President Biden Cloaks His Legacy in Infamy With the Hunter Biden Pardon

Below is my column in Fox.com on President Joe Biden’s pardoning of his son Hunter of not just his convicted crimes but any crimes that he may have chosen to commit. President Biden has set a standard that is not merely a new low but positively subterraneous for future presidents.

Here is the column:

President Joe Biden’s decision to use his presidential powers to pardon his own son will be a decision that lives in infamy in presidential politics. It is not just that the President used his constitutional powers to benefit his family. It is because the action culminates years of lying to the public about his knowledge and intentions in the influence-peddling scandal surrounding his family. Even among past scandals in the abuse of the pardon power, Biden has done lasting damage not just to his legacy but his office.

Despite its noble origins and purpose, the pardon power historically has not been a pristine power used by past presidents. As I have previously written, it was used to benefit the political cronies of past presidents. President Warren Harding was even accused of selling pardons, including to mob enforcer Ignacio Lupo, known as “Lupo the Wolf.” Former president William Clinton waited for the final days of his presidency to pardon his own brother as well as a major democratic donor.

In 2023, I wrote that Biden might follow this same pattern and pardon his son as a lame-duck president. The column suggested that Biden might withdraw as a candidate for office and then take the action as a father: “The pardon-and-apology approach might appeal to Biden not only as an effort to convert vice into virtue but to justify his withdrawal from the election as a selfless act.”

In the 2020 election and throughout his presidential term, Biden repeatedly lied to the American public with an ease and impunity that shocked even many political veterans in Washington. He was repeatedly asked if he knew about Hunter’s foreign dealings, including millions in alleged deals with Russians, Ukrainians, Chinese, and other clients. President Biden lied and denied such knowledge. As I detailed in my testimony in the Biden impeachment hearing, he had repeated discussions of these dealings. He is even on tape discussing news stories on the dealings.

President Biden was also repeatedly asked if he met any of his son’s clients. He repeatedly lied. We have pictures and records of dinners and meetings with these clients. Hunter Biden was expressly thanked for his arranging such access to his father.

Few reporters pressed Biden on the corruption scandal, but they were often met not only with denials but angry retorts from the president. When Fox reporter Peter Doocy raised it, the President steamed “Yes, yes, yes. God love you, man — you’re a one-horse pony, I tell you.”

When CBS’s Bo Erickson broke ranks and raised the scandal and drew a rebuke from Biden “I know you’d ask it. I have no response, it’s another smear campaign, right up your alley, those are the questions you always ask.”

The President continued to lie throughout the election, the presidential debates, and his term.

Then, the press repeatedly asked him whether he would pardon his son. The President was now running for reelection and again lied. He and the White House said over and over again that no such pardon would occur and was not being contemplated. That was also a lie. NBC is reporting that, while issuing these denials last June, there were discussions about the pardon.

The pardon power was written in absolute terms, and a president can even, in my view, pardon himself. However, what is constitutional is not necessarily ethical or right. This is one of the most disgraceful pardons even in the checkered history of presidential pardons.  President Biden has lied to cover up a corruption scandal that reportedly brought his family millions in raw influence peddling. His portrayal of his son as a victim stands in sharp contrast to the sense of immunity and power conveyed by Hunter in his dealings.

There were diamonds as gifts, lavish expense accounts, and a sports car, in addition to massive payments that Hunter claimed were “loans.” There are messages where Hunter belies the President’s portrayal of a political witch hunt, including messages like the one to a Chinese businessman openly threatening the displeasure of Joe Biden if money is not sent to them immediately. In the WhatsApp message, Hunter stated:

“I am sitting here with my father, and we would like to understand why the commitment made has not been fulfilled. Tell the director that I would like to resolve this now before it gets out of hand, and now means tonight. And, Z, if I get a call or text from anyone involved in this other than you, Zhang, or the Chairman, I will make certain that between the man sitting next to me and every person he knows and my ability to forever hold a grudge that you will regret not following my direction. I am sitting here waiting for the call with my father.”

The President has now pardoned Hunter for his convicted felonies and any crimes he may have committed from “Jan. 1, 2014, to Dec. 1, 2024.”

It is all now being buried under a sweeping immunity deal and a pack of presidential lies.

