Kenyan police are facing a global outcry this month over a brutal gang-raping of a girl named Liz during which men broke her back and then dumped her into a latrine. Not only were the men not prosecuted but they were told to simply cut grass as their punishment. There is a demand for an investigation of the local police but many Kenyan women are rallying around the case as illustrative of a rape epidemic in the country.
The local police force, known as administration police, are being investigated by the national police force. The rapists however have gone into hiding.
Liz was attacked after returning from a grandfather’s funeral in a village in Busia, western Kenya. She must now use a wheelchair and there is an effort to raise funds for her medical costs. I know of one group of employed local police officers who would seem an obvious source of such funds.
News accounts say that the girl was dropped into a pit latrine and had to climb out after finding stairs used by the workers to dig the latrine. To make matters worse, she knew the men and they were captured by villagers . . . only to be given the grass cutting duty. The girl herself was taken to the local doctor who completely missed a diagnosis of the broken back and told her to seek physical therapy. The family had to lease their farm to get money to take the girl to a more distant hospital where her broken back was confirmed by doctors.

and yes, I would categorize 14 hrs of invasive procedures, against the subjects will or consent, as rape. Personally I feel law enforcement agencies throughout this country should be investigated for crimes against humanity.. War crimes even.. After all in their own words. “They made a mistake. The devaluization of women in countries such as China and India has resulted in a shortage of marriage partners for their precious sons. I find it disturbing to say the least to see growing anti women legislation in our own country. I am well aware of false allegations and have worked on a number of false allegation cases involving both rape and child abuse. However, I am also appalled at the total cluelessness of all too many people who simply don’t believe it is possible to rape an unwilling victim. It becomes even more problematical when those who are so disbelieving are first responders. The best rule is to treat all persons claiming to be victims as victims until the incident can be investigated. As in the instant case, there seems to be no doubt the girl was brutalized, certainly enough to cause a spine injury, and I see no justification whatever for the authorities equating that with mowing the lawn.
As for the guy who made the remark, his follow up comments made it clear that he thought ALL rape reports were bogus.
Another disgusting story. Any rapist found guilty should do more time than mowing lawns. That is an incredible sentence.

your comment that a woman can’t be raped unless she is threatened with a weapon or is physically restrained is not only disturbing, but scary and wrong. While all defendants should be considered innocent until proven guilty, when a guilty verdict comes back, it is rape and the penalty should fit the heinous crime. I guess since there are some wrongfully convicted defendants, according to you, you can’t convict on the eyewitness testimony if a weapon was not used. Rape is such a traumatic assault that women are frightened to make the allegation in many cases for just the very reason that Howdy discusses. She made the allegation two months later so it must not be rape according to his theory. These men allegedly broke her back during the crime and she shouldn’t be afraid to bring charges? Especially when the authorities give them a lawn mowing sentence????
OS While I think the comment of the older cop was over the top and left off what I think he really meant, it is in fact pretty hard for most men alone to be able to commit rape absent a weapon or physical restraints. The one case that got publicity was the rape trial of William Kennedy Smith in which the woman alleged that he raped her without any weapon, or restraints. The problem was that the woman was the nearly the same size as Kennedy. Then we have a number of cases reported on this blog of men wrongly convicted of rape. Smith was fortunately found not guilty because he had good lawyers and got his rights protected. I am astounded at the attitude of many folks to take the word of the woman as being true and the accused not given any benefit of the doubt.
Kenya supplies troops to battle pirates elsewhere, as well as troops to combat al Shabab. This is a terrible crime, but it does not disprove these facts.
I have read about this and she accused the men 2 months after the alleged rape occurred. I am surprised that she could get them even sentenced to mowing the grass with no physical evidence. Unless the story I read was totally wrong,I don’t see how justice would be done by convicting 4 men based on no evidence at all when there was no accusation of a rape until months after the original injury. I don’t know how justice can be done for the basic attack. What justice can there be to a girl who is savagely beaten and thrown in a pit latrine? Had she reported the rape earlier,there could have been physical evidence to prove her attackers hurt her. Women need to know that they will not be further harmed by reporting rapes-it is part of the justice that we all deserve. Both the victims and those who are accused-whether guilty or innocent, the sooner it is reported,the better. The guilty deserve full punishment and the innocent deserve exoneration.
Oh…. What a waste…. Isn’t there some remedy in that culture that requires them to be responsible for the injuries….

When a society, culture or religion teaches and or allows women to be treated like chattel or second class citizens who to be controlled and directed by men this is what results.
After almost a half century of dealing with sex criminals, I am still bemused by the cavalier attitude of all too many authorities. Sometimes we discover the authorities who are charged with protecting the weak and innocent have dirty hands too. Examples.
There was one case where the father was a documented member of the Janus Society and NAMBLA, yet the judge in the child custody case bent over backward with favorable rulings for the father. It was not until the mother’s attorney set an ethical trap for the judge and had him removed from the case that we found credible indications that the judge was more than sympathetic to the father and his, shall we say, personal preferences.
There was another case where a mother and father were both participating in some less than savory sexual activities and making no secret of it. Both sets of grandparents jointly petitioned the court to assign custody to them. The judge ruled for the parents. That judge made similar questionable rulings in other cases, but despite the suspicions of a number of lawyers, nothing was ever proven.
I sometimes give invited lectures to first responders on sex crimes and how to best deal with victims. This is not an isolated incident, but the last talk I gave, an older guy in the back of the room held up his hand. When I asked him what his question was, he growled, “There ain’t no such thing as rape. If somebody claims rape, they are lying. A woman can’t be forced if she don’t want it.” The younger officers turned around and looked at him in disgust, but several others–mostly older officers–agreed with him. This is the problem in a nutshell.

I suppose that commenters will start rapping about Obama’s ancestors and forget that George Bush and Johnboy Kennedy each had mobsters for fathers. I suppose no women ever got raped in Boston and no Indians ever got murdered in Midland. But all that aside there could be justice for both the perps and the pigs back over there in Jomo Kenyatta Pirate Territory. Cut their weenies off, stuff them in their mouths, hang them upside down in the market place in Nairobi and let the flys eat on them until they are dead. Then throw their bodies in the latrine and ask all citizens of that great Pirate Territory to come and pee.
If Obama is informed of this atrocity I wonder if he, whose ancestry is associated with Kenya’s struggle for freedom, will comment about this as he was so quick to comment about Trayvon Martin and Zimmerman.
