“What Do We Do if He Doesn’t Recuse Himself?” Rep. Raskin Raises Eyebrows with CNN Interview on Justice Thomas

Rep. Jamie Raskin raised eyebrows on Sunday with a CNN interview where he said that there may have to be action taken if Justice Clarence Thomas does not recuse himself from pending appeals over the disqualification of Donald Trump from the Colorado and Maine ballots. Not only is there a weak basis for demanding such recusal, the suggestion of some type of response or retaliation raises ongoing concerns over efforts to influence or intimidate justices.

CNN host Dana Bash asked Raskin, a former law professor, whether Thomas or any of the judges appointed by the former president should recuse themselves. Raskin responded that “anybody looking at this in any kind of dispassionate, reasonable way would say, if your wife was involved in the ‘Big Lie’ and claiming that Donald Trump had actually won the presidential election and been agitating for that and participating in the events leading up to January 6, that you shouldn’t be participating in (the rulings).”

I, for one, disagree. Under this theory, Thomas would have to recuse himself from any election or Trump related case because of his wife’s advocacy. Justices on both the left and right have long applied a far more narrow view of recusal.

However, Raskin then stated: “He absolutely should recuse himself. The question is, what do we do if he doesn’t recuse himself?”

The reference to some response from Congress or the public was left unexplained. In the past, Democrats have been criticized for fueling the attacks or targeting of conservative justices.

In fairness to Raskin, I do not believe that he is an advocate for violence. He could be referring to the public voting against Trump. I wish, however, that his fealty to the constitution would extend to opposing this pernicious and dangerous theory. Other leading Democrats in Congress have done so.

Senate Minority Leader Sen. Chuck Schumer was widely criticized (including by Chief Justice John Roberts) when he went in front of the Supreme Court to publicly declare “I want to tell you, Gorsuch. I want to tell you, Kavanaugh. You have released the whirlwind and you will pay the price! You won’t know what hit you if you go forward with these awful decisions.”

There is nothing Congress can do to force Thomas off the appeal. The concern is that Raskin is encouraging new targeting of justices at their homes by protesters.

The interview had other curious elements. Raskin made a rather anemic effort to portray the removal of someone from the ballot as weirdly democratic under the theory that Trump picked himself for disqualification: “If you think about it, of all of the forms of disqualification that we have, the one that disqualifies people for engaging in insurrection is the most democratic because it’s the one where people choose themselves to be disqualified.”

That is akin to treating every criminal charge as an act of self-selection and consent by the accused.

Raskin also stated that all of the justices on the left and right “call themselves textualist and originalists.” That is not true in the sense of originalism as a school of constitutional interpretation. Justices Sotomayor, Kagan, and Jackson do not follow an originalist approach but rather a more flexible living constitutional approach.

Moreover, many of us do not believe that the text or original intent of the 14th Amendment support this anti-democratic theory.

      This is why US elections are SUPPOSED to be conducted according to laws passed by legislatures and signed by governors – not made up by Secretaries of State.
      This is why in the US ballot counting is supposed to be done publicly with observers and the press present to confirm that no cheating takes place.
      This is why in the US ballots are supposed to have a perfect end to end chain of custody it they are to be counted.
      This is why 49 US states make ballot harvesting – which was rampant in 2020 illegal.
      This is why in 38 states the requirement for secret ballots is part of the state constitution.

      The 4 requirements of a secret ballot are
      an official ballot being printed at public expense,
      on which the names of the nominated candidates of all parties and all proposals appear,
      being distributed only at the polling place and
      being marked in secret.
      This has been part of U election law since the late 19th century as a result of the massive voting fraud in the 19th century.
      Mailin voting can not anywhere ever meet those requirements.

      This is why a majority of states require voter ID – a valid government issued photo ID presented to an election official as roof of eligability to vote on the day of the election.
      This is why the constitution specifies an election DAY – not week. not month.

      With the exception of Poll taxes, there is no constitutional bar to making elections difficult.

