Want to Defeat Joe Biden? Look to the 1800 Election and Make Free Speech the Key Issue in 2024

Below is my column in USA Today on why the opponents of President Joe Biden should make free speech the focus of this election. With the Supreme Court taking an off ramp in Murthy v. Missouri on Internet censorship, the free speech community is left, for now, with the political process to protect free speech.  It is a potentially unifying issue for many Americans who are alarmed by the current anti-free speech movement. I have previously written that the Biden Administration has chilling analogies to the Adams Administration in the weaponization of the legal system and the crackdown on free speech. What should most concern Biden is the possibility of another aspect of history repeating itself: a defeat like the one in 1800.

Here is the column:

Since his dystopian speech outside of Independence Hall in 2022, President Joe Biden has made “democracy is on the ballot” his campaign theme. Pundits have repeated the mantra, claiming that if Biden is not elected, American democracy will perish.

While some of us have challenged these predictions, the other presidential candidates are missing a far more compelling argument going into this election. While democracy is not on the ballot this election, free speech is.

The 2024 election is looking strikingly similar to the election of 1800 and, if so, it does not bode well for Biden.

In my book “The Indispensable Right: Free Speech in an Age of Rage,” released last week, I discuss our long struggle with free speech as a nation. It is an unvarnished history with powerful stories of our heroes and villains in the struggle to define what Justice Louis Brandeis called our “indispensable right.”

One of the greatest villains in that history was President John Adams, who used the Alien and Sedition Acts to arrest his political opponents – including journalists, members of Congress and others. Many of those prosecuted by the Adams administration were Jeffersonians. In the election of 1800, Thomas Jefferson ran on the issue and defeated Adams.

Government efforts to limit free speech are Orwellian

We are now seeing what is arguably the most dangerous anti-free speech movement in our history. President Joe Biden is, in my view, the most anti-free speech president since Adams. Under his administration, we have seen a massive censorship system funded and directed by the government.

A federal judge described the system as “Orwellian” in its scope and impact.

Biden has repeatedly called for greater censorship and accused social media companies of “killing people” by not silencing more dissenting voices. Other Democrats such as Sen. Elizabeth Warren of Massachusetts have pushed for restrictions on “unacceptable” speech.

The Biden administration seeks to censor even true statements as disinformation.

For example, I testified before Congress last year on how Jen Easterly, who heads the Cybersecurity and Infrastructure Security Agency, extended her agency’s mandate over critical infrastructure to include “our cognitive infrastructure.” The resulting censorship efforts included combating “malinformation” – described as information “based on fact, but used out of context to mislead, harm, or manipulate.”

The left has picked up the cudgels of censorship and blacklisting once used against them. During the McCarthy period, liberals were called “communist sympathizers.” Now, conservative justices are called “insurrectionist sympathizers.”

Candidates should call out Biden on censorship

In this election, Robert F. Kennedy Jr., Jill Stein, Donald Trump and Cornel West should talk about the threats against free speech at every debate and stump speech. They will have to overcome a news media that has been complicit in the attacks on free speech, but these candidates can break through by raising it as a key issue dividing Biden from the rest of the field.

Democrats and the news media have hammered away at cracking down on those accused of “disinformation.” The public, however, has not been won over by those seeking to limit their right of free speech or the push to amend the First Amendment because it’s too “aggressively individualistic.”

So far, the anti-free speech movement has flourished largely in the echo chambers of academia and the media. It is time for the public to render its judgment.

As discussed in my book, we are hardwired for free speech. It is in our DNA. Despite these periods of crackdowns on free speech, we have always rejected those who wanted to regulate the views of others. Jefferson called the Federalists “the reign of the witches.” (Ironically, Jefferson would himself prosecute critics, though not to the same extent as Adams).

Attacks on free speech have returned with a vengeance before another presidential election. After fighting in the courts and in the public to expand censorship, Biden should now have to defend it with the voters. Let’s have at it, as we did in 1800.

Free speech is again on the ballot. It is time for the public to decide.

    (1) Trump lacks the unique intellectual traits of Jefferson, i.e., knowledgeable, analytical, problem solving, motivating, convincing, creative, and careful planning.
    (2) Too much of the media equivocate on the issue of free speech and fail to educate their readers on the full substance of the “Indispensable Right.”
    But then again, there is always hope that at least 51% of voters will ignore and move past the problems.

