Below is my column in the New York Post on the Supreme Court’s historic presidential immunity decision. I am not someone who has favored expansive presidential powers. As a Madisonian scholar, I favor Congress in most disputes with presidents. Yet, the reaction to the Court’s decision has been baffling from academics who did not raise a whimper of opposition when President Barack Obama killed an American citizen without a trial or a charge. When former Attorney General Eric Holder announced the “kill list” policy (that included the right to kill any American citizen), he was met with applause, not condemnation. Moreover, even the government conceded before the Supreme Court that official acts did deserve protection from prosecution. The issue was only where to draw that line. The Court found that there was absolute immunity for actions that fall within their “exclusive sphere of constitutional authority” while they enjoy presumptive immunity for other official acts. They do not enjoy immunity for unofficial, or private, actions.
I felt that there were good-faith arguments on both sides of this issue. The reaction, however, of politicians and pundits is to again denounce and even threaten the justices. Rage has again replaced reason as commentators misrepresent the opinion and race to the bottom in reckless rhetoric. It is not clear what these paper-bag pundits are more upset about: the fact that the Court ruled in favor of immunity or that the Court again failed to yield to years of harassment and threats from the left. What they fail to understand is that this is precisely the moment that the Court was designed for.

Within minutes of the Supreme Court’s decision on presidential immunity, liberal politicians and pundits seemed to move from hyperbole to hyperventilation. When not breathing into paper bags, critics predicted, again, the end of the republic.
CNN’s Van Jones declared that it was “almost a license to thug, in a way.”
Sen. Richard Blumenthal (D-Conn.) declared: “My stomach turns with fear and anger that our democracy can be so endangered by an out-of-control court” and denounced six justices as “extreme and nakedly partisan hacks — politicians in robes.”
Blumenthal has previously shown greater intestinal fortitude, as when he threatened the justices that they would either rule as Democrats demanded or face “seismic” changes to their court.
Jones warned the justices that “politically it’s bad” for them to rule this way.
The comment captures the misguided analysis of many media outlets. The Supreme Court was designed to be unpopular; to take stands that are politically unpopular but constitutionally correct.
Court independence
Indeed, the Democrats have become the very threat that the court was meant to resist.
Recently, senators demanded that Chief Justice John Roberts appear to answer to them for his own decisions. (Roberts wisely declined.)
Senate Majority Leader Chuck Schumer previously declared in front of the Supreme Court, “I want to tell you, [Neil] Gorsuch, I want to tell you, [Brett] Kavanaugh, you have released the whirlwind, and you will pay the price.”
Now Rep. Alexandria Ocasio-Cortez (D-NY) announced that she will seek the impeachment of all six of the conservative justices. She was immediately joined by other Democratic members.
Notably, scholars have long disagreed where to draw the line on presidential immunity. The court adopted a middle approach that rejected extreme arguments on both sides.
Yet, because Ocasio-Cortez disagrees with their decision, she has declared that this “is an assault on American democracy. It is up to Congress to defend our nation from this authoritarian capture.”
Previously, Ocasio-Cortez admitted that she does not understand why we even have a Supreme Court. She asked “How much does the current structure benefit us? And I don’t think it does.”
Other members, such as Sen. Elizabeth Warren (D-Mass.), have called for packing the Court with additional members to immediately secure a liberal majority to rule as she desires.
For these pundits and politicians, justice is merely an extension of politics and subject to the whims of the majority.
These are same voices who chastised Judge Aileen Cannon for “slowwalking” her decisions by holding hearings on constitutional questions. They pointed to Judge Tanya Chutkan, who supported the efforts of special counsel Jack Smith to try Trump before the election, turning her court into a rocket docket.
Chutkan quickly set aside this challenge, as well as other objections from Trump.
Indeed, at the oral argument, Chief Justice Roberts marveled at the conclusory analysis by Patricia Ann Millett in upholding Chutkan. He referred to the opinion celebrated by the left as little more than declaring “a former president can be prosecuted because he’s being prosecuted.” Chutkan and the DC Circuit were fast but ultimately wrong. Indeed, the Supreme Court noted that the judge created little record for the basis of her decisions.
In a perverted sense, Democrats are giving the public a powerful lesson in constitutional law. As Alexander Hamilton stated in The Federalist No. 78, judicial independence “is the best expedient which can be devised in any government to secure a steady, upright and impartial administration of the laws.”
This is the moment that the Framers envisioned in creating the Court under Article III of the Constitution. It would be our bulwark even when politicians lose faith in our Constitution and seek to dictate justice for those who they dislike.
An ‘Age of Rage’
In my new book, “The Indispensable Right: Free Speech in an Age of Rage.” I discuss other such moments in our history. This is not our first age of rage. During periods of intense fear or anger, people often turn on free speech or other rights as inconvenient or outdated.
We have heard the same voices of the faithless today. MSNBC commentator Elie Mystal has called the Constitution “trash” and argued that we should simply just dump it. Law professors Ryan D. Doerfler of Harvard and Samuel Moyn of Yale called for the Constitution to be “radically altered” to “reclaim America from constitutionalism.”
None of these threats or bloviating will work. The court is designed to stand against everyone and everything except for the Constitution. It was forged for this moment.

I think that one of the key components of this decision is the tone Chief Justice Roberts took with his leftist colleagues. It was somewhat harsh and not like we have seen in previous decisions. Does this signal that the Chief Justice is starting to lose patience with Brown, Kagan and Sotomayor. He usually tries to be a great conciliator and unifier for decisions but not this time. May herald a significant change in the tenor of the court’s decisions.
Prayers may be answered, that is the hope of Americans.

