Want to Defeat Joe Biden? Look to the 1800 Election and Make Free Speech the Key Issue in 2024

Below is my column in USA Today on why the opponents of President Joe Biden should make free speech the focus of this election. With the Supreme Court taking an off ramp in Murthy v. Missouri on Internet censorship, the free speech community is left, for now, with the political process to protect free speech.  It is a potentially unifying issue for many Americans who are alarmed by the current anti-free speech movement. I have previously written that the Biden Administration has chilling analogies to the Adams Administration in the weaponization of the legal system and the crackdown on free speech. What should most concern Biden is the possibility of another aspect of history repeating itself: a defeat like the one in 1800.

Here is the column:

Since his dystopian speech outside of Independence Hall in 2022, President Joe Biden has made “democracy is on the ballot” his campaign theme. Pundits have repeated the mantra, claiming that if Biden is not elected, American democracy will perish.

While some of us have challenged these predictions, the other presidential candidates are missing a far more compelling argument going into this election. While democracy is not on the ballot this election, free speech is.

The 2024 election is looking strikingly similar to the election of 1800 and, if so, it does not bode well for Biden.

In my book “The Indispensable Right: Free Speech in an Age of Rage,” released last week, I discuss our long struggle with free speech as a nation. It is an unvarnished history with powerful stories of our heroes and villains in the struggle to define what Justice Louis Brandeis called our “indispensable right.”

One of the greatest villains in that history was President John Adams, who used the Alien and Sedition Acts to arrest his political opponents – including journalists, members of Congress and others. Many of those prosecuted by the Adams administration were Jeffersonians. In the election of 1800, Thomas Jefferson ran on the issue and defeated Adams.

Government efforts to limit free speech are Orwellian

We are now seeing what is arguably the most dangerous anti-free speech movement in our history. President Joe Biden is, in my view, the most anti-free speech president since Adams. Under his administration, we have seen a massive censorship system funded and directed by the government.

A federal judge described the system as “Orwellian” in its scope and impact.

Biden has repeatedly called for greater censorship and accused social media companies of “killing people” by not silencing more dissenting voices. Other Democrats such as Sen. Elizabeth Warren of Massachusetts have pushed for restrictions on “unacceptable” speech.

The Biden administration seeks to censor even true statements as disinformation.

For example, I testified before Congress last year on how Jen Easterly, who heads the Cybersecurity and Infrastructure Security Agency, extended her agency’s mandate over critical infrastructure to include “our cognitive infrastructure.” The resulting censorship efforts included combating “malinformation” – described as information “based on fact, but used out of context to mislead, harm, or manipulate.”

The left has picked up the cudgels of censorship and blacklisting once used against them. During the McCarthy period, liberals were called “communist sympathizers.” Now, conservative justices are called “insurrectionist sympathizers.”

Candidates should call out Biden on censorship

In this election, Robert F. Kennedy Jr., Jill Stein, Donald Trump and Cornel West should talk about the threats against free speech at every debate and stump speech. They will have to overcome a news media that has been complicit in the attacks on free speech, but these candidates can break through by raising it as a key issue dividing Biden from the rest of the field.

Democrats and the news media have hammered away at cracking down on those accused of “disinformation.” The public, however, has not been won over by those seeking to limit their right of free speech or the push to amend the First Amendment because it’s too “aggressively individualistic.”

So far, the anti-free speech movement has flourished largely in the echo chambers of academia and the media. It is time for the public to render its judgment.

As discussed in my book, we are hardwired for free speech. It is in our DNA. Despite these periods of crackdowns on free speech, we have always rejected those who wanted to regulate the views of others. Jefferson called the Federalists “the reign of the witches.” (Ironically, Jefferson would himself prosecute critics, though not to the same extent as Adams).

Attacks on free speech have returned with a vengeance before another presidential election. After fighting in the courts and in the public to expand censorship, Biden should now have to defend it with the voters. Let’s have at it, as we did in 1800.

Free speech is again on the ballot. It is time for the public to decide.

      All that means is that Barrett/SCOTUS does not like the party bringing the lawsuit.
      The other basis presented was that The Biden admin had STOPPED the bad behavior – allegedly.
      There is a small amount of dicta in the decision – most of which is contradicted by the slightly earlier NTA VS. NYS decision where Sotomayor wrote the opinion for a UNANIMOUS court.

      Is Barrett wrong on Standing ? I am not sure.

      But the decision was a whimp out.

      With respect to “the law, and Constitution” – YOU – Not Barretts claim that the Biden administrations conduct was acceptable is REJECTED by no other than Justice Sotomayor in a 9-0 oppinion in NYS vs NRA.

      The NRA case was simpler – but outside the legal issues of standing and mootness was THE SAME.

      And the conclusion in NYS VS NRA is that the Govenrment can not seek to have third parties restrict speech – PERIOD.

      Either the Sotomayor Decision and the Barrett Decision – decisions in the same term with the same justices are at odds with each other.
      Or the only reason for a different outcome in Missouri were issues of form and process – such as STANDING – NOT actual constitutional issues

      And yes it is proper for free speech advocates to piss on Barrett and the majority for failing to slap down the Federal government for infringing on constitutional rights.