      Whether those of you on the left like it or not, Conducting elections that can be trusted is a Supra constitutional requirement,

      Trust does NOT mean the people who voted for the aparent winner beleive the results.
      It means nearly everyone beleives the results.

      2020 inarguably WAS NOT.
      I would note numerous courts have actually concluded that.
      Delaware found mailin voting unconstitutional.
      Wisconsin found 7 or 8 major violations of michigan election law.
      The 8th circuit found 3rd party election lawfare to coerce states into ignoring their election laws unconstitutional.
      Several states found their signature matching did not comply with the law.
      Several people were convicted of running large ballot harversting operations – though plea deals reduced the scale of what they plead guilty to.

      In newark in the 2020 democratic primary a local judge found over 200,000 fraudulent ballots,
      In bridgeport connecticutt recently a judge threw out a democratic party using evidence weaker that the TTV 2000 mules evidence of massive ballot harvesting in the 2020 election.
      A house election in SC in 2018 was tossed over small claims of ballot harvesting.

      If election fraud is possible – it WILL occur. The history of all elections everywhere ever teaches us that.
      Philadelphia has had someone convicted of significant election fraud every single election during my entire life.

      The same Raffensberger who refused to look into claims of fraud in Fulton county in 2020, later used the same claims of fraud in Fulton County in 2020 to have the state come in and take over Fulton county elections – because of a LONG history of election fraud.

      Some time after the bitter deviceisve 2000 election in Florida two FL election officials in 2 different counties were removed by the state for very serious election law violations in 2000.

      From after the 2000 election right through to the present I have been fighting to eliminate black box computer systems like Dominion from US elections.

      Both Jimmy Carter and Barack Obama and Hillary Clinton and many many other democrats opposed the use of electronic voting machines – including tabulators right through until the 2020 election.

      What Changed ? Dominion – then Diebold was closely tied to George Bush in the aughts and democrats were afraid they would rigg the elections for republicans. By 2020 The leadership of Dominion was publicly promising to deliver the election to Biden.

      There are lots of things we can do to both make elections easier and more importantly more trustworthy.
      Some of those things are opposed by BOTH parties. Just about all are opposed by the left.

      The first most important rule is KISS – Keep it simple stupid.

      We saw in 2022 in NV and AZ as well as many places in 2020 the consequences of convienience over trust. and simplicity.

      The moment you allow voting at any time other than election day, you guarantee that you will not have results election night in any election that is within a few percent. Many of the states that have gone to mailin voting have gone to EXCLUSIVELY mailin voting for that reason.
      Mailin voting can not be made secure. PERIOD. But until recently we have not had a close election in a state with mailin voting so there wasw litte reason to be concerned about fraud.

      It is likely there was very large scale fraud in the Newsome Recall election. But there is zero chance the fraud was large enough to overcome Newsome’s large margin of victory. So there was no challenge.

      With in person voting and good chain of custody for ballots, in person fraud is unlikely to exceed several thousand votes in any state.
      It is possible inperson fraud tipped the 2016 NH Senate election to Hanson – that election was within about 1600 votes.
      But without ballot stuffing by election officials or a complete lack of eny voter identification – large scale inperson fraud is not possible.
      But small scale is. There are two major forms of in person election fraud with voter ID.
      The first is college students who either vote in the state where their college is or try to vote both in their home state and the state where their college is. as a rule states do not allow college students to vote unless they are residents and they make it hard to become residents – not to stop them from voting, but to prevent out of state students from getting instate tuition rates.
      The second which si SOMETIMES students but more often older adults is people who actually legally reside in two states. It is arguably legal for them to vote in the same election year in two different states. But it is certainly illegal to vote for president twice, and likely illegal to vote for federal representatives in more than one state.

      In states with lax id requirements we see trhe same problems as we did during the 19th century. Politican groups usually not linked with parties bus people from elsewhere to where they need votes – often accross state lines and frequently people who can not legally vote anywhere.
      in places without voter ID and places without clean voter registation rolls – that would be all 50 states, it is pretty easy to do that.
      But there is only so large a bussing operation you can run without getting caught.

