Below is a longer version of my column that ran in the Los Angeles Times on the danger of using antibody testing as a basis for discrimination. The concept of a pandemic passport of course will only be plausible if such antibodies truly yield a form of immunity. The WHO has declared that there is no evidence to support that claim. Yet, plasma treatments are reportedly successful.

With the coronavirus antibody tests being rolled out, the country is about to be flooded with millions of tests to determine if individuals have already been exposed to the virus and presumably have immunity from it. The development is key for researchers to understand both the scope and spread of the virus as well as how close we may be to a type of “herd immunity.” That public health breakthrough however could trigger some difficult legal questions. First and foremost, what if you are not part of the herd? The country may soon have to deal with a new concept of bias: antibody or immuno discrimination.
There is a growing and urgent need to get this economy rolling as the virus outbreak subsides. President Donald Trump is correct that destroying this economy will ruin the lives and dreams (and yes health) of tens of millions of citizens. It could reduce the horizon for an entire generation saddled with crippling debt and reduced markets.
Recovery will occur only to the degree that people feel comfortable about getting on airplanes, trains, buses, restaurants, and other closed spaces. With a vaccine projected as still a year away, the population could soon be divided into the immunized and the potentially contagious. If you are in the later group, the question is whether you can be denied certain services.
It is not as far-fetched as you might think. Take the airlines. Planes need to be near capacity to be profitable as a general rule. Social distancing on an airplane is not economically viable. One solution is to require proof of antibodies in your system with one of these available tests. Indeed, the airlines this week floated the idea of a required blood test. That conversely would create barriers to those who are immuno signatures.
Various countries are already using tracking technology to identify carriers and the same technology can be used to distinguish those who are immune. In Moscow, the government has issued “digital permits” to travel that bars others from public transport and even car traffic.
Our legal system is poorly suited for discrimination based on antigens. The discrimination laws focus on immutable characteristics like race and there are both constitutional and statutory protections for those singled out for their religion, gender, sexual orientation, and other classifications. This is not an immutable characteristic but one based on the status of a person’s immunity from a virus.
The other area of relevant law covers quarantine powers in a pandemic. However, those laws and cases focus on confining the contagious, not the potentially contagious.
This issue could actually become more acute once a vaccination is available. The imposition of a mandatory vaccine would be necessary to prevent a renewed outbreak. Putting aside the logistics of vaccinating over 300 million people, many will object or fail to comply. They will continue to represent a fertile population for the virus to take hold. There are three ways to maximize immunization. First, make it mandatory. Second, convince people that they need it. Third, give him an incentive or disincentive in complying.
The first option will turn on a 1905 case where the Supreme Court upheld a state mandatory vaccination program of school children for small pox in Massachusetts. In Jacobson v. Massachusetts (1905), the Court found that such programs are the quintessential state power rather than a federal power. It also held that “every well-ordered society charged with the duty of conserving the safety of its members the rights of the individual in respect of his liberty may at times, under the pressure of great dangers, be subjected to such restraint, to be enforced by reasonable regulations, as the safety of the general public may demand.” States are allowed to subject citizens to restraints to protect “general comfort, health, and prosperity of the State.” The Congress should fund a national vaccinations program and leave mandatory compliance orders to the states.
The second option is already well-established in the minds of most citizens. A deadly pandemic helps. However, we continue to be ministers die who defied orders against large services and young people who put spring break above survival concerns. There will continue to be a percentage of citizens who simply do not believe the virus will touch them or faith or youth will protect them.
That leaves the third option. If people face limitations on travel and employment, a rational actor is likely to comply even if they see little need to do so otherwise. Yet, such a system of proven immunization will create an insular group of the immune deficient. In Jacobson, the law focused on children and the penalties were being blocked from school and a small fine. With the coronavirus, a state would have to compel the population at large of every age.
Some may raise religious or other constitutional rights to refuse a vaccine. The states will have a strong argument that this is not a case of simply self-inflicted harm like those who handle snakes as a matter of faith. By not complying, individuals are fueling the spread to others, particularly more vulnerable populations. In 1922, the Court ruled in Zucht v. King that a school system does not violate the 14th Amendment’s Equal Protection Clause in denying school to students who refused for any reason to be vaccination.
Most importantly, in 1944 in Prince v. Massachusetts, the Court upheld such mandatory programs because “the right to practice religion freely does not include liberty to expose the community or the child to communicable disease or the latter to ill health or death.”
The coronavirus vaccination program would be broader but still rely on the same precedent. Congress can impose limits on interstate travel and the Transportation Security Administration could impose entry requirements but gate areas. The question is whether private businesses like airlines could also make vaccination or immunity a condition for customers. Airlines are part of a regulated industry and could face difficulty in the unilateral imposition of such conditions.
Thus, while states are key to mandatory vaccinations, the federal government would be key to allowing travel restrictions and other barriers to the noncompliant. In doing so, the restrictions would have to trump the right to travel and other constitutional rights. The coercive impact on individuals would be extreme. Noncompliant and non-immune citizens would be isolated physically and socially. Moreover, to make such a system work, there would have to be an easy form of proof of immunization or vaccination – a type of antibody passport.
In the end, the federal and state government may decide to accept a certain level of noncompliance and resulting contraction of the virus. If this is a slowly mutating virus, a second wave may be manageable with therapeutics and ramped up resources. However, if the country wants to impose a mandatory program, it will have to deal with a new status dividing the population between the immune and non-immune.