He left out an important distinction about the court’s opinion. They also made sure that no prosecutor can use any official acts as a basis for showing motive for unofficial acts. Now it’s up to judge Chutkan to determine what are and are not official acts. SCOTUS could have done that itself, but instead chose to subversively let that question be answered by Chutkan to further delay the trial. Once Chutkan decides what is and isn’t an official act it will again be appealed to the Supreme Court for another 6 month wait.
There is ample reason to increase the number of justices in the Supreme Court. There are too many ideologues on the court. It needs to be properly balanced. It’s too unbalanced right now.

To be a Leftist must mean taking a pill which erases memory. There have been many examples of the left trying some novel approach designed specifically to screw over the Right, only to have it bite them in the ass. My favorite example is Harry Reid’s elimination of the filibuster for Federal Judge appointees (except for the Supreme Court), which allowed Trump, with little opposition, to replace 1/4 of the Federal judges with conservative leaning individuals.
I wonder what level the howls would have reached if Obama had been indicted for the murder he commited? They’d probably be in favor of this ruling if that had happened.
I see that this decision also re-ignites the “pack the court” discussion. This current round started when Trump was still President. You really don’t get credit for dumb things you don’t do, but were I him back in 2018-19, I might have done something like “So, you want to pack the court? No Problem. Today, I am nominating this list of 1,000 conservatives for newly created Supreme Court Associate Justice positions”. That would have been fun. (“Brain cleanup in the House Chamber, now!”)

As a result of the weaponization of the DOJ by Joe Biden a case found its way to the Supreme Court because: the DOJ appointed a special counsel with a history of bias for the purpose of prosecuting the leading opposition Presidential candidate. It found its way to the Supreme Court because Fani Willis with a White House counsel to coordinate a prosecution strategy in Georgia. It found its way to the Supreme Court because the third highest ranking attorney in the DOJ appeared in Alvin Bragg’s NYC/NYS prosecution. Further more, the special counsel Robert Hurd said that Joe Biden, while he was President, faced criminal liability for having had classified files, a felony to be in his possession. He didn’t notify anybody that he had them until he selected the special counsel to go after Donald Trump. Biden’s speech writer had no security clearance who admittedly was looking at those files in the presence of Joe Biden. The only reason he wasn’t prosecuted was that Robert Hurd represented that Biden was too enfeebled and would win the sympathy of a jury. Biden as a sitting President has flouted and re-written promulgated Federal law by establishing his own immigration agenda through Executive action. Biden’s administration has a lawless Attorney General and DOJ presently being sued by the House Judiciary committee, and a special prosecutor whose modus operandi is ‘show me the victim and I’ll find you the crime. The House Rule Committee may have enough votes to charge the DOJ with inherent contempt. Critics find themselves illused?? Joe Biden has already made himself the next Stalin.

All presidents have had immunity for their actions taken under their constitutional powers, but this case made it to the Court due to the Biden team being the only corrupt people in the WH that have actually gone after a prior president. No other president has done any more than blame their predecessor for some of the nations problems (actually only Obama has even done this) and none has certainly ever gone after another president legally.
The on;y reason that Biden has done the above is because Trump is running against him again. The Left and the Bidens will fight like typical communists to win power…all as they “worry about democracy”.

The liberal/ progressive reaction to the Supreme Court’s immunity decision reveals an astonishing level of ignorance or duplicity or both. Nearly all elected or appointed government officials, including members of Congress and the Supreme Court, enjoy some level of immunity. A member of Congress, even someone as nutty as AOC, can say whatever creeps into his or her mind and, as long as the words are spoken from the floor of the House, for example, there can be no prosecution or civil liability. The judges of every court in the land, from the Supreme Court to a local Justice of the Peace, enjoy some form of “judicial immunity” which means generally there can be no civil liability for their judicial decisions. As an assistant attorney general many years ago, I enjoyed immunity for my official acts. Immunity in one form or another as been a part of the fabric of many legal systems since the memory of man runneth not to the contrary. I have yet to hear a single liberal or progressive commentator call for the abolition of immunity across the board. Only President Trump is the focus. Only President Trump puts the country at risk of someone who is “above the law” even though the two stark examples cited by the Professor show that Obama and Holder were far worse than President Trump. Well, actually, in addition to President Trump, many of the liberal/ progressive commentators also have clamored for the removal of immunity from law enforcement officers so that any routine traffic stop that goes south could carry with it the risk that the officer will lose whatever financial future he or she has. The role of the media used to be putting a spotlight on ignorance and duplicity. Today, instead, much of the media is the prime purveyor.
I would say it reveals a deep ignorance and stupidity among democrats. The leaders are duplicitous, the rank and file are useful idiots.

I wholeheartedly hope you are right – that the Supreme Court will continue to stand as a bulwark against the naked politics of such as AOC and the other raging leftists in Congress and the media. The calls to “pack the court” are especially heinous as they directly attack the purpose of the court – to not be as volatile as the other two branches of the federal government can be in November.
I am amazed by the statements on social media. To me, the decision was a no brainer – of course the Chief Executive has immunity for actions within the scope of his/her authority. Of course he/she can be prosecuted for actions outside such authority. Both Congress and the judiciary have some degree of immunity for their official actions, but not the President?
The real question is whether a specific action, such as a speech, is protected. I do not envy the judge(s) who will have to decide that question