      And the most important limiting factor we have on election fraud – which is why election integrity laws are so important is that the higher the odds of getting caught the lower the odds of fraud – even if fraud is easy.

      Regardless you can eliminate or significantly diminish in person election fraud by requiring voter ID and requiring that ID have an address within the precinct.

      After that you need to reconcile the number of ballots with the number of voters as a post election audit. Those should match nearly perfectly in each precinct. In states where there are 100,000+ more ballots counted than voters who voted – we KNOW we have ballot stuffing by election officials. Or more accurately – we know that for inperson elections.

      You must have paper ballots everywhere.
      And they MUST be preprinted by the state before the election – none of this nonsense as in AZ in 2022 where ballots were custom printed at the polls and people were allowed to vote at any precinct not just the one their home was in.

      An election ballot today has a value of about $300 – that was the going rate for Ballots in Michigan in 2020.
      That should not surprise as accorss the country who gets to controll trillions of dollars of spending is on the line.

      One of the things the left completely discounts is the possibility of a political election fraud – i.e. not affiliated with either party in anyway.

      How much is it worth to a sales team with a defense contractor that a specific senator is re-elected ?

      Rigging mailin elections by third parties is not only relatively easy,
      But does not require large numbers of people to know about it.

      With unattended ballot boxes and no security cameras – PA cameras were wiped shortly after the election in violation of federal law.
      A single person can forge several hundred thousand ballots and get away with it at a cost maybe .10/ballot.

      I can go on and on about the ways that election fraud can be committed, and the ways to protect against it.

      But what is certain is wishfull thinking will not work. I would further note that both parties are capable of Fraud – as well as third parties.

      If yuou do not make election fraud hihgly likely to get caught and prosecuted – ultimately both parties will be doing so large scale. \

        I would further note that a private party soliciting a bribe – even fro private services is a crime in the US and most of the places Hunter got money.
        That is based on international treaties that required changes to nations laws that the US forced on the world.

  17. Professor Turley, I enjoy and glean much information from your editorials. I believe that sometimes you cut people to much slack when you state what their motives or intentions were in making statements. I concede that we cannot know what is in a persons heart or mind unless they provide us with some insight. I believe that Rep Raskin has provided that by many of his past statements when he accused President Trump for threating or intentionally instigating violence with his statements. Then we should view his statements as being made for that purpose, because that appears to be his thought pattern .

      I do not agree that we should toos the protections of Free Speech for Rep. Raskin – because he has sought to do so for Trump.

      It is immoral to claim constitutional rights for yourself you refuse others.

      It is also unfortunately unconstitutional to refuse constitutional rights to people because they have refused them to others.

  19. As I understand it, the House could choose to impeach Justice Thomas for violating the Good Behavior clause of the constitution and then the Senate could, maybe, convict to remove Justice Thomas from office.

    So write your congressperson, yes?

    1. That would be the correct process. I would note that the constitutional grounds for impeachment those besides the president are much broader than the president.

      Separately, PLEASE, PLEASE, PLEASE attempt to impeach Thomas. As Soon as Possible.

      Our past exchanges make it clear you do not have the intelligence required to understand that acting on your own ideology is a mistake.

      This is one of the common misconcpetions of those on the left.

      We are constantly told that despite never working in the past that communism or socialism will work this time – because we did not have the right leaders last time. Ignoring that any scheme that does not work with those who it attracts to leader it, can not ever work,
      there is the separate problem that communism and socialism do not work either in theory or practice.

      Libertarianism is such an excellent ideology that it works even as badly implimented as it is in the US or even to a lessor extent in Europe.
      But there does come a point at which free market libertarianism is unable to push things forward when wrapped too tightly in statist, communist or socialist chains.

      The Biden administration has not failed because it has the wrong people, or because mistakes were made – though some of that is true.

      It has failed because the ideas of the left are not merely wrong, they are a self contradictory mess that fails the more strongly it is tried.

      So PLEASE keep trying to do stupid things so that everyone will see exactly how stupid they are.

      The question is when will you ?
