“Content Agnostic”: EU Official Denies Anti-Free Speech Policies in Bizarre Letter to Congress

Congressional SealAfter returning recently from speaking at the World Forum in Berlin, I testified in the Senate Judiciary Committee and warned about the building threat to free speech from the use of the European Union’s Digital Services Act (DSA). House Judiciary Committee Chair Jim Jordan has taken up the issue and received a letter from the EU’s Vice-President for Tech Sovereignty, Henna Virkkunen. The letter is both evasive and deceptive.

In my book, The Indispensable Right, I detail how the DSA has been used to allow for sweeping speech investigations and prosecutions. In direct contradiction to past statements by the EU, Virkkunen denied any effort to regulate speech or enforce the DSA outside of Europe.

What is particularly maddening is the false claim that the EU remains “deeply committed to protecting and promoting free speech.” Many in the free speech community view the EU and the DSA as the greatest threats to free speech in the West.

In his letter, Jordan correctly raised the concern that the DSA could “limit or restrict Americans” constitutionally protected speech in the United States by compelling platforms to crack down on what the EU considers “misleading or deceptive” speech.

In her response, Virkkunen bizarrely describes the DSA as “content-agnostic” while insisting that the DSA “applies exclusively within the European Union.”

That is not what EU officials previously said or what the law itself allows. Articles 34 and 35 of the DSA require all sites to identify, assess, and mitigate “systemic risks” posed by content, including any threats to “civic discourse”, “electoral processes,” and “public health.” It is up to the EU to define and judge such categories in terms of compliance.

The act bars speech that is viewed as “disinformation” or “incitement.” European Commission Executive Vice President Margrethe Vestager celebrated its passage by declaring that it is “not a slogan anymore, that what is illegal offline should also be seen and dealt with as illegal online. Now it is a real thing. Democracy’s back.”

Some in this country have turned to the EU to force the censorship of their fellow citizens. After Elon Musk bought Twitter and dismantled most of the company’s censorship program, many on the left went bonkers. That fury only increased when Musk released the “Twitter files,” confirming the long-denied coordination and support by the government in targeting and suppressing speech.

In response, Hillary Clinton and other Democratic figures turned to Europe and called upon them to use their Digital Services Act to force censorship against Americans. (Clinton spoke at the World Forum and lashed out at the failure to control disinformation).

The EU immediately responded by threatening Musk with confiscatory penalties against not just his company but himself. He would have to resume massive censorship or else face ruin.

This campaign recently came to a head when Musk had the audacity to interview former president Donald Trump. In anticipation of the interview, one of the world’s most notorious anti-free speech figures went ballistic.

Former European Commissioner for Internal Markets and Services Thierry Breton issued a threatening message to Musk, “We are monitoring the potential risks in the EU associated with the dissemination of content that may incite violence, hate and racism in conjunction with major political — or societal — events around the world, including debates and interviews in the context of elections.”

The EU has long been one of the most aggressively anti-free speech bodies in the world. It has actively supported the evisceration of free speech among its 27 member states. The EU is not “agnostic” when it comes to free speech; it has long championed a type of free-speech atheism. We have faced EU officials engaging in Orwellian doublespeak for years. Nevertheless, Virkkunen’s letter to Jordan stands out for its sheer mendacity.

We know that they have never really believed in free speech or a limited government. The elites of Europe have never accepted the United States as a cultural equal in anything.     In a way, she’s right. The DSA’s new Code of Conduct does *not* criminalize any particular opinion, e.g., “I hate Muslims.” Or any particular words, e.g., “Atheists are crazy.”

    The EU’s new Code is far worse than that. It criminalizes the expression of opinions deemed “illegal hate speech online.” The censorship Code does what all censorship laws do: Its terms are intentionally vague, arbitrary, and capricious — so that a person cannot know in advance what speech is and is not a crime.

    Such nonobjective “law” gives bureaucrats unchecked power to decree, after the fact, whether your opinions will land you in jail.

Diogenes, I agree with almost all of your comment, as I usually do, but I do take a little issue when good conservatives go after moderate Republicans without also mentioning the Democrats that are the real opposition. We need Republicans from purple, or even blue states like Maine in order to have a majority so we have to live with the hand we have been dealt.

