No Friend of Congress: Pascrell Seeks To Block 120 House Republicans From Being Seated For Signing Amicus Brief

It appears that Rep. Bill Pascrell (D., NJ) has a serious problem with Republicans going to court.  We recently discussed Pascrell’s absurd effort to disbar roughly two dozen Republican lawyers for challenging the results of the 2020 election. Now Pascrell is declaring that 120 House Republicans signing a “Friend of the Court brief” (or amicus brief) is tantamount to supporting a rebellion against the United States and that they should be blocked from taking their seats in Congress. I previously denounced Pascrell for his “dangerous form of demagoguery.” This latest call shows the demagoguery has reached a level of utter delusion.   

From the outset of the Texas lawsuit, I stated that it was virtually guaranteed to fail on standing.  It did fail last night. However, courts are where we take cases alleging such injuries. Tens of millions of American believe that the election was not fair, including many Democratic voters.  Roughly 70 percent of Republican voters believe the election was stolen. Such challenges and concerns are brought to the courts where we can have disputes resolved without violence in a constitutional system.

Pascrell has long denounced political critics of destroying the Constitution based on his disagreement with their views.  In the case of President Trump, he called for impeachment in 2019 on such undefined grounds as “disgrac[ing] his office and our nation beyond measure.”

Rather than welcome such review, Democrats have launched a scorched earth campaign, including an abusive campaign of harassment and abuse by the Lincoln Project. These efforts notably began shortly after Biden was declared the presumptive winner of the election and before any challenges were actually ruled upon by the courts.

Speaker Nancy Pelosi has also fueled such reckless rhetoric, declaring that the Republicans are “subverting the Constitution by their reckless and fruitless assault on our democracy which threatens to seriously erode public trust in our most sacred democratic institutions, and to set back our progress on the urgent challenges ahead.”

Pascrell’s move against his colleagues mirrors language in the response of Pennsylvania’s Attorney General Josh Shapiro calling the Texas lawsuit “seditious.”  Seeking judicial review is the antithesis of sedition or rebellion. It is working within our constitutional system for a legal opinion on the merits of a challenge. These litigants have complied with court orders, as has President Trump.

On Twitter, Pascrell declared

“Stated simply, the men and women who would act to tear the United States Government apart cannot serve as Members of the Congress. These lawsuits seeking to obliterate public confidence in our democratic system by invalidating the clear results of the 2020 presidential election undoubtedly attack the text and the spirit of the Constitution, which each Member swears to support and defend.” 

 Pascrell cites the 14th Amendment to argue that filing with a federal court is an act of rebellion and “trying to overturn a democratic election and install a dictator seems like a pretty clear example of that.”

Pascrell’s call is utterly unhinged from any logical or constitutional foundation. Rebels do not storm the courts with legal filings. They overthrow courts with the rest of the constitutional system. Those who lack faith or fealty in our constitutional system are those who label litigants “rebels” and legal filings as forms of “rebellion” and “sedition.”

    1. Why should I pay attention to any oppinion by any judge in any court that starts the oppinion with lots of political garbage.

      2016 is irrelevant to the decision before her. Only immediate facts are.

      This is precisely what we talk about when we talk about the rule of law.

      As Gorsuch said – any judge that is not periodically force to rule against their own beleifs because that is what the law or facts require should not be a judge.

      NONE have address the actual lawless conduct of the election.

      Judges do not get to legislate. They are required to enforce they law that exists, not the law they beleive should exist.

      The laws in these states were violated – we ALL know that.

      Had that not occured – we might have had confidence in the results of the election -regardless of who won.

      But they were not.

      It is likely – near certain that eventually we will actually know the number of invalid votes cast in each of these states – though it is near certain those on the left will have their head in the sand.

              The WI federal judge – despite using the phrase “on the merits” did NOT rule on the merits.
              He found (incorrectly) as a matter of law that the WI legislature had delegated its power over elections to the WEC.
              That is a matter of law, not on the merits.

          Or if you do not like that – 2022 and 2024 will come shortly. Allow anyone who wants to submit fraudulent mailin votes in addition to legitmate ones and lets see if you really were following the law ?

          You keep ignoring the fact that the entire purpose of election laws are to allow all of us to trust that all LEGITIMATE votes were counted and ONLY LEGITIMATE votes were counted.

