Lock’Em Up: MSNBC Host Scarborough Demands The Arrest Of Trump, Giuliani, and Trump Jr. For Insurrection

In a profanity laced diatribe, MSNBC host Joe Scarborough demanded the arrest of President Donald Trump, Rudy Giuliani, and Donald Trump Jr. for insurrection.  Scarborough declared “If Donald Trump Jr., Rudy Giuliani and Donald Trump are not arrested today for insurrection and taken to jail and booked . . . then we are no longer a nation of laws and we only tell people they can do this again.” What he is suggesting would be the very antithesis for the rule of law.

Scarborough also struck out at the police as racist for not shooting the protesters:

“If these insurrectionists were black, they would have been shot in the face. And my god, if these insurrectionists were Muslim they would have been sniped from the top of buildings. So I want to know from the Capitol Hill police — what, is it just white people? Or is it Donald Trump supporters? Why do you scream at people for walking across the street three blocks away from the Capitol? Why are you known as these badasses around the Capitol? But then Trump supporters come in and you open the f—— doors for them. You open the doors for them and let them breach the people’s house. What is wrong with you? Are we a nation of laws? Are we a nation of one man?”

CNN’s Jake Tapper also argued that this was racial double standard and that, if the protesters were black, they would have been crushed by police.

Trying to politicize this tragedy is fundamentally wrong. Scarborough ignores that police in various cities have been criticized in past violent protests by groups like Black Lives Matter for standing back and not intervening.  Prosecutors were criticized for dropping charges against many protesters.   Protesters engaged in days of violence and arson outside of the White House before former Attorney General Bill Barr ordered the Lafayette Park area cleared. He was criticized for both the order to clear the area and (more legitimately) the degree of force used. Scarborough was one of those who denounced the use of force, which was justified after officials feared the breaching of the White House complex security.

I certainly agree that the Capitol appeared utterly unprepared for this protest. That will be the subject of investigation. However, the breach of the Capitol happened quickly after a protest that was peaceful for hours on the mall.

The call for the arrests however are beyond the pale.  Many of us of criticized Trump’s speech as he was giving it.  Many of us opposed the challenge made to the electoral votes.  That however is not the crime of insurrection to call for a protest march on Congress.  We have seen violent protests on the left and the right being led by instigators from groups like Antifa and Proud Boys.

I previously wrote in opposition of declaring Antifa a terrorist organization or labeling left-wing protesters “seditious.” Such efforts would gut protections of free speech under the First Amendment. The same is true with Scarborough’s Siren’s call. If we start charging people for insurrection for reckless political speeches, we will truly “no longer [be] a nation of laws.”

  1. What happened yesterday was clearly a coup attempt by a bunch of clowns. There were armed people in the capitol building attempting to thwart the confirmation of Biden as our next President. These people were there at the direction of prez Trump just hours before in a rally in front of the White House. Yes, arrest prez Trump, his son Eric, and Guilani, among many others I am sure. This was a disgrace and should be a lesson to any future President that this will not be tolerated.

    This was Treason and nothing less.

    1. The “coup” came from within the government and the Establishment. What happened yesterday was in response to the “coup.”

        Charges for those arrested included Unregistered Firearm and Carrying a Concealed Weapon.

        The QAnon Shaman guy was carrying a flag mounted on a spear.

        You say it was “nothing more than some pushing and shoving,” when there were multiple law enforcement injured, offices were broken into, windows smashed, things stolen from offices, and more.

  2. The people suggesting use of the 25th amendment, impeachment, arrest, etc., are demonstrating that they want to increase the violence not tamp it down. Pelosi and Schumer are happy for the riots. It gives them another chance to attack Trump and get some more fawning press.

    Many years ago, the discarded 1st wife of the Governor of Maryland said, on the occasion of his sentencing on corruption charges, “I had the best years of Marvin Mandel. She has what’s left”.     Turley is not being deliberately ignorant here. This has nothing to do with free speech. This is about inciting rhetoric being used to deliberately foment violence. Free speech doesn’t protect you from the consequences of abusing it, especially when one is knowingly using it to incite unlawful action.

