So It Begins: The European Union Unleashes the DSA on X with Initial $140 Million Fine

For years, some of us in the free speech community have warned about the threat of the European Union to free speech, particularly in the enactment of the infamous Digital Services Act (DSA). The EU has virtually declared war on free speech and is targeting American companies. That war just began with the first DSA fine. Not surprisingly, X was the chosen target — a company blamed by many in the EU and the U.S. for rolling back free-speech protections.

In a historic speech in Munich this year, Vice President J.D. Vance confronted the Europeans over their attacks on free speech, declaring, “If you are running in fear of your own voters, there is nothing America can do for you.” However, the EU has long worked in conjunction with many on the American left in seeking to force companies to censor Americans.

One of the lowest moments came after Elon Musk bought Twitter on a pledge to restore free-speech protections. Clinton called upon European officials to force Elon Musk to censor American citizens under the DSA. This is a former democratic presidential nominee calling upon Europeans to force the censorship of Americans.

She was joined by another former democratic presidential nominee, John Kerry, who called for government crackdowns on free speech.

In my book on free speech and various columns, I write about the DSA as one of the greatest assaults on free speech in history. As I wrote in the book:

“Under the DSA, users are ’empowered to report illegal content online, and online platforms will have to act quickly.’ This includes speech that is viewed not only as ‘disinformation’ but also ‘incitement.’ European Commission Executive Vice President Margrethe Vestager has been one of the most prominent voices seeking international censorship. At the passage of the DSA, Vestager was ecstatic in declaring that it is ‘not a slogan anymore, that what is illegal offline should also be seen and dealt with as illegal online. Now it is a real thing. Democracy’s back.’”

After the Vance speech, American politicians and journalists quickly added their voices of condemnation. CBS anchor Margaret Brennan confronted Secretary of State Marco Rubio to suggest that Vance’s support for free speech was outrageous because he was “standing in a country where free speech was weaponized to conduct a genocide.”  Brennan’s bizarre suggestion that free speech contributed to the death camps was amplified by Rep. Seth Moulton (D-MA), who accused Vance of using “some of the same language that Hitler used to justify the Holocaust.”

In the wake of the Munich speech, leading anti-free-speech figures from around the world gathered at the World Forum in Berlin. I was one of the few speakers from the free-speech community at the conference which declared “A New World Order with European Values.”  Various Americans were present to reaffirm the worst about the United States as a nation descending into tyranny.

The two most celebrated figures were Bill and Hillary Clinton, who also criticized the current Administration.

After returning from Berlin, I testified before the Senate Judiciary Committee and warned about the growing threat to free speech posed by the use of the DSA.

Since then, the EU has moved forward with its aggressive campaign against U.S. companies and figures who refuse to yield to its expansive censorship demands.

This is the first fine under the DSA and the EU officials acknowledged that it will lay the foundation for additional penalties to come to force companies to comply with EU “values” on free speech.

The European Commission has imposed a €120 million ($140 million) fine on X after finding that it misled users with its paid-for blue checkmark verification symbol, failed to provide researchers with access to data, and did not properly set up an advertising repository.  X has 60 days to develop solutions to address the issues and 90 days to implement the changes, or it may face additional fines.

Under the DSA, the EU can impose fines of up to 6% of an online platform’s annual global revenue for failing to address illegal content, disinformation, or transparency requirements. It is still investigating X as well as several other major US tech firms, including Apple, Google, and Meta, under the DSA and the Digital Markets Act. This includes investigations for failing to carry out demands for censorship, including of American citizens.

This is just the first salvo in a war that some of us have warned is coming. We cannot be passive at this moment. The EU is threatening the very indispensable right that has long defined us as a people. Many in the United States are rooting for the Europeans to roll back free-speech protections at X and Meta. Some have appeared before the EU to call for this type of action. They could use the EU to achieve abroad what they have failed to accomplish in the United States. The results will be the same for Americans, who will find themselves subject to European censors and “values.”