      As Turely and others have pointed out Social Media companies were absolutely clear –

      they acted at the direction of the federal govenrment and would not have censored but for the request of the federal government,
      and worse still they felt that failure to comply would have negative consequences.

      It is precisely that, that is why the constitutional standard MUST be a bright line. Government may NOT seek to suppress the speech of anyone directly or through third parties – not even if those third parties appear willing, absent the speech ACTUALLY being criminal.

      But the really good news is that long before SCOTUS acted or failed to act that the issue is dead – Because the lefts efforts at censorship have FAILED.

      It is probable that the left successfully tipped the 2020 election as a result of their massive efforts at censorship.

      But the long term consequences have been a loss of trust for the left and the media.

      You wonder why your lawfare against Trump has failed ?

      Atleast part of that is because the left, democrats and the media have lost a substantial portion of the trust they once had.

I know it was a bitter pill to swallow–especially after years by you in arguing just the opposite.

    The only actual “censorship” is not coming from the Biden administration. It’s coming in GOP right-wing state legislators and governors who have passed voter suppression laws, book banning, anti-abortion laws, passing anti-LGBTQ+ legislation and forcing school kids to adhere to “Christian values”–all intended to suppress “free speech” prevent citizens from reading the books of their choice, voting for the candidate of their choice or allowing women to access their right to reproductive care–or violating the 1st Amendment by imposing a religious test for school instruction. FL’s Gov. DeSantis is the poster child for such “censorship” around the country where the GOP governs. DJT is a big supporter of that “censorship”. That’s the part you conveniently ignore in your attempt to paint Biden as anti-“free speech”.

      You seem to disregard the 9-0 decision written by Sotomayor just a few weeks ago on nearly identical facts – NYS vs. NRA.

      THAT decision unequivocally says that Government CAN NOT censor disfavored content by proxy.

      That is 9-0 and Sotomayor wrote the oppinon.

      So What is different in the Misourri Decision ? Why didn’t the court Slam the Biden administration ?

      Complex nonsense over standing which is frequently what the court does when it it trying not to do the right thing.
      And the FACT that the Biden administration completely stopped the conduct the moment that the AG of Misourri started his investigation.

      The Missourri decision is NOT a victory for Govenrment censorship by proxy, and it does NOT say the Biden administration can do what it did.

      It is likely the outcome in the NYS decision was different because NYS (as it has done in other matters) engaged in unconstitutional conduct, stopped when they were sued, and then RESTARTED as soon as the lawsuit was stopped. Got sued again and stopped when they were sued.

      Sotomayor chose NOT to dismiss the case on the same grounds as was used by Barrett BECAUSE NYS was clearly trying to game the courts.

      Barrett is taking the Biden administration at its word that it has stopped the unconstitutional behavior and is not going to resume.

      I think that trust is greatly misplaced – accross the country democrats and those on the left like you have demonstrated over and over, that you will violate constitutional rights at any chance.

      Anxious democrats are terrified that Biden will step on his d!ck and hopeful that Trump will say something incredibly stupid.
      Regardless it will be a 3:1 contest with Trump facing two pro biden anti-trump moderators, and Biden himself.

      My prediction is that the debate will change nothing. Biden will have little opportunity to fail – because the moderators will protect him.
      It is near certain that tomorow YOU will take something Trump said out of context – or just make something up and claim victory for Biden.

      But I highly doubt that tomorow much will have changed.

      There is little either Biden or Trump have to say that will change anything.

      Biden is president – and whether he is competent or not actually does not matter much.
      Trump is running against whoever is calling the shots in the Biden administration, and they have blown it – whether that is Demonto Joe or someone else.

      Conversely Trump was president and we know exactly what to expect. We do NOT need you or the left or Biden telling us what to think.
      We are all capable of comparing the Trump administration to the Biden administration.

  15. Is this so called “debate” really necessary? We already know what both individuals offer. There are no gotcha moments, the past four years have devastated not only free speech but damaged all our rights under the US Constitution, our safety and standing internationally. There is only one choice.

    1. Yes, it IS necessary. Joe has dodged any serious questioning for years. This is Trump’s opportunity to hold Biden’s feet to the fire. Biden brings up the “16 economists”, Trump has the perfect chance to say “Well, how about those 51 intelligence officials”. Joe the laptop has been established as genuine by your own DOJ. Didn’t you know it was when you lied about it in our last debate? Are you saying you didn’t ask Hunter about it? That he lied to you? Why should we take this economy letter any more seriously?

        1. Trump doesn’t get to ask Qs but he does get the chance to respond to what Joe says. Joe got that economist letter to use it in the debate. When he does Trump gets the opportunity to raise the Qs I mentioned. Will Joe answer? No, but it won’t be necessary. The point will be made, that you can’t trust anything the Biden camp pulls out of its butt right before a debate.

            This still means he would go after his political opponents (i.e., Joe Biden) after he wins the election, no?

            If anything, the context of Trump’s quote makes the comparison to the Alien and Sedition Acts more apt. Here, Trump emphasizes Joe’s connections to foreign governments. The Alien and Sedition Acts were principally focused on protecting the US from foreign influence.