          If you beleive that to be the case – you will have no problem with testing that – now and in the future.

        In person and Absentee voting in the US is “austrialian voting” or “secret ballot” – that is because all other forms are subject to inducement or coercion. You can not protect a mailin election from inducement or coercion.         CA allowed ballot harvesting in 2018 – a practice that is criminal in much of the country. You blindsided republicans and they lost several close races. In 2020 they came back with their own ballot harvesting operations – and took back most of the seats they lost.

        They have nothing to lose, can not get caught, have legal precidents now that will blind the courts.

        1. Every mail in ballot envelope is individually barcoded and matched to the voter, so that there are no duplicate votes. And yes, voting should be easy, because there are large numbers of people who can not make it to the polls on election day because they have no transportation, or they work, or they are disabled, or they are in the military, or out of town that day. We as a country should never put barriers to voting because “we don’t want to make it too easy”.

            First I would refer you to the recent GA hearing on this matter where a GA election supervisor demonstrated myriads of ways that it is trivial to enter and manipulate votes.

            She was able to scan a blank ballot, and then vote it.
            She was able to scan the same ballots multiple times – and have them counted multiple times.
            She was able to take any ballot that was scanned and completely change every vote on that ballot.

            Further she demonstrated that there is no audit trail for this there actually can not be and still have secret ballots – this is why all aspects of ballot handling and the adjudication of problematic ballots MUST – in most states BY LAW have observers.

            It is not possible – or legal to track a ballot from its envelope to its final count. Doing so would violate election secrecy laws.
            And those are also very important.

          3. As to your actual claims – no there are NOT large numbers of people who can not make it to the polls on election day because they have no transportation, or they work, or they are disabled, or they are in the military, or out of town that day.

            Who in this country is unable to get to the grocery store ? There are an estimate 500,000 polling places in the US – 21,000 were closed in 2020 do to mailin balloting – actually reducing the number of pollling places.

            So the LEFT actually made voting in person harder.

            Polls typically open at 8am and close at 8pm – 12hours.

            Both parties as well as other groups go out of their way to provide transportation for the disabled or those without it.

            We already know the left buses people from out of state (they have admitted it on hidden camera videos) – why do you beleive they do not move people down the block ?

            Regardless lack of transportation is an advantage for THE LEFT. Republicans on the whole have to travel far further to get to a poll than democrats. 75% of the democrats in the country live in the major cities of the US. Nearly all cities larger than 500,000 are 75% or more democrat. Politics is about evenly split from 500,000 to 50.000 and below 50,000 it is nearly exclusively republican.

            I was out of town on election day 3 states away – I still voted before I left. Regardless every state has for cause absentee balloting.

            Absentee balloting is NOT the same as mailin voting. Absentee balloting requires the voter to go to a courthouse or some other similar place, to have their identitity verified, and THEN to vote SECRETLY, and to seal and turn in their vote before leaving.

            There is no opportunity for third parties to influence your vote as their is in mailin votes.

            I would personally have congress require that all polls in the entire country remain open for exactly the same full 24hour period from coast to coast so that all polls in NY and in HI opened at exactly the same time, and they all closed at exactlyt he same time and there was exactly 24hrs to vote. And that all polls had to produce raw tallies of every voting machine without an hour of polls closing.

            This would significantly complicate many forms of counting fraud.

            One of the PREDICTED big problems with 2020 is that in person voting ended and the results were quickly available And then – mostly in 5 cities in the US counts of mailin votes over the next 24hrs produced almost exactly the votes needed to erase the leads.

            No matter what form of voting is used – you want all counts to come in as near simultaneously as possible. You want those contemplating engaging in fraud to be unable to KNOW how much fraud they must commit to win. If they have to guess they are incentivized to cheat more to be sure and that makes the fraud easier to catch.

            Biden won and Trump lost – as a result of less than 1% of the votes in 5 major cities.

                6,540 people voted using out-of-state licenses
                As of Aug. 30, 2017, about 15 percent had been issued N.H. driver’s licenses.

                Each of these items is FACT, they can be checked out via the NH State department.

                I have further noted that others who have looked at this more thoroughly have been able to eliminate as much as 30% of the 6540 as subsequently establishing evidence fo NH residence.

                It is likely that under very serious scrutiny – that might rise to 50%.

