No Friend of Congress: Pascrell Seeks To Block 120 House Republicans From Being Seated For Signing Amicus Brief

It appears that Rep. Bill Pascrell (D., NJ) has a serious problem with Republicans going to court.  We recently discussed Pascrell’s absurd effort to disbar roughly two dozen Republican lawyers for challenging the results of the 2020 election. Now Pascrell is declaring that 120 House Republicans signing a “Friend of the Court brief” (or amicus brief) is tantamount to supporting a rebellion against the United States and that they should be blocked from taking their seats in Congress. I previously denounced Pascrell for his “dangerous form of demagoguery.” This latest call shows the demagoguery has reached a level of utter delusion.   

From the outset of the Texas lawsuit, I stated that it was virtually guaranteed to fail on standing.  It did fail last night. However, courts are where we take cases alleging such injuries. Tens of millions of American believe that the election was not fair, including many Democratic voters.  Roughly 70 percent of Republican voters believe the election was stolen. Such challenges and concerns are brought to the courts where we can have disputes resolved without violence in a constitutional system.

Pascrell has long denounced political critics of destroying the Constitution based on his disagreement with their views.  In the case of President Trump, he called for impeachment in 2019 on such undefined grounds as “disgrac[ing] his office and our nation beyond measure.”

Rather than welcome such review, Democrats have launched a scorched earth campaign, including an abusive campaign of harassment and abuse by the Lincoln Project. These efforts notably began shortly after Biden was declared the presumptive winner of the election and before any challenges were actually ruled upon by the courts.

Speaker Nancy Pelosi has also fueled such reckless rhetoric, declaring that the Republicans are “subverting the Constitution by their reckless and fruitless assault on our democracy which threatens to seriously erode public trust in our most sacred democratic institutions, and to set back our progress on the urgent challenges ahead.”

Pascrell’s move against his colleagues mirrors language in the response of Pennsylvania’s Attorney General Josh Shapiro calling the Texas lawsuit “seditious.”  Seeking judicial review is the antithesis of sedition or rebellion. It is working within our constitutional system for a legal opinion on the merits of a challenge. These litigants have complied with court orders, as has President Trump.

On Twitter, Pascrell declared

“Stated simply, the men and women who would act to tear the United States Government apart cannot serve as Members of the Congress. These lawsuits seeking to obliterate public confidence in our democratic system by invalidating the clear results of the 2020 presidential election undoubtedly attack the text and the spirit of the Constitution, which each Member swears to support and defend.” 

 Pascrell cites the 14th Amendment to argue that filing with a federal court is an act of rebellion and “trying to overturn a democratic election and install a dictator seems like a pretty clear example of that.”

Pascrell’s call is utterly unhinged from any logical or constitutional foundation. Rebels do not storm the courts with legal filings. They overthrow courts with the rest of the constitutional system. Those who lack faith or fealty in our constitutional system are those who label litigants “rebels” and legal filings as forms of “rebellion” and “sedition.”

      2. There is not a republican legislature that would not jump at the chance to count every single legitimate ballot – regardless of who it was for.

        But by ignoring SOME but not all election laws we have created a situation where that is not possible – and that was not accidental.

        Secret ballot laws require that before mailin ballots are counted they must be stripped of any connection back to the voter.

        We can potentially identify how many fraudulent ballots were case. We will never be able to extract the fraudulent ones from the legitimate ones.

        BTW that is why observers and challenges are so important – because a challenged mailin ballot is isolated, and not counted until it can be determined to be valid.

        But we ignored laws requiring mailin ballots be verified by signature, DOB, Drivers license, ….

        But did not ignore laws that required they be secret – even though mailin ballots are NOT secret ballots – one of their other problems.

        You say that only legitimate ballots were counted in these big cities ? So if in the next election those cities are flooded with mailin ballots that favor republicans you will have no problem counting those too ?

        The laws that you flouted exist to prevent illegitimate ballots – from being counted. If you think that the procedures followed were sufficient to accomplish that – then you will have no problems if those procedures are tested in the next election.

        While we are at it – we might as well flood republican precincts with additional mailin ballots, and have republican election officials ignore the same election laws as democrats have.

        What degree of stupidity do you have to have to fail to understand that if you ignore the law you WILL get massive fraud.

        You can pretend it did not occur in 2020.
        But the only way you can stop it in the future is to follow the law.

        In fact I would suggest that the legislature pass laws authorizing the deliberate flooding of all precincts with fraudulent ballots to test whether they properly catch them.

        I have argued repeatedly that it is relatively easy to secure elections – if we actually want to.
        It is even relatively easy to secure them – knowing those administering the election are corrupt – all that is necescary is to assure that if they fail to do their job there will be a consequence.

        One consequences would be that they are fired or even prosecuted.

        But another possibility is to assure that if they fail to stop illegal votes, that the election will be tipped against them.

        The TX challenge was not specifically about fraud – it was about the failure of 5 states to conform to their own election laws and constitutions.

        Separately plenty of evidence of fraud has been provided.

        No sane person has claimed there was no fraud.

        The court decisions against Trump are problematic as they are all summary judgements for failing to prove SUFFICIENT fraud to have changed the outcome.

        That is not the standard for summary judgement.
        That is the standard for a final decision – after hearings and discovery.

        Contra the left and far to many courts – it is not required to prove that you will win to get into court.
        It is merely a requirement that you have a plausible case.

        No one who has taken even a cursoury look at the evidence doubts that 3 things are present.

        States faliing to follow their own laws – that is an absolute given.
        Actual instances of fraud – every lawsuit provided numerous examples of that.
        The possibility of fraud of sufficient scale to alter the outcome.

            Data from 2018, 2016, and 2014 was still on those machines – only 2020 have been deleted.

            And why it required a court order in GA to stop deleting election data.

            That would be why in Milwaukee, Atlanta, Philadelphia, and Detroit election observers were told to go home on election night – that counting was stopping, and after they left democrat election officials continued through the not without any oversight ?

            It SHOWS election officials clearing everyone from the counting room, turning off the lights, and THEN a few come back turn on the lights. pull cases of votes from under the table and resume counting.

            It is possible that is evidence of election fraud – meaning counting illegal ballots – we can not really know that.

            It is inarguable that it is evidence of election fraud – counting without required observers – which I beleive is a fellony in GA.

            If you are going to demand proof the least you should do is make it hard ?

      regardless, SCOTUS did “dodge” pretty much as expected.

      Had they addressed the RX lawsuit which 3/5 of all states signed on to on the merits – there was only one possible outcome – the election in atleast 4 states violated state laws, state constitutions and the US constitution. There was ZERO doubt regarding the merits.

      SCOTUS found a way out – found a way to avoid a very difficult decision to follow the law and the constitution.

      Regardless lawlessness has consequences.

      You do not seem to gather this.

      While it would be preferable for the courts to DO THEIR JOB, and uphold the constitution,
      there is no good outcome for the left.

      WE can either follow the law – and the left loses.
