Raskin and the Agents of Chaos: Democrats Prepare to Resume Disqualification Efforts in Congress

Calling it “one on a huge list of priorities,” Rep. Jamie Raskin (D., Md.) announced that he will be reintroducing a prior bill with Reps. Debbie Wasserman Schultz and Eric Swalwell to disqualify not just Trump but a large number of Republicans from taking office.

The alternative, it appears, is unthinkable: allowing the public to choose their next president and representatives in Congress. It appears that the last thing Democrats want is for the unanimous decision to actually lead to an outbreak of democracy. Where the Court expressly warned of “chaos” in elections, Raskin and others appear eager to be agents of chaos in Congress.

Soon after the decision, Raskin went on the air at CNN to assure people that he and his colleagues would not stand by and allow the right to vote be restored to citizens in the upcoming election. He pledged to offer a prior bill that would declare Jan. 6 an “insurrection” and that those involved “engaged in insurrection.”

I previously wrote about these “ballot cleansing” efforts because it would not just disqualify Trump but potentially dozens of sitting Republican members of Congress. Rep. Bill Pascrell (D-NJ) sought to bar 126 members of Congress under the same theory. Similar legislation offered by Rep. Cori Bush (D-Mo.) to disqualify members got 63 co-sponsors, all Democrats.

Raskin’s participation in this effort is crushingly ironic. In 2016, he sought to block certification of the 2016 election under the very same law as violent protests were occurring before the inauguration.

The prior bills were sweeping and included members who did not engage in any violent acts (no member has been charged with such violence or even incitement) but merely opposed certification.

Raskin recently offered a particularly Orwellian argument for the disqualification of Trump and his colleagues in Congress: “If you think about it, of all of the forms of disqualification that we have, the one that disqualifies people for engaging in insurrection is the most democratic because it’s the one where people choose themselves to be disqualified.”

In other words, preventing voters from voting is “the most democratic” because these people choose to oppose certification . . . as he did in 2016.

After the ruling, Raskin added the curious claim that the justices “didn’t exactly disagree with [the disqualification theory]. They just said that they’re not the ones to figure it out. It’s not going to be a matter for judicial resolution under Section 3 of the 14th Amendment, but it’s up to Congress to enforce it.”

That was sharply different from the pre-decision Raskin who insisted that there was no real question legally and that the case before the justices was “their opportunity to behave like real Supreme Court justices.”

Well, they did act as “real Supreme Court justices” by unanimously opposing what the Court described as the “chaos” that would unfold with such state disqualification efforts.  Raskin, however, is seeking a new avenue for chaos through Congress.

Raskin’s statement is also bizarre in claiming that somehow the justices agreed with him and the others pushing disqualification. No one, not even the Trump team, questioned that Congress could act to bar people from office. It is expressly stated in the Constitution. It is not an “argument” but a fact.

Of course, the Democrats would need to craft the legislation correctly to satisfy the standard and secure the support of both houses. Neither appears likely at this point.

However, Raskin is succeeding in one respect. He and his colleagues have bulldozed any moral high ground after January 6th. Most of us condemned the riot on that day as a desecration of our constitutional process. Yet, the Democrats have responded with the most anti-democratic efforts to prevent voters from exercising their rights in the upcoming election.

For these members, citizens cannot be trusted with this power as Trump tops national polls as the leading choice for the presidency.  It is the political version of the Big Gulp law, voters like consumers have to be protected against their own unhealthy choices.

Raskin has continued to accuse the nine justices of being cowards in not supporting ballot cleansing. He told CNN that the court “doesn’t like the ultimate and inescapable implications of just enforcing the Constitution, as written.” In other words, all nine justices, including the three liberals justices, are disregarding clear constitutional mandates to protect Trump.

It is the same delusional view echoed by other liberals who were enraged by the decision. Former MSNBC host Keith Olbermann declared that “the Supreme Court has betrayed democracy. Its members including Jackson, Kagan and Sotomayor have proved themselves inept at reading comprehension. And collectively the ‘court’ has shown itself to be corrupt and illegitimate. It must be dissolved.”

After all, nothing says democracy like ballot cleansing and dissolving courts before a national election.

