The police in Overton Texas have scored another victory over neighborhood lemonade stands. We have periodically seen these cases where police swoop down on stands run by kids in one of the oldest traditions of American life. I do not blame the police as much as the City of Overton for failing to have a code that can accommodate such kid lemonade stands or a modicum of discretion afforded to police in the enforcement of city permit regulations. In the meantime, Andria and Zoey Green’s business is closed by order of the city.
A video shows the police questioning the mother and instructing her that a permit is required. When a friend went down to city hall to obtain a permit, the family was told that the city was willing to waive the $150 fee for the city’s Peddler’s Permit but would need to contact the health department for permission to operate the stand. This in turn would require an inspection that must be conducted and a permit must be issued in order to sell anything that must be temperature-regulated to prevent bacterial growth, including lemonade. In case you missed the gist of the story, this is a child’s lemonade stand that would require a variety of adults inspecting, permitting, and approving the operation before they can sell their first cup.

The Police get blamed for so much of the un useable law that is written by the influence of money on Politicians. Badly written law, influenced by money is a Political Problem the Judicial Branch then has to deal with.

This is awesome! So nice to see some kids taken down by an over regulated govt.This is the America the progressives want. Here in NY it is illegal to sell cider without unnecessary expensive pasteurization equipment. I have an old cider press from my youth that we used to make and sell cider at the yearly church fair. I wanted to do the same thing for the church I belong to now and they won’t let me. So everyone misses out on the fun social event of making cider. And yet Mrs. Jones can sell baked goods from her kitchen with her 20 cats sunning through the batter. I’ve wondered if a way around the cider issue would be to not sell the cider, but rent the machine for 10 minute intervals for the same price as a gallon of cider. What the customer does with the press is up to them.
David, I agree. The over regulation mentality also destroys more then just the youth of the country. It also stops adults from trying the “Two guys” in the garage inventing something. I have a mill and a lathe in my garage and I’m sure there are a thousand regulation I am breaking by just having them. God forbid I ever use them to start a business.
Can’t have that white privilege widening the income gap at such a young age. These girls probably have an unfair advantage because both parents live at home and actually read them bedtime stories. What have I missed? Maybe these horrible girls won’t sell to anyone with a rainbow or Obama/Biden sticker on the car.

People are having to take welfare and food stamps because they need to survive, not because they are ‘welfare queens’. Corporations are making record profits, but no workers benefit from that. Workers wages have stagnated while production has gone up but their rights, benefits etc. have gone down. Sir, you have no soul, no heart and you must have never worked a real job in your life. I did. Go join the Koch (John Birch Society) bros. teabagging friends. My parents worked from the time they were able, picking cotton etc., refused to allow me an afterschool job. Education more important. Some people have no heart, no soul, no conscience, shame, shame.
Just a note, I’ve been retired for over 5 years. I’ve lived full time in Thailand for over 5 years, been here for over 13, the kids here, including ours, seldom work anymore either, their parents don’t want them to have to live like they did. Only a sick mind would not want their children to have a better life.
Not to worry, the repugthuglicans will send the US back to 3rd world status, they’ve already destroyed most of the middle/working class.
The child labor laws are destroying this country, especially the federal laws. Businesses should be free to hire young children under 16, even those under 12, to sweep the floors or do other tasks that they are able to do. Drop the minimum wage to make this attractive to business owners. Force schools to hire children for the janitorial work at schools. The upside is that children learn the value of work. Teenagers should not be forced to have breaks every 4 hours. This only causes some restaurants not to hire anyone under 18 because it disrupts their shifts. There are just too many regulations and so our children grow up being lazy bums and not knowing how to work, earn money, spend money, etc. All of these are reasons why so many are on welfare today and why businesses interview 50 applicants and can barely find one ready and desirous to work. Most just want to sit in a chair and collect a paycheck.
Yes, go after Texas.
Meanwhile, kids walking home from the park alone in Washington DC get their parents arrested for neglect.

Everything is bigger in TX, even the stupidity apparently. Must blame those ‘liberal’ TX government bureaucrats and liberal police for their inability to bend their robotic brains around a lemonade stand.
The bureaucracy is staffed by those who do the same job for decades, are not encouraged to think outside the expanding rules book, are rewarded for compliance and not making waves, are not held accountable for their clueless acts as long as they have union representation, are then they are rewarded with a 3/4 for life paycheck upon retirement from the same job they held 30 years earlier. So regarding the lemonade stand, that is how the bureaucracy is forced to think; as visions of lifetime retirement checks dance in their heads. And if that’s liberal……

Growing up in SE Texas I sold figs, and pecans from a very similar stand. Made my “summer” money that way. It was deposited in the bank, back then one could trust the banks, especially since most were local.

I saw these kids on TV last night. So cute! The city won’t let them SELL lemonade, but there were no rules about giving it away for free, so they stayed open and handed the stuff out without charge. Not sure if that is still going on.
