Video: Oakland Police Officer Shoots Photographer With Rubber Bullet Without Any Apparent Provocation

As fellow law professor sent me this video of Oakland police shooting a photographer. The video raises serious questions of the unjustified use of force.

In the video, the police appear to be standing without challenge when, around the 33 second mark, an officer suddenly shoot a photographer who is a good distance from the police line.

I cannot imagine the claim of justification in this case when the use of rubber bullets present significant potential harm to citizens, as shown below.

  2. the answer to taxation of wealthy Americans is to lower the rate for everyone and have a flat tax with no deductions for anyone and all income of any type is taxed at the same rate.

    Exclude the first $40,000 from any taxation to make up for lost deductions by the middle class.

    The right and left do not want to reduce taxes on anyone, they just want to spend and spend.

  3. At Occupy Atlanta there were reports picked up by many media outlets that tuberculosis had hit the camp, but the Atlanta Journal Constitution reports tests showed “No trace of any TB at all.”

    I should know better than to take information from anyone on the ‘right’ who posts . Face it, there is a huge undertaking in MSM and right wing media to discredit this movement any way they can.

    It is too big, and it already has a couple of victories against corporate America (BofA dropping debit card fee & the XL pipeline delay until 2013 which will mean investors will drop out).

    Interesting what a REAL grassroots movement can cause. Sheer panic by corporate America and corporate media.

    The OWS movement has appropriated $29,000 to go to Egypt for the next elections. It has already gone world wide. The people are organizing on a scale never seen before. New technology is helping this happen.

    I love small business and use them as much as possible. Big corporations are faceless and could give a hoot about my business for the most part. Although I know the CEO does because I have called one or 2 when I wasnt happy with an answer I got from middle management. Middle management usually called me back before the day ended and solved/fixed my problem.

    I think more people should stop working for large corporations and start their own business or go to work for a small businessman like you. Small business owners tend to treat their people pretty well and appreciate their people more.

    Seems to me people are either beholden to a corporation or government for their daily bread. If they could rely on themselves more, things would turn around pretty quickly. But people are afraid and that benefits government and the big corporations.

    you can’t claim that the OWS movement isn’t growing and you can’t claim that its principles are not sound, but you can try to divert attention to the cause with your continual allegations and insinuations that they are dirty, unsanitary and evil people who are trying to destroy your beloved Banksters. Fortunately, no one is buying it because it is just Rovian tactics to save the Banksters. The same Banksters who cheated Americans out of Billions and then demanded a hand out from Government. I am soundly behind the OWS movement because they understand that there are no sides here, except the side supporting the middle class and the rest of the 99% of America.

    I do not know where this obsession with hygiene comes from. Have none of the right wing ever camped out or lived outdoors? When I was between jobs at age 22, I hiked the Appalachian trail one whole glorious summer. Just braving the elements and finding solutions with ingenuity is part of the experience that is so rewarding. Battling the elements is a victory.

    All these problems are common among the homeless, which is why they are shunned by ‘society’, thrown off the bus, swept under the rug. Abandoned by regular society, all these ‘problems’ go underground. (Or they ride the light rail in Houston all night in order to stay out of the weather.)
    When I was in Vegas on business last summer, I could ‘spot’ the people who were urban campers. I know what they have to do to maintain their health and minimal cleanliness.

    Dont you think having antibiotic resistant TB is a failure, not of the people who contract it, but of our health care system and our food system? Scientists have been clamoring for over a decade that we should end non-theraputic use of antibiotics in CAFOs. This is ONE MORE problem that has been created by giant corporations buying our government to block laws regulating them.

    As for this ‘lung sickness’, when you live outside in the damp cold- sure some people will be more likely to become ill. That is why we have a huge effort now to get the camps the right equipment they need to stay healthy while being exposed to the elements during the winter.

    As far as the Tea Party goes, we have a number of them in office now. We know what they stand for: they do not have the intellectual depth to understand the problems facing the nation, much less propose solutions to these problems. It makes them the perfect foil for giant corporations to manipulate in the worst ways.

    I was going to complain about this kid, who shall remain nameless but his initials are HenMan, sitting behind me in class constantly dipping my pigtails in his inkwell.

    The next day he, who shall remain nameless but his initials are HenMan, brought pictures of his pet bobcats to class for show and tell.

    “Hmm,” thought I, “perhaps tattling to the teacher is not the smartest move I could make.”

    Immediately after class I took the bus downtown and got a haircut.

    Now political differences in America are equated with the terrorist acts perpetrated by Palestinians on Israelis or Israelis on Palestinians. Yikes! On reflection, there is some truth to that for Tea Partiers are the ones who attend rallies with their six shooters proudly strapped.

    Why did Tea Partiers close their ears and refuse to listen to Wisconsinites who were fighting for their hard-earned right to bargain collectively?

    I’m not sure why you get so upset when people criticize Tea Partiers. You often criticize Obama. We should feel free to speak out against things we see that trouble us–just as we should speak out against the people we think have done things we strongly disapprove of/believe to be immoral

    Just because one criticizes others–it doesn’t follow that she hates them.

    I’d say it was Tea Partiers who chose to pit themselves against many other Americans. Here’s an example: They went into Wisconsin on buses paid for by Americans for Prosperity–which receives funding from the Kochs. They were there to support a governor and other Republican legislators who were working to take away collective bargaining rights from public sector workers. They fought healthcare reform. Why aren’t the Tea Partiers fighting for financial reform in this country instead? Why aren’t they demanding that wealthy hedge fund managers be taxed at the same rate as us regular folks? Too many members of the Tea Party have become tools of people like Dick Armey and the Kochs. I think they deserve our criticism.

    OK, then lets talk about that for a moment. Scan over the thousands of photos of tea party rallies on the internet. How many brown and black faces do you see? The only place you might see more white faces is at a Klan rally. I looked at pictures of Republican rallies. Same thing. The minority people there are REALLY a minority. And how about the way they treat gays? They support what they call “right to life” which apparently applies only to fetuses. Immigration reform means demonizing Hispanic people and driving them out of town.

    It boggles my mind that any person of color (any color), women and gays would be willing to join the Republican party.

You are the same person who just claimed that I was dehumanizing people by telling the truth about their actions and now you want me to assist you? The Tea Party is bought and sold by radical factions of the Republican Party, or as I like to call them, Teapublicans. If you are aligning yourself with a group that believes that the 1% should control the economy and the tax code, then your comments about the Bush Administration are old news.The Tea Party backs politicians that want to return women to the time when they were considered chattel and yet I am not supposed to tell the truth about them because that would be dehumanizing a group of people. Just as I criticize Obama for not going after the Bush crime family for their torture, I criticize the Tea Party or Teapublican presidential candidates for backing the theft of our economy.
