While Donald Trump is now saying that he might still run for president, he might want to keep one case off his campaign resume. In Scotland, Trump is bullying a Scottish couple who have had the temerity to refuse to surrender their home to his development. Trump is reportedly not only seeking governmental order to acquire the land but he encircled the home with a fence and then charged the couple with half of its cost — hitting David Milne, 46, and his wife Moira with a bill for £2820 for a fence they do not want.
Trump is building a new golf course in the Menie Estate in Balmedie, Aberdeenshire. He already has acquired a huge amount of land for two courses, a clubhouse, a hotel and 950 houses. However, he now wants more land and Milne and his wife are in the way. He does not appear to care that the couple has lived in the house for almost 20 years and simply do not want to give up their dream home — which Trump has publicly called “ugly.” (Presumably, this is because the home is not covered in gold gilitter, fake Corinthian columns, and of course the Trump name).
Trump appears to be using a rule that I have long opposed from the common law — the ability of a property owner to force a neighbor to pay for a fence. This device was used by the infamous Virginia attorney John Frederick Ames to allegedly ruin his neighbors. Since Trump is being supported by many Tea Party members, it may seem a bit odd that he is not only using this abusive fence rule but angling for a Kelo-type claim to the land.
I suppose the Milnes could just look him in the eye and say “Fella, you’ve had your fun. Your fun is over.” Then again taking the home from a middle-aged couple for a golf course seems to be part of the fun for Trump.

Scotland really needs to tighten up its immigration rules to keep the likes of Trump totally out of the country.

If this couple can’t get out of paying for Trumps’ fence, can we start a fund to help them. Maybe a fund to hire a good lawyer who could charge Trump with harrassment and make him pay, When I say pay, I don’t mean just money. Obviously that little prick has plenty. Maybe full page ad admitting to being a jerk and not fit to be anyone’s neighbor.
By the way, are people really so callous they would play golf on his course? Maybe some protest might be a goood idea for the people who live in the area. Either that or get use to Trump deciding what they can do.
Woosty, I am just grateful that as a country we are not so insane and self destructive that we would elect Donald Trump or Sarah Palin. Not yet anyway.
I went from distain to a personal hatred of Trump when he was bragging about being smart enough to game the system and use the courts (though he refused to all it bankruptcy) to re-capitalize his holdings and coming out of it in an even stronger business position. He also bragged and laughed that he managed to screw Quadiffi out of a lot of money by renting him a plot of land to expressly pitch his tent (literally) and then going back on that part of his understanding/contract.
He’s a sociopath that touts his moral and business failings as his strengths. POS. And s**t is defamed by the comparison I know.

In Missouri the laws governing fencing are quite detailed and apply to the restraint of domesticated animals such as sheep and cattle. They also specify what type of fence a neighbor can be made to pay for (last 2 paragraphs below).
While a neighbor may want to make you pay for a ‘fancy’ fence the directed contribution must be limited to the fence determined by statute to do the job: 4 strands of barb wire and posts not farther than 12 or 15 feet apart in some counties and a somewhat sturdier fence for horses if they are the livestock, in others.
Trump is such a pos. I hope that his reluctant neighbor can get out from under this burden but if the law does indeed burden his neighbor I hope that it limits his liability as would Missouri’s. Or makes Trump keep a herd of cattle or sheep mandated to wander hither and yon across his well manicured greens.
“11. What constitutes a “lawful fence?”
General fencing law counties: Any fence consisting of posts and wire or boards at least four feet high which is mutually agreed upon by adjoining landowners or decided upon by the associate circuit court of the county is a lawful fence. All posts shall be set firmly in the ground not more than twelve feet apart with wire or boards securely fastened to such posts and placed at proper distances apart to resist horses, cattle and other similar livestock. (272.020)
Optional fencing law counties: A fence with not less than four boards per four feet of height; said boards to be spaced no farther apart than twice the width of the boards used fastened in or to substantial posts not more than twelve feet apart with one stay, or a fence of four barbed wires supported by posts not more than fifteen feet apart with one stay or twelve feet apart with no stays, or any fence which is at least equivalent to the types of fences described herein. (272.210)
22. Can I legally force my neighbor to pay for half the cost of a special fence (one more expensive than those described as “lawful fences”)?
No. But the definition of “lawful fence” varies between the general and the optional fence law counties.
i. In general fence law counties, a “lawful fence” is one which will restrain horses, cattle, and other similar livestock. So you can force the neighbor to pay for half the cost of a sturdier fence to restrain horses, even though he would prefer a less expensive fence suitable to restrain his cattle or sheep. (272.020)
ii. In option fence law counties, a “lawful fence” for forced contribution purposes is one with four strands of barbed wire with post twelve feet apart or fifteen feet apart if with one stay. Any fence more expensive than this (such as one with boards or woven wire) would have to be paid for by the neighbor desiring such a fence, not the reluctant one satisfied with the four strands of barbed wire. (272.290)”

I think the bigger point is that he is being an asshole and when is someone going to stand up to the bullyng TRUMPLETTES of the world? We truly are living in lawless times…despite your kelos and hohos and whatever other selectively applied whingdingy soundbites (laws) there are out there. So instead of an Obediant Wives Club like Malaysia is offerring….I think more apropos would be the Worldwide Assholes Rough Theives and Harm Order Group, W.A.R.T.H.O.G.s….it can be the first of many unthink-tanks.
They apparently need a Kelo decision over in Scotland. Trump could simply argue that his use would generate increased tax revenue for government thereby entitling him to the land.
If that won’t do it, perhaps he could offer to build a dozen Section 8 housing units 20 miles away? Governments go for that too.