With the resumption of efforts to disqualify Republicans from running on ballots, Raskin and his colleagues seem to be channeling the spirit of former Mayor Dick Daley in the 1968 Democratic convention in Chicago.

With allegations of abuse by the police in cracking down on protests, Daley declared “the policeman isn’t there to create disorder; the policeman is there to preserve disorder.” With Democrats preparing to return to Chicago for their convention this year, Raskin and others appear to be responding to the Court that “the party isn’t there to create chaos, the party is there to preserve chaos.”

    How is it treason for Republicans to complain about stolen elections and election interference, but not when Democrats do the same for every election they lost?

    How were Jan 6 rioters supposed to take over the entire US? With blue face paint and selfies? We’re actually to believe that protesting election interference is tantamount to trying to overthrow the government, but burning major cities is not.

    Democrats are already positioning themselves to try to overthrow Trump if he wins in 2024, so I suppose “election denying” will no longer be treason if Trump wins?

  3. Jonathan: Moving on. Seeing that you are a big proponent of “free speech” you will love the decision just out of the 11th Circuit. The Court struck down FL Gov. DeSantis’s 2022 “Stop WOKE Act” as an unconstitutional violation of the 1st Amendment.

    The case stems from a challenge to the SWA by two employers who had instituted a D&I training program for staff. Under the SWA that would be prohibited. The Court ruled: “By limiting its restrictions to a list of ideas designated as offensive the Act targets speech based on content. And by barring only speech that endorses any of those ideas, it penalizes certain viewpoints–the greatest First Amendment sin…Banning speech on a wide variety of political topics is bad; banning speech on a variety of political viewpoints is worse”.

    So, finally, the 11th court of Appeals has slapped down DeSantis attack on free speech. He can’t censor businesses simply because he doesn’t agree with what’s being expressed. What’s up next? Challenges to SWA by school teachers? You can take that to the bank!

    So this is a big win for those in FL who take “free speech” seriously. No doubt you will want to cover the 11th Circuit opinion in one of your next columns–maybe not. Now some of us on this blog think “free speech” is a fundamental constitutional right that people like Gov. DeSantis can infringe upon with his crazy laws.     J. Michael Luttig, a conservative former U.S. Court of Appeals judge who co-wrote with Laurence H. Tribe a piece for the Atlantic in August that helped to galvanize interest in the 14th Amendment as a means to disqualify Trump, cited the language of the three liberal justices in their concurring opinion, which critiqued elements of the majority’s decision. The liberals agreed with the conservatives that states should be prohibited from kicking candidates off the presidential ballot under Section 3, while disagreeing with the majority specifying Congress’s role in any disqualification. The standard, Luttig argued, makes it functionally impossible to disqualify insurrectionists from holding federal office.

    “The court today decided that no person in the future will ever be disqualified under Section 3 of the 14th Amendment regardless of whether he or she has engaged in insurrection or rebellion against the Constitution of the United States,” Luttig said. “The decision is stunning in its overreach.”

    The court’s Federalists went beyond the immediate issue to say Congress needs to define ‘insurrection’, knowing damn well that Congress can’t even pass a budget. In this regard the court has essentially bucked the matter to a ‘functional’ Congress that doesn’t exist; the perfect strawman for a disingenuous court.

    Like, “Yeah, we passed it on to Congress. Whether they act or not is none of our business.”

    Meanwhile, those of us who watched January 6th unfold in real time are left to wonder if the Federalists were visiting the moon that day. Terribly unconcerned are they; as though riots at the Capitol happen all the time.

    1. You fundamentally misunderstand the Court’s role. It has nothing to do with expediency of anticipated legislation. The court engages in Constitutional interpretation – that is, discerning the meaning of the text, as the framers intended it. Your starting assumption is that it’s yet another political branch of government, which it is not. It is highly improper to judge the quality of the Court’s work by whether the present political atmosphere is conducive to political compromise; that is totally irrelevant to the Court’s interpretive exercise of the Constitution’s text.