  2. Spot on, I couldn’t agree more with Professor Turley on this point. Its the one thing that the other candidates need to focus on as its the major issue of the day, along with the war in the Ukraine which is a crime against humanity that WE are perpetrating equally as much as Putin is. This is our war in the Ukraine, its not the Ukrainians and its not Putins, its ours. We own it. We need to clean it up and get out and make peace with Russia.

    And we need to restore free speech protections and hold accountable those who support this mass censorship effort by removing them from office and negating their power over us.

    But, …we also need to be wary of who we hand the keys too. Trump has had the opportunity to stand up for free speech many times, so why isn’t he?

    One possible answer is simple, based on his past it is likely Trump is all for censorship, as long as HE’s the one doing the censoring.

    IF that is the answer, and explains why he hasn’t taken this tiger by the tail and made it the key issue, then its important to look at the other candidates, particularly Kennedy who DO make free speech a front and center issue in their campaigns already. Kennedy has numerous ads, videos, etc about the Biden administrations censorship efforts.

    Trump I’ve seen none, maybe I missed them but other than few mentions in passing I’ve not heard take this issue to heart, which to me smacks of a pretty obvious sign that its not a big issue for him, and for him its just more of a matter of who doing the censoring instead of censorship itself.

    We need to be wise as wolves here, and make sure who we hand the keys to again isn’t just a devil in different clothes.

Well I agree the economy is a key issue and its one that Trump is particularly adept at addressing, violent crime depends on where you live, that’s a geographically subjective issue, in rural America violent crime is not a huge issue, and while a lot of people talk about the border problem its only really a deal breaker in states near borders or who have a large influx of illegal immigrants, again not a problem here in the bulk of rural America.

        Govt censorship since Covid however has impacted everyone and most Americans who really do honor the flag and the country know that free speech is the one foundation stone that keeps that flag flying, and without freedom of speech we have nothing.

        The economy could be gold but if we lose free speech then all the money in the world won’t make us free, and money without freedom is nothing.

    3. You might be right. If the moderator was a student then he is no longer in charge of moderating the blog. I assume nobody wants to take care of the blog or it’s left on ‘autopilot’. Perhaps if Turley paid someone instead of relying on free volunteer work this blog would not be hijacked by foul mouthed personal attacks on others. However, it’s also part of the free speech the professor constantly promotes.

        That’s actually kind of an interesting issue. One can espouse free speech without allowing one’s living room to be used to broadcast racist propaganda or obscene content. Policing speech emanating from one’s private property to exclude that kind of content would be entirely consistent with the core free speech value of allowing a free and open debate of ideas.

        One can be an avid free speech fan without going so far as to say people should be free to incite violence, promote lewd and indecent content in public, make terroristic threats, make fraudulent or libelous statements, or joke about having a bomb at an airport, courthouse, or border checkpoint. These latter types of speech do not promote a meaningful debate about ideas or issues of public or private concern, or help people arrive at the truth. They have been deemed of such little value that society is allowed to weigh them against the harm they cause and prohibit them. I doubt that would be inconsistent with a robust defense of the First Amendment, or with Professor Turley’s position on free speech issues.

        1. OMFK – absolutely there is a property right to exclude whatever speech you wish from your own property.

          That does not mean you are obligagted to do so
          or worse – spend money to do so.

          Absolutely there is lots of speech that is atleast arguably of no benefit – though even fools revealing themselves as fools has some small value.

          But just because some speech may have little or no value does not mean that it is worth money or effort to eliminate.

          I do not see anyone here being actually harmed by the posts they would censor if they could.

          So why bother ?

          I have more problems with the fact that the automated processes that get rid of clear span and some other things periodically also filter valid contributions, than with the fact that lots of posts here are little more than juvenile ad hominem.

          While Turley has always been a free speech advocate – he is being pushed by the censorious left – as well as some of the tit for tat right that have bought left wing nut speech arguments into ever more absolutist positions.

          I commend that.

          I am happy to tolerate a plethora of juvenile posts for the right to say whatever I wish with little fear of censorship.

          1. John Say – Professor Turley evidently agrees with you. His wish not to pay someone to moderate is rational; who wants to pay someone to do something if they don’t have to?       There is actually a valid purpose served by allowing broad free speech – including trolls and other such nonsense.

      The absence of good arguments strongly hints that good arguments do not exist.
      The volume of ad hominem and other nonsense strongly suggests that is the best those involved can manage.

