Bullets and Burgers: 9-Year-Old Girl Accidentally Kills Instructor After Being Given Uzi At Target Range

Screen Shot 2014-08-28 at 3.24.58 PMWe previously discussed the tragic case of an eight-year-old boy who shot himself accidentally with a fully automatic Uzi. A similar tragedy has now occurred but it is the instructor who was killed by a 9-year-old girl learning to fire a submachine gun in Arizona at the Bullets and Burgers shooting range. The instructor, 39-year-old Charles Vacca, died at a hospital after he was shot in the head.

300px-uzi_1Bullets and Burgers allows children between 8 and 17 to shoot such weapons. An Uzi is an Israeli-made submachine gun. In this case, the recoil moved the weapon off the shoulder of the little girl and turned toward the instructor. The video showing the event up to the second before the shooting is shown below. The video shows Vacca positioning the little and her firing off a single round. Vacca then adjusted the Uzi, put his right hand on her back and his left under her right arm. She fired several rounds in rapid succession before the gun kicked to the left as she lost control. She was with her parents.

Bullets and Burgers advertises that “We separate ourselves from all other Las Vegas ranges with our unique ‘Desert Storm’ atmosphere and military style bunkers.”

These types of accidents are generally covered under issues of assumption of the risk and contractual waivers by all of the parties, including the instructors. The death would be covered under worker’s compensation unless the Vacca family will seek negligence liability for how the facility is run or structured as well as standards of training and safety. There is the separate question of whether the state should limit such use of weapons, a highly controversial question with gun rights advocates who are likely to point out that all of the parties consent to such risks (with the parents consenting for the minor). Finally, there is the emotional distress for this little girl who will have to live with this incredibly horrific memory.

Notably, some coverage suggests that Vacca may have been negligent in where he was standing. Greg Block, who runs California-based Self-Defense Firearms Training, said that a child should not be using this type of gun and that Vacca “was literally in the line of fire. He did pretty much everything wrong, and I don’t like saying that because it cost the man his life.” That would raise the question of possible liability of the range if the family were to sue over the trauma to their daughter, though such a lawsuit would present difficult issues since they would effectively have to sue the man killed by the minor under a respondeat superior theory.

In the Massachusetts case, former Pelham Police Chief Edward Fleury was found not guilty two years ago in a prosecution for involuntary manslaughter and furnishing a machine gun to a minor in the death of 8-year-old Christopher Bizilj.

    I read your comment and had to laugh. Not for what you said (I agree with that part), but for the CAPS when you want to emphasize a word.

    A while back I happened across a motion where the attorney did the same thing. I was surprised that it was an actual attorney, as opposed to a pro se litigant, but what was really cool is when the judge ruled on the motion, he did so in all caps. 🙂 That took one-upsmanship to a whole new level.

      1. Everybody reporting something doesn’t make it correct. Everybody is often wrong. But I am not, in this case. Las Vegas still is not in Arizona. You are missing the point, just as everybody else does about this, apparently. But that point is small and irrelevant to the issue, I will concede, so never mind.

      2. If liberals are so against war, why are they so silent about all the wars today? There have been no concerted protests against the Government’s wars since the 1960’s. Liberals acquiesce to the horrors of Government armies killing hundreds or even thousands with guns in wars going on every day, but shriek in terror and anger about an individual using a gun to kill people, even when it is clearly an accident and only one person died. Color you shocked about that?

    When you want to convince the other side that YOU are not a Gun FANATIC, then you at least realize that 9 years old is NOT an appropriate age for shooting an Uzi at a PUBLIC Firing range, where OTHER people could get hurt…..

  6. OK, REALLY???? You can’t see making a LAW that mandates that at a public shooting range, that if a customers wants to shoot an Uzi, that they should be at least 16 years of age????
    and possibly a height and weight requirement???

    That is hardly taking anybody’s guns away…..

    WE would NOT allow a 9 year old to pilot a plane with an instructor….
    We do not allow 9 year olds to take part on Race Car Driving instruction….

    And really, it is NOT a Constitutional RIGHT to go and eat a burger and PLAY with guns…..

    It is NOT even close to ridiculous to put some restrictions on age, height and weight when shooting CERTAIN guns……

    and yes, I thought that people would have learned from what happened 2 years ago….. But, that does NOT seem to be the case…..

