Below is my column in the New York Post on the expanding scandal surrounding the Hunter Biden investigation. Even CNN legal analysts are now calling the handling of the investigation at the Justice Department an “unholy mess.” The responsibility for this theater of the absurd is Attorney General Merrick Garland who has again shown a lack of strength and leadership at a key moment for his department.
Here is the column:
“There is a time to laugh and a time not to laugh, and this is not one of them.”
Those words from Inspector Jacques Clouseau may have to be emblazoned across the hearing room of the House Oversight Committee. It was a month ago that House Democratic members mocked the testimony of two whistleblowers who testified about the rigged investigation to protect Hunter Biden, the son of President Biden.
Now it appears that the controversial “sweetheart deal” was not the first choice of US Attorney David Weiss. He actually was planning to let Hunter walk without even a misdemeanor charge despite massive unpaid taxes, gun violations, and work as an unregistered foreign agent, among other alleged crimes.
The reason for his change at Justice, according to the New York Times? Those pesky whistleblowers.
One of the most insulting moments for the respected IRS agents came from ranking member Jamie Raskin (D-Md.), who mocked the allegations as part of “this Inspector Clouseau-style quest for something that doesn’t exist [that] has turned our committee into a theater of the absurd, an exercise in futility and embarrassment.”
Raskin assured the public that these “disagreements” are “routine” matters in investigations (a position echoed by his junior colleague, Rep. Dan Goldman of New York). The IRS agents tried to object that they had never seen anything like what happened in this case.
Then the case became anything but a laughing matter for Democrats. The plea agreement with Hunter Biden collapsed within minutes of a federal judge asking a few basic questions.
When District Judge Maryellen Noreika balked at sweeping language on immunity, she asked the prosecutor if he had ever seen any agreement like this one. He answered “no” and the deal quickly fell apart, with Hunter Biden’s lawyer finally saying exasperatedly, “Just rip it up.”
The language was anything but routine.
Then an FBI agent spoke to Congress and confirmed testimony of the IRS agents, including that Hunter Biden was tipped off on an attempt to interview him. The agent said they were forced to sit a block away and told not to approach the house. The interview was then cut off. He described being “upset” and how this was not routine.
The New York Times, which has spent years downplaying the Hunter Biden scandal, has published an internal account of the investigation. The Times reported that US Attorney David Weiss was actually preparing to let Hunter walk “without requiring a guilty plea on any charges.” However, that “changed in the spring, around the time a pair of IRS officials on the case accused the Justice Department of hamstringing the investigation. Mr. Weiss suddenly demanded that Mr. Biden plead guilty to committing tax offenses.”
In other words, according to the Times, those two mocked whistleblowers prompted the Justice Department to prosecute. Why would that be?
Attorney General Merrick Garland insisted that no political pressure or political considerations would affect the investigation.
Yet it appears that the Biden team did raise the potential embarrassment for the president and the Justice Department if Hunter faced serious charges. New emails reveal that Hunter Biden’s lawyers told the prosecutors that, if there were serious charges, it would be President Biden in the spotlight.
Hunter’s lawyer Chris Clark (who just asked the court to be allowed to leave the Biden team) wrote Weiss and the prosecutors that the best thing for everyone was to just walk away: “This of all cases justifies neither the spectacle of a sitting President testifying at a criminal trial nor the potential for a resulting Constitutional crisis.”
So the Justice Department had the Biden team warning that it needed to avoid the embarrassment for the president from any trial while their own investigators were threatening to reveal embarrassing details on the special treatment afforded to Hunter.
The solution appeared to be a plea deal that would involve minor crimes with no jail time. The appearance of prosecution without any real consequences for the Bidens. No time would be served and, again, the investigation could be shut down without further complications or controversy.
Then the wheels fell off in court and left everyone in a bit of a muddle.
There was no way now to kill the case.
There was no way to ink the original plea deal.
Congress was calling Weiss and key Justice Department figures to answer questions about this investigation, the compromised investigation, and the sweetheart deal.
Weiss had agreed to supply answers when he thought the plea deal was a done deal. Now that “spectacle” was becoming more and more likely.
It got even worse. If Merrick Garland finally yielded to demands for a special counsel, the regulations specified that the person had to come from outside the Justice Department. That meant it could not be Weiss. That person would presumably start by reviewing not just the evidence but the crimes that might have been charged years earlier.
Yet the Justice Department reportedly allowed the statute of limitations to run on major crimes, including the tax offenses related to the suspicious payments to Hunter Biden from Ukraine and other countries.
Garland decided to violate the regulations and appoint the most controversial person (with the possible exception of Hunter himself) to offer an independent examination of the case: Weiss.
While Weiss may be able to justify his actions or contest these allegations, he is clearly viewed as compromised by many in the public. He stands accused of running an allegedly fixed investigation and, now according to the Times, only pursued the “sweetheart deal” when whistleblowers moved to expose the allegations of special treatment for the president’s son.
The question is why, knowing the distrust over the past handling of the investigation, Garland would make an appointment guaranteed to further deepen that unease. According to a new ABC News/Ipsos poll, almost half of Americans lack trust that the Justice Department will conduct the Hunter Biden investigation in a “fair and nonpartisan manner.”
For these Democratic members and Garland, the case has truly become the “theater of the absurd” that Raskin predicted … only no one is laughing.