      In terms of relying on Judge Luttig as a supposed source of wisdom . . . sigh. He’s a never-Trumper, Trump-hater in the extreme, and sadly he has lost his marbles as a result. He used to be a highly intelligent, very reasonable federal appellate judge. That was 30 years ago. His utterances in the ear of Trump have become ever more unhinged.

      What the majority said was that A14S5 empowers congress to make laws that put A14S3 into effect.

      A14S3 did not repeal the rest of the constitution.

      The Court did decide it would be difficult to disqualify someone using the 14th amendment.

      That has been true for 150 years, it is not something new.
      It has ALWAYS been hard to disqualify candidates for office.

  10. Turley apparently doesn’t like the fact that the Constitution provides that those who engage in insurrection cannot serve in the federal government. Good grief, Turley, t’s part of the CONSTITUTION.     This case is further proof of just how fast the SCOTUS can act to help Trump–they made sure their ruling went out in time for Super Tuesday. As to the simple matter of whether presidential immunity exists, it took them 2 weeks to even decide whether to accept certiorari, and they set a briefing schedule out for several weeks, even though the issue was already thoroughly briefed.

We can all hope that when Trump is re-elected, he will appoint a bipartisan commission to conduct an examination of the conduct of that election, including such issues as: changes in election laws before the election; genuineness of absentee ballots; effect of loosened criteria for accepting absentee ballots; legality and conduct of ballot-harvesting; effect of monetary contributions to election officials in Democratic cities; security of the election machines; opaqueness of the handling of ballots; actual fraud; and the effect of the suppression of the Hunter laptop story.
          This kind of thorough examination is long overdue. It should have happened after the 1960 Presidential election.

      I mentioned the Democrat party seems to be willing to push the bounds of un-Constitutional laws, disregard the rule of law, previous norms, civility, ignoring facts and truth when it is a inconvenience to them but feed into fear, uncertainty and doubt to feed into the age of rage they promote. They are highly emotional, giving into their emotions rather than common sense, logic and critical thinking.
      If we were to get to the point a hot civil war, no doubt they will start it. As it is, they are pushing for one, blatantly shoving it in our faces, daring us to do something about it.
      If we were to do something about it, it will not go well.

      1. If the Left does start something, I suspect it will be in blue states, and large blue urban areas. I don’t see it happening in small town Oklahoma, for example, not unless there is a woke college in town. Note the problems Antifa-types had even in Atlanta, over the Cop City protests. If they do start it, I hope they do a good job! Those areas might finally wake up.

  20. Man, this is freaking *unbelievable* on the part of the dems in the face of a perfectly legitimate SCOTUS decision. I hope this doesn’t unleash the beast in a fashion that can only be fought. Accept it: our modern dems are part of a globalist regime, one that does not have your freedom or best interests in mind, and they will stop at nothing to make their power permanent. Absolutely nothing, and that is crystal clear now. we used to call the Nazis the ‘Armies of Evil’, well, here they are again, but on our own shores, under the guise of a political party in a Constitutional Republic where everyone who is not them still wants to be free.

    I am literally just in awe; I am fully cognizant that the gears on all of this have been turning for some time, but Obama (I am beginning to think a greater liar and/or sociopath, or at the very least, a clinical narcissist, has not graced our government in quite a long time) was the lynchpin, they would love for Trump and the rights of the people to be merely an inconvenience on their march to totalitarianism.     The thing that strikes me is that this a BIG country. For this to have been fomented so thoroughly is no mean feat, and this proposal is disgusting in the extreme. anyone that can’t see it for what it is at this point – I just do not know what to say. We have come this close to being fully captured. Please do not let them go the rest of the way; that’s on us. And they will not go gently into the night, no; we will have to keep standing up long after the votes are cast, and you’d better believe the same nonsense we saw in the past two election cycles will be in full force, and possibly on steroids. It is going to be ugly, it is going to be frustrating, it is going to be drawn out as long as possible, and it is going to be full of chicanery from the left. That is absolutely, 100%, already guaranteed.

    If you are a real liberal democrat, then insist that your party evolve instead of demonizing those of us who still possess our sanity, and stop supporting them until they do. Yes, that means stop sending them money. Do any of you have the courage? Because I know in your hearts you think it’s madness, too.