      It is hard when the Democrats seem to never lose even one member on any important vote while Republicans always get a few peeled off. But a good lesson may be learned from the Dems and their Joe Manchin example. Manchin voted against the ending of the filibuster and the Dems trashed the guy to the point where he ended up not running again which helped them lose the majority. We don’t want to force 3 Republicans out in an attempt to get perfect candidates only to lose three seats.

      As for the filibuster, why haven’t the Republicans at least threatened to end it? Even if we don’t want to end it let’s get Schumer and his band of idiots on record voting to sustain it to finally shut them up about it.

        I agree that circular firing squads and litmus tests can backfire. It’s a judgment call. Romney was an intransigent never-Trumper, and he was voted out and we have a better majority today. On the other hand, Ossoff and Warnock the Warlock got elected in Georgia due to GOP infighting. One has to pick one’s battles.

        The problem we have is that much of the so-called right in the West has sold out to globalism. This is a major problem in Western Europe. It has forced new parties to form, but all that did was split the right, but what choice did they have? It was split the vote or be silenced completely.

        Trump got elected because he was willing to trade RINO’s for working-class votes, but the problem remains in Congress.

        We need to know how many GOP Senators are sold out to mass migration and globalism. How we go about it can be debated, but if they are going to split the right and continue the trend to Caesarism, we probably need to consciously confront that reality.

The correct process to tell the person the government wants to revoke the visa, give them a change to respond before the decision is made, revoke the visa, and deport them if they don’t leave. What they are doing now is revoking the visa and arresting them hours later without any warning or due process. Without due process we can’t know if their visa is being revoked legally or even if they are non-citizens.

Especially after viewing the ProPublic Frontline March 25, 2025, PBS presentation of “The Rise and Fall of Terrorgram” (https://www.pbs.org/wgbh/frontline/documentary/the-rise-and-fall-of-terrorgram/), as a now eighty-one year old lay American male who’s been battling mostly mild (now) externally imposed chronic illness for forty-four years and counting I find that the real issue might just be the “Rage” JT refers to. And, what good is “free speech” when the so-called “experts” are ignorant and incompetent?

    In 1981 the US FDA approved the expanded use of added artificially cultured “free” monosodium glutamate (MSG) knowing full-well it would be harmful to some of us but, apparently, not “how, how many or how soon?” I became mysteriously, seriously ill in early 1981, the US obesity epidemic presented by 1990 (CDC) and the US diabetes epidemic presented by 1994 (CDC). Mass and school shootings have been on a similar trajectory to the consumption of added MSG foisted on a mostly unsuspecting American population and gradually going global with the so-called “Western Diet.” In 2020 the world was turned upside-down with a phony Covid-19 pandemic additionally also illegally foisted on many, with most of the alleged deaths due to added MSG related preexisting conditions, comorbidities and medical mistreatments.

    I’ve observed that excitotoxic, neurotoxic added MSG is a brain damaging, mind altering drug, worse than marijuana, cocaine and heroin, together. We now have two and a half generations of young (relative to me) Americans who’ve been ignorantly ingesting added MSG all of their young lives and many are second and third generation victims. In the state of Michigan the parents of Oxford High School shooter Ethan Crumbley (e.g., ingesting added MSG most, if not all, of their lives; Ethan probably too in school lunches) have been prosecuted and imprisoned for allowing their son to have a gun. Now it seems, that chemically induced “rage” has gone international.

    Not everyone reacts the same to added MSG, probably because we don’t all have the same allergic reactions to common foods that added MSG can aggravate in ‘worse’ and ‘worst’ case individuals. So is it really a question of free speech or is it a question of mental capacity in a world poisoned with an alleged “flavor enhancer,” for Big Food and Big Pharma profits? Bottom line: how can any young adult be held fully legally responsible for any act while ignorantly ingesting officially approved food poisoning, all of their young lives, and that includes a new generation of domestic and foreign leaders; Trump?

Extoling the glories of socialism has failed. Advocating free stuff has failed. Inviting illegal immigrants has totally failed. Exterminating undesirables has failed. Finally, the left is trying to destroy democracy by working within democracy to dissolve the glue that binds it: Freedom of Speech. Will it work?
