Texas Police Shutdown Girls’ Lemonade Stand As Unlawful “Peddlers”

lemonade-shut-down-leadThe police in Overton Texas have scored another victory over neighborhood lemonade stands. We have periodically seen these cases where police swoop down on stands run by kids in one of the oldest traditions of American life. I do not blame the police as much as the City of Overton for failing to have a code that can accommodate such kid lemonade stands or a modicum of discretion afforded to police in the enforcement of city permit regulations. In the meantime, Andria and Zoey Green’s business is closed by order of the city.

A video shows the police questioning the mother and instructing her that a permit is required. When a friend went down to city hall to obtain a permit, the family was told that the city was willing to waive the $150 fee for the city’s Peddler’s Permit but would need to contact the health department for permission to operate the stand. This in turn would require an inspection that must be conducted and a permit must be issued in order to sell anything that must be temperature-regulated to prevent bacterial growth, including lemonade. In case you missed the gist of the story, this is a child’s lemonade stand that would require a variety of adults inspecting, permitting, and approving the operation before they can sell their first cup.

  4. I always have to laugh and shake my head when people talk about other Americans “being on the dole”.There are many Americans that worked from a young age on into their older years. That is NOT unique. I worked from the time I was 12 years old babysitting, then at 15 worked throughout high school as a waitress, then at 18 worked as a nurse’s aide through nursing school, then got married and had children and worked soon after having every one of my children. Then after becoming single again I worked full time while going back to school, sooooo let’s not think we are so unique and continuously deride others.

    My husband and I, along with others, have come to the conclusion that we cannot “vote our way out of this mess” and that other measures will likely be resorted to at some point.

  11. How in the world did we (old farts) ever survive.

    No permits for lemonade stands. No FDA inspections. Rode our bikes without helmets or knee pads chasing down the ice cream truck to get some sugar laden treats. Practically no adult supervision. Basically it was “Go outside and play, but be back in time for dinner”. Rough games where we would often get hurt and even bleed. Baseball,red rover red rover, play war games and pelting each other with dirt clods, climbing all over the new construction down the street….way better than jungle gyms at the school yard (which don’t exist anymore….tooo dangerous). Shooting bb guns at targets….hopefully not at each other…”You can put someone’s eye out with that!!!”. Walking and riding our bikes to parks and fields without being under the watchful eyes/thumbs of our parents. Spending hours and hours just having fun.

  12. David, Great comment. One of the most valuable experiences I had was being able to work in the family restaurant @ a young age. I also was able to caddy, there were no restrictions on that. I had a morning paper route as well. I came from a hard working, blue collar family and it is that work ethic that shaped my life. That is dying in this country w/ way too many people on the dole. Taking the shackles of govt. off and allowing kids to work would help. There are labor laws that would prevent the abuses of the early 20th century.

  13. Discretion is the most important word in law enforcement. These Overton cops had the discretion to just walk on by when they saw this lemonade stand. Over and out.

  14. The author, Charles Murphy, has called upon Americans to employ civil disobedience against our intrusive and overreaching govt. He suggests a trust fund be set up and people have free legal representation to fight back against a govt. that needs to be shown its place. This would be a perfect example of its usefulness.

  16. I’ve often thought that the worst statement a parent can make is, “I want my child to have it better than I did”. There are very few generations where that statement makes any sense. In this time period it would just make lazy kids, which is what we have.

    So nice to hear from you and your wonderful sense of humor. Your ‘explaining’ routine is hilarious. Another thing that works well with children is that they can get into tight places to clean out residue, etc. Along with a small donkey a child makes the perfect way to get the coal out of the mines. The NSA is considering using kids shorter than 4′-6″ to spy on people because at that height they can get real close and be out of most people’s central vision. Nobody thinks twice about a kid hanging around.

  18. I think these cases have larger ramifications. I believe one of the main factors allowing this country to rise to the top of the world so quickly was the impetus of the individual to succeed, regardless of the negative factors staring that them (of course, that thinking has it’s drawbacks, too). Point being, what does this tell these girls who had to impetus to start a business. They did all the front end work, prepared themselves with a professional presentation (as one could at that age), and government authority says “no.”

    Years ago, when my son was small, he was obsessed with the movie “The Hunt for Red October.” He wasn’t much of a drawer, he preferred to build his play toys in 3D with paper. He researched submarines from history, and built many replicas out of paper. I said, “you should go in business selling submarines.”
    He read a little, got busy, made himself a big “Submarine Sale” sign, set up shop on a table in the front yard, and displayed his subs. All the neighbors stopped, and he sold all of his subs in an afternoon. That was nine years ago, and he saved that money–still has it–and has learned the value of the effort involved and how it is important to be careful with your money. He learned a lifetime lesson that afternoon! Has has quite a savings account for a teenager, and is more frugal with money than his old man.

    It is disheartening that the “all-knowing” government denied such a learning opportunity for these girls. It seems as though so many times, these government regulations are so very short-sighted in their well-meaning.

  19. This is in fact the sorties paradox in action. The city has a law that establishments selling food must have a permit. Probably most would agree that it’s reasonable, but the same people apparently unhappy than kids’ undertaking wasn’t made an exception. So, when should the exception be granted? when the kids become old enough? when they sell too much of the lemonade? and most important, who should grant the exception, without even asking – the cops?
