FBI Raids Project Veritas Writers . . . Over A Missing Biden Diary?

There is a curious story out this weekend on reported FBI raids of writers or associates of Project Veritas, the conservative investigative journalism outfit. Project Veritas has been described variously as “Gonzo” or “guerilla” journalism and some insist it is more of a political than a press organization. However, it fits the definition of journalism, in my view, and that makes the raids troubling. All the more troubling is the cause: the missing diary of President Biden’s daughter Ashley. [Update: The FBI reportedly also raided O’Keefe’s home]

The New York Times reported that the FBI searched two locations in New York in search of the “stolen” diary that went missing days before the 2020 presidential election. Project founder James O’Keefe questioned how the Times received the story within an hour of the first raid.

O’Keefe says that the organization actually received a tip that the diary was abandoned in a room, an allegation that harkened back to the abandoned laptop of Hunter Biden.  However, Ashley reportedly insisted it was stolen.

The use of the FBI is also reminiscent of the still unexplained use of the FBI when Joe Biden was Vice President to search for a gun owned by Hunter Biden that was discarded behind a restaurant.

Project Veritas decided not to run the story because it could not verify that the diary belonged to Biden. (The FBI may have just offered that confirmation). Instead, it alerted the police, according to O’Keefe: “Project Veritas gave the diary to law enforcement to ensure it could be returned to its rightful owner. We never published it.”

So why the raids?  Since when does the FBI conducted raids over missing diaries?

The FBI can cite the interstate elements of the alleged theft as raising a federal crime. However, what is the crime? It is not clear if they are suggesting that the responsible parties were seeking to sell the diary or that there was some national security element (which would be bizarre since Biden’s daughter was writing before her father ever became president).

Journalist organizations are routinely given material removed from businesses, agencies, or private owners without permission by confidential sources. If this is a federal crime subject to FBI raids, what happened to the new media policies of the Biden Administration after the Tucker Carlson controversy?

There are a host of unanswered questions. Here are five to start with:

  1. What was the context for the diary’s loss? (Did Ashley Biden leave the diary in a room or was it stolen?)
  2. What is the alleged federal crime (and what is the precedent for a major federal investigation over such an alleged theft)?
  3. What precautions were taken by the Biden Administration in light of the claimed media status of the targeted individuals?
  4. Why was there a delay in this action being taken if the alleged theft occurred a year ago?
  5. Has this matter been under investigation for a year and did the White House request the intervention of the FBI?

Regardless of how one feels about Project Veritas, there should be calls from media outlets for some answers to these basic questions.  Likewise, Congress should be seeking such answers as part of its oversight responsibilities.

            It’s one thing to simply report that a candidate is claiming something that is (or may be) untrue- that is newsworthy; it’s quite another to adopt those untrue claims and promote them as if they are true (or indifferent that they may be false). That’s the crux of the defamation lawsuits.

            Fox News has a journalistic duty to investigate the credibility of the persons and their claims prior to allowing them to be broadcast. The question is whether the Fox producers undertook any due diligence to resolve their doubts about these claims of massive voter fraud before allowing these persons to repeat them on air. The jury will have to decide if Fox acted in good faith in spreading these falsehoods; that is, was it an honest mistake on its part or, rather, were the Fox hosts engaged in the sort of “advocacy journalism” that Turley denounces at Fox’s media competitors on the Left but never on the Right, i.e., Newsmax, OAN, etc.

            I suspect Fox canned Lou Dobbs because he clearly crossed that line, and Fox needed to demonstrate that fact. It’s also telling that Fox has completely ceased mentioning the Big Lie ever since it has been sued as well as banning Trumpist liars from appearing on the network. Of course, if Fox believed that the election was stolen, there would be no reason to cease broadcasting it, for truth is a defense to defamation. Obviously, Fox doesn’t believe it’s true!

            Hopefully, these election companies will not settle out of court and accept an undisclosed amount of money to buy their silence so that Fox can escape civil liability. It is important to have discovery and a trial to determine the merits of these lawsuits. These cases could be precedent setting in establishing just how circumspect a broadcaster must be to claim that it acted without legal malice in broadcasting a statement of apparent fact.

                A quid pro quo when it comes to foreign aid is not only legal, it is desirable. We want to condition our tax money on elimination corruption in foreign governments. Trump’s quid pro quo for a Ukrainian mere *announcement* of a criminal prosecution into the Bidens in return for military aid was illegitimate since it was for Trump’s personal political benefit.

(2) Why is the FBI reviving this “investigation” after it has lain dormant for several months? Can either Joe or Ashley Biden be happy with the publicity, and the implicit confirmation the investigation brings, to the contents of the diary. Most of us ignored accounts of the diary last year because anyone could have written them, but now we have the FBI pretty much confirming that it was Ashley Biden’s diary and that is not good for Joe Biden.

        2. As subpoena and a warrant are both documents issues by the government forcing persons respond, under the penalty of prison.

          One is to search your brain, one is to search your private property/documents. The both pierce constiututional privacy protections.

          I see little difference in how citizens are abused by an all powerful, abusive government.

            ATS responded with O’Keefe ostensibly quoting from a subpoena, not from a warrant.

            Why won’t O’Keefe quote from the search warrants? Were his underlings too stupid to ask to see the search warrants, or do the search warrants include information that O’Keefe doesn’t want to come out?

            We don’t know. We’ll just have to be patient until the facts come out.

            As for privacy protections, Justice Scalia noted that “most rights … [are] not unlimited.”

            The 4th Amendment says “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

            The 5th Amendment says in part “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in [limited] cases … nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law.”

            Notice the limits on the rights in these amendments. You allude to “constiututional privacy protections” that aren’t actually protected by the Constitution. There is no right not to be subpoenaed. There is no absolute right against searches.

            O’Keefe remains free to invoke his 5th Amendment rights if subpoenaed, despite your hyperbole that a subpoena is to “search your brain.” But O’Keefe does not have an absolute right against PV properties being searched after a judge approves a warrant upon probable cause. You may think that the search was unreasonable, but none of us knows all the facts here. We’d know more if the PV employees asked to see the warrants and O’Keefe truthfully stated what they covered. But his quote about the GJ subpoena is not a quote about the search warrants and shouldn’t be confused with a statement about the warrants.

            1. @Anon 9:38 – So it is your studied opinion that using the power of the State to look for a missing diary, or the circumstances of its loss is *reasonable*? Do you further believe that using Federal law enforcement to look into some girl’s missing diary to be reasonable as well? Would you change your mind if you were the target of the full force of the United States government?

              If you answered “yes” to any of those questions, it would seem that your ability to reason is highly in doubt. That would make a lot of sense, considering your argument hangs on how to define “reasonable.”

    Perhaps the diary ‘was’ given to police. But here we have no details. ‘Who’, exactly, gave the diary to police? And ‘which’ police force was it given to?

    If these facts are true then there is no criminal case. But it seems odd the FBI was not aware of these facts. Something doesn’t add up here.