As a practicing lawyer myself, I keep wondering why no one, including well-qualified lawyers like Turley or Andrew McCarthy, emphasize that what Garland, Weiss and his DOJ team are doing, working in complicity with Hunter Biden’s defense team to fashion a sweetheart deal, not only breaches legal professional ethics, justifying disbarment, but is flat-out obstruction of justice, for which they could and should be criminally charged. Frankly, both are very solid cases, almost no-brainers.
I gave you a “like” because I tend to agree with you — however, as you know, a plea deal generally requires some give and take, and whether or not it’s a “sweetheart” deal is a subjective assessment probably well within the gray area allowed for plea negotiations. If it were me, there’d be no plea deal offered when there is so much solid evidence of wrongdoing. Instead, I would be willing to accept a guilty plea and leave it to the judge to decide whether the defendant is remorseful or deserves to feel the full weight of the law.

Doug, I love your comment. Obstruction of justice is exactly what or JUSTICE DEPARTMENT was/is doing with the Biden family.
As far as the DOJ not just negotiating with the “defendant” but actively working with him in order to NOT charge him is analogous to when we have an elected panel, say the school committee or the town council, “negotiating” with the PUBLIC unions regarding their contracts. The same PUBLIC unions that donate almost all of the funding needed to get elected to these same officials. There is no counterweight at the table. There is nobody actually representing the people. In a business setting when the union makes demands the business owner knows how much he can afford to pay without driving his company out of business, but with the PUBLIC unions there is no way the town will go out of business, they will just raise taxes. By the time the people are fed up with the town these crooked pols will have advanced to the state level and will not have to pay the price by getting defeated. Then the unions, teachers, fire and police, will donate to the next group, get them elected and then negotiate their next contracts.
No government employees should be allowed to unionize.
They also should be forbidden to engage in any group political activities.
Also, no group collection of political donations.
We used to have a sane government that balanced incentives properly most of the time with the laws.

-Look at the election cycle calendar and the proposed Trump trial schedules.
-Look at the intentional unresolved issue surrounding Weiss as Special Counsel. By the time the dust settles on that issue it will be months down the road as Garland well knows.
-Add to those months lost even more time for the a new Special Counsel to get up and running.

In your view is this simply a good man making a mistake?
Mr. Turley has desperately tapdanced his way around the fact that Garland is not even remotely close to being an honest man. Nor one simply a human being making an occasional mistake or slightly shading a few decisions once in a while after giving in to personal bias and animosity.

I agree completely. I am 65 and have often observed how spoiled both my and succeeding generations have been, so much so that they (we) have zero appreciation for the struggle, sweat and toil borne by previous American generations “trying to get things right” by our Constitution (such as by outlawing slavery and then Jim Crow) and even just for national survival. Yet we, the most privileged and pampered generations in the history of the world, judge them unworthy, spit upon their memories and absurdly imagine that we will do better, that we are somehow the pinnacle of civilization. When, in fact, we are pathetically spoiled, ignorant ingrates bent on self-destruction. It’s mind-boggling.
What gets me is that from 2016 to now, few-to-none of these Democrats have shown any remorse. Not one bit.