                All that is speculation. but it is reasonable.

                But that still leaves about 3200 people who voted in NH in 2016 using out of state licenses who do not appear to have been NH residents.

                To be clear since you jump to conclusions and you do not read and you are generally clueless.

                I have NOT said that Out of state voters were bussed into NH.

                The Claim that democrats have bussed in voters, is based on undercover Video of democratic campaign managers in OTHER STATES having admitted to doing just that.

                When people admit to violating the law – I tend to beleive them.

                Regardless, there is a LONG history of democrats bussing people from out of state – a history as long as there has been sufficient transportation to do so.

                The FACTS in NH have nothing specific to do with Bussing.

                My GUESS is that the 3000+ improper votes are mostly out of state students attending college in NH.

              It is not on the merits. It never addresses the actual merits.

              The first problem is that the judge starts with the presumption that there is no legitimate remedy that can result in tossing lots of legitimate votes.

              All of us will admit that rejecting legitimate ballots is really really hard to do.

              But the fact that we have arrived at that point MAKES Texas’s point and REJECTS the poor claim of the judge.

              Do you accept that the constitution – both us and state, does not allow states to deliberately or recklessly run an election where the outcome of the election is fraudulent ?

              If you accept that – then the WI Federal judge is by definition WRONG on the MERITS and TX is correct.

              The WI judge claimed that the WI legislature legitimately delegated election authority to the WEC – that is arguably false. But even if true it violates a fundimental originalist constitutional principle – non-delegation. Neither the legislature, nor congress can delegate to the executive responsibility and authority that belongs to the legislature – particularly with respect to elections.

              I do not know that the claim that the WI legislature did delegate that authority is correct.
              But the claim they could is inherently false.

              But even accepting that as the case. As the authority is the legislatures exclusively – it remains their exclusively to revoke.

              Finally the judges decision is not on the merits for another reason – the decision is based on procedural due process rather than substantive due process.

              Best demonstrated by an example – if an innocent person is sentenced to death for a crime they did not commit, and prior to execution it is proven beyond any doubt that they did not commit the crime – but all appeals have run out and all the correct processes specified by law have been followed, can the innocent person be executed by the state.

              Substantive due process requires that you can not execute a person who is innocent of a crime – even if they were convicted at a fair trial, and afford every opportunity the law allows to correct the error of that trial.

              Procedural due process allows the state to procede to do whatever it wants regardless of the outcome – so long as dotted its I’s and crossed its t’s no matter how egregious the outcome.

              It is trivially arguable that neither WI not the rest of these states followed their own laws. In the specific case of WEC – the election commission authorized the relaxation of statutory requirements for elections. Even if you do not accept non-delegation The WI legislature can not delegate the authority to wave a statute. Statues always trump regulations and executive actions.

              If the legislature by statute says that voter signatures must be verified, the executive can not say – no they need not.

              Just to be clear – everyone knows that all these decisions against Trump are a consequence of the left playing a game of chicken with mostly receptive courts.

              Judges – even some on the right balk at enforcing the law when the remedy requires throwing out hundreds of thousands of legitimate votes because their may have been thousands of illegimate ones.

              That is a hard choice. But it is the only lawful one. And it is the only one that prevents future fraud.

              While that is false it is still massively problematic.

              He did NOT rule there was not fraud. He did NOT rule there was not sufficient fraud to change the outcome.

              Most importantly he did NOT rule that the process followed – whether lawful or not was sufficient to preclude fraud.

              His ruling has two logically fallcious components.

              The first is that if the election laws are such that they allow fraud even if that fraud changes the outcome, then the results must stand.

              Then he ruled that the WI law was followed – even though the statutory law was ignored, because the WEC – an executive branch agency had waived the law, and the legislature had implicitly delegated the authority to do so.

              Basically he ruled that WI law was not law if the WEC said otherwise.

              That is not a decision on the merits.

            The only requirements regarding government restrictions on voting are:
            There can be no poll taxes – that is actually a mistake. A small poll tax would be incredibly wise. rooting out people who will not pay $1 to vote would get rid of lots of idiot voters. But the constitution as amended prohibits poll taxes.
            And that government may not overtly discriminate in certain ways in voting laws.

            There is absolutely no requirement that voting be easy.