I understand you are approaching this thorny issue from a legal context and appreciate your thoughts on this. Given that we do not live in a legal vacuum, a few other points may be worth considering:
The possibility of scientists developing a perfectly functioning coronavirus vaccine is nil. The possibility of a well-functioning coronavirus vaccine? Very low. They have had over a decade to create a SARS vaccine and have been unable to. They have been working on an influenza vaccine since the late 1940s and have never been able to achieve anything very effective. Even if the vaccine worked perfectly, the length of time which it would protect is different for everyone. For a measles vaccine, it may last as long as 10 years in some people while for others, just a few. To make matters worse, the W.H.O. recently admitted that antibodies—as a measurement of coronavirus immunity—may be ineffective. How do airlines or other public services mitigate risk when a person’s vaccination status is a meaningless indicator?
Some vaccines don’t prevent the spread of disease at all, but simply lower the risk of serious harm to the recipient. For each coronavirus vaccine that is approved, they will all differ on these issues. For a coronavirus vaccine which doesn’t prevent its spread at all, why should we mandate its use when it has the potential to only affect the recipient? Some vaccines cause long-running side effects to the immune system, making people more vulnerable to other infections. How do you measure the net-benefit of protecting millions from coronavirus if the result is an increase in other respiratory illnesses, let alone other associated disorders?

This is just the beginning of a long sequence of variables that make immunological legality a very difficult area to intelligently and fairly judicate. Even if a perfect coronavirus vaccine existed, one that protected the spread of the virus, and one that protected for a known amount of time, the possibility of side effects for the person receiving it makes the calculus intractable.
This is to say nothing of the rampant abuse that would inevitably occur once government agencies have been given the green light to determine which medical procedures a given individual should or should not receive in order to be considered a citizen in good-standing (or able to work, receive their tax refund, vote, etc.). The correct response to this issue is for U.S. citizens to protect themselves as they see fit. Any other attempt to manage or dictate the health of its citizens, no matter how intelligent or knowledgeable the epidemiologists, politicians, and attorneys believe they are, will end poorly.

Oh God. Even if people have “co-morbidities”, if they were doing fine before getting infected, COVID-19 is the cause of death. That death is properly listed as due to COVID-19. This is a common insurance company ploy that I never thought would be used to try to confuse the issues when someone who cheated to win an election botched the response to a predicted pandemic.
The argument goes like this: if you are in a bad accident and injure your back so that you need surgery, if you ever had any condition involving your back in your life, the insurance company lawyer tries to confuse the jury by arguing that the accident really wasn’t the cause because you had a bad back to begin with. If you had no ongoing symptoms, weren’t being treated, and could work and enjoy life up to the accident, by law, the accident was the sole cause, regardless of your past history, even if caused you to be more-susceptible to injury than someone without a prior history of back problems. The person causing the wreck bears responsibility for the whole loss because the victim was doing fine before being injured. The tort class example is the person with an “eggshell skull”, who gets hit on the head and suffers a skull fracture due to the negligence of another person. Despite the fact that the victim was more vulnerable than the average person to skull fracture because of delicate bone structure, he/she didn’t have a fracture before getting injured, so the responsible party cannot defend his actions or try to escape paying for the damage done by blaming the victim’s susceptibility to injury. A tort law adage: “the tortfeasor takes his victim as he finds him.” The same is true for COVID-19.
People with conditions like diabetes, heart and lung disease are more susceptible to serious illness and death from COVID-19, but the cause of death and illness is still COVID-19. Trying to argue that co-morbidities should be blamed instead of COVID-19 and to so skew the statistics as a means to defend against Trump’s lying and incompetence is outrageous.

