As fellow law professor sent me this video of Oakland police shooting a photographer. The video raises serious questions of the unjustified use of force.
In the video, the police appear to be standing without challenge when, around the 33 second mark, an officer suddenly shoot a photographer who is a good distance from the police line.
I cannot imagine the claim of justification in this case when the use of rubber bullets present significant potential harm to citizens, as shown below.

rafflaw, dont you know in America, if you do not follow any order from a policeman, you DESERVE to be tased, billy clubbed, pepper sprayed, shot,etc.
You have to do whatever the police tell you to do these days, no matter what.
In my town as well. The Occupy fb page went from 6 followers to over 500 in two weeks. People meet every Thursday for the General Assembly and every Saturday to ‘march’ on our old courthouse square. A town of 30,000.
I went today for the first time. It is an old fashioned way to meet people and talk about our nation. We walked (I would say marched, but it was a stroll) with some signs, and talked to people. People who supported us honked their horns, and my dog made some fun friends. Old fashioned Democracy. People talked to each other respectfully.

Those who support the “teabag” movement are quite simply assholes and as such do not deserve my respect, or my trying to make common cause with them. I do believe in reaching out to all people despite their viewpoints and so thus try to make common cause. The answer to the issues of the ongoing feudalization of our society does not lie with the old paradigms of “left” and “right”. However, there is no common cause to be had with those who are too stupid or too greedy to understand who their enemy really is.
In that sense those who “teabag” fill the bill as hopelessly irretrievable.
I think some folks here are whistling past the cemetery. OWS appears to be growing, based on several parameters. Facebook links are growing almost exponentially. Reports of crowd sized in various media outlets indicate that either growth is holding steady or growing. In some areas, there seems to be a media blackout, but they cannot contain Twitter, Facebook or YouTube. Or the blogosphere.
Latest from the Bay Area is the official position of Berkeley police is that students linking arms is such an act of violence against the police that use of batons is necessary, even if it causes ruptured spleens, kidney damage or broken bones.

The OWS movement has appropriated $29,000 to go to Egypt for the next elections. It has already gone world wide. The people are organizing on a scale never seen before. New technology is helping this happen.