        Further Biden has pushed Hegsoth and Patel out of the news.
        Those few MSM hosts with the slightest credibility left are grilling Democrats like Swallwell who repeatedly said this would never happen.

        This has provided the opportunity for the IRS whistle blower to speak out again – saying absolutely this was political bias – the WH and DOJ were actively interfering with a normal IRS tax evasion investigation.

        Trump has pardons lined up for January. There will be lots of J6 pardons. Trump has promised he will commute the sentence of Ross Ulbricht – most on the left do not know who that is – but libertarians do. There will likely be a pardon for Julian Assange, and possibly one for Snowden. And there is another Snowden like person who leaked information that the State department was lying about North Korea.

        Regardless, Biden’s unbeleivably broad pardon of Hunter give Trump Carte Blanche.

        Separately many are noting that Hunter can now be required to testify about anything after 2014 – there is no fifth amendment protection left to him.
        Rather than shutting down the Biden investigation this may have made Hunter the star witness.

        So much for honerable or cosciencious, or humbling.

    4. Actually, the police declined to press charges. Video of the encounter showed Hegseth noticeably drunk, being led off by the smiling alleged victim. There was no sign on video that she was impaired. If the genders had been reversed, Hegseth would have been a sexual assault victim, due to incapacity.

      The woman in question was married, and regretted her pursuit of Hegseth after the fact. Making a false allegation like that can cause so much damage.

      Simply making an accusation is not, nor should it be, enough to brand anyone a rapist.

      Does this underscore why casual sex can be risky, and why having too much fun can bite you later? Absolutely. Hegseth partied like a rock star in his youth, and he’s been married 3 times. He has apparently outgrown his libertine phase.

      Apparently, the Left espouses sexual freedom, except for a political conservative. Then it becomes Puritanical.

      Hegseth was not charged. His past would be thoroughly investigated for clearance.

      And, yes, Trump does love veterans.

        I personally really don’t like people violating their marriage to commit adultery. Whether oath of office or oaths of marriage, they should mean something IMO.

        That said, I believe the reporting was Hegseth’s marriage was over and done when this happened You’re single: you aren’t answering to a spouse – you answer to yourself and possibly your faith and your family and friends.

        As far as failed marriages go, a LOT of veterans did their deployments and those deployments did their marriages in. It’s a common family tragedy resulting from service; the sad joke is that their ex is the “starter wife”.

        Three is a large number of failures. That said, I see him as being hired to do a job, not to fill the role of being a model of probity. My role models are family I personally know. Not politicians, academics, military, police, businessmen, etc.

        If he does a good job of cleaning all the rot and cancer out of Defense, then I don’t care if he suddenly becomes the next Admiral Rachael Levine and starts showing up for work dressed in a black evening gown. Just do the job and do it well.

    4. The felony convictions will be overturned, because there never was a law that required an NDA to be reported as a campaign contribution to oneself. Joe Biden certainly did not report any expenses for denying the veracity of the Hunter Biden laptop as campaign contributions to himself.

      It was also not election interference to believe that voter fraud took place, and to say that you don’t need to ferret out all voter fraud, just enough to count. Trump never told anyone to fake ballots. It’s not like a Trump truck showed up at midnight with thousands of mail in ballots, suddenly found, filled out for Trump.

      The Big Guy was obviously Joe, and we know from Hunter’s laptop that his cut of the bribes Hunter collected for him was FIFTY percent, not ten. Which, considering that they were HIS bribes, not Hunter’s, seems very generous to me. I don’t know what a bagman’s usual cut is, but I doubt it’s as high as 50%.

      The 10% comes from a deal Hunter was part of, in which a company would be established, and the shares would be distributed among those involved. 10% of the shares in that company were to be held by Hunter in trust for the “Big Guy”, since obviously it wouldn’t do to give him the shares officially.

  7. Jonathan: There is another of DJT’s picks for his cabinet who is facing some strong confirmation headwinds. It’s Pete Hegseth–DJT’s choice for Defense Secretary. Hegseth is facing scrutiny–not only because he is utterly unqualified for the position– but also for another reason.

    It seems Hegseth has a bad habit of sexually abusing women. In 2017 a woman filed a police report saying Hegseth physically blocked her from leaving his hotel room, took her phone and then raped her. The police never filed charges against Hegseth but he later made a financial settlement with the woman and forced her to sign an NDA. Hegseth said he did that because he was afraid the incident might adversely affect his employment as weekend host at Fox if it came to light.