It’s all speculation and innuendo. Comer thought he had a “smoking gun” in Devon Archer who he thought would prove Joe Biden was deeply involved in his son’s business activities. Archer’s testimony blue a big hole in that claim. Now, you and the MAGA Republicans are attacking the appointment of David Weiss as Special Counsel. It’s ironic that it was the Republicans who originally wanted Weiss as Special Counsel. Why? Because he is a conservative Republican and a Trump appointee. Now that you have that you are still complaining. Ironies of ironies. Ultimately, whatever happens, whether he is prosecuted or there is another plea deal, I don’t think that Hunter Biden is going to be a big issue in next year’s election for most voters. The only “theater of the absurd” is your desperate hope that it will resonate with the electorate.
Now onto some important news. In the Fani Willis cases in Fulton County Judge Scott McAfee issued a Consent Bond Order yesterday against DJT. It was broader and and more restrictive of what DJT can do or say. McAfee first required DJT to post a bond of $200.000. In none of the prior federal indictments of DJT has that been imposed. Second, McAfee imposed more restrictions that even Judge Chutkan imposed on DJT. The Order prohibits DJT from trying to “intimidate any person” or threaten a co-defendant, witnesses,victims, and the “community or to any property in the community”. The kicker is that the Order also prohibits DJT’s threats using “posts on social media or reposts of posts made by another individual or social media”.
Why is McAfee’s order more restrictive? No doubt McAfee is aware of DJT’s attempt to keep former Georgia Lt. Gov. Jeoff Duncan from testifying against him and all of DJT’s continuing threats against witnesses, the judges and prosecutors in the cases. Trump has also tried to hide behind the posts of his MAGA supporters in reposting them. If anybody thinks McAfee’s Order is an infringement of DJT’s 1st Amendment rights you would be wrong. When you enter the courtroom you lose the right to intimate witnesses, judges or prosecutors–or to try to taint the jury pool. It’s called the “fair administration of justice”.
The big Q is whether DJT will abide by Judge McAfee’s Order? Everyone knows the Trumpster. He can’t keep his mouth shut–even if his lawyers try to admonish him. So what happens when DJT does the inevitable and violates McAfee’s Order. He could well end up in the Fulton County jail. By all accounts that jail is a nasty place!

Comer said that Archer would provide the nexus between Hunter Biden and Joe Biden because he was present during phone calls that were on speakerphone when Hunter was with alleged business associates. Topics for discussion were the weather, where Joe Biden was traveling and other innocuous matters that had nothing whatsoever to do with any alleged “influence peddling”, crooked deals or anything else nefarious.
Turley is paid to keep stirring the pot on the “Hunter Biden Scandal”, but do you disciples notice how many times Turley uses hedge words like “alleged”? He pathetically tries to make it sound like Weiss was trying to pull a fast one when the judge questioned the language in the agreement–without explaining the fact that she was concerned about how to adjudicate future issues regarding immunity should they arise. This was an issue because Hunter’s attorneys foresaw that some a-hole Republican prosecutor might try to resurrect charges down the road. Legal experts who do criminal law say that immunity from future prosecution is standard in plea agreements–but language regarding future judicial enforcement for a politically-motivated prosecutor is not–THAT was the sticking point–not that this was some “sweetheart deal” that Hunter was getting that the judge wouldn’t buy, and she made clear that the deal could still go thorugh with clarification of the immunity language. First-time offenders who pay their back taxes and plead guilty routinely do NOT get prison time–something else Turley does or should know. But, providing a balanced assessment is not what Turley’s paid to do. He tries to paint a picture of the DOJ trying to avoid embarrassment to Joe Biden, pretending to be an insider and “in the know” about internal discussions and negotiations, But, Turley sn’t an insider–he’s a paid pundit for a media outlet that has been proven to lie for political reasons–the Dominion lawsuit is proof.
So Garland makes Weiss a special prosecutor, which enlarges his authority, but Turley has to try to make this sound bad, too: “While Weiss may be able to justify his actions or contest these allegations, he is clearly viewed as compromised by many in the public. He stands accused of running an allegedly fixed investigation and, now according to the Times, only pursued the “sweetheart deal” when whistleblowers moved to expose the allegations of special treatment for the president’s son.” The ONLY reason “many in the public” question anything about any “ALLEGEDLY fixed investigation” is media outlets like Turley’s employer and paid pundits like him, who play word games and spin the facts to try to deflect attention away from the worst political scandal in US history–a twice-impeached and four-times indicted former President who just can’t stop lying, attacking the justice system and attacking prosecutors and witnesses–and, none of this is “allegedly”–it’s in the public domain.
