Below is my column in the New York Post on the sudden guilty plea from Hunter Biden in his federal tax case. It was not the plea but the timing of the plea that was the surprise. What is missing is any cognizable legal strategy in waiting until the first day of the trial to make a “naked plea” when it offered the least possible benefit to him. It was like waiting for the water to reach the deck of the Titanic before asking about swimming lessons. He was a tad late and then unsuccessfully sought to plead guilty without admitting guilt.

Hunter Biden just showed the perils of playing the game of chicken with yourself.
For months, many of us have marveled at the sight of Hunter careening toward a cliff while declaring publicly that he was prepared to go all the way.
The Justice Department was never going over the cliff because they had nothing to gain or lose in open-and-shut cases in Delaware and California.
There was never a serious question of convicting Hunter of these crimes, just a will of the Justice Department to secure them.
Special Counsel David Weiss inexplicably allowed serious felonies to expire, refused to bring obvious crimes as an unregistered foreign agent, and sought to cut an embarrassing sweetheart deal with Hunter to avoid any jail time on a couple of minor crimes.
The deal then collapsed in open court when a judge balked at a provision that would give Hunter sweeping immunity for any crime.
When she asked the federal prosecutor if he had ever seen such a plea bargain offered a defendant other than the President’s son, he admitted that he had not.
That is when the chest pounding began. Unwilling to accept anything but the sweetheart deal, Hunter’s defense counsel told the prosecutors in court to “just rip it up.” They did and Weiss was forced to actually prosecute Hunter.
According to the Justice Department, Weiss continued to try to cut a plea bargain with Hunter but was rebuffed by the defense.
They then went to Delaware, the home of the Bidens, and tried to convince a sympathetic jury that Hunter was a drug addict who was not responsible for his action as well as other unsupported claims.
It failed in spectacular fashion with a conviction on all counts.
Hunter then floored it for the California cliff on the tax charges as the Justice Department and most of us watched confused about how he was trying to intimidate. He hit the brakes as the trial was beginning.
Hunter has succeeded in putting himself in the worst possible position for a plea. He waited until he had little to trade and reportedly did not even inform the prosecutors of his decision.
But it gets worse. If he had agreed to a less generous plea deal last year, he could have secured a recommended sentence on both the gun and tax charges.
Instead, he will go into this sentencing with a past criminal record, an aggravating factor that could reduce the benefit of the belated plea.
In the end, Hunter had nothing to offer, nothing to bargain. He plead guilty to all nine counts.
This decision may still be based more on political than legal calculations. Hunter was almost certain to be convicted. But it would have taken time as his father’s administration (and pardon authority) wanes.
If Hunter still hopes for a presidential commutation or pardon, the chances of such executive action is dramatically improved after a sentencing.
The White House rarely considers pardons before a trial and sentencing. Indeed, they often wait for appeals to run their course.
Moreover, a demand for jail time seems likely from the Justice Department given this history and it is equally likely to be granted.
If that sentence is lengthy, it will add pressure on President Biden to take action with a commutation or pardon.
If President Biden does violate his promise to not pardon Hunter, it would not be a surprise for many. In 2022, I wrote that the President could resign or withdraw as a candidate and pardon Hunter.
I referred to this as “break-the-glass option”: “He would end his political career with an act as a father, which some would condemn but most would understand.”
The plea also avoided the massive influence peddling operation of the Biden family from being aired in open court.
The refusal of the Justice Department to charge Hunter as an unregistered foreign agent stands in flagrant contradiction to past and current cases under the Foreign Agents Registration Act (FARA).
None of this explains the logic of Hunter’s criminal defense strategy. A legal one-man game of chicken is certainly engrossing to watch, but leaves most lawyers wincing rather than flinching as the spectacle unfolds.

This actually points to a tinfoil hat moment of mine that is slightly OT: as a last gasp, the dems might embrace a hard coup and fully retire Biden, make Kamala POTUS, then simply refuse to cede power in November after a bunch of EOs. Jonathan, this is the DJT cult members showing that they don’t know how American justice operates. They were complaining exactly like this because the same Department of Justice accidentally let the statute of limitations expire on many of the charges back in 2020 while negotiating a plea deal with Hunter Biden’s lawyer.
Just as they were complaining when the Department of Justice offered a reasonable amnesty offer to Hunter Biden and his lawyer last year.
Private ex parte negations between judges and defense counsel are the norm; convicted felon DJT has also had such negotiations with judges hearing his trials prior to his felony convictions.
I’m not sure how to read Turley’s article. Was it meant to be serious or satirical? There was never any question that Hunter was going to pardoned. Never. That was one of the many reasons offered as why the Hunter “investigation” was conducted in the bungled manner that it was. That was the point, why should the “Biden” DOJ air the Biden family dirty laundry when, with the stroke of a pen, everyone knew that it all goes away. I doubt that Joe is worried about preserving his legacy as one of the biggest hacks in politics or that he’s worried about potentially running for office again. Never mind the Biden’s being worried that Hunter wouldn’t turn rat if the alternative was a prison sentence, whether pardoned or not, in subsequent Trump administration investigations. A Trump administration may not allow him to ignore subpoenas and then walk away as Eric Holder was allowed to do. He might get the Bannon treatment instead. For as long as he refused to comply – just as was done with that reporter when that Special Counsel was trying (and succeeded) in jailing Scooter Libby for somebody else revealing the identity of that CIA employee.

