“A Gross Necropolitical Calculation”: Rutgers Professor Charges Trump and White Conservatives With Using The Virus To Kill Black People

Brittney Cooper, an associate professor in the Department of Women’s, Gender and Sexuality Studies at Rutgers University, is doubling down on her prior public comments denouncing Trump supporters and alleging a conspiracy to kill black people.  She notably has invoked her tenure status with the latest tweet attacks: “I have tenure. Rutgers won’t be firing me for tweets.”  As many of you know, I have long taken the same position on the free speech rights of faculty on social media and public comments. However, schools have been less than consistent in punishing or investigating faculty based on the content of their views.  Cooper declaring “F— each and every Trump supporter” obviously would include many students in the university.  She blames “white depravity” and claims “when whiteness has a death wish, we are all in for a serious problem.”  As previously discussed, it is doubtful that these same attacks directed against African-Americans or other groups would be treated in the same fashion.

This week, Cooper tweeted “F— each and every Trump supporter. You absolutely did this. You are to blame” for the pandemic.  She brushed off past criticism and declared “I said what I meant. And I curse cuz I’m grown. I have tenure. Rutgers won’t be firing me for tweets.”

In another post, Cooper claimed Trump supporters’ loyalty to the president impaired their judgment about the outbreak: “They are literally willing to die from this clusterf—ed COVID response rather than admit absolutely anybody other than him [Trump] would have been a better president. And when whiteness has a death wish, we are all in for a serious problem.”  She has previously denounced “white depravity.”

As we have previously discussed (including a story involving an Oregon professor), there remains an uncertain line in what language is protected for teachers in their private lives. The incident also raises what some faculty have complained is a double or at least uncertain standard. We have previously discussed controversies at the University of California and Boston University, where there have been criticism of such a double standard, even in the face of criminal conduct. There were also such an incident at the University of London involving Bahar Mustafa as well as one involving a University of Pennsylvania professor. Some intolerant statements against students are deemed free speech while others are deemed hate speech or the basis for university action. There is a lack of consistency or uniformity in these actions which turn on the specific groups left aggrieved by out-of-school comments.  There is also a tolerance of faculty and students tearing down fliers and stopping the speech of conservatives.  Indeed, even faculty who assaulted pro-life advocates was supported by faculty and lionized for her activism.

Again, I believe Cooper’s speech should be protected but the recognition of such free speech values seems to often exclude faculty and students from opposing political or social perspectives.  The protection of such speech continues to depend on its content in determining if actions will be taken by the university.

  1. Well, to start, racism is evolutionary; I’ve never met a single individual of any race that was not on some level a racist. Racism then, expressly expressed, is not, for me, an issue Secondly, the question is not whether Cooper’s speech is protected, but whether her employer has the right to dismiss her for public statements – it’s not a question of speech rights – this after-all IS “America” – but a question of labor rights. Can a university as private employer dismiss an employee for statements or behavior? Well, unless there is state law to the contrary, I would say, absolutely. To suggest otherwise is to mandate that relationship; it is to deny all the ability to terminate both personal and business relationships; it is to deny freedom itself, which I’m guessing, is probably “unconstitutional.”

    2. I agreee that ethnocentrism is an evolved social response. See the work of Professor Kevin MacDonald of Cal State u Long beach. I think he’s retired now. He wrote a lot about this. Caught hell over it, too.

  3. The article is long. The professor is goofy and perhaps mentally deranged. Rutgers has gone to hell in a handbasket. If your kid goes there think about some other place like a mental hospital.

  4. JT: If she had made those comments as a private citizen, I think it would be a free speech matter. But the 1st amendment says CONGRESS shall pass no law……. Rutgers isn’t mentioned. And since she held herself out as a professor at Rutgers University I think the school could take some disciplinary action if they thought that her comments tarnished the reputation of Rutgers University. They could — they should — but they won’t.

If I as a lawyer can lose my license over “off the job” “private speech’ which some people think may be racist– and I content that in many states that is exactly what is possible under RPC 8.4– then I say let all the university professors abide by the same restrictions of the vaunted “free speech” that I have as a lawyer.

      1. I was not aware that RPC 8.4 could be stretched to include comments separate from one’s role as a member of the court unless it is leveraged through (g).

        Should be able to say whatever you want, even if it is wrong or stupid, in a private capacity without having it redound against your professional role.

        By the way, do you recall the federal district court judge who attacked the integrity of the conservatives on Courts of Appeal and the Court a few weeks ago? That type of thing seems to fall well within the judicial equivalent of 8.4 and, since he is also a lawyer, 8.4 itself. Yet nothing came of it.

I think Cooper should change her name to her Twitter handle! Anyway, the ho deserves an Irish Poem!

    1. OLLY – 1) we know the ChiCom virus death numbers are skewed because Dr. Brix told us that in any case of co-morbidity, ChiCom virus would be selected as the cause of death. Hospitals are getting paid more, besides.
      2) We know that a significant percentage of the black population is over-weight, which puts them at risk for the ChiCom virus.
      3) Of all the degrees on campus, Women’s Studies is the weakest and least valued in the outside world.

      1. After we return from quarantine, most universities are going to rename their liberal arts degrees (and especially somethingsomething-studies) as: Bachelor of Arts in Non-Essential Employment.

  8. Lets admit it: blacks are America’s children and we tolerate speech and behavior from them that would not be acceptable from an adult of any other racial or ethnic group. Whether it’s trashing a McDonald’s restaurant because her order was too slow, or spewing racist hate speech on Twitter, this ghettopotamus is not expected to conform to the standards of civil society.

    1. Amen! Tommy Sotomayor says blacks, and black women in particular, are America’s snack-pack throwers, that is the little kids in school who ride the short yellow bus and have mental issues and throw their lunches around.

      But Crunk will get by with this not because she has tenure, but because she is black – a Woman of Color, no less.

      If she is right, though, Detroit, Baltimore, South Chicago, and inner city areas throughout the nation will soon be livable again. But I am betting she is wrong.