No matter how many co-morbidities someone has, if COVID-19 played a role in their death, then the death is due to COVID-19, regardless of how susceptible the person was. That is the same disingenuous argument made by insurance companies to avoid paying claims, but it can confuse jurors. The fact is, if the US didn’t have COVID-19, these victims would be alive with their comorbidities.
All of this is to try to confuse the issues in an effort to deflect blame away from Trump for ignoring the multiple warnings when there were only a handful of cases, by downplaying the risk, by lying and trying to bluff his way through this crisis. If a stroke doesn’t kill you, it could leave you with serious impairments, including permanent disability, but even if you survive, you will need blood thinners and close monitoring, probably for the rest of your life.
Is it fair to spread the cost of taking care of additional COVID-19 victims to others who are insured, which will increase premiums, or to Medicare or Medicaid, covered by taxpayers? Or, is it fair that you or your victims receive care that hospitals are forced to write off, which causes rates to increase? Or, maybe, you just take bankruptcy, so that the cost of credit goes up for everyone else, and also hospital costs increase. Who supports your minor children while you can’t work or if you die? Doesn’t society have an interest in preventing the spread of infections, solely for economic reasons?

If Fat Boy had only listened to and acted upon the multiple warnings from the intelligence community and other agencies, starting in January, and things had been closed down 2 weeks sooner, 90% of these infections would not have happened. Because he doesn’t care and also because he has ADD and won’t actually read Presidential Daily Briefings, he receives a Cliffs-Notes version of the highlights about 3 times a week, according to sources. Even after he figured it out, he called it a “hoax”, said 15 cases would soon be 0 cases, said we’d have a vaccine “very quickly”, he pushed for dangerous medical treatments, and had Kellyanne and Kudlow lie by claiming the virus was “contained”. If anything, this should be called the “Trump Virus”. His laziness, incompetence, bluffing, lying and downplaying of the risk is responsible for 90% of the suffering, which includes the economic impact.
The real epidemic to fight is Trump and slow-witted people like the Lt. Gov. of Texas who actually said that death is less important than the economy. BTW: most Americans do not think things should open up right now. I am doubting that most people will return to theaters, restaurants, airplanes or other closed spaces until there is a vaccine.

Henny-Penny is a story young children should learn early: trying to incite panic can result in opportunists like Foxy-woxy doing real harm. The iconic story was published in English Fairy Tales, retold by Flora Annie Steel (1922), illustrated by Arthur Rackham.

So Foxy-woxy went into his burrow, and he didn’t go very far but turned round to wait for Henny-penny, Cocky-locky, Ducky-daddles, Goosey-poosey, and Turkey-lurkey. Now Turkey-lurkey was the first to go through the dark hole into the burrow. He hadn’t got far when—
“Hrumph!”
Foxy-woxy snapped off Turkey-lurkey’s head and threw his body over his left shoulder. Then Goosey-poosey went in, and—
“Hrumph!”

Foxy-woxy had snapped off Ducky-daddles’ head and Ducky-daddles was thrown alongside Turkey-lurkey and Goosey-poosey. Then Cocky-locky strutted down into the burrow, and he hadn’t gone far when—
“Hrumph!”
But Cocky-locky will always crow whether you want him to do so or not, and so he had just time for one “Cock-a-doo-dle d—” before he went to join Turkey-lurkey, Goosey-poosey, and Ducky-daddles over Foxy-woxy’s shoulders.
Now when Henny-penny, who had just got into the dark burrow, heard Cocky-locky crow, she said to herself:
“My goodness! it must be dawn. Time for me to lay my egg.”
So she turned round and bustled off to her nest; so she escaped, but she never told the King the sky was falling!

Geez. They’re talking about antibody passports and they don’t even know the scope of actual infection and the real CFR. What if the actual death rate is closer to .1 or less? Are we going to have antibody passports for seasonal flu?
Seasonal flu is about 1/10th as deadly.

By contrast, COVID-19 is currently estimated to kill at least 10 people per thousand infected (1%). “It’s about 10 times more lethal than the seasonal flu,” said Dr. Anthony Fauci, director of the National Institutes of Allergy and Infectious Disease, in congressional testimony on March 11.
“Both studies estimated a mortality rate of 0.1% to 0.2%, which is closer to the death rate associated with the seasonal flu.”

Quest Diagnostics announced Tuesday that individuals can now skip a doctor’s visit and order a coronavirus antibody test online in a push to broaden Covid-19 screening.
It doesn’t guarantee immunity, but physicians say a positive antibody test indicates that a patient may have some level of protection against reinfection. The test costs $119, according to Quest’s website.
It would be a nightmare.
