Harris Renews Calls to Pack the Court Despite Poll Showing Most Americans Agree with Court’s Decisions

Kamala Harris is again promising the radical wing of her party that she will pack the Supreme Court. Pete Buttigieg and others have done the same to pander to the extreme left. These calls are increasing among Democratic leaders despite a recent poll showing that the Court remains the more popular institution vis-à-vis Congress, and that the majority of Americans agree with its major decisions.

The Marquette Law School poll shows that the Court remains slightly underwater in popularity (47% favor, 53% disfavor), but it is still much more popular than Congress or the two political parties. Moreover, that popularity is increasing, not decreasing, as a result of recent decisions. It was at 44% in 2025.

The mantra to pack the Court is premised on the false claim that the Court is ideologically robotic and partisan. That claim has always been disconnected from the actual voting record of the Court. Forty-four percent of cases are decided unanimously by the Supreme Court. When nearly unanimous cases (8-1 and 7-2) are included, that figure jumps to over 60 percent.

The liberal justices themselves have pushed back on the Democratic narrative. Justices Stephen Breyer, Elena Kagan, and Sonia Sotomayor have all contradicted these claims. Justice Kagan recently spoke publicly on these claims, “rejecting claims that the high court’s conservative majority is in President Donald Trump’s corner.”

The most recent poll shows that Americans agree with most of the major decisions in the last year.

The poll highlights a disconnect with the logic of court packers. Sen. Elizabeth Warren (D., Mass.) has called for packing the Court because it does not follow her views and those of “widely held public opinion.” I have pushed back on that rationale given the Court’s function to be a countermajoritarian institution. However, this poll even challenges the flawed rationale for court packing.

Even the most controversial decisions break at around fifty percent. Notably, the opinion that Harris repeatedly denounces as an attack on democracy (barring racial gerrymandering) is supported by a majority of the country.

Yet, Democratic leaders and the far left continue the false claim that the Court is out-of-step with America and captured by the Administration. The reason is simple. The DSA and far left are threatening establishment candidates. They are throwing institutions such as the Supreme Court to the mob in an attempt to use them to regain power. It is not just tragic but pathetic. These establishment figures are unlikely to be safe from the mob. Hakeem Jeffries can call the Supreme Court “illegitimate” and brandish a baseball bat on social media, but the mob is still chanting “you’re next” when he appears on the screens at rallies.

For its part, the far left knows that the full agenda of changes that it wants to make to our constitutional system cannot occur without control of the Supreme Court. Law professors and deans are joining them in calling for the trashing of our Constitution and “radical changes” to our system. They will need control of the Court to achieve many of those changes.

So the American people may support the Court and favor its decisions, but it still needs to be packed with a liberal majority.

Harris and Buttigieg consider trashing the Supreme Court to be a small price to pay for their own election.

  2. Packing SCOTUS is not intended to serve the public interest for the betterment of the country. It’s purely about enacting laws in violation of the Constitution and to the detriment of public welfare. It’s goal is to make permanent their power. It is backed by both the DNC and DSA. I read a quote in JT’s “Rage and the Republic” that said to the effect that when a leader’s actions run consistently contrary to the welfare of the governed that they no longer owe loyalty to that leader. In such a case revolution is justified. The Democrat party whichever faction assumes control is the threat to our democratic, capitalist republic that has defended our freedom, security and prosperity since it’s founding. That is what is at stake now.

  4. My opinion of SCOTUS has gone up considerably in the last decade. What I hated most was the almost religious devotion to Stare Decisis, the stubborn reluctance to revisit wrongly decided past rulings that were clearly influenced far more by personal politics than the Constitution, especially where new rights were conjured out of thin air (or a body orifice). When there is no constitutional basis for a decision on a deeply dividing issue, SCOTUS needs to leave the politics to the political institutions.

    The judges on the supreme court for my (deep-blue) state are elected by popular vote, and the decisions have been horrible. In recent years in particular, the state legislature has passed laws that blatantly violate the state constitution, knowing that the state supreme court will “defer to their judgement”.

    A bit off topic, there is a recent video that captures the essence of what passes for an impartial judge in my state (search YouTube for “Unhinged activist judge exposed by Brandi Kruse”, video id N6oPY4dzBqY. Background: the state legislature has been trying for years to diminish citizen ballot initiatives, especially initiatives that cut taxes; their most recent attempt is requiring the inclusion of a “sabotage sentence” in the ballot title, to the effect that any tax cut will starve children, etc. Some recent polling has shown that such sabotage sentences are effectively the kiss of death for a ballot initiative.

The SCOTUS has been “interpreting,” modifying, amending, and corrupting the Constitution from the outset. Primarily, the absolute essential right to private property has been shredded by the SCOTUS, and the right to private property is what first differentiates America from communism. The SCOTUS must be corrected forthwith and with extreme prejudice.

The same Article enumerates and provides Congress the power to regulate ONLY “the Value of money,” “Commerce with foreign Nations, and among the several States, and with the Indian Tribes,” and “land and naval Forces.” 

      Further, the 5th Amendment right to private property was initially qualified by the Framers and is, therefore, absolute, allowing no further qualification and allowing ONLY the owner the power to “claim and exercise” dominion over private property. 

      Government exists, under the Constitution and Bill of Rights, to provide maximal freedom to individuals, while government is severely limited and restricted to facilitating that maximal freedom of individuals through the provision of security and basic infrastructure. 

      The Necessary and Proper Clause is nothing more than a perfunctory redundancy for the purposes of clarification—a reinforcement of that which was previously codified—and may not be wielded to amend and impose separate acts that do not represent but alter the letter and spirit of the Founders and Framers.

It would lose all legitimacy and likely a significant number of states would announce that they no longer believe the SCOTUS to be legitimate. After such a statement they would also announce that they will not follow or adhere to any decision made by such a “packed court”. I’m quite sure that the DSA would realize that those states will resist any such decision coming from SCOTUS and it would cease to exist in any meaningful manner. Packing the court only requires a change in law and signed by the president but eliminating the senate or the presidency would, of course, require a 2/3 vote of each chamber and 3/4 of the states to agree. So I am sure they know that will never happen. So they must be thinking of an alternate process like a coup.
    The red states would never accept a “packed court” even if done legally. Or the other DSA plans. So, once again, what are their real plans?

  14. More and more I’m impressed with the founding fathers’ creation of our separation of powers governance. They seemed to fully understand the nature of power and the consequences of power concentration.

    The current Democrats, however, seem to have rejected that and desires to concentrate all power within Congress itself. Packing the court is effectively eliminating the court’s independence. Eliminating the Presidency and the Senate goes farther still. Buttigieg and Harris are followers, not leaders, perfect for a castrated Presidency – like Biden. Even within their party, we see a concentration of power, also reflective of their national goals.

    If the DSA gets its way, America will no longer have a Supreme Court. That crucial check on government power will be replaced with a “policy court” — a panel of “policy judges” appointed by and answerable to a *single* legislative body, whose sole purpose is to enforce party doctrine. That is called a politburo, which is a key feature of a communist form of government. That is not a government of laws. That is a government of men.

    In substance and in form, the Left’s vanguard is not socialist. It is thorough going communist.

The court has already been packed down thru the federal courts. It’s how you get Presidential immunity which will haunt us for decades if not centuries. I see there was no question about presidential immunity or partisan gerrymandering.