    Trump’s speech inciting his supporters with lies is not an isolated incident. Turley likes to pretend this only applies to this one speech or incident. No. It’s the culmination of months of incitement and lying to deliberately foment the sentiments he’s been forcing on his ignorant masses.

    Turley is a law professor. What transpired yesterday was not merely an issue of “labeling”. It was an actual coup attempt, one that failed and backfired spectacularly. There are actual crimes that occurred, people DIED because of Trump’s “reckless political speech” which was INTENTIONAL. The goal was to prevent the rightful transfer of power to a duly elected winner.

    To not hold trump responsible for this, to not demand it, Turley’s concerns about freedom of speech aren’t worth squat. Ironically it’s Turley’s own sycophantic enabling that is a detriment to his precious freedom of speech.

    Trump instigated the mob. He literally told them to March to the Capitol. For months Trump sowed the idea into their heads that the election was stolen. He made no effort to make any distinction about what should be done. He deliberately let those poor ignorant folks get the idea that they should do this. He wanted it. His very nature for the need to be vengeful clearly shows his intent.

    The president has a big influence on these deluded masses and he knows it. Knowingly instigating insurrection even blithely or obtusely is still instigation. He encouraged it. Embraced it Did NOTHING to stop it until everyone demanded he do so. It was intentional.

    The very fact that the prey did nothing to condemn the violence and in fact sympathized with their anger which he deliberately stoked is enough reason to invoke the 25th amendment and have him removed.

  16. Mail in balloting is unconstitutional any mail in ballot is unconstitutionalIt does not meet the constitutional threshold of a time, place and manner of voting. It was intended for symbolic use for the military in war time and expatriates and the infirmed. It should never be a widespread mechanism for casting votes. It’s inherently prone to fraud and does not protect a persons right to privacy regarding how they cast their vote. In California 74% of people vote by mail in ballot and are accustomed, despite having the best weather, the most cars and the highest income per capita and it’s how the Democrats have controlled the state. This is why republicans are leaving. Proving Voter fraud through mail in balloting is in fact legitimizing it as a constitutional method for voting and it needs to argued that it is not. The US mail system was in place when the framers developed the constitution it was never their intent that a vote could be cast any other way than in person at a specified time, place and manner.

    1. William Henderson, mail-in voting is not unconstitutional. There is no prohibition of voting by mail at all. Each state determines the manner in which their citizens can vote. In some states every voter votes by mail. Oregon automatically registers their citizens.

      The entire point of being able to vote by mail is due to convenience and safety this year due to the pandemic. Trump’s own lawyers and thru their multiple lawsuits proved voter fraud is not the big issue they claim it is. When they can’t provide proof and offer only hearsay in affidavits it undermines their rationale.

      Congress does not have the power to dictate how states choose to have their citizens to vote. The constitution does not prohibit voting by mail. You would be hard pressed to justify how is mail in voting is unconstitutional.

      Scarborough was married to Melanie Hinton from 1986 to 1999. He then married Susan Warren in 2001 before the two split in 2013. He married Brzezinski in 2018. He has four children from his marriages to Hinton and Warren.

  20. Honestlawyermostly, the attorney with whom I am currently sleeping, (aka hubby) was a Capitol Hill Policeman before he joined Peace Corps and later went to law school.
    There was a Capitol lockdown while he was on duty one night in 1968 (Democrat Lyndon Johnson was President)
    To get a bill passed, prostitutes and liquor were brought into the Capitol building during the lockdown. Honestlawyer says the job of the Capitol Hill Police that night was to.pick up (and dodge!) all of the liquor bottles being thrown off the balconies of the Capitol building by drunk lawmakers and their hookers.
    The Capitol Hill police were also given the license tag numbers of President Johnson’s own hookers, and were told never to stop those automobiles.
    Yea, those Dems have such a sterling history of patriotism.
