New York Times Debunks War Crime Story By the Washington Post

The pattern is all too familiar. The Washington Post runs a story with a sensational claim: Secretary of Defense Pete Hegseth ordered the killing of survivors of one of the first boat attacks back in September — a coup de grace or finishing shot that would constitute a war crime. The Post appears to have had only one source making the specific claim about Hegseth, but ran with the story. What followed was a line of politicians and pundits calling for the usual criminal charges, impeachments, and resignations. Then, various sources, including the New York Times, debunked the story.

When this story broke, some of us cautioned that the law was clear, but the facts were not. Yes, it is generally a war crime to intentionally kill or order a “double tap” strike for the sole purpose of killing the survivors at sea. The Nazis were charged with such heinous acts in World War II. However, such allegations are often difficult to resolve even after investigations in the “fog of war,” where decisions are made in seconds on a battlefield. This claim was being made with only the Post and a single source as “evidence.”

The Post claimed “Defense Secretary Pete Hegseth gave a spoken directive, according to two people with direct knowledge of the operation. ‘The order was to kill everybody, one of them said.”

This is the same newspaper that won the Pulitzer Prize with the later debunked Russian collusion story — a scandal started by the Clinton campaign, which secretly funded the infamous Steele dossier.

Nevertheless, the airways were filled with experts stating categorically that a war crime was committed.

Notably, these claims were made over the Administration’s vociferous objections, which denied that any such order was given by Hegseth during the attack. Indeed, a later attack did involve survivors who were retrieved and then returned to their country.

The New York Times this week ran a multiple-source story saying that Hegseth gave no such order.

Putting aside the sensational and apparently false claim about Hegseth, the issue of the order by Admiral Bradley comes down to motivation. It is common in war to deliver a finishing blow on a vessel. It has been routinely done by many countries, including when survivors remain on board or near the boat. While countries must take reasonable measures to allow survivors to leave a sinking vessel, the demands of war often allow for a finishing shot to achieve a mission with personnel on or near the boat.

The first attack did not sink the boat in question, and Bradley ordered a second hit. If he did so to sink the vessel, he is likely within the laws of war.

Of course, reasonable people can question the overall policy and whether killing drug carriers is consistent with international law. However, that is not the specific claim raised in this controversy. The question is whether, in a military action, a second finishing shot can be delivered to complete a mission to sink a vessel. The answer is likely yes.

It is also worth noting the distinction between operations targeting boats and operations targeting people. Past presidents like Barack Obama have unilaterally ordered the killing of people abroad, including U.S. citizens. Presumably, if an attack on a targeted individual did not clearly kill that person, Obama would have ordered a second attack to finish him off.

That brings us back to the sudden appearance of this story about an attack in September. The Administration was hitting the Democratic members hard over their controversial video telling military personnel to refuse unlawful orders. Those members later admitted that they could not actually name such an order. While some have demanded sedition charges against the members, I have written that such a case would be legally unfounded and would certainly collapse immediately in court. This was protected speech, even though I disagreed with these members about posting the video.

As the heat over the video continued to rise, the Post suddenly had breaking news of an illegal order from Hegseth. You would have to be a complete chump to ignore the obvious timing and purpose of such a story. The fact that the Post would run to print with a single anonymous source made the story even more incredible. Yet, it did not matter. It was a fact too good to check for the Post and a long line of experts and pundits.

It still does not matter. We are living in a post-truth political environment where media outlets feed the demands of echo-chambered readers. It was true because they wanted it to be true. They wanted Hegseth watching survivors clinging to a boat and ordering the military “to kill everybody.”

The Congress is moving forward with investigations, and that is a good thing. We should be clear on the rules of engagement and confirm that the motivation was not to kill survivors in the water. However, the real lesson here is one that still has not been learned about the corrosive effect of political bias in the media.

Polls show trust in the media at an all-time low with less than 20 percent of citizens trusting television or print media. Yet, reporters and academics continue to destroy the core principles that sustain journalism and ultimately the role of a free press in our society. Notably, writers who have been repeatedly charged with false or misleading columns are some of the greatest advocates for dropping objectivity  in journalism.

Indeed, the whole “Let’s Go Brandon” chant is as much a criticism of the media as it is President Biden.

There was always an obvious alternative explanation for the second strike in this story. The boat was clearly not destroyed by the first attack. Yet, in the midst of the sedition debate, there was a need for an illegal order as the six Democratic members struggled to give an example to support their public call. The Post supplied it like an actor walking in on cue at just the right moment. As we investigate the claim, it would be equally commendable for the media to look into its own role in this “double tap” story. Most citizens would likely agree that the media “rules of engagement” also warrant some review.

    The halo is misunderstood. The halo doesn’t eminate from the executive’s head. It descends upon the head from above. That halo is the Constitution.

    The boat story is covered. Drugs that kill Americans exported from hostile 3rd worlds suffices as a weapon. Perhaps Venezuela might export poison gas instead.

        It is not possible to protect the leaders of western democracies from assassination by the militaries of even small countries.

        The job of the Secret Service is hard enough, Typically they only provide coverage against snipers out to about 1/4 mile – yet military snipers have hit targets at over 2 miles.