    So, NOW, it looks like it is time to maybe put in a little restriction or 2….

  7. Jag, so true. My first words after hearing this was what sheer idiocy and gun nuttery. This poor little girl will probably need therapy to help her get over this trauma. The gun instructor is dead, does he leave behind children, wife?

    Two observations:

    1. Las Vegas is not in Arizona.

    2. Hundreds of thousands of people have been killed by machine guns during wars, yet it is rare, if ever, that anyone suggests passing a law that makes wars illegal.

    Question: Why aren’t the anti-gunners wanting wars banned? (Governments and their armies with guns have killed millions more during wars than individuals with guns have ever killed, intentionally or accidentally.)

    I was at a shooting range many, many years ago and learned some basics with a military weapon that shot 22s. I did quite well. All shots were at or near the middle of the target. Just before I left, I was handed a different, “sleeker” gun. Nice. Then they set it to automatic. One squeeze on the trigger and Holy shot! I didn’t go nuts with it, but if I hit the target it was a wonder. I stuck with single shot 22s after that but when it became obvious that I was expected to use it to shoot live things with it, I quit. Haven’t touched a gun since.

    That’s a big no, no. Seems the man got careless. When I was growing up large numbers of hunters would kill themselves every hunting season, either by trying to clean a loaded gun or carrying the rifle around with the safety off. You can write all kinds of safety rules, but people have to follow them.

I thought that after that 10 year old boy SHOT himself in the head in from of his FATHER with an Uzi, 2 years ago, that shooting ranges would have become safer and barred children UNDER 16, and a certain height and weight from firing an Uzi,…… But….. NOPE…. Idiocy strikes again…..

    A few of those trainees also refused to take showers in the Army barracks open bays.

    The 101st DI’s washed them with comet cleanser and toilet brushes. After that, the word was out that M-16’s & M-60’s would be used for payback.

  13. The instructor was at fault here, he suffered the consequences of his mistakes in the most permanent way possible. All live range instruction will look to this now infamous incident and become safer. We evolve and move forward when we learn from our mistakes and the mistakes of others. Those who witness violent car crashes where safety belts are not worn are more likely to wear there’s. They learn from the mistakes of others.

  14. That was extremely stupid to have a child that young and small fire a submachine gun.

    I would say there is liability on behalf of the gun range disregarding reasonable safety for this use of the weapon.

    A properly supervised child can shoot small weapons such as .22 calibers and such but the ability for a submachine to go wild in such a shooter is too high.

  16. Perhaps the best solution to such “accidents” is to correct an accident of evolutionary biology, to wit, the evolution of the species which in a specious manner, has accidentally given itself the flagrantly false taxonomic label “homo sapiens sapiens.”

    Enough more (about 8 billion?) similar events, and this planet, so-called “Earth,” may yet become a safe place for other forms of life to thrive.

    When the last member of the falsely-self-alleged species, “homo sapiens sapiens” has proven itself to really be a form of “homo stulus stultis,” and has relived planet Earth of its atrocities by eliminating itself, will “Earth” finally become a place that is safe for decent forms of life to live?

    The self-eradication of humanity is necessary to save humanity from itself?

    To save humanity from itself, humanity needs to destroy itself?

    Or, is the rule of law actually fractal?

  17. So in one state we give grade-school children a permanent black mark on their school records until age 18 for chewing a pop-tart gun and another child with a “Lego” gun (the size of a dime) while simultaneously placing them on the police radar screen probably for life.

    In another state we have a 9 year old allowed to fire an real automatic weapon that actually killed someone with no penalty for the parents or gun range operators.

    We have found the extremes, where are the rational gun policies?

  18. Army Drill Instructors, the ones that trained me. They were 101st airborne combat.

    About 15 trainees were pulled off the firing line for physical or physiological problems.
    Hint: I was working with the military provost marshal and CID. And could pick out troublemakers from a mile away. Street slang is your busted. Average age 19 – 21.

  19. Is Progressivism rooted in the assumption that the Human Species is too big to fail? I can see no amount of government intervention that will completely succeed in securing human nature from itself. If that is true, then the best government should hope to accomplish is to provide as secure an environment as possible in which we have the liberty and freedom to make our choices without infringing the natural rights of others. A lesson in common and special cause variation would be useful here.
