long ago.

“Stash of weapons in a Virginia hotel room across the Potomac, waiting for the call from Trump.”
By stash – you mean 1 or two.
There were not enough firearms brought to DC by Trump supporters to take over a Starbucks, much less the US Capitol.

Also – do you actually think about these claims ?
If you are looking to stage a coup – you go in hard and fast with as much as possible at the start.
You Do not send in a bunch of guys to break windows, engage in a shoving match for an hour and only then “send in the troops”

This is a common left wing nut problem – you propose these alleged right wing conspiracies – that only an idiot left wing nut would seriously think about.

“Frankly. We did win by a lot “
        Sounds fine to me.

        “Stop the Steal”
Can I buy a “Stop the Steal” t shirt ?

“Neither Joe nor Kamala encouraged anyone to riot.”
Actually yes they did – but Trump did NOT.

        “Democrats do NOT steal elections.”
        ROFL

Look at the mess you have in Georgia – not only is Fanni trying to steal the 20204 election – she was trying to personally profit from it.

“against the will of the American people”
Certainly Biden is president against the will of about 75M voters.

“WTF are you talking about? Trump isn’t going to “win “ in 2024”
Trump is winning the popular vote by about 8M votes right now.
He is winning all 6 swing states COMMANDINGLY.
That lead has been GROWING slowly.
Currently the polling is showing a Trump win that is beyond the margin of Fraud.

It is highly unlikely that Democrats can pull off the election rigging they did in 2020.
While you can successfully censor those living in the blue bubble – those numbers are way down from 2020.
Further Voters get to compare Trump and Biden head to head – and despite your constant idiotic claims about the economy
Voters know the economy sucks and it did not under Trump.

Please do not trot out your stupid lies about Trump and Biden’s economy – we have heard them all before, they are factually false
but more importantly – Voters have rejected them.