    There is someone else who knew about Hegseth’s abuse of women. It’s Penelope Hegseth, Pete’s mother. In 2018 she sent an email to her son in which she stated: “I have no respect for any man that belittles, lies, cheats, sleeps around and uses women for his own power and ego. You are that man (and have been for years). As your mother, it pains me and embarrasses me to say that, but it is the sad, sad truth”. Penelope has now tried to back peddle–claiming the email was sent “in anger, with emotion” and now claims everything she said in 2018 to her son was untrue. Just curious. Why would Penelope wait 6 years to try to correct the record? Maybe it’s because some one from the DJT transition team got to Penelope and “suggested” she come forward to defend her son?

    DJT made a fundamental error. He thought in his intoxication from winning the election he could push through his Cabinet nominees while no one was watching–and do it way before the normal nomination process occurs around Jan. 3 when Congress comes back–and do it without FBI background checks. But the press is doing its work a month early by fully investigating nominees like Matt Gaetz and now Pete Hegseth. So at least we still have the free press to do the dirty work of exposing DJT’s disastrous picks.

    Now the Q is why DJT would pick some one with no qualifications to run the largest military in the world and with so much baggage? There’s the simple answer. DJT wants people who will be utterly loyal and with whom he shares some personal affinity. DJT is an adjudicated rapist who cheated on his wives. Why wouldn’t he want someone, like Pete Hegseth, with a similar background to be in his Cabinet? Makes perfect sense.

          At End Of Sentence – rather than pardoned or commuted, he can not be charged again for those crimes or have the penalty for the crime increased. So, whether pardoned, commuted, or EOS, he no longer has 5th Amendment protections to use to refuse to answer questions (or subpoenas). As in “what services or products did you sell in exchange for those millions you failed to declare and pay income tax on”? As in “Did anyone in the State Department, Department of Justice, etc have any involvement with your actions relating to this undeclared income.

          And then there’s the good ol’ Statute of Limitations.

I know that President Ford’s pardon of Richard Nixon was a sort of blanket, but the issue (of impeachment) was more or less moot. Surely there are limits, and it seems to me that they have been exceeded.

        Where do people get the bizarre idea that you can’t be? That has NEVER been true. Pardons for crimes not yet charged, even for people who hadn’t even been caught, go all the way back to the very beginning of the USA. The president can pardon anyone who committed a specific crime, even if nobody but them knows about it. Carter did it for all Vietnam draft dodgers, but he was only following George Washington’s example.

        What has impeachment got to do with it? Impeachment was NOT the issue. It couldn’t be, because a pardon doesn’t affect impeachment. Ford pardoned Nixon for ALL CRIMES that he may have committed between two dates. Hunter Biden’s pardon is almost a verbatim copy of the Nixon pardon, with just the name and dates changed.

        And yes, if Nixon had subsequently been found to have kidnapped someone between those dates, he could not have been charged with it in federal court. Ditto for Hunter Biden. If he’s found to have kidnapped someone in the past ten years he can’t be charged in any federal court.

      George Washington pardoned an entire class of people, without even naming them. Everyone who committed the crime was pardoned, even if they had not yet been caught, let alone convicted.

    Amends the Omnibus Crime Control and Safe Streets Act of 1968 to create a new term of service for the office of Director of the Federal Bureau of Investigation (FBI), which shall begin on or after August 3, 2011, and continue until September 4, 2013.

    Makes the incumbent Director on the date of enactment of this Act eligible to be appointed for such new term but only for such new term. Prohibits such incumbent from serving as Director after September 4, 2013. Exempts such incumbent from the prohibition against a Director serving more than one 10-year term.

    I read this article this morning, it was titled Biden was “Liar in Chief”, and echoed that sentiment a few times in the article. Now I don’t see those words anywhere.

    Did you guys (Jonathan and the editors) tone it down because you felt it was too bellicose or abrasive? Maybe trying to tone down some of the rhetoric?

    While I’d understand and even concur with that approach as we all need to get along better now if possible, I have to admit I liked the title this morning and felt it was more than appropriate and justified.

    I mean they didn’t just lie about it, they were insulting and adamant stating in no uncertain terms that he was “not going to pardon him”. He said so. His press secretary said so. Just weeks ago.
