Prostitution May Become Legal This Saturday in Ontario

To the delight of civil libertarians and libertarians alike, the Canadian courts have been leading the world in dealing with conflicts between privacy principles and morality legislation. I am serving as an expert in the review of Canadian polygamy laws in British Columbia. In the meantime, the Ontario Superior Court may allow three prostitution laws to die this Saturday.

In September, the Court struck down the laws. The federal government is charging that this is nothing short of a “social experiment unprecedented in this country.” However, it is also a frank acknowledgment that consenting adults came engage in sex for money as a consensual choice. Currently, an individual can have sex with any number of partners but can be arrested if they accept anything of value in exchange for sex. They can receive gifts as part of a “relationship” no matter how fleeting but not as payment.

The Court previously noted that criminal laws force prostitutes in the shadows where they are easy prey for abuse and even homicides. Once legal, protections and regulations can apply to the world’s oldest profession. With the demise of the laws, street walking will be legal.

    Not unless there is conscription to the Prostitute Corps and I hear that Congress hates the competition.

    Now, they may choose to engage in prostitution for reasons you stated, but I hardly think you could force them into sex slavery without running into some major problems. Probably very violent problems.

    No one is pointing out the negative impact on neighborhoods from prostitution.

    I think the Canadians are already preparing for red light districts similar to Amsterdam. But, even if they don’t have a red light district I am sure that they have noise/disturbance laws to cover that argument.

    The real idea is to protect the women (and men) from harm.. The pimps, and the dangerous johns etc.

    Canadians already have a health care plan for everyone.

    I am sure that Canada will tax (income)the prostitutes just like any other citizen/resident, and will probably even reduce their unemployment rolls and benefits.

  3. I agree w Bud that prostitution agreements involving only the people engaging in it should be legal but that pimping and facilitating it should be illegal.

    Another point is that the State of Nevada formerly required women to work as prostitutes if the work was available as a condition of getting Medicaid, Aid to dependent children etc. Gloria Steinem stopped that practice but who will stop it now?

    Now that homosexuality and kinky sex are so accepted, men in America should be prepared that if prostitution is legal they will be required to submit to all sorts of sex and S&M as a condition of getting means related government benefits and a way of repaying debts. It shouldn’t matter if the man is homosexual or not as earning money through prostitution doesn’t require mutual enjoyment.

    My understanding of the Canadian Criminal Code is slightly different from your interpretation.

    1. Prostitution is clearly legal everywhere in Canada.

    BUT, (or should that be (BUTT),

    1. Living off the avails,
    2. Operating a bawdy house and,
    3. Communicating for the purpose of prostitution,

    are all illegal.

    I believe that these three offenses are the center of this
    appeal.

  10. Prostitution is already legal in Canada, I believe what is outlawed is street-walking, advertising, and pimping. Once in Canada, one can look up escort services or companions or some such in the phone book, and prostitutes are allowed to discuss fees, acts, etc over the phone freely, and accept payment. It has been that way a long time. Americans don’t realize it because of the prohibition on promotion and public displays.