I would add one bit of information. Judge Mark Scarsi, Hunter’s California trial judge, is a Trump appointee. Both Hunter and Jack Smith have had bad track records with honest judges.

If Hunter was pardoned, he can claim all sorts of things including he was a crazed drug addict. The ability to incarcerate him is unlikely after a pardon. Can he plead the Fifth? I think so, but has that ever happened with someone pardoned? You indicate he can’t. Is that a verified legal decision?
A conventional plea agreement was probably never in the mix to begin with. Absent the collapsed sweetheart deal, a conventional plea agreement, according to the Justice Department’s Manual (Sect. 9-27.420 – Plea Agreements), would have to include cooperation by the defendant in snitching out all other crimes and criminals in the matter in question [Sect. 9-27.420(1): “The defendant’s willingness to cooperate in the investigation or prosecution of others.”] Realistically, this would bring down the entire Biden crime family and then some. No, Hunter was doomed from the beginning and his antics and goofy lawyer cost him whatever leniency he might have received had he played by the rules. Joe Biden has likely told Hunter that a pardon will be given if and only if he takes the heat, all of it, and keeps his mouth shut. As the Biden-Harris administration fades into history, the political appointees at DOJ no longer feel olbligated to pay back their sinecures and are prepping for partnerships in prominent law firms. The careerists are back in charge, meaning no Alford deal and no deal at all. Aty this point, only the Big Guy can save Hunter from going to the slammer. And he will. For sure. Because Hunter kept his part of the deal and protected the family. Simple.

Prole: Ironically, even a pardon does not solve the problem if Trump is elected or if the House remains in the hands of Republicans. Assuming an out-the-door pardon (a la Bill Clinton style), Hunter could no longer invoke the Fifth if called before Congress or a grand jury. He in effect would be immunized and required to testify completely and truthfully or face new and more serious charges that could land him in the slammer. No matter how one navigates this maze, it’s truly a sticky wicket.

Can a Congressional Committee with or without the DoJ, or a prosecutor by themselves, subpoena Hunter Biden to testify about the crimes he no longer has to fear criminal liability about? Whether FARA violations, money laundering, accepting bribes, etc I assume the statute of limitations has him free and clear of any criminal liability.
There’s those 150 Suspicious Activity Reports filed with Obama during their second term relating to money laundering, bribes, etc going to the Bidens.
There’s the $30+ MILLION that adversarial nations like the Chicoms, Russia, etc forked over through Hunter Biden: who did that go to, what was it for, and did those who got it declare and pay taxes on it?
Etc and so forth. And would any of it together form a RICO case applicable now?
My time in police work was long, long ago. But we regularly squeezed criminals with the threat of further jail much worse than what they’d been released from if they didn’t fink out other criminals in exchange for us backing off. The easiest ones to squeeze were those who were in danger of serious jails and serious jail time that had never spent a day in jail
With that in mind, can a prosecutor with a willingness to put pressure on Hunter Biden to testify to who was involved in all those crimes, who knew, when, how long, who helped, etc do that?
For that matter, there’s all the evidence Joe Biden’s favorite Special Prosecutor says he found of Biden committing a long string of felonies stretching back decades. Is there any reason that Trump’s DoJ/Special Counsel can’t tell Robert Hur “Thanks for your opinions on what juries would decide, we’ll take it from here”?
I’d like to see the Biden’s punished for their decades of criminality, but the more important criminality is everything around them – and everyone in political office or bureaucratic offices that chose to hide and protect that criminality. Many of them will still be around for years.

The irony of this whole situation is that Hunter’s relationship as son to a political figure enabled his misdeeds, but also put him in his current predicament. It would be political disaster for Hunter to accept the plea bargain and admit guilt while his father was still a candidate for re-election. By the day of trial, the calculus had changed. Only his father’s legacy, not his political future, was still at stake. Furthermore, Hunter was faced with the reality that the facts were coming out whether he pled guilty or not. He tried to save the legacy by his attempted Alford plea. When that last card was played, he gave up the ghost. His guilty plea did, however, shorten the news cycle thereby reducing the President’s embarrassment. The familial relationship in the end worked to his detriment. What the family giveth, the family taketh away.
End game is near. Full unconditional pardon after the election.

Yes, this is an important point. The Big Guy’s refusal to grant a pardon may be truthful because a pardon would essentially immunize Hunter and eliminate his ability to invoke the Fifth Amendment since he no longer would be in legal jeopardy of self-incrimination.