            The actual requirement is that voting must be trustworthy – even if that requires that it is difficult.

            A voting system that does not have near universal trust is no voting system at all – no matter how easy it is.

                Again in the real world – those things are not true. They SHOULD be true, but they are not.

                In this election democrats in several states violated the election laws of their states.
                There is no meaningful dispute on this.

        IF someone tries to vote for me at my polling place not only will they not have proper ID, but the election officials will recognize that it is not me. No matter what in person voting requires a real human to appear at the polls.

        There is no means to assure that a mailin ballot came from a real person and is their actual vote.

        It is trivial for anyone with access to registration databases to submit fraudulent votes. And it is dirt cheap to get registration databases.

        I could mass produce hundreds of thousands of bogus ballots in my basement.

          Those on the left and in power should not count on the police to enforce your orders.

          What about the Army – not much different from the national guard. Except even the generals might reduce to act as civilian law enforcement.

          The left does not seem to grasp that the people they depend on to ENFORCE the Law are increasingly NOT THEIR FRIENDS.

          Overall i suspect we have a ways to go before a complete refusal of the police and military to enforce laws – particularly against those acting politically and non-violently. But we are coming to that.

          Regardless, the failure of the left to follow election laws is a big step towards the breakdown of law and order. The courts failure to order that the law be followed or to remedy it when it was not, takes us a step further.

          The left forgets that the legitimacy of government is NOT determined by those in government – not even the courts.

          It also forgets both that we are not a democracy and that democracies always fail. The majority is not free to tyranize the minority.

I remember walking by the polling places where lines of drunks who had to be sober on that day would stand in line to get a small piece of paper and go in and vote under that name. When they came out they got money for their next bottle of booze. That was small potatoes to what the Democrats did in this election.

    All of the witnesses who came forward and put their name and some even their career on the record to testify at hearings under risk of perjury will now understand that only they will be punished for standing up. One woman that sticks in my mind from Philadelphia was told to alter ballots and said everyone around her was doing it. Thousands of ballots were altered. She was a Democrat and worked for the city and knew she would probably lose her job but she filled out an affidavit and testified about it.

    The writers on various sites and the people who write opinions on here that say there was no fraud should be ashamed with how they sold out these brave courageous whistleblowers in not one state but many states. Most of the people that claim there was no fraud admit they never watched the hearings that were televised,or online portions of the hearings or saw the whistleblowers on networks that had them on. Everyone just passed on the no fraud message without bothering to see for themselves. I spent much of yesterday watching a hearing before a committee of the Wisconsin legislature where a succession of poll “watchers” (most Republican, some Independents) testified under oath how they were harassed, bullied , screamed at, physically pushed around and generally prevented from doing any effective poll watching in Milwaukee and other Democrat-controlled Wisconsin cities. All the while strange and unexplained things were happening to stacks and stacks of ballots in the back of the room. It was hard to believe they were describing an American election.

        As for why those challenging this election (not Trump personally) have “lost in every court”, each case has its own answer to that and stands on its own. To my knowledge (and it is not complete) not one of those cases has been resolved by a decision on the merits. All have been dismissed at one stage or another on procedural or technical grounds, just as Texas’ case was dismissed for lack of “standing” (i.e., that Texas could not bring the case because, even if all of its allegations were true, Texas did not suffer the kind of direct injury from the wrongdoing alleged to qualify as a plaintiff deserving of relief). This election has clearly demonstrated that the courts are totally impotent in dealing with election fraud or other “irregularities” in a situation where a city or a state run by one party decides to promote or even endorse election fraud. Mayor Daley’s Chicago was not the first such situation. It is as old as elections and has been perfected in many other countries, I.e., Soviet Union, Cuba, Iran, Venezuela, etc. A preview of coming attractions.

        And it could get worse. If the Democrats succeed in eliminating the Electoral College and in making the national popular vote the determinant in future elections, (and they want to do this precisely because they want fraud to become national and not local, because they are so good at it), there will be a powerful incentive in every precinct in the country to run up the vote wherever you can get away with it. A precinct in San Francisco with 10,000 voters will record 50,000 votes for the Democrat and dare the courts to do something about it. So, of course, unless something is done to STOP it, the Republicans, against their general nature to be law-abiding, will have to respond in kind. It is inevitable. It is an exceedingly slippery slope.