        That is just ONE of many easy ways that another nation can take out a western world leader.

A snippet from General Tommy Franks books ‘American Soldier’, “May 10 was day three…., By 1040 hours, the companies were maneuvering south along a main road , attempting to encircle the VC dug into the ruins of what had been and industrial complex….” Lieutenant Franks was observing a fire fight from a helicopter and observed and heard “Heavy contact” and that the troops were taking RPG fire from a warehouse in the complex. General Franks looking for the nearest battery of a 105 fire base contacted them and ordered ordnance to target coordinates using his commanders authorizing initials [Echo Alpha], by late afternoon the attach was over.

    Now the interesting part of the story [May15]; “I woke up when the Huey from U.S. Army Viet Nam headquarters clattered in to land at the Battalion command post. The fighting had been over for four days. Eric Antila was up at Division with the other Battalion commander, reporting on the engagement. The two-star general and two colonels climbed out of the helicopter and asked for the 5-60 Artillery LNO….

    I button my shirt and saluted. None of the senior officers shook my hand; nor did they smile, or exchange the usual pleasantries. One of the colonels was from the Inspector General’s office; the other was a JAG lawyer. He presented a printed form and directed me to swear that my statement was voluntary, true, and complete.

    What the f—‘s all this all about?

    Half an hour later, as we drove from the blasted house to shattered factory, I’d begun to figure it out.

    ‘What hit this building?” the IG colonel asked, pointing at the ruined warehouse beside the canal.

    “Five-hundred –pound high-drag bomb, Sir,” I answered.

    “And you ordered the air strike?”

    “Yes, Sir.”

    The questions were all the same. We spent an hour driving through the area, reviewing targets on which I had ordered fire missions, or air strikes, or both. By the end of that hour I realized what was going on: These sour-faced senior REMF’s were looking for someone to court-martial for employing excessive force in case there was trouble over the destruction of this district on the outskirts of Saigon.

    And every time we stopped, either the General or one of the colonels would ask: “And you are sure that the unit you supported was in contact”.

    It looked like I might be going to DEROS sooner than expected-wearing handcuffs.

    We were examining a burned-out house near the command post when Lt. Colonel Antila’s muddy jeep pulled up. He saluted the officers and walked along with us as we continue the inspection of the ruined building.

    After he heard two of the team’s formally phrased queries, Eric Antila stepped between the general and me. “Sir” he said quietly, looking the man right in the eye. “Those are excellent questions. But you’re asking the wrong man. The duty log will reflect that every fire mission and air strike was cleared by Echo Alpha-Eric Antila. Lieutenant Franks simple relayed my orders”.

    I only present this for two words in the last paragraph: {duty log}. Any fool can use hyperbole (you dirty rat) but in the military orders are documented.

    I’ll ask those that say it’s just drugs; we should stop, frisk, and arrest, not kill. What would you say if the mules were bringing in Ebola packaged as a pleasure time, just give it a try?

  3. The whole “second strike” issue is a red herring. In WWII, when we torpedoed a Japanese freighter, our subs usually fired multiple “fish.” If it didn’t sink, it was torpedoed again. If our tank shot a German or Iraqi tank and it wasn’t destroyed, we shot it again. When our P-51 shot a Me-109 but it kept flying, our pilot kept shooting until it crashed. It’s called warfare and the purpose is to kill people and break things. As for the whole “non-combatant” argument, 100,000 dead Americans per year would probably disagree. Besides, how is a Venezuelan “civilian” on a boat carrying drugs to the U.S. in 2025 any different than Japanese “civilian” on a freighter carrying ammunition to Guadalcanal in 1942?

Your warfare argument requires an actual war, when was that war declared and against whom? I don’t recall Congress declaring one.

        That mostly comes up – as it does now to refute stories like this one.

        Congress has not declared war since WWII

        Regardless, Congress and the constitution do authorize the use of Military force by the president without a declaration of war.
        There are myriads of examples.

      Occasionally I am surprised that MSM will actually report on a story with no bias and with facts. It is rare but it does happen. I recall for like two weeks, NPR of all MSM was very critical of Obama, even reporting on his deportations and protesters at the Obama built detention centers. And now, I am mildly surprised the NYT debunked WaPo with sources to back them up. Even a broken clock can be right once a day.

    After losing the Schumer shutdown fiasco, and the Epstein debacle that only outed Democrats as pedophile whores, they and their propaganda media, like WaPo, are just desperate for anything that looks like a win.

      Africa is rich in natural resources – but politically it is a complete and total mess. Further it is NOT in the US interests.
      We did not break it. We did not colonize it (not that colonization was bad for Africa). It is not our problem
      we just do not care about africa.

      But the western Hemisphere is a MAJOR us interst – and it has been since the 5th US president put forth the Munroe Doctrine.
      There are myriads of reasons that south and central america are major interests of the US.
      Expect they will be even more so in the future.

      The next major US interest is the Anglosphere – the UK, CA, NZ, AU.

