Rubber Hits The Road: Goodyear Under Fire For Listing Of Unacceptable Symbols

932px-Goodyear_Cord_Tire,_1920Goodyear Tire company is under fire this week for a listing of acceptable and unacceptable symbols or attire in the workplace.  President Trump has railed against the inclusion of MAGA hats as “unacceptable” and called for a boycott.  I do not agree.  I think it is appropriate to ban political endorsements or symbols in a business but there is a legitimate concern over what is deemed “acceptable.” The touchstone of free speech protections is content neutrality and Goodyear appears to be enforcing a viewpoint preference. The question is whether, as a private business, it has an obligation to be neutral.

The story went viral after a Goodyear employee shared a slide from a recent company diversity training session at a plant in Topeka, Kan., which showed two categories: Acceptable and Unacceptable.  The acceptable items included Black Lives Matter (BLM) and Lesbian, Gay, Bisexual, Transgender Pride (LGBT). The unacceptable items included Blue Lives Matter, All Lives Matter, MAGA and politically affiliated slogans or material.

The MAGA reference is what set off President Trump who declared “Don’t buy GOODYEAR TIRES—They announced a BAN ON MAGA HATS. Get better tires for far less“(This is what the Radical Left Democrats do. Two can play the same game, and we have to start playing it now!).”

While stressing that the list came from a diversity training session, the company did not deny the line drawn between these groups and causes. The company released as statement that:

“Goodyear is committed to fostering an inclusive and respectful workplace where all of our associates can do their best in a spirit of teamwork. As part of this commitment, we do allow our associates to express their support on racial injustice and other equity issues but ask that they refrain from workplace expressions, verbal or otherwise, in support of political campaigning for any candidate or political party as well as other similar forms of advocacy that fall outside the scope of equity issues.”

I get the policy on barring “forms of advocacy” and businesses have the right to impose limitations, an issue that we discussed on the NFL kneeling controversy. However, the list does not seem to follow a needed bright-line rule to avoid the appearance of bias.

The inclusion of Black Lives Matter but not Blue Lives Matter raises the most obvious concern over a preference for political viewpoints. There are some people who support the call that Black Lives Matter but do not support the organization. Others support both the Black Lives Matter as well as Blue Lives Matter.  I understand the view of many people that we need to focus on BLM to address problems of racial justice in our system.  But it is a viewpoint preference.

In my view, Goodyear has a right to limiting viewpoints expressed in their stores. For example, a clothing store may want to espouse environmental causes. In taking such an approach, there is an obvious risk of boycotts and backlash but I do not believe that there is a legal requirement to evenly apply such rules in a private space.  Even with government property classified as a non-public forum, content-based speech limitations need only be reasonable and viewpoint-neutral. Perry Educ. Ass’n v. Perry Local Educators’ Ass’n, 460 U.S. 37, 46 (1983). In 1972, the Supreme Court ruled in Grayned v. City of Rockford that in determining the time, place, and manner limitations on speech “[the] crucial question is whether the manner of expression is basically incompatible with the normal activity of a particular place at a particular time.”

In this dispute, Goodyear is allowing some advocacy while barring other forms of advocacy. However, this is a private space (albeit open to the public). The first amendment applies to government limitations on free speech. Thus, Goodyear is likely to face economic and political consequences rather than legal consequences for its policy.  Goodyear reportedly stocks fell six percent after the Trump call for a boycott.

        1. I wrote the following on August 26, 2019 at 9:32am in a comment over on Ethics Alarms after witnessing Democrats apparently advocating for a recession for about a month. The advocating trend was bothersome to me.

          I’m waiting to see how the new tactic to unseat President Trump is going to take shape in the media propaganda machine, the economy. This one is actually destructive to the United States of America.

          I’m sure we’ve all heard it; prominent lefties are actively hoping for a recession so the President can’t run on a good economy.     What Goodyear is doing is straight up bigotry and they are in a position of power being the employer that makes this a prejudicial abuse of power, it’s in-your-face suppression of certain kinds of thinking and chills free speech, it’s unethical and immoral! If they are going to ban some then they need to ban ALL of it or they will suffer the what ever consequences come their way for their choices. If some, or all, consumers choose to boycott Goodyear because of this obvious abuse of power I have absolutely no problem with that; this is the kind of moral bankruptcy that consumers should consider when choosing who they purchase from.

    President Trump, shut the hell up and stop punching down; let the consumers make their own choices and speak with their dollars in the manner in which they choose.

Given that extreme adherence to a religion and/or political position is more often than not accompanied by an equally extreme ignorance as to the real meaning of either the religion and/or the political; visual statements are more to be found among those who are making a statement outwardly. Again, in a workplace that depends on balance and integration, some one wearing a MAGA hat or a religious garment of a contentious religion, can be and often is disrupting. Like I stated, no politics or religion at the diner table. A workplace is best as a secular society.

        Regarding religious garments, in a perfect world where religion is as much dependent on the freedom of individual beliefs as it is on community; where community is resilient and confident enough to cease requiring its members to physically manifest something that is, in essence, completely ethereal; where individual believers are confident enough in their beliefs so as not to require expressing them outwardly thereby placing them as more chosen, closer to, of greater meaning, etc. this conversation would not be taking place. The foundation of every major religion is that it is more than any other. Therein lies the seed for confrontation. The same is so with politics. How will all these tires get rolling if these distractions are there.

        Or, you could allow the MAGA hats and the Dump Trump t-shirts and see.

        1. It doesn’t matter. You cannot make workplace rules that violate religious expression, but you can do that for political expression. That’s how it is and that’s what Turley’s article is about.

          but for apologists like you, I suspect, they have played you, they have tricked you, they have exploited your generous liberal nature, they have got you to work for free for interests which actually will come at your expense, not only in your wasted time, but in the impact the policies will have on you in the long run.

          This is what I believe of many of my Democratic party friends, and I have a lot. In turn, they think I am a cynical curmudgeon, but, usually associate with me anyhow. This is one of the things I like about Democrat rank and file people, they are usually very nice and generous and make good personal friends.

  14. Goodyear is not stupid. The company sees which way the country as a whole is moving. Whether anyone likes it or not, the US is definitely taking a list to the left. Maybe it’s a reaction to the extremism of Trump and his Republican enablers. The law of unintended consequences.

  15. The President called for a boycott, not Federal policing efforts. I think that is fine. There is clearly an inequity in the way Goodyear handled their training, and using the bully pulpit instead of trying to use the pen is good restraint. More bully pulpit, less ridiculous laws. The President got the word out, and if you like what Goodyear is doing, you can choose to do business with them. If you do not like Goodyear’s message, you can choose another business to do deal with.

  16. My husband worked 21 years for Goodyear and was constantly harassed for being conservative. The union also flooded the workplace with campaign propaganda for the Democrats during election cycles daily.

  17. Black Tires Matter. Especially for black Wives. They feel they don’t matter because they are married and can’t get their check. An in married partner is a check mate. Not talking chess here.
