We have often discussed the rising incivility and anger in our political discourse. That derangement was on display at a Whataburger in San Antonio when an unidentified man assaulted a teenager for wearing a Make America Great again hat. It was fortunately caught on tape and hopefully the culprit will be apprehended. However, a prior such assault by a University of California-Riverside student will not face jail time for an earlier assault on a student wearing a MAGA hat. In the videotape, the man throws a soda in 16-year-old Hunter Richard’s face before triumphantly walking out of the restaurant. Update: The man has now been arrested. The man’s name is Kino Jimenez, 30.
The teen is heard in the video below stating “I support my President and if you don’t let’s have a conversation about it instead of ripping my hat off. I just think a conversation about politics is more productive for the entire whole rather than taking my hat and yelling subjective words to me.” The man is shown saying “you ain’t supporting shit” as he proudly waived the hat on his way out of the restaurant. Jimenez adds “This is gonna go great in my f**king fireplace.”

Notably, Jimenez was fired from his part-time job at the Rumble Bar in San Antonio after he was identified online as the man seen in the video. We have followed cases where people have been fired after boorish or insulting conduct once their names and employers are made known. (here and here). This includes YouTube videos and drunken scenes.
It seems to me that the sentence should be more severe when someone is attacking a victim for their exercise of free speech. The degree of utter impunity shown by the attacker speaks to his lack of remorse or control. For that reason, I would impose a jail sentence despite the lack of serious injury.

What a creep Kino is – clearly a case of arrested development. Did the boys say things to provoke him? Maybe they did however that still didn’t give him the right to assault the boy and take his hat. Jail time seems extreme though – I think mandatory anger management classes and community service would be more affective. Jail is just gonna make him angrier and play the victim card.
I’m confused. First, what is his “trans-sexual girlfriend?” Is he saying his “girlfriend” is a dude? And second, why is this Hispanic guy talking like he’s a ghetto black? Is he some kind of trans-racial, bi-sexual? This story is getting stranger….stay tuned!

It is a serious reach to accept his versions of events with no evidence. He is not credible.
Mostly he seems to be paranoid. He claims to know that the person he assualted saw and heard things prior to his entering the store – as if he is the focus of the world.
He claims to know what they were talking about, at the same time as he notes that he could not make out what they were saying.
He further claims that a private conversataion that he could not hear – but still clairvoyantly knows what was said is justification for his actions.
Even if true – his actions are not justified.
But his version of events is unlikely to be true.
Kino made a chilling threat at the end of his video rant. He said “come test my gangsta”. That would be guns & ammo in street gang lingo.
Except Kino: there’s security video of the whole night, and your version of events is pure fiction.

Unfortunately for some, you are judged by the company you keep. When your fellow travelers are avowed racists, xenophobic authoritarians, the adage of “you reap what you sow” comes to mind. Don’t ever expect the targets of a pogrom to sit meekly by and allow themselves and their families to be eradicated. If the hat fits, wear it.
All that being said, the actions of the star of the movie arguably constitute misdemeanor assault, with the caveat that if the person who was assaulted with the drink is under 14 years of age, some creative intake prosecutor may shoot for injury to a child.