      Further what people post is the best evidence of who they are.

      I am perfectly happy with the volume of poor posts on this site.

      It paints a picture of the debate that is unflattering for those posters and their positions.

          A major factor effecting Social Media after Musk’s takeover of X is that he fired lost of people in the censorship positions.
          Did Twitted become worse as a result ? Not that I have seen.
          Did Twitters costs go WAY down ? Absolutely.
          We have separately but Quietly seen similar cuts in the rest of Social Media.
          Why ?
          Because shareholders do not like paying for operations that do not alter the value of the business.

          There have been massive layoffs accross country in media censorship roles.

          This is one of the HUGE reasons that the recent SCOTUS censorship decision is abhorent.

          While I disagree with Barret that the AG did not clearly establish that Govenrment action was coercive.

          I DO NOT CARE. Government has almost no role at all in public debate. Especially NO back channel role.

          The CORRECT SCOTUS decision was that absent requests involving ACTUALLY illegal speech, Government should NOT be even making requests of the press social media, ro others regarding speech.

          Turley has recently – and correctly argued that the Biden administration – and particularly its efrforts at censorship is ACTUALLY the most dictatorial in US history. And the greatest “threat to democracy”.
          He has been enlightening us with John Adam;s most repugnant conduct – Note Adam’s was a great founder and a great man.
          But he was absolutely wrong in his efforts to censor political opponents.

          It does not seem to have worked for Adam’s.

          It also does not seem to be working today.

          I do not think it is accidental that Trump whose speech DELIBERATLEY enflames many is a major figure at the very same time as government, the media, social media and even large portions of the electorate have gone way off the rails in favor of censorship.

          Or put differently – Turley has argued that John Adam’s censorious approach backfired.

          I beleive the same is happening to the left today.

          The supreme court did not save the republic in 1802, it has abdicated that role today.

          But just as in 1802 – as powerful as the effort to censor is, it is still LOSING, as well as FAILING.

And says nothing when Texas removes school books about Anne Frank from school libraries, or when one person, Rep. Maria Elvira Salazar R-cult made a phone call to a billboard company to take down billboards around Miami because it showed a picture of Trump and Castro saying “no to dictators”. And guess what, they took them down, even after someone had paid for their “free speech”.

    2. The school problem can be solved trivially by getting rid of public schools. Sweden allows you to choose either public or private school and funds both equally. While I really want government out of schools including funding – Government makes EVERYTHING expensive.

      Getting government out of schools returns the balance of power in education to PARENTS – where it belongs.
      My kinds are in their 20’s. I have no interest in the education of pre-teen and teens today – except that I must pay for it.
      It is not the states business what books are in schools. Nor is it the unsupervised education bureaucracy.

      Teachers can teach what they want. Librarians can choose whatever books they want and parents can demand they are fired for doing so.

      3) Texas had ONE district remove over 670 books from their libraries, most focused on sexuality and race. Unfortunately, that also collected a few books that were Jewish positive books as well. There were 9 titles removed that covered Holocaust themes. It was not all of Texas. You hate the Conservative take on education, you know, focusing on learning, not focusing on gender studies and how many pronouns they can teach and how many graphic sexual pictures they can show to first graders. What has that done for the conservative bastion of Florida? You know, where the governor removed the sex language and sex teaching and the gay agenda from kids under 8th grade? What did that do? Well, let’s see. Where were they in 2022? They were 16th in the nation. What about 2023, when the law went into effect? 10th. After 1 year of actual teaching of the basics, where are the? Oh, wow. Look at that. They’re #1 in the nation. Where’s California? They literally spend over $5000/pupil more than Florida does. You’d think they’d be doing great. The have a 34% literacy rate at graduation.

      Maria Salazar didn’t like something. She made a phone call, and it got taken away. She asked the company to remove the billboards. You have no proof of any threats or any payments or kickbacks. What you have is she got upset with a blatant lie (Trump isn’t even 1/100th the dictator you idiots claim he was, and that’s still less than 1/100th of the dictator Joe and his handlers have ACTUALLY become), and called, as any citizen can do, ask, and they decided to do so. Was it because she was a politician? Possibly. Was it because she knew someone at the company? Possibly. Who knows. You certainly do not. It wasn’t a violation of the person’s free speech. It was the company no longer wishing to do business with them.