      And last but not least the Pacific rim

      China is the major US global power threat right now – I am not sure how long that will last – but they are far more of a threat than Russia,
      and US interests in Asia are far more important than in Europe.

      Regardless it is in the US interests to create a prosperous western hemisphere.

      The way to stop the flood of drugs and illegal immigrants is to have functioning and prosperous nations in Central and South america.

      Before Chavez Venezeuala had the highest Standard of living in South Amrica. Now they have the lowest.

          Nearly all have sent aide to Ukraine. NONE have sent Troops to Ukraine.

          I am Sure Poland and the Baltics and Finland and many other nations with concerns about Russia are happy to See Ukraine killing off large numbers of Russian young adult males. But not so much so that they have sent their own troops.

          The populations of Poland and Ukraine are about equal. Based on what we have seen in this war – if Poland was willing to provide Troops to Ukraine – Russia would be driven out of Ukraine, and Crimea. Of cource Poland is a NATO member and has a NATO security guarantee if attacked.

          Russia has spent an enormous amount of blood and treasure on this war – and nothing in the peace deal being discussed is going to allow Russia to recover any of that quickly.

          Russia’s energy infrastructure has been decimated. Further Russia has not been educating the engineers and workers necescary to rebuild that energy infrastructure without outside help. SOME of the damage to Russias energy infrastructure is repairable by any nation with energy engineering experience. But any of the damage in Siberia requires energy expertise that is pretty much limited to the US.

          Next Russia has brned through massive stockpiles of military equipment – about 50% of their equipment reserves have been destroyed by this war. Further the equipment that has not been damaged is antique – some dating back to WWII and in bad shape.

          Russia will be able to replaces the losses in equipment – but it is going top take a very long time.

          Russia is just plane NOT going to be able to engage in any aggression against neighbors anytime soon.

          Regardless as I said before – Russian aggression IS in the interests of Europe, and Europe has assessed the threat that Putin and Russia posed and delivered what they believe is the appropriate level of aide to Ukraine to address their security concerns.

          One of the reasons this war has gone on so long is because both the US under Biden and the Europeans WANT IT TO.

          Neither the US nor the EU have wanted peace – so long as they do not have to commit troops to the fight.

          Both the US and EU were willing to pour hundreds of billions of dollars into Ukraine to use Ukraine to weaken Russia.
          The US and the EU have tolerated significant waste and Fraud in Ukraine – because Ukraine was very effectively weakening Russia.

          The damage this war has done to Russia is gargantuan and it is going to take a decade or more to replace.

Trump is far less concerned with the niceties of creating a “self-defense justification” that the state dept types so love.       By God, I think you’re right! Trump is clearly the president most likely to either find a “Maduro Dossier” inside an FBI investigation, or create a fraudulent military attack on our troops!

      That or something similar so he can send the SEALS emerging from the sea to kitten crawl across the beaches into Venezuela, while he orders the 101st Airborne battalions into a combat jump into Caracas while the Rangers do night drops to assault and seize all communications facilities, power plants, etc.

        Trump is the First US president since Ford to NOT invade a foreign country.
        Do I need to list the various invasions of every other recent president ?

        There is an open question as to what Trump will do if Madoro does not leave.
        I am not sure that Trump would be willing to attempt an “operation Just Cause” invasion of Venezeulla to depose Maduro.
        But even if he did – that would still make him less of a war monger than all other recent US presidents.

        Regardless, Trump goes to a great deal of trouble to avoid the US of US forces in any way that results in noticeable US casualties.

        the next president that did not start a War would be Eisenhower, and before that Hoover and Coolidge.

  8. apparently no one on the side of this being ‘illegal ‘ or saying it’s murder has ever been in combat. when you are trying to destroy a target, you hit it until it is destroyed. in WW2 when we hit a Japanese carrier in the battle of Midway we didn’t stop ltrying to sink it after just one bomb hit their carrier. We didnt stop the attack after each bomb hit one of their carriers to check to see if there were possible survivors. We continued the attack to ensure the targets were destroyed. Police officers are trained to shoot center mass and keep firing until the target is down. The left is in serious need of a brain on this.

    You may have heard of the Five Eyes intelligence alliance that was formed after WWII. After the war there were only 5 democracies left standing, the United States, Canada, UK, Australia and New Zealand. They formed an intelligence alliance to share all information so that another world war might be averted. Historically they have worked very closely together.

    The UK has particular expertise in intelligence gathering in the Caribbean, more so than the other four allies. They still have 5 Overseas Territories (colonies) in the Caribbean that they govern directly, Anguilla, British Virgin Islands, Cayman Islands, Montserrat, and Turks and Caicos Islands.

    There are also 12 countries in the Caribbean that are former colonies and now part of the British Commonwealth with very close ties to the UK, Antigua and Barbuda, The Bahamas, Barbados, Belize, Dominica, Grenada, Guyana, Jamaica, Saint Kitts and Nevis, Saint Lucia, Saint Vincent and the Grenadines, and Trinidad and Tobago.

    The UK has a lot of eyes and ears on the ground in the Caribbean, much more so than the US. Historically, the UK has been the best source of intelligence regarding drug trafficking.