  1. I think I will wait and see. This affront from the EU may be something that will get negotiated away. That being said, one wonders what the EU hopes to accomplish here. I think this is more a statement, fairly mild in character, with a desire by the EU to see how we respond. Also the EU is not all of Europe. It is a superstate imposed on the nations of Europe and has varying levels of support from nation to nation. This may have unanimity but it may not. There is particularly a disconnect between the people of Europe and their EU masters, again state by state. So I am really not sure if this a real shot across the bow or simply an unpleasant note that starts negotiations.
    An attack on an American company may bring people to close ranks (except for the Clintons). So the effect of this note could have a result opposite to what the EU hopes for.
    European Sates tend to be less direct and like to play their little games and pretend to be obscure to their real purpose.

Americans won’t buy from abroad at the high tariff price, and so those countries unwilling to trade fairly won’t be making sales here, costing them dearly.   2. The old adage “when in Rome…” comes to mind when looking at how US companies operate in other countries.

    If people from across the globe come to the USA, we not only expect them to follow our law, we demand it, and we prosecute those that break our laws. I find it a bit hypocritical to try to force other nations to conform to our laws when we travel to their countries.

    Conclusion
    If US companies don’t like the laws in other countries, including free speech, then don’t operate in that country, period. Instead, intentionally isolate countries that suppress things like free speech and let their population exert their power to change their own country.

  4. The first duty of the U.S. government is to defend our national security and our God-given, unalienable rights — not only for individual citizens, but for American businesses protected under the First Amendment.

    Right now, the U.S. isn’t hesitating to strike narco-boats in the Caribbean and near Venezuela because those pipelines deliver fentanyl and other narcotics that kill Americans. When a foreign pipeline sends death into this country, we shut it down without apology.

    What the EU is doing is morally the same kind of attack, even if the weapon is different. Instead of poison to the body, it is poison to liberty. They are threatening and fining an American company, X, specifically to coerce censorship of lawful speech by Americans. That is not ordinary regulation. It is foreign punishment aimed at a constitutionally protected right. It is an attack on American sovereignty.

    Our response should be just as decisive as it is with the drug trade: harsh, immediate, and painful enough that it is never attempted again. If the EU can impose ruinous fines to force censorship, the U.S. must be willing to impose reciprocal economic consequences to defend free speech.

    Now, if X were truly facilitating real criminal harm — trafficking, direct threats, organized violence — that is a legitimate law-enforcement issue. But if this is about political speech or “disinformation” that remains protected under the First Amendment, then there is no gray area here.

    Drug traffickers kill bodies. Foreign censors kill republics.
    Both deserve to be stopped.

    The US has huge leverage over Europe if real censorship occurs. It could simply pull all its troops out and end other forms of military and intelligence support. It could also return to the trade war.

  15. The EU really doesn’t matter much anymore, and it is getting less relevant by the day, economically and politically. The European so-called “World Wars” of the first half of the twentieth century exhausted Europe, financially and morally. Postwar “communism” reached its peak in the second half of the twentieth century as the do-gooder (buy self-interested) United States form of relatively fairly distributed capitalism wiped out the elitist socialism of the Russian dominated Soviet Union’s imperial ambitions. Now in the twenty-first century, a fat-at-the-very-top American capitalism is facing a resurgent form of (called for window dressing purposes’) Chinese communism with very capitalist characteristics.
    The EU, bereft of resources, ruled by a crypto-aristocratic remnant of long eclipsed dominance, and economically destroyed by a foolish adherence to a non-religious cult of the end-times (climate change) is California writ-large, in this case a continent of welfare serfs with an impoverished center with no long-term plan at all. Radical Islam is again Europe’s immediate danger, as it was in 1474, but this time there is a hegemon, China, that doesn’t care about who pretends to rule in its outer area of power.
    The United States no longer cares to nurture a clearly dead Europe. Instead, it is withdrawing its influence from there and repurposing it to maintaining its hegemony in the America’s, where China is battling it for raw materials and markets.
    A resource rich Russia holds the EU in contempt, and knows that if it weans the USA from the EU it will have a free hand to replay the history of pre-World War One Czarist imperialism in Europe. Russia plays a dangerous game with China, its contemporary ally, but certainly not concerned with Russia’s interest other than as they support China’s.

After all, you in the US think the Second Amendment trumps the prevention of school shootings, the rest of us do not. “Free speech” is not a God given right, but one which US politicians chose to, belatedly, enshrine in your Constitution as an Amendment.
