Illinois police have been accused of violating religious sensitivities by forcing Nour Hadid, a 26-year-old woman accused of beating her 2-year-old niece Bhia Hadid to death over four days. She demanded to be photographed wearing her veil covering her face and her husband Alaeddin Hadid has announced an intention to sue the police for the “insult against our religion.”
It is hard to see the validity of the demand for a mugshot with a concealed face or hair. The police has a valid need to be able to have a full picture of the face of an arrested person.
However, I am a bit curious why the mugshot showed her bare shoulders when that is not necessary and would add to the problem. She appears virtually undressed and I fail to see why the police could not have place a jacket or cover over her shoulders given her religious beliefs.
Nour Hadid is accused of a pretty offensive act in any religion. The child was found with 55 separate bruises and was beaten “from head to toe.”
Nevertheless, the husband has promised that police are “really going to be in big trouble” for the mugshot.

I live a stone’s throw (stoning anyone??) from Orland Park. It is a pretty nice, and pretty boring suburb that was mostly farm land until a few years ago, and is now mostly occupied by decent public schools, Mc-Mansions with about three inches of empty lot between them, and a huge shopping mall. Also, most likely because of the good schools, an increasing number of middle-eastern folk have started to live there. This used to be a pretty lilly white burb. There is now a “community” of Arab, Indian, Pakistani, people living there. I have heard complaints from folks I know. (My law partner’s Iraqi, should I be required to do the “some of my best friends are…dance”)
This was likely the first murder case for the Orland Park Police this year. It is a relatively crime-free town. I find no fault with taking this woman’s mug shot. It’s a damn murder case. The current controversy wouldn’t have arrisen if some overly rambuncious cop hadn’t decided to give her mug shot to the local paper. That was dumb. It is possible that the mug shot was circulated with some crypto-racist glee knowing it would be extra insulting to hyper-sensitive burka-wearing folk; but I’ll give the Orland Park Police the benefit of the doubt and assume that since this is most likely the “crime of the century” so far, somebody just wanted some press and their name in the paper.
Well I think that they should be flogged and beaten for showing or tending to incite religious intolerance.
I guess if bank robbers have a sincerely held religious belief then they should have the right to wear masks during the Photo Opportunity as well. It is not like they killed a 2 year old over a 4 day period.
I have read and do not know this first hand, but generally they hit and run. They don’t stay around, the robbers that is, for very long.

Yes they do. As a practical matter guards need to be able to visually identify prisoners, hence the standardized clothing.
Maybe she can get an orange veil with that jumpsuit. I do not like it when people try to hide behind their religous beliefs when determining who beat a child. Go ahead and file your suit, but I am guessing she will have to get used to how she looks without the veil. Do prisons have the right to mandate no veils on prisoners?
As far as First Amendment claims go, they don’t have much of a chance. The free exercise clause analysis gets rational basis for laws that are generally applicable to the populous as a whole. You have the unburdened right to believe, not to practice. Enjoy the orange jumpsuit!
The husband’s response, while seeming irrational, given the heinous crime his wife is accused of, is not surprising. Islamic fundamentalism is a “shame based culture”. The crime, in the husband’s eyes was the shame of his wife having to reveal herself in a booking photograph made by the authorities, since the child beating was probably conducted outside of public view, there is no attendant shame attached to that.
Another factor to consider, is that children and wives seem to be viewed more as chattel by the patriarchs of Islamic fundamentalist families, and no amount of abuse that might be dished out would be considered inappropriate, given the pecking order.
I don’t know which culture has been the biggest failure at adaptation towards learning that we no longer live in the dark ages, Catholicism or Islam?\

most head shots do show the shoulders it appears she didn’t have anything but a top with thin shoulder straps on when she was taken into custody
and this is about testing whether Quranic law should prevail over American secular law
the quran does state a story when the Prophet Mohammed forgave his sevant for spilling hot water on him…including paying the servant money…but other parts of the quran does discuss the right to beat unruly wives and children…will have to find that for u…most of the sharia laws come from the hadith which is verbal law passed down that was at one point written down

Sorry! Your religion doesn’t give her the right to the anonymity of hiding her face. She gets her picture taken like every other person charged with a felony. Fingerprinted too. She’ll also be going to prison where her or your choice of garb means nothing. You don’t like it? Move. You want Sharia? Then you should have gone to Saudi Arabia instead of coming here. But the child killer stays here until her sentence is served. The biggest insult to your religion here, or any religion for that matter, is your “righteous indignation” in protecting a child killer, Hadid. Or are you more concerned with protecting your religion? I’ve read the Koran. No where does it approve of beating children to death. Where the hell was all that concern over what Mohamed would think when your child was dying? Your reaction shows a total lack of critical perspective as well as a retrograde sense of responsibility. As a parent, you have one job and one job only – protect the children. That responsibility trumps all other considerations – religious or otherwise. You’re both failures, doubly so in her case as the child died by her hand. How about saving that anger for the ones who deserve it – yourselves. As far as human judges and American law in relation to your suit, good luck with that. You stand a better chance of bringing the child back from the dead than winning this ridiculous suit.
